Abstract

Supreme Court Decision Number 23 P/HUM/2024 which annuls PKPU No. 9 of 2020. Supreme Court Decision Number 23 P/HUM/2024 relates to changes in the minimum age requirements for regional head candidates. In the decision, the Supreme Court granted the lawsuit filed by the General Chairperson of the Garuda Party, Ahmad Ridha Sabana, who challenged Article 4 paragraph (1) letter d of PKPU No. 9 of 2020 concerning the Nomination of the Election of Governor, Deputy Governor, Regent, Deputy Regent, Mayor, and Deputy Mayor. The problem is, what are the legal consequences of the Supreme Court Decision Number 23 P/HUM/2024 which annuls PKPU No. 9 of 2020 concerning the fourth amendment to PKPU Number 3 of 2017 concerning the Nomination of the Election of Governor and Deputy Governor, Regent and Deputy Regent, and/or Mayor and Deputy Mayor? How are the Aspects of Benefit and Legal Certainty in the Supreme Court Decision Number 23 P/HUM/2024 regarding the Age Limit for Regional Head Candidates? Normative legal research method. In conclusion, the legal consequences of the Supreme Court Decision Number 23 P/HUM/2024 which revoked PKPU No. 9 of 2020 concerning the Fourth Amendment to PKPU Number 3 of 2017 concerning the Nomination of the Election of Governor and Deputy Governor, Regent and Deputy Regent, and/or Mayor and Deputy Mayor. This decision has various legal implications that not only change the regulatory framework for regional elections, but also raise two (2) problems from the decision, namely: (a) Impact on the hierarchy of laws and regulations; (b) Impact on the nomination process. The Aspects of Benefit and Legal Certainty in the Supreme Court Decision Number 23 P/HUM/2024 regarding the Age Limit for Regional Head Candidates reflect efforts to realize a balance between the aspects of benefit and legal certainty in the general election system in Indonesia. Overall, from the aspect of utility, this decision does not provide a substantive solution to the community's need for clear and inclusive regulations, especially regarding the participation of the younger generation. From the aspect of legal certainty, this decision actually creates a vacuum of norms, opens up opportunities for new disputes, and creates instability in the implementation of regional elections. Thus, although this decision is legally valid, its impact shows weaknesses in creating utility and legal certainty.

Abstract

Penelitian ini menganalisis kendala dalam implementasi penggunaan konten YouTube sebagai jaminan fidusia serta konsekuensi hukumnya di Indonesia. Berdasarkan Undang-Undang Hak Cipta dan Peraturan Pemerintah tentang Ekonomi Kreatif, karya intelektual dapat dijadikan sebagai objek jaminan fidusia. Namun, implementasinya di lapangan menghadapi berbagai kendala, seperti ketiadaan lembaga yang dapat menilai nilai konten YouTube, ketidakjelasan bentuk akta notaris yang sesuai, dan keraguan lembaga keuangan dalam menerima konten sebagai jaminan. Penelitian ini menggunakan metode yuridis normatif yang didukung oleh wawancara lapangan dan data dari informan kunci. Hasil penelitian menunjukkan bahwa belum terbentuknya infrastruktur hukum dan kelembagaan yang memadai merupakan penghambat utama. Kesimpulannya, agar skema ini dapat terlaksana dengan baik, pemerintah perlu membentuk lembaga berwenang yang bertugas menilai konten YouTube sebagai objek jaminan fidusia.

Abstract

Kebijakan rehabilitasi pecandu narkotika melalui mekanisme wajib lapor belum sepenuhnya diterapkan secara konsisten dalam praktik peradilan. Penelitian ini bertujuan untuk mengevaluasi kesesuaian putusan hakim terhadap pengguna narkotika golongan I dengan prinsip keadilan dan regulasi yang berlaku. Metode yang digunakan adalah penelitian yuridis normatif berbasis studi putusan dan peraturan perundang-undangan. Hasil penelitian menunjukkan bahwa dalam Putusan No. 423/Pid.Sus/2021/PN.Jkt.Sel dan No. 273/Pid.Sus/2021/PN.Skt, terdakwa dijatuhi pidana penjara dua tahun meskipun perbuatannya terbukti sebagai penyalahgunaan narkotika untuk diri sendiri. Tindakan tersebut dinilai melanggar semangat keadilan restoratif sebagaimana diatur dalam Pedoman Jaksa Agung No. 18 Tahun 2021 dan Peraturan Kapolri No. 08 Tahun 2021. Disparitas hukum muncul karena belum adanya keseragaman tafsir dan penerapan prinsip rehabilitasi. Inkonsistensi ini berdampak pada perlindungan hak penyalahguna sebagai korban ketergantungan narkotika. Implikasinya, sistem peradilan pidana perlu memperkuat koordinasi antarlembaga dalam menerapkan pendekatan rehabilitatif secara menyeluruh dan berkeadilan.

