Abstract

Tujuan dari penulisan artikel ilmiah ini adalah untuk mengetahui dan menganalisis tanggung jawab negara dalam melindungi pekerja anak dari pekerjaan terburuk bagi anak. Untuk itu, metode penelitian yang digunakan berupa penelitian yuridis normative dengan pendekatan konseptual dan pendekatan perundang-undangan, dengan menggunakan bahan hukum primer dan sekunder. Hasil dari artikel ini menunjukan bahwa negara Indonesia telah meratifikasi semua konvensi internasional utama mengenai pekerja anak. Selain itu perlindungan terhadap anak dari pekerjaan terburuk bagi anak telah diatur dalam sejumlah peraturan perundang-undangan di Indonesia. Sayangnya, negara belum melaksanakan isi dan ketentuan perundang-undang yang telah diratifikasi tersebut. Bukti diberikan oleh banyak contoh pelanggaran hak-hak anak yang sedang berlangsung, termasuk mempekerjakan anak-anak meskipun ada penentangan keras dari konvensi tersebut. Hal ini terjadi karena kurangnya pengawasan yang dilakukan oleh pemerintah terhadap perusahaan. Untuk itu negara dalam memberikan perlindungan terhadap pekerja anak harus melibatkan seluruh peran dari DPR, Pemerintah Pusat, DPRD, Pemerintah Daerah, dan Peradilan.

Abstract

The purposes of this research are: first, to identify and analyze the arrangement of the consultant responsibilities in making the AMDAL in Indonesia; second, to analyze and criticize the implementation of the consultant responsibilities in making the AMDAL in Bangka Belitung. Based on these purposes, so the issues that have been discussed are: first, how the arrangement of the consultant responsibilities in making the AMDAL in Indonesia?; second, how the implementation of the consultant responsibilities in making the AMDAL in Bangka Belitung?. To discuss these issues, conducted empirical legal research with the type of research the effectiveness of the law. This research proved, that: first, the consultant responsibilities in making the AMDAL regulated by the Act Number 32 of 2009 years, and the Environment Minister Regulation Number 7 of 2010 years; second, the consultant responsibilities in makin AMDAL will be completed to the extent of agreement with the proponent. Therefore, the recommendations of this research are: first, needed to optimize the enforcement of the Act Number 32 of 2009 years, and the Environment Minister Regulation Number 7 of 2010 years; second, needed more specifically regulation concerning the recognition in makin the AMDAL document.

Abstract

Most People around this country must have their own ways and mechanism for land issues before the form of written legislation is being publicized including people in Bangka Island. For example, the plantation land in Pasirputih Village, Tukak Sadai District, South Bangka Regency is arranged orderly. There are several requirements that must be obey in order to open the plantation land, such as they must be ‘herenteng’ (equal) between one plantation land and others. Besides, there are several prohibitions when opening the plantation land that shouldn’t be break by the people, those are ‘apit’ and ‘kaet’. These prohibitions are not written, but still being obeyed by the people. Something that is still maintained in this area is interesting to examine from the perspective of law number 5 of 1960 that is concerning the Basic Regulations of Agrarian (UUPA).

Abstract

Pancasila sebagai cita hukum (rechtsidee) bangsa Indonesia. Kedudukan Pancasila sebagai cita hukum mengandung konsekuensi bahwa tatanan norma dan norma-norma hukum harus bersumber dari nilai-nilai Pancasila. Nilai-nilai ideal yang terkandung dalam cita hukum tersebut kemudian diderivasi menjadi seperangkat asas-asas hukum umum yaitu asas negara hukum, asas demokrasi, asas perlindungan terhadap hak asasi manusia serta asas partisipasi publik dalam sistem penyelenggaraan negara. Asas-asas hukum di atas merupakan dasar sekaligus pedoman dalam membentuk norma-norma yang berlaku umum dan asbtrak. Dalam konteks pembentukan norma-norma hukum yang bersifat abstrak-umum, asas-asas hukum harus dijadikan landasan dan atau pedoman. Dalam konteks Mekanisme Seleksi Dewan Pengawas KPK ini, digunkan dua asas yng sudah diderivasi dari Nilai Cita Hukum Pancasila yaitu asas negara hukum material atau negara hukum material atau asas negara hukum kesejahteraan dan asas pembatasan kekuasaan atau pebatasan kewenangan. Penulis berpandangan dengan adanya Presiden dan DPR dalam Mekanisme Seleksi Dewan Pengawas KPK jutru menggnggu sifat independen dari KPK tersebut, sehingga penulis mempunyai gagasan sebagai berikut: (1) pemerintah harus membuat panitia seleksi Dewan Pengawas KPK yang diangkat secara administratif oleh Presiden dan diberikan tugas yang independen dalam menentukan keputusn terkait ketua dan anggota Dewan Pengawas KPK , (2) penghapusan kewenangan Presiden dan DPR sebagai lembaga negara yang ikut serta membentuk Dewan Pengawas KPK , (3) Pembaharuan mekanisme seleksi Dewan Pengawas KPK harus dituangkan dalam suatu peraturan perundang-undangan.

