Abstract

This article aims to review the understanding of the hadith umirtu an uqātil al-nās, which is often interpreted as an absolute command to engage in warfare. Through a comprehensive study of takhrīj syāmil (comprehensive sourcing) and an analysis of the science of wurūd al-hadīṡ, it can be found that the hadith, which straightforwardly commands fighting non-Muslims, actually contains a call for peace and civility. The study incorporates an examination of the exposition of this hadith in various media, both oral and written, as the primary data source. Through critical discourse analysis, it can be stated that the hadith umirtu an uqātil al-nās does indeed exist and recurs in various cases, but it has been used and understood in different contexts by later generations of Muslims. The population of the chain of narrators (sanad) for this hadith reaches 1,121, which has been traced with the assistance of the Gawami Al-Kalem version 4.5 application. From this population, it was found that 94.6% had a maqbūl status (accepted narration), while the remaining 5.4% were mardūd (rejected narration). In detail, the composition of the maqbūl al-sanad population includes 28.6% (321 sanads) with a sahih status, 41.7% (467 sanads) with a hasan status, and 24.4% (273 chains) with a ḍa’īf status that has been upgraded to hasan li gairih. Furthermore, this article also documents the original contexts of the hadith and its shift in the understanding of Islamic law regarding warfare among the Muslim community. The textual understanding of this hadith is considered potentially prone to radical interpretations if not approached holistically and comprehensively. The research also identifies a phenomenon of neglecting the analysis of wurūd al-hadīṡ and the misuse of sabab wurūd al-hadīṡ and sabab irād al-hadīṡ by hadith scholars. This is supported by the exposition of hadith without considering its context in sahihain and secondary hadith reference books, which leads to an understanding based solely on the general wording of the hadith. [Artikel ini bertujuan untuk meninjau ulang pemahaman tentang hadis umirtu an uqātil al-nās yang sering dipahami sebagai perintah perang secara mutlak. Melalui kajian takhrīj syāmil (komprehensif) dan analisis ilmu wurūd al-hadīṡ, dapat ditemukan bahwa hadis yang secara lugas memerintahkan untuk memerangi orang non-muslim ini ternyata berisi seruan damai dan santun. Kajian tentang eksposisi hadis dalam berbagai media, lisan maupun tulisan menjadi data utama kajian ini. Dengan analisis wacana kritis, dapat dinyatakan bahwa hadis umirtu an uqātil al-nās memang benar adanya dan muncul berulang kali dalam kasus yang berbeda-beda, namun kemudian digunakan dan dipahami dalam konteks yang berbeda oleh generasi muslim belakangan. Populasi sanad hadis ini mencapai 1.121 yang ditelusuri dengan bantuan aplikasi Gawami Al-Kalem versi 4.5. Dari populasi tersebut didapati 94,6% berstatus maqbūl (dapat diterima periwayatannya) dan sisanya yang 5,4% adalah mardūd (tertolak periwayatannya). Secara rinci, komposisi populasi sanad yang maqbūl adalah 28,6% (321 sanad) berstatus sahih; 41,7% (467 sanad) berstatus hasan; dan 24,4 (273 sanad) berstatus ḍa’īf yang naik menjadi hasan li gairih. Selanjutnya, artikel ini juga mendokumentasikan beberapa konteks asli hadis itu dan pergeserannya dalam benak pemahaman umat Islam tentang syariat perang. Pemahaman terhadap lahiriah hadis ini dinilai berpotensi kuat melahirkan paham radikal jika tidak dilakukan secara holistik-komprehensif. Penelitian ini juga menemukan sebuah fenomena pengabaian analisis wurūd al-hadīṡ dan keserampangan penggunaan sabab wurūd al-hadīṡ dan sabab irād al-hadīṡ oleh para pensyarah hadis. Hal ini juga didukung oleh eksposisi hadis yang tanpa konteks wurud ke dalam sahihain serta kitab-kitab hadis sekunder yang menjadi rujukan utama dalam pendidikan Islam, sehingga melahirkan pemahaman yang hanya berpijak pada keumuman lafal hadis.]

Abstract

Konsep keselamatan (al-najāh) merupakan tema sentral dalam studi keislaman, khususnya teologi dan studi hadis. Al-Qur'an menjanjikan surga bagi orang beriman dan beramal saleh, menekankan inklusivitas dan keadilan. Namun, hadis tentang perpecahan umat Islam menjadi 73 golongan menimbulkan problematisasi, karena secara eksplisit menyatakan hanya satu golongan yang selamat, memicu eksklusivisme dan sektarianisme. Penelitian ini bertujuan menganalisis kualitas sanad dan matan hadis tersebut, serta implikasinya terhadap realitas keberagamaan kontemporer. Melalui pendekatan kualitatif berbasis library research, dilakukan kritik sanad menggunakan metode para ulama yang ditulis oleh Syuhudi Ismail dalam bukunya dan kritik matan menggunakan metode Salah al-Dīn al-Idlibī. Hasil penelitian menunjukkan bahwa sanad hadis dinilai Hasan li ghairihi, namun matannya mengandung kontradiksi dengan Al-Qur'an dan hadis sahih lainnya. Pemahaman tekstual hadis ini berpotensi memicu sektarianisme. Oleh karena itu, penelitian ini menekankan pentingnya pemahaman kontekstual, mengutamakan persatuan, toleransi, dan moderasi beragama, serta menjadikan aqidah yang berlandaskan Al-Qur'an dan Sunnah sebagai kunci menjaga harmoni sosial umat Islam.

