Abstract

The application of the formal truth concept in civil courts, particularly religious courts, ought to have been abandoned. In several civil disputes, judges are guided by the pursuit of formal truth, resulting in unjust verdicts. This study examines the situation of the principle of formal truth in the investigation of civil matters in the Religious Courts and the view of the Makassar Religious High Court Judge regarding its application. This study is a legal-empirical investigation informed by legal philosophy. Techniques for data collecting consisting of in-depth interviews with key informants and research of court decisions and relevant literature. The findings of the study indicate that, first, the principle of formal truth that is applied to religious courts is still legitimate today, just as the HIR/RBg approach of proving civil cases in Indonesian civil courts is still valid. Second, the opinion of the judges of the Makassar Religious High Court regarding the application of the formal truth principle in the environmental courts of the religious courts demonstrates that, in general, the Makassar PTA judges believe that this principle must be applied as a trial process provision. In their opinion, the formal principle of truth serves as a guide for parties and judges when reviewing cases. Several other judges, however, believe that the formal truth principle should be substituted by the material truth.

Abstract

This study aims to analyze the multicollinearity of environmental variables in the Bakongan-Bengkung Forest, part of the Leuser Ecosystem, to understand its implications for the habitat of key species such as Sumatran elephants, Sumatran rhinoceros, Sumatran tigers, and Sumatran orangutans. The research was conducted in August 2023 across an area of 75.912,46 hectares spanning three districts in Aceh. The data utilized includes elevation, slope, river density estimation, Normalized Difference Vegetation Index (NDVI), distance from roads, and annual rainfall, sourced from various geospatial datasets. Data processing was performed using ArcGIS 10.3, Google Earth Engine (GEE), and RStudio 4.2.2. Multicollinearity testing was carried out using Pearson correlation coefficients to identify relationships between environmental variables. The analysis revealed a significant positive correlation between elevation and annual rainfall, with a correlation coefficient of 0,724, indicating a strong linear relationship. This correlation suggests that higher elevations in the area are associated with increased rainfall, likely due to orographic effects. These findings are crucial for conservation planning and habitat management for wildlife. The correlation between elevation and annual rainfall should be considered when developing accurate habitat models for key species in the Bakongan-Bengkung Forest, to ensure effective and sustainable conservation strategies.

Abstract

In the context of increasingly complex and dynamic infrastructure development, government construction projects have a very important role in driving economic growth and social development in Indonesia. These projects often involve many parties, including main contractors and subcontractors, who collaborate to complete the work according to the specifications and standards set. The cooperative relationship between contractors and subcontractors is very important to ensure the smooth running and success of the project, and to ensure that all parties fulfill their obligations stipulated in the contract. However, in its implementation, problems often occur that can disrupt this relationship, one of which is default. This study aims to determine the legal regulations governing the cooperative relationship between contractors and subcontractors in the implementation of government construction projects, and to determine how legal protection is provided to subcontractors in the event of default by the contractor. The research method used in this study is the normative legal research method, by observing, studying, and understanding legal material, based on the study of positive law. From this study, it can be concluded that the legal rules governing the working relationship between contractors and subcontractors in carrying out government construction projects are regulated in Article 1320 of the Civil Code concerning the requirements for the validity of an agreement and Article 1234 of the Civil Code concerning the elements of default. Article 52 of Law Number 2 of 2017 concerning Construction Services states that service providers and subservice providers in the implementation of construction must operate in accordance with the agreement stipulated in the contract. Article 53 paragraph (3) states that if the service provider transfers part of the work to a subcontractor, the payment request must be accompanied by proof of payment to the subcontractor. The legal protection provided to subcontractors in the event of default by the main contractor includes several aspects, such as the existence of clear contract provisions, which explain the rights and obligations of the parties. Subcontractors have the right to claim compensation through a lawsuit in court as stated in the Medan District Court Decision No. 29/Pdt.G/2022/PN Mdn which resolved the dispute between the plaintiff, Bayu Afandi Nasution, ST, as a subcontractor, with the main defendant, PT Gunakarya Nusantara, who was suspected of default. The decision gave the plaintiff the right to seize collateral against the defendant's account and restore the subcontractor's financial rights as an effort to legally protect the subcontractor's rights.

Abstract

The narcotics law is implemented on the basis of justice. However, its enforcement does not reflect a sense of justice because there is no classification of drug abusers. This study aims to analyze the criminal law policy on drug crimes and analyze the reconstruction of the law in the application of criminal sanctions for drug abusers for themselves based on the value of justice. This study used a normative legal method. The application of criminal sanctions for drug users in judicial practice is often inconsistent and does not reflect justice, especially due to differences in judges' interpretations and the absence of recognition of attempted drug use in drug legislation which causes injustice for individuals who have not consumed but are subject to articles with heavier penalties. The implementation of the drug criminal law policy still faces ambiguity in distinguishing between addicts, abusers, and victims. This legal uncertainty often results in drug abusers being charged with articles that are heavier than dealers, thus causing injustice that worsens their condition and burdens correctional institutions. A fairer legal reconstruction is needed to clearly distinguish between users and dealers and prioritize rehabilitation rather than punishment for drug abusers themselves.

