Abstract

This study aims to analyze the enforcement of law against femicide in the context of human rights (HR) in Indonesia. The main focus of this research is to identify the obstacles faced by law enforcement officers in handling femicide cases and to assess the extent to which legal protection for femicide victims aligns with human rights principles in Indonesia. This research employs a qualitative approach with a descriptive-analytical design, collecting data through literature studies, interviews with legal practitioners, human rights activists, and an analysis of relevant legal documents. The findings indicate that the enforcement of law against femicide in Indonesia faces various challenges, such as a lack of understanding of femicide among law enforcement, the dominance of a patriarchal culture, and weak reporting and handling mechanisms for gender-based violence cases. Legal protection for femicide victims remains ineffective, despite the existence of regulations aimed at safeguarding women's rights. This research recommends the need for enhanced legal awareness, training for law enforcement, and stronger law enforcement measures to provide better protection for femicide victims in Indonesia.

Abstract

Currently business competition is getting tighter, many companies are choosing to implement an outsourcing system because this system is felt to be more effective. In the outsourcing system, it is easier for employers to terminate employment relationships (PHK), so this outsourcing system cannot provide job security for workers. In fact, guarantees to work and earn a decent living are the constitutional rights of every citizen. The state has regulated the protection of workers' rights and guaranteed continuity of work in the Job Creation Law through the TUPE concept. However, these regulations have not been equipped with clearer regulations so they are still difficult to implement. The aim of this research is to examine and understand the legal protection for outsourcing workers from arbitrariness by employers in the implementation of layoffs and to examine and analyze the principles of outsourcing so that there is no arbitrariness by employers in the implementation of layoffs. This research uses a normative juridical approach, namely an approach carried out on the basis of the main legal material by examining theories, concepts, legal principles and statutory regulations related to this research. The author also uses a comparative legal approach method, namely comparing law in different countries as a system (law is seen as a system), so that based on the differences, researchers are able to provide conclusions regarding a legal issue. The outsourcing system in Indonesia currently does not reflect justice for outsourcers. There needs to be legal reform so that worker protection can be improved without leaving the flexibility of the outsourcing system behind. From this research, the author was able to find a prospective concept for developing better outsourcing regulations. Abstract

As proprietors of Intellectual Property Rights (IPR), creative professionals (designers, creators, and inventors) in Karawang regency own exclusive rights that enable them to independently profit from their works in the form of royalties or licensing. However, in reality, they have difficulties in accessing capital needed to expand their business. Some financial institutions might not accept IPR as collateral for credit even though the law principally states that they are valuable assets and therefore eligible as collateral. Copyright Law No. 28 of 2014 (Article 16) and Patent Law No. 13 of 2016 (Article 108) both permit owners and holders of intellectual property rights to utilize such rights as collateral for loans under a fiduciary arrangement. The laws should apply to copyrights and patents, but so far they haven't, which is a shame because in theory they should. The lack of a change to Article 43 of BI Regulation Number 14/15/PBI/2012, which pertains to the forms of credit collateral, makes it difficult to use intellectual property rights as security for loans. Abstract

Many problems concerning food occur in Indonesia, we encountered food circulating in the community who do not heed the provisions on labeling, thus disturbing the public. Food trade expired, the use of dyes that are not intended for food, formalin, foods containing preservatives, or acts of other consequence is very detrimental to the community, it can even threaten the health and safety of human lives, especially for children in general, this cas ususally through of fraud on the food label. label is falsified or misleading adverse effects on human health and development.

Abstract

Mudharabah financing is a financing product that is run based on the principle of profit sharing in the sharia banking system, where the sharia bank is the shahibul maal (capital owner) and the customer is the mudharib (business manager). In Indonesia, mudharabah financing has shown significant development as an alternative financing that complies with sharia principles. However, there are various problems that hamper the effectiveness of this financing product. This analysis aims to identify and analyze problems that occur in mudharabah financing in Indonesian sharia banks, as well as provide recommendations for solving them.

