Abstract

Tujuan penelitan ini dimaksudkan untuk mendapatkan gambaran konkrit menyangkut tentang pengaturan kewenangan penegakan hukum di wilayah laut (maritim). Pendekatan penelitian menerapakan studi perbandingan hukum (comparatice approach), pendekatan undang-undang (statute approach), pendekatan konseptual (conceptual approach). Penggunaan data yang dipakai dalam penelitian ini adalah data sekunder. Data penelitian yang ada dikumpulkan oleh penulis dengan teknik data kepustakaan dan dokumen. Temuan penelitian menunjukkan bahwa pengaturan kewenangan penegakan hukum antar instansi dalam Undang-Undang Kelautan belum mencerminkan prinsip kepastian hukum dan keadilan. Keberadaan Bakamla sebagai aparat penegak hukum telah menimbulkan dualisme penegakan hukum. Dalam Undang-Undang juga terdapat konflik norma, yang pada akhirnya menimbulkan implikasi ketidakjelasan kewenangan. Ketidakjelasan pengaturan tersebut pada akhirnya menempatkan kedudukan Bakamla demikian superior. Ketidakjelasan kewenangan dalam penerapan fungsi penegakan hukum akan berdampak pada inkonsistensi kelembagaan sistem peradilan pidana. Hal ini dapat dilihat dari adanya pertentangan pengaturan dengan Undang-Undang Pelayaran, khususnya yang terkait dengan fungsi keselamatan dan keamanan maritim (maritime safety and security). Dalam upaya mendesain sistem penegakan hukum keamanan maritim, diperlukan adanya pembetulan (remedy) atas adanya antinomy dimaksud. Pendirian Indonesian Coast Guard dengan penggabungan (fusi) Bakalamla dan KPLP dipandang sejalan dengan politik hukum keamanan nasional. Demikian itu sebagaimana dianut oleh berbagai negara.

Abstract

Fenomena kekerasan seksual terhadap anak merupakan masalah serius yang mengancam hak asasi manusia dan kesejahteraan generasi penerus bangsa. Penelitian ini bertujuan untuk menganalisis mekanisme perlindungan hukum terhadap anak korban kekerasan seksual, menilai efektivitas implementasinya, serta mengidentifikasi hambatan dan solusi yang dapat diterapkan. Metode penelitian menggunakan pendekatan yuridis normatif dengan analisis terhadap peraturan perundang-undangan, putusan pengadilan, dokumen hukum, dan literatur akademik relevan. Hasil penelitian menunjukkan bahwa meskipun perlindungan anak telah diatur dalam UU No. 23 Tahun 2002 yang diperbarui dengan UU No. 35 Tahun 2014, implementasinya masih terkendala oleh kurangnya sumber daya aparat, keterbatasan fasilitas, rendahnya literasi hukum, dan budaya malu yang menyebabkan kasus tidak dilaporkan. Studi internasional seperti Finkelhor et al. (2021) dan Stoltenborgh et al. (2021) menegaskan bahwa perlindungan yang efektif memerlukan sistem peradilan ramah anak, pendampingan psikososial, serta kolaborasi multisektor antara pemerintah, lembaga internasional, dan masyarakat. Penelitian ini memberikan implikasi penting bagi penguatan kebijakan, peningkatan kapasitas aparat, dan perluasan jejaring perlindungan agar hak anak dapat terjamin secara optimal

Abstract

Penegakan hukum yang adil menjadi fondasi utama dalam mewujudkan negara hukum yang menjunjung tinggi perlindungan hak asasi manusia dan kepastian hukum. Penelitian ini bertujuan untuk menganalisis penerapan ketentuan minimal dua alat bukti dalam penetapan status tersangka berdasarkan Pasal 184 KUHAP serta mengevaluasi efektivitas praperadilan sebagai mekanisme pengawasan terhadap kewenangan penyidik, khususnya pasca Putusan Mahkamah Konstitusi Nomor 21/PUU-XII/2014. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan yuridis, berbasis studi kepustakaan melalui analisis undang-undang, putusan pengadilan, literatur ilmiah, dan referensi internasional bereputasi. Hasil penelitian menunjukkan bahwa meskipun putusan Mahkamah Konstitusi telah memberikan landasan kuat bagi perlindungan hak tersangka, praktik praperadilan masih menghadapi kendala serius berupa inkonsistensi penerapan, kevakuman norma, dan perbedaan tafsir antarpenegak hukum. Penelitian ini berimplikasi pada pentingnya pembaruan KUHAP dan penerbitan pedoman teknis Mahkamah Agung guna mewujudkan sistem peradilan pidana yang lebih transparan, akuntabel, dan berkeadilan