Abstract

Basically, humans are born with different intellectual abilities in processing their thougths and produce somethingfrom that thought. Therefore, it is important to provide protection for the results of thought through the intellectual property rights regime. However, in practice there are still many cases where the intellectual property of a person or agroup or a legal entity is used without prior permission. This juridical normative research examines fundamental thoughts for the protection of the results of one's thinking which is called intellectual property rights. There are several thoughts which become form the basis for protecting intellectual property rights; they are the natural right protection to reputation that has been built over a long time and quite high cost and also as a form of compensation and encouragement for people to create or find something.With the basic ideas behind the protection of IPR, the protection provided will be maximized, and the results of one's thinking will be more respected, both moral rights and economic rights

Abstract

A therapeutic agreement is a contractual relationship between a doctor and a patient. As a legal act, a therapeutic agreement carries legal consequences when the parties neglect or do not perform their obligations. In practice, often civil lawsuit cases are filed by a patient against a doctor as a result of non-performance of the therapeutic agreement. This study aims to identify and determine the legal problems in the implementation of therapeutic agreements between doctors and patients at Ir. Soekarno Hospital, Bangka Belitung. Based on these objectives, academically the results of this research are expected to be used as a starting point in legal research related to the implementation of therapeutic agreements between doctors and patients, and practically the results of this research are expected to be used as input in legal research on the implementation of therapeutic agreements between doctors and patients. This research uses socio legal research methods

Abstract

The development of global digital technology has brought significant challenges to Indonesia's digital sovereignty, especially regarding the control of personal data and cyberspace. Foreign digital platforms that dominate use in Indonesia process citizens' data massively through big data mechanisms, often outside the jurisdiction of national law. This dependence poses risks to personal data protection, national security, and state control over digital infrastructure. This study uses normative legal methods with a legislative and conceptual approach to examine the role of national regulations, such as Law Number 27 of 2022 concerning Personal Data Protection, in strengthening the state's position. The results of the study show that strengthening regulations, developing local technology, community digital literacy, and international cooperation are key strategies to uphold Indonesia's digital sovereignty. Without concrete and comprehensive steps, control over data and digital space will continue to be in the hands of foreign entities, which can weaken the nation's independence in the digital era.

Abstract

Seiring dengan perkembangan ilmu pengetahan dan teknologi, objek perlindungan hak kekayaan intelektual pun semakin berkembang dari waktu ke waktu. Objek-objek yang dimaksud tidak hanya ada di satu tempat saja, tetapi menyebar di berbagai daerah. Pada beberapa cabang HKI, salah satunya karena kepemilikan komunal atau penemunya tidak lagi diketahui, tidak dapat diberikan perlindungan perspektif HKI, misalnya pengetahuan atau obat-obatan tradisional. Beberapa kasus di antaranya adalah pembajakan keanekaragaman hayati dari pengetahun obat-obatan tradisional Indonesia, yakni dipatenkannya tanaman brotowali oleh perusahaan Jepang. Di sisi lain, peraturan perundang-undangan bidang HKI minim memberikan kewenangan secara langsung kepada pemerintah daerah berkaitan dengan perlindungan HKI. Oleh sebab itu, penelitian yang bersifat normatif dengan pendektan peraturan perundang-undangan ini mengkaji politik hukum tentang kewenangan pemerintah daerah dalam peraturan perundang-undangan di bidang hak kekayaan intelektual. Hasilnya, dari seluruh peraturan perundang-undangan bidan HKI, kewenangan pemerintah daerah secara eksplisit hanya diatur dalam Undang-Undang Merek dan Indikasi Geografis. Selebihnya penyebutannya bersifat umum, misalnya penggunaan istilah “negara” dalam Undang-Undang Hak Cipta sebagai pemegang ekspresi budaya tradisional dan hak cipta atas ciptaan yang penciptanya tidak diketahui. Padahal, dalam konteks negara hukum, wewenang pemerintahan berasal dari peraturan perundang-undangan yang berlaku, sejalan dengan asas legalitas yang merupakan dasar dalam setiap penyelenggaraa kenegaraan dan pemerintahan.