Abstract

Regulations governing worker rights safeguarding are enacted via Outsourcing as specified in Government Regulation Number 35 of 2021, a response to the worldwide economic climate. Outsourcing serves as a strategy by the government to tackle global economic challenges, enabling business owners to preserve the viability and continuity of their enterprises during the economic downturns experienced both within Indonesia and globally as a result of the Covid-19 pandemic. In practice, the implementation of internship programs often experiences various problems. Among them, Interns are often positioned as workers without getting the rights they deserve, such as decent wages, insurance, or career advancement opportunities, even internship participants have the potential to become or replace Outsourcing and/or Outsourcing workers. So that the use of Outsourcing is affected by termination of employment. The purpose of this study is to examinelegal protection in Government Regulation Number 35 of 2021 regarding the guarantee of the continuity of work for Fixed Time Work Agreement (PKWT) workers in outsourcing companies who are laid off, reviewed from the theory of justice and to examinethe occurrence of Termination of Employment of Fixed Time Work Agreement (PKWT) workers at PT. X as an outsourcing company. The methodology employed in this study is characterized by normative legal research, focusing on the examination of secondary or primary Legal Protection materials such as theories, legal concepts, principles, and regulations. The gathering of data was executed through bibliographic research and empirical research, deriving from secondary sources like interviews and observations. Subsequently, this data was subjected to qualitative analysis to derive the anticipated outcomes of the research. The examination of Legal Protection within Government Regulation Number 35 of 2021 concerning the assurance of work continuity for PKWT workers in Outsourcing firms, interpreted through the lens of justice theory, reveals that multiple PKWT Workers at PT. X were dismissed as their tasks were assigned to interns participating in a local internship scheme facilitated by the Employing Company for the Outsourcing Company. Observing the events that transpired, the researcher concludes that the safeguarding of job continuity stipulated in Government Regulation Number 35 of 2021 does not meet the criteria of fairness for PKWT Workers employed by the Outsourcing company.

Abstract

Abstrak BUMN merupakan pelaku usaha strategis yang berkontribusi signifikan terhadap perekonomian nasional, namun masih berpotensi mengalami kebangkrutan jika tidak dikelola secara profesional. UU No. 37 Tahun 2004 Kepalailitan dan PKPUmengatur mekanisme pengajuan pailit BUMN, khususnya dalam Pasal 2 Ayat 5. Praktek pengadilan menunjukkan kompleksitas permasalahan, di mana beberapa putusan Pengadilan Niaga menolak permohonan kepailitan dari kreditur dengan alasan hanya Menkeu yang berwenang mengajukan permohonan. Kondisi ini mengindikasikan ketidakharmonisan dalam penanganan kasus kepailitan BUMN Persero. Penyebab utama ketidakselarasan ini adalah adanya konflik antar peraturan per-UU di bidang keuangan negara, perbendaharaan, kepailitan, BUMN, dan PT. Perbedaan interpretasi hukum di antara penegak hukum menciptakan ketidakpastian hukum, yang pada gilirannya dapat menghambat iklim investasi dan kepercayaan pelaku usaha terhadap BUMN. Oleh karena itu, perlu dilakukan harmonisasi peraturan perundang-undangan untuk menciptakan kejelasan dan kepastian hukum. Kata Kunci: BUMN, Persero, Kepailitan. Abstract BUMN is a strategic business actor that contributes significantly to the national economy, but still has the potential to go bankrupt if it is not managed professionally. UU KPKPU concerning KPPU regulates the mechanism for filing bankruptcy for BUMN, especially in Article 2 Paragraph 5. Court practice shows the complexity of the problem, where several Commercial Court decisions reject bankruptcy applications from creditors on the grounds that only the Minister of Finance has the authority to submit applications. This condition indicates disharmony in the handling of the BUMN Persero bankruptcy case. The main cause of this disharmony is the conflict between laws and regulations in the fields of state finance, treasury, bankruptcy, BUMN, and PT. Differences in legal interpretation between law enforcers create legal uncertainty, which in turn can hinder the investment climate and business actors' trust in BUMN. Therefore, it is necessary to harmonize laws and regulations to create legal clarity and certainty. Keywords: State-Owned Enterprises, Persero, Bankruptcy.