Abstract

This paper aims to find out how to improve the application of a creative attitude in resolving conflicts in organisations (case study of SDN 009 Maredan). The research method used by the author is qualitative research with a library research approach. The data sources are books and scientific journals that discuss improving the application of a creative attitude in resolving conflicts in organisations (case study of SDN 009 Maredan). Based on the conclusion, Islam teaches that conflict is a part of life that can be resolved wisely through the principles taught in sharia, such as deliberation (shura), peace (islah), and reconciliation. Creativity in resolving conflict includes the ability to find innovative, fair, and peaceful solutions without having to harm any of the parties involved. Creative approaches based on Islamic teachings and applied at SDN 009 Maredan, such as involving joint activities, prioritising peace, and understanding differences through open communication, are not only effective in resolving disputes, but also have the potential to strengthen relationships and increase organisational productivity. Conflicts handled in the right way can be an opportunity for organisational innovation and growth. By applying Islamic principles that promote justice, balance, and compassion, conflicts can be resolved with solutions that are not only effective, but also beneficial to the welfare and continuity of the organisation. This creates a harmonious, productive work environment that is in line with religious and social values that support the creation of harmony and good cooperation within the organisation.

Abstract

Purpose: The present study focuses on the development of a robust fish freshness classification system based on the application of different digital image processing techniques from mackerel tuna eye images toward better classification. Methods: Contrast stretching and histogram equalization were done to improve image quality before the classification. The system contained 250 training images in a dataset, for five freshness classes which are 3, 6, 9, 12, and 15 hours post-catch, with 50 test images. For classification, the K-Nearest Neighbor (KNN) algorithm was employed with a parameter setting of K = 5, ensuring effective differentiation between the various freshness levels based on the enhanced image features. Result: The results depicted very low MSE values after enhancement at 6 hours, as low as MSE = 0.0012606 and PSNR = 28.9944 dB for contrast stretching, and for 12 hours, histogram equalization gave the best results, MSE = 0.0030712 and PSNR = 25.127 dB. Further, classification done through the KNN classifier with K=5 gave results with accuracy as high as 100% was achieved on the testing data, proving that the model was successfully able to identify the classes of freshness. Novelty: The novelty in the present research work is the integration of advanced image-processing techniques, which allow the achievement of an improved level of detection of fish freshness and a very useful solution to the seafood industry in view of product quality and safety assurance. Generally, the paper epitomizes an important milestone in the application of machine learning and image processing for the assessment of the quality of foods.

Abstract

This study aimed to describe students' learning independence, learning styles, and  analyze their influence on chemistry learning achievement. The population as well as sample in this study were 42 students from classes XI.C and XI.D SMA Negeri 2 Pasarwajo in the 2024/2025 academic year. Questionnaire was used to obtain data of learning independence and learning styles, while learning achievement was obtained from semester test scores. Techniques of data analysis employed were descriptive and inferential statistical analysis, namely multiple linear regression analysis using dummy variables. The results showed that students' learning independence was in the moderate category (85.71%). Students' learning styles consisted of visual (21.43%), auditory (14.28%), kinesthetic (21.43%), and other combined styles. Meanwhile, students' learning achievement was in the moderate category (80.95%). Learning independence and learning styles influenced the chemistry learning achievement, both partially and simultaneously. Partially, learning independence contributed 35.3% and learning style namely visual, auditory, and kinesthetic sequentially contributed 19.9%, 10.4%, and 7.3%. Simultaneously, they contributed 72.9% to chemistry learning achievement.

Abstract

Establishing a spatial mathematical model that uses diverse data types such as ratio data, interval data, and ordinal and nominal data is a challenge. This paper describes how the mathematical model of the rate of natural forest cover change was developed by considering the causes and/or driving forces that come from the society's biophysical and/or socioeconomic aspects. The main objective of this research is to establish a spatial mathematical model using the environmental and socioeconomic variables that play a significant role in determining the rate of natural forest cover change. From a number of variables considered in the analysis, coupled with any other reason, the rate of natural forest cover change (y), in units of ha per year), this study found that there are 10 potential variables, namely the proximity of the road (x4), the proximity of the river (x5), the proximity of the settlement (x6), proximity from the regency capital (x8), the proximity of the capital city of the district (x9), proximity of the edge of the forest in 2015 (x11), the proximity of the plantation area in 2009 (x12), the proximity of the plantation in 2015 (x13), slope class (x16), and elevation class (x17). The standardization process successfully transformed the non-ratio data type into a ratio data type. Using the standardized data, the study obtained spatially mathematical models that are reliable in estimating the rate of forest cover change, namely y = 0.017 + 0.00040x9 with SR of 17.3% and R2 is 88.0%. The study concludes that the most significant factor affecting the natural forest cover change in the study site is the proximity from sub-district capital (x9). Therefore, a spatial mathematical model can facilitate the government in monitoring forest cover.