Abstract

Criminal acts due to the negligence of the perpetrator resulting in traffic accidents and serious injuries and/or deaths according to Law Number 22 of 2009 concerning Traffic and Road Transportation are regulated in Article 229 paragraph (1) of Law Number 22 of 2009 concerning Traffic and Road Transportation, although Article 229 paragraph (1) letter c of the Law on Traffic and Road Transportation has regulated the rights of victims regarding compensation for losses from victims, however, the compensation for losses is only limited to medical expenses and/or funeral expenses and compensation for losses the amount of which is determined by a court decision, which means that the compensation for losses may not necessarily be able to restore the losses suffered by the victim's family. By remembering and paying attention to Article 310 paragraph 3 of Law Number 22 of 2009 and Article 193 of the Criminal Procedure Code, it is correct. Implementation of the Panel of Judges' Decision on Criminal Acts of Negligence Causing Traffic Accidents and Resulting in Serious Injuries and Death of Others in Decision Number 212 / Pid.Sus / 2023 / PN Idm. and Decision Number 238 / Pid.Sus / 2024 / PN. In fact, the defendant's negligence has caused the loss of 2 lives, in addition, the defendant's negligence has caused 2 victims to suffer minor injuries and one person to suffer serious injuries. The Panel of Judges considered that the defendant had been responsible by replacing all losses suffered by the victim and assisting in the evacuation process of the victim. In fact, Article 235 paragraph (1) of Law Number 22 of 2009 concerning Traffic and Road Transportation explains that in the case of a driver who has caused death and has provided assistance to the victim's heirs in the form of medical expenses and / or funeral expenses, it will not dismiss the criminal case charges.

Abstract

The most common criminal law in society is criminal acts against property (material crimes), such as theft, extortion, embezzlement, fraud, vandalism, and receiving. The existence of a receiver as a receiver for theft crimes makes it easy for the perpetrator to gain profit, so that the perpetrator of theft does not have to sell the stolen goods to consumers himself but can channel them through a receiver who pretends to be a trader. The problems that arise are both violations of social norms and legal regulations to create a phenomenon that is contrary to moral and ethical rules and legal regulations. In Article 480 of the Criminal Code concerning receiving goods, if understood from its elements, namely "required to know or should suspect that the goods received are the proceeds of crime" it is very confusing and difficult to distinguish if the goods received from the proceeds of crime were obtained in good ways and did not arouse any suspicion, such as buying and selling at a price that is generally appropriate, carried out in crowded and bright places and other ways that should not be suspected as crimes. (2) Recipients of goods resulting from crime who truly do not know and do not suspect that the goods they receive are the proceeds of crime for acceptable reasons as stated above can be considered consumers who must receive legal protection as regulated in Article 4 of Law Number 8 of 1999 concerning Consumer Protection.

Abstract

Penelitian ini membahas upaya hukum yang dapat dilakukan oleh pekerja yang tidak menerima PHK, yang dapat mengajukan gugatan ke lembaga penyelesaian perselisihan hubungan industrial dalam waktu satu tahun sejak pemutusan hubungan kerja berdasarkan Pasal 171 UU Ketenagakerjaan juncto Pasal 82 UU PPHI. Pembatasan waktu tersebut menimbulkan ketidakpastian hukum. Rumusan masalahnya adalah mengenai makna Pasal 82 UU PPHI tentang batas waktu pengajuan gugatan PHK dan kepastian hukum pasca Putusan Mahkamah Konstitusi Nomor 94/PUU-XXI/2023. Metode yang digunakan adalah penelitian yuridis normatif. Hasil penelitian menunjukkan bahwa Pasal 82 UU PPHI memberikan tenggang waktu satu tahun untuk pekerja yang mengalami PHK dengan alasan tertentu, namun pasca Putusan MK, ketentuan tersebut tidak memberikan kepastian hukum karena tergantung pada peraturan pelaksana. Selain itu, peraturan terkait alasan PHK, seperti PP No. 35 Tahun 2021, belum sepenuhnya jelas.