Abstract

Abstrak Sektor pertanian memegang peranan strategis dalam pembangunan, terutama dalam menjamin ketersediaan pangan bagi Masyarakat. Dalam konteks sektor pertanian di Indonesia, PT Pupuk Indonesia berperan sebagai salah satu korporasi utama dalam penyediaan pupuk bersubsidi yang sangat penting bagi petani. Namun, keberadaan pupuk bersubsidi yang seharusnya memberikan manfaat kepada petani sering kali menjadi sasaran penyimpangan. Kasus penyimpangan distribusi pupuk bersubsidi yang melibatkan PT Pupuk Indonesia dan oknum-oknum terkait mengundang perhatian besar dalam ranah hukum bisnis. Berdasarkan analisis komprehensif, dapat disimpulkan bahwa penyimpangan distribusi pupuk bersubsidi merupakan tipikor yang serius, sebagaimana diatur dalam UU No 31/1999 juncto UU No 20/2001. Pelanggaran Pasal 3 UU tersebut mencakup penyalahgunaan wewenang, pengayaan diri atau pihak lain, dan merugikan keuangan negara. Analisis kasus penyimpangan distribusi pupuk bersubsidi dalam Putusan No. 28/Pid.Sus-TPK/2022/PN Srg mengungkapkan dampak hukum dan sosial yang signifikan. Secara hukum, terdakwa Mahdi dijatuhi hukuman penjara 1 tahun 3 bulan dan denda Rp. 50.000.000,- atas pelanggaran Pasal 3 Jo. Pasal 18 UU No. 31/1999 jo. UU No. 20/2001 tentang Pemberantasan Tipikor. Kata Kunci: Bersubsidi, Bisnis, Korupsi, Penyimpangan. Abstract The agricultural sector plays a strategic role in development, especially in ensuring food availability for the community. In the context of the agricultural sector in Indonesia, PT Pupuk Indonesia plays a role as one of the main corporations in providing subsidized fertilizer which is very important for farmers. However, the existence of subsidized fertilizer which is supposed to provide benefits to farmers is often the target of irregularities. The case of irregularities in the distribution of subsidized fertilizer involving PT Pupuk Indonesia and related individuals has attracted great attention in the realm of business law. Based on a comprehensive analysis, it can be concluded that irregularities in the distribution of subsidized fertilizer are a serious criminal act of corruption, as regulated in Law no. 31 of 1999 jo. UU no. 20 of 2001. Violations of Article 3 of the Law include legitimate protection, enrichment of oneself or other parties, and harm to state finances. Analysis of cases of irregularities in the distribution of subsidized fertilizer in Decision Number 28/Pid.Sus-TPK/2022/PN Srg reveals significant legal and social impacts. Legally, the defendant Mahdi was sentenced to 1 year and 3 months in prison and a fine of Rp. 50,000,000,- for violation of Article 3 Jo. Article 18 Law No.31/1999 jo. Abstract

Hukum pidana memiliki peran penting dalam menegakkan keadilan, khususnya melalui pemidanaan terhadap tindak pidana seperti korupsi dan kejahatan yang melibatkan anak. Penelitian ini bertujuan untuk mengeksplorasi teori hukum pidana dalam konteks pemidanaan, pemberantasan korupsi, dan perlindungan anak di Indonesia. Menggunakan metode yuridis normatif dan pendekatan kasus, penelitian ini menganalisis sumber hukum tertulis serta studi kasus konkret untuk memahami tantangan dalam penegakan hukum pidana. Hasil menunjukkan bahwa sistem pemidanaan di Indonesia sering mendapat kritik karena kurangnya efek jera, terutama dalam kasus korupsi yang melibatkan pejabat tinggi. Selain itu, pemidanaan anak memerlukan pendekatan yang lebih humanis melalui restorative justice untuk memastikan perlindungan hak anak dan rehabilitasi. Analisis terhadap teori retributif, preventif, dan rehabilitatif menunjukkan perlunya keseimbangan antara pembalasan dan rehabilitasi dalam penegakan hukum pidana. Implementasi teori hukum pidana di Indonesia memerlukan reformasi, baik dalam penanganan kasus korupsi maupun pemidanaan anak, untuk mewujudkan keadilan yang lebih efektif dan humanis. Penelitian ini merekomendasikan penguatan regulasi dan peningkatan infrastruktur pendukung untuk mendukung sistem pemidanaan yang lebih adil dan efisien.