Abstract

This study seeks to examine and elucidate the significance of the principle of good faith within the national legal framework, as well as to develop norms pertaining to good faith in the context of operational cost recovery for production sharing contracts in Indonesia's oil and gas industry. This study utilizes a normative legal methodology alongside a legislative framework. The sources of data encompass essential legal materials, including legislation, journal articles, books, and pertinent research reports that contribute to the discourse. The analysis of the data is performed qualitatively through a juridical-philosophical lens, developing arguments rooted in legal philosophy, legal theory, and various legal principles. The findings reveal that the principle of good faith in the operational cost recovery of production sharing contracts in Indonesia is governed at each stage of the contract to safeguard the interests of disadvantaged parties. This regulation addresses the essential principle of good faith that all parties must adhere to in order to guarantee the equitable execution of rights and obligations. In the context of operational cost recovery for production sharing contracts in Indonesia, good faith is characterized by adherence to and compliance with audit results, reflecting a commitment to the proper execution of the business contract's terms. The operational cost recovery system is anticipated to serve as a reimbursement mechanism for expenses associated with oil and gas production.

Abstract

Kekerasan Dalam Rumah Tangga (KDRT) khususnya terhadap isteri terus muncul dan meningkat di berbagai wilayah Indonesia termasuk Aceh. Di Aceh, ekses dari kondisi ini mendorong tingginya angka gugatan cerai di Mahkamah Syar‟iyah oleh isteri sebagai upaya keluar dari lingkaran kekerasan dengan persentase mencapai 83%. Penelitian ini ingin menjawabpertanyaan bagaimana perlindungan hukum atas perempuan dalam kasus gugat cerai akibat tindak KDRT di Mahkamah Syar‟iyah dengan mengambil lokasi penelitian di wilayah hukum Kota Banda Aceh. Pendekatan yang dipakai adalah pendekatan perundang-undangan (Statute Approach), serta pendekatan kasus (Case Approach). Hasil penelitian menunjukkan bahwa: Pertama,tindak pidana KDRT tidak dituntut secara pidana melainkan secara perdata, karenanya hakim tidak dapat memberi putusan pidana lebih dari apa yang dimohon oleh Penggugat dalam petitum-nya. Sehingga bentuk perlindungan hukum bagi perempuan dilakukan melalui beberapa hal; mempercepat proses persidangan danmengabulkan gugatancerai untuk menghindarkan isteri dari kemungkinan terulangnya tindak KDRT dan menjauhkannya dari trauma.Kedua, Hakim Mahkamah Syar‟iyah Kota Banda Aceh belum mengintegrasikan UU Nomor 23 Tahun 2004 tentang PKDRT sebagai acuan maupun dalil dalam putusan. Sebaliknya, hakim mendasarkan putusannya pada pertimbangan: (1) Ketidakberhasilan proses mediasi;(2) Penolakan Penggugat atas nasehat majelis hakim untuk membatalkan gugatan cerai;(3) Ketidakhadiran pihak Tergugat dalam proses mediasi (Peraturan Mahkamah Agung Nomor 1 tahun 2008) dan dalam persidangan sehingga perkara tersebut diadili secara verstek (Pasal 149 R.Bg. ayat (1));(4) Perselisihan yang terus menerus terjadi antara kedua pihak telah memenuhi syarat dan alasan hukum dalam Pasal 39 ayat (2) Undang-undang Nomor 1 tahun 1974 jo Pasal 65 Undang-undang Nomor 7 tahun 1989 dan Pasal 19 huruf (f) Peraturan Pemerintah Nomor 9 Tahun 1975 jo Pasal 116 huruf (f) Kompilasi Hukum Islam;(5) Keyakinan majelis hakim bahwa kedua pihak tidak mungkin lagi dipertahankan sebagai suami isteri; (6) Kaidah-kaidah maslahat dalam hukum Islam. Ketiga, Putusan Mahkamah Syar‟iyah Kota Banda Aceh dalam penyelesaian perkara cerai gugat akibat KDRT adalah mengabulkan gugatan cerai secara verstek akibat ketidakhadiran pihak suami (tergugat) dalam proses mediasi dan persidangan, dan menjatuhkan putusan talak satu ba‟in sughra Tergugat atas Penggugat. Hal ini menunjukkan bahwa putusan hukum di Mahkamah Syar‟iyah Kota Banda Aceh sudah sesuai dengan konsep hukum perlindungan korban tindak pidana KDRT di mana hakim mempertimbangkan nasib korbandalam putusan hukum.Namun tidak semua butir-butir dapat diimplementasikan karena isteri menganggap putusan cerai dari suaminya sudah cukup.