Abstract

As the era progresses, the emancipation voiced by women has become a reality. Nowadays it has changed 180 degrees. It is not uncommon for government seats or posts that were previously thought to only be occupied by men to be occupied by women, including those who are currently undergoing the 'iddah period. This has become an urgent problem for society that must be resolved by fiqh, one of the the only community in Jogoroto Village, the majority of whose wives also work to support their families, so the researchers felt this was very important to discuss. The objectives of this research are: First, to summarize the practices of 'iddah and ihdad of working women in Jogoroto Village. Second, Knowing the limitations of 'iddah and ihdad for working women from the perspective of maslahah murlah. To obtain relevant results, researchers use mixed methods, by combining progressive law with analyzing values ​​and laws that apply in the field (field research) as well as analyzing literature studies as arguments to strengthen the research, so that readers can understand the process and reasons Fiqh answers these problems. In practical terms, women workers in Jogoroto Village carry out 'iddah in accordance with the Shari'a, but in practical ihdad there are several actions that are in accordance with the concept of maslahah murlahah. they do not stifle their productivity by blindly staying at home, but other ihdad practices are considered too lenient in terms of leaving the house.

Abstract

This study aims to compare the ta'lil (causality) method used by two great scholars in the field of hadith, namely al-Daruqutni and al-Albani. The ta'lil method is an approach used to classify hadiths based on their strength or weakness. They both represent two different periods in the history of hadith, namely the ulama' mutaqaddimīn (early period) and the ulama' muta'akhirīn (modern period). This study uses a comparative approach by analyzing the written works of the two scholars. The results of the study show that these two 'ulama', despite coming from different eras, both have a deep concern for hadith. They also have their own methods in knowing the 'illat (defects) that exist in the hadith. Imam al-Dāruquṭnī's method in researching 'illat in a hadith is focused on research in the sanad or the narrators of the hadith. He also considers that the study of al-jarḥ wa al-ta'dīl (criticism and authentication of narrators) is also included in the study of the 'illat of hadith, so al-Dāruquṭnī often examines the hadith narrators from that perspective. Meanwhile, Shaykh al-Albānī has a more in-depth research method on the 'illat in the hadith. He is not only focused on the study of the 'illat of hadith in terms of the sanad and narrators, but his study also touches on the research of the matn (text) of the hadith. Therefore, it becomes reasonable that al-Dāruquṭnī is more lenient in determining the validity of a hadith, and al-Albānī is more strict in determining the validity of a hadith. Abstract

Taʿlīl al-ḥadīth—the critical investigation of hidden defects in prophetic reports—has been practiced since the formative period of Islamic scholarship and has undergone renewed expansion since the mid-14th/20th century. In this contemporary phase, distinct methodological orientations have emerged around leading figures such as Abū Isḥāq al-Ḥuwaynī (Salafī), Saʿīd Mamdūḥ (Ashʿarī-traditionalist), and Ḥamzah al-Malībārī (Iḥyāʾ Manhaj al-Mutaqaddimīn). This article presents a comparative analysis of their thought, utilizing library research and thematic interpretation, and highlights the methodological, epistemological, and socio-religious implications of current debates. The study argues that contemporary discourse on taʿlīl al-ḥadīth is no longer confined to technical isnād criticism but has become a site of ideological contestation and the renegotiation of religious authority within global Muslim communities. Al-Ḥuwaynī rejects tafarrod (solitary transmission) as a valid ʿillah and emphasizes strict muʿāṣarah (narrator contemporaneity); Mamdūḥ also rejects tafarrod but fully accepts ziyādat al-thiqah (trustworthy narrators’ additions); whereas al-Malībārī regards all ʿilal as potentially qādiḥah (damaging) and widens criticism to include weak transmitters. These positions implicitly respond to pressing contemporary concerns: al-Ḥuwaynī to the global spread of Salafism, Mamdūḥ to sectarian tensions and calls for social justice, and al-Malībārī to rising spiritual disorientation and permissive cultural trends. By mapping these orientations and their implications for academic scholarship, religious practice, and communal dynamics, this article highlights the need to reassess taʿlīl al-ḥadīth as both a technical discipline and a significant influence on shaping authority, orthodoxy, and Muslim public life today. The study thus contributes a critical framework for understanding the evolving epistemology of ḥadīth criticism in the modern era.

Abstract

Penelitian ini difokuskan pada uapaya memahami regulasi hukum terkait perkawinan dalam islam  di Indonesia serta bagaimana respons para Kyai di wilayah Diwek, Jombang terhadap kasus perempuan yang mengandung di luar ikatan pernikahan. Penelitian ini mengadopsi metode kualitatif dengan pendekatan hukum islam, melalui telaah terhadap prinsip-prinsip dasar, teori hukum perkawinan Islam, peraturan perundang-undangan, serta opini sebagian ulama yang sesuai topik pembahsan. Hasil menunjukkan bahwa perkawinan wanita hamil di luar nikah belum diatur secara eksplisit dalam Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan. Namun, legalitasnya dikembalikan pada ketentuan agama masing—masing sebagaimana disebutkan dalam pasal 2 ayat (1). Adapun dalam Kompiasi Hukum Islam (KHI) Pasal 53, dijelaskan bahwa pernikahan antara wanita hamil dan pria yang meyebabkan kehamilan tersebut diperbolehkan. Ditemukan suatu pemikiran berbeda dari sebagian ulama terkait validitas pernikahan tersebut, tergantung pada madzhab yang dianut. Sesuai  hukum nasional, anak yang terlahir di luar ketentuan hanya mempunyai hubungan hukum dengan ibu serta keluarga ibunya. Sedangkan menurut perspektif hukun Islam, anak dianggap memiliki nasab yang sah apabila dilahirkan minimal enam bulan setelah akad nikah berlangsung. Para Kyai di daerah Diwek, Jombang secara umum meyampaikan bahwa memperbolehkan pernikahan kepada perempuan yang hamil merupakan langkah yang membawa kemaslahahatan