Abstract

Perkembangan teknologi informasi dan komunikasi mendorong peningkatan sistem transaksi digital, namun juga memunculkan tantangan serius berupa meningkatnya kejahatan siber, khususnya pencurian data elektronik melalui metode skimming. Penelitian ini bertujuan menganalisis pembuktian tindak pidana pencurian data elektronik dan pertanggungjawaban pidana pelakunya berdasarkan kerangka hukum Indonesia, khususnya mengacu pada Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik beserta perubahannya. Penelitian menggunakan pendekatan yuridis normatif dengan teknik pengumpulan data melalui studi kepustakaan dan analisis kualitatif deskriptif. Hasil penelitian menunjukkan bahwa pembuktian tindak pidana skimming dilakukan dengan menggunakan kombinasi Pasal 184 KUHAP dan bukti elektronik sebagaimana diatur dalam Pasal 5 ayat (1) dan (2) serta Pasal 44 huruf b UU ITE, sementara pertanggungjawaban pidana pelaku diatur melalui Pasal 30 ayat (2) jo Pasal 46 ayat (2) UU ITE serta unsur “turut serta” pada Pasal 55 KUHP. Penelitian ini menegaskan pentingnya penguatan regulasi, peningkatan literasi digital, serta kolaborasi lintas lembaga guna memperkuat perlindungan data pribadi dan mencegah maraknya kejahatan skimming di era transformasi digital

Abstract

Bankruptcy is a solution that can be used to resolve debt and receivable problems that are pressing on a debtor. This situation occurs when the debtor no longer has the ability or goodwill to pay his debts to his creditors. The problems discussed in this research What is the legal protection for creditors if the debtor experiences bankruptcy? What is the mechanism for the process of resolving bankruptcy cases until creditors obtain their rights? Normative juridical research methods. In conclusion, the declaration of bankruptcy of PT Corpus Asa Mandiri as debtor, and the rejection of the cassation application against the bankruptcy decision is a form of legal protection of the interests of creditors' rights. The mechanism for resolving the management and settlement of the bankrupt debtor's assets (bankruptcy boedel) is basically the treatment of all the bankrupt debtor's assets, both real and potential, in order to restore the rights of creditors. Completion of the management and settlement of a bankruptcy debtor is nothing more than an activity or action relating to the continuation of the distribution of assets which are declared legally valid as a bankrupt debtor's property.

Abstract

Business decisions taken by the Board of Directors are solely an obligation for the Board of Directors so that SOE can grow sustainably, stably, and have high competitiveness, but an unavoidable reality is that a business entity does not only experience profits, but is also faced with phases of loss. Business decisions that have been made with full calculation and prudence are still not free from business risks that can result in the SOEs they manage experiencing losses, so that they are categorized as detrimental to state finances and lead to criminal justice processes. This study aims to (1) analyse losses in SOEs that can be qualified as state financial losses and (2) analyse what business decisions made by the President Director of SOEs are categorized as fulfilling the elements of corruption in criminal cases in the Central Jakarta District Court Decision Number 15/Pid.Sus-TKP/2019/PN.Jkt.Pst. This research uses normative juridical research methods using statute approach, conceptual approach, and case approach. The results showed that separated state assets are state assets originating from the state budget to be used as state equity participation in SOEs. State assets that become capital in the form of shares are no longer state assets. State assets in SOEs are limited to the ownership of the company's shares, so that if there is a loss in the SOE Persero, this is not a state loss, but a loss of the SOE. The business decisions made by the President Director of the SOE are categorized as fulfilling the elements of corruption due to a series of actions by Karen that do not entirely reflect the principle of prudence in making decisions, nor do they fully fulfil the elements of Article 97 paragraph (5) of the Limited Liability Company Law.

Abstract

Most of Indonesia's population lives in rural areas, for this reason it is necessary to prioritize development to improve public services and the village economy in order to form individuals and communities to become self-reliant. One of the government's efforts is to implement a village digitization program. Digitalization through the use of this technology really needs to be implemented on a micro-scale development located in rural areas such as village-owned enterprises. The research method used is descriptive research. The results of the study show that digitalization of legal education has a very crucial role for the village head in empowering Village-Owned Enterprises (BUMDes), one of which will increase sufficient capacity and knowledge so that they can properly run and empower BUMDes. In addition to technical skills such as accounting and managerial skills, character-deepening training is also needed in order to produce honest and trustworthy BUMDes staff managers. BUMDes specifically cannot be equated with legal entities such as limited liability companies or cooperatives. in conclusion, the status of BUMDes after the issuance of Law Number 11 of 2020 concerning Job Creation, namely as a New Entity Legal Entity whose position is equivalent to BUMN at the national level and BUMD at the regional level.