Abstract

One example of a case of falsified documents in the issuance of overlapping land certificates occurred in East Luwu Regency and was raised in court through Decision Number 90/Pid.B/2020/PN MII. In this case, it was discovered that land certificate falsification was carried out by a land mafia, resulting in the emergence of two certificates for the same plot of land. This practice not only harms the legitimate owner but also creates laws and gives rise to complex agrarian conflicts. This research uses a normative juridical method, with an approach based on laws and court decisions. The results show that the preservation was an intentional act carried out by one party, with the aim of controlling land rights that did not belong to him. In the decision, the perpetrator was found guilty and sentenced because it was also proven to have falsified documents, as stipulated in Article 263 of the Criminal Code (KUHP). From this case, it can be concluded that law enforcement against overlapping duplicate certificates is very important to ensure legal certainty and protection. Protection efforts for land rights holders are carried out through a land registration process that complies with procedures based on Law Number 5 of 1960 concerning the Principles of Agrarian Law. Compliance with these procedures can provide a strong basis for identifying legitimate rights holders and preventing future damage, including cases of overlapping certificates caused by document falsification. To prevent the recurrence of similar cases, it is necessary to improve the monitoring system and digitize land data comprehensively by the National Land Agency (BPN). An integrated digital-based land system can minimize the opportunity for the issuance of duplicate certificates for a single plot of land, because all land rights data can be accessed and disclosed transparently and in real time.

Kejahatan di era moderen semakin sulit untuk dicegah. Salah satu kejahatan yang ikut bertransformasi seiring dengan kemajuan teknologi adalah tindak pidana korupsi. dampak negative akibat maraknya korupsi adalah keuangan negara mengalami kebangkrutan, tidak berfungsinya admnistrasi publik secara efektif, kemiskinan dan merusak sendi-sendi kehidupan masyarakat Permasalahan yang dibahas dalam penelitian ini bagaimana penerapan pidana tindak pidana korupsi pengadaan barang/jasa pemerintah? dan bagaimana pertanggnugjawaban tindak pidana korupsi pengadaan barang/jasa pemerintah? Penelitian ini menggunakan metode yuridis normatif. Pada penelitian ini menghasilkan kesimpulan sebagai berikut;bahwa penerapan tindak pidana korupsi pengadaan barang/jasa pemerintah pada umumnya dilakukan dengan melakukan Persekongkolan, PPK melakukan post bidding, membatalkan tender apabila peserta tender yang diajak bersekongkol tidak menang, menggunakan metode penunjukan lamgsung dan Swakelola, intervensi negativ Pimpinan. Ancaman hukuman dalam tuntutan Jaksa Penuntut Umum menggunakan ancaman hukuman minimal, hal tersebut dapat menbuat pelaku tindak pidana korupsi merasa takut dan jera.

Abstract

Tujuan penelitan ini dimaksudkan untuk mendapatkan gambaran konkrit menyangkut tentang pengaturan kewenangan penegakan hukum di wilayah laut (maritim). Pendekatan penelitian menerapakan studi perbandingan hukum (comparatice approach), pendekatan undang-undang (statute approach), pendekatan konseptual (conceptual approach). Penggunaan data yang dipakai dalam penelitian ini adalah data sekunder. Data penelitian yang ada dikumpulkan oleh penulis dengan teknik data kepustakaan dan dokumen. Temuan penelitian menunjukkan bahwa pengaturan kewenangan penegakan hukum antar instansi dalam Undang-Undang Kelautan belum mencerminkan prinsip kepastian hukum dan keadilan. Keberadaan Bakamla sebagai aparat penegak hukum telah menimbulkan dualisme penegakan hukum. Dalam Undang-Undang juga terdapat konflik norma, yang pada akhirnya menimbulkan implikasi ketidakjelasan kewenangan. Ketidakjelasan pengaturan tersebut pada akhirnya menempatkan kedudukan Bakamla demikian superior. Ketidakjelasan kewenangan dalam penerapan fungsi penegakan hukum akan berdampak pada inkonsistensi kelembagaan sistem peradilan pidana. Hal ini dapat dilihat dari adanya pertentangan pengaturan dengan Undang-Undang Pelayaran, khususnya yang terkait dengan fungsi keselamatan dan keamanan maritim (maritime safety and security). Dalam upaya mendesain sistem penegakan hukum keamanan maritim, diperlukan adanya pembetulan (remedy) atas adanya antinomy dimaksud. Pendirian Indonesian Coast Guard dengan penggabungan (fusi) Bakalamla dan KPLP dipandang sejalan dengan politik hukum keamanan nasional. Demikian itu sebagaimana dianut oleh berbagai negara.
