Abstract

Many problems concerning food occur in Indonesia, we encountered food circulating in the community who do not heed the provisions on labeling, thus disturbing the public. Food trade expired, the use of dyes that are not intended for food, formalin, foods containing preservatives, or acts of other consequence is very detrimental to the community, it can even threaten the health and safety of human lives, especially for children in general, this cas ususally through of fraud on the food label. label is falsified or misleading adverse effects on human health and development.

Abstract

The People's Business Credit Program is one of the government's programs to increase access to financing for Micro, Small, and Medium Enterprises (MSMEs) which is channeled through financial institutions with a guarantee pattern. The financing distributed by people's business credit comes from banking funds or financial institutions that are people's business credit distributors. The funds provided are in the form of working capital and investment funds which are distributed to individual/individual MSMEs, business entities, and/or business groups who have productive and viable businesses but do not have additional collateral and also do not have good financial records. Even though the government has provided large MSME funds, the public is still unaware of people's business credit distribution. The people's business credit program is still the spearhead of government programs in efforts to expand access to financing for micro, small, and medium enterprises. The main aim of implementing this socialization is for the community to be able to develop their business into a bigger one, have business activities with good financial reports, and have no doubts about applying for people's business credit to the nearest state-owned bank to expand their business.

Abstract

Sustainable development is a critical concept used to enhance global welfare. In this context, peremptory norms recognized within international law are integrated as general, universal, essential, and fundamental principles for societal benefit. Therefore, this research aimed to investigate the role of sustainable development within international law and examine the contribution of norms to the formation of a modern legal state. The legal status of norms and capacity to embody universal values are clarified using descriptive analysis with a normative juridical approach and qualitative data. The results show that sustainable development has been developed as an indispensable paradigm, widely confirmed across legal frameworks. In addition, the integration as a universal norm within international law reflects the potential to influence legal systems globally. This depends on the balance of established sources such as treaties and customary practices. Moreover, this research contributes to legal scholarship by stating the role of international norms in advancing sustainable development.

Abstract

Problems that arise due to the increasing number of female workers, ranging from issues of gender equality, health, legal protection and wages. The 2000 Indonesian Occupational Health and Safety (K3) training document explains that for certain chemicals, conditions in factories such as excessive heat. In this research, researchers focused on the problems that existed when the research was carried out, secondary data related to reviewing maternity rights for pregnant women workers in ensuring the safety and health of pregnant women and the fetuses they contain. Article 86 paragraph (1) of the Manpower Law emphasizes: every worker has the right to obtain protection for occupational safety and health (K3) where pregnant female workers can ask to do work that is not heavy and dangerous. PT. This AFI violates existing legislation where pregnant women workers are employed on night shifts in accordance with the Company's operations without paying attention to Occupational Health and Safety, but the author provides a strategy to increase the fulfillment of maternity rights for pregnant women workers at PT. AFI's first step involves understanding the company's understanding of the applicable legal framework, including Law Number 13 of 2003 concerning Employment, which regulates the protection of female workers, including maternity rights.

Abstract

Penelitian ini bertujuan untuk menganalisis perlindungan hukum bagi pemegang polis dalam konteks pengalihan liabilitas dan restrukturisasi asuransi berdasarkan Undang-Undang Nomor 40 Tahun 2014 tentang Perasuransian. Metode yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa meskipun regulasi telah mengatur perlindungan hukum bagi pemegang polis, terdapat ketidakseimbangan kekuasaan antara perusahaan asuransi dan pemegang polis yang berdampak pada kerugian pemegang polis. Kasus Jiwasraya menjadi contoh di mana proses restrukturisasi yang tidak transparan menyebabkan penurunan manfaat bagi pemegang polis, serta ketidakpastian terkait hak-hak mereka. Hal ini menyoroti pentingnya pengawasan yang lebih kuat dari Otoritas Jasa Keuangan (OJK) untuk memastikan proses restrukturisasi dilakukan dengan adil dan transparan. Kesimpulan dari penelitian ini adalah bahwa perlindungan hukum bagi pemegang polis harus ditingkatkan melalui pengawasan yang lebih efektif dan transparansi yang lebih baik dalam proses restrukturisasi asuransi. Penting bagi perusahaan asuransi dan OJK untuk memastikan bahwa hak-hak pemegang polis dilindungi secara optimal, sesuai dengan prinsip-prinsip hukum yang berlaku. Restrukturisasi harus dilakukan dengan mempertimbangkan kepentingan pemegang polis dan menghindari pelanggaran terhadap hak-hak mereka.

Abstract

This study aims to analyze the development of limited liability companies (LLCs) following the enactment of Law Number 6 of 2023, which ratifies Government Regulation in Lieu of Law Number 2 of 2022 on Job Creation, and to explore the concept of The Private Individual Limited Company in Indonesia. The research employs a qualitative methodology, using a normative legal approach. The findings indicate that the Job Creation Law introduced a new legal entity, The Private Individual Limited Company, and altered the conventional paradigm of LLCs. Previously, LLCs were understood as capital partnerships requiring at least two founders, formed through an agreement. However, under the new law, LLCs can now be established by a single individual, provided the company qualifies as a micro, small, or medium enterprise (MSME). The concept of The Private Individual Limited Company allows a single person to establish an LLC, expanding the traditional understanding of LLCs as partnerships formed through agreements. However, this concept of single-person LLCs is not entirely new in Indonesia. Before the Job Creation Law, the Company Law (PT Law) already permitted such exceptions, allowing LLCs to be established by one person if the company’s shares were wholly owned by the state, state-owned enterprises, or regional government-owned enterprises.

Abstract

Foreign investment plays a crucial role in driving a nation's economic growth. It involves capital investments by international investors into various sectors of a country's economy. In qualitative research on policy and law, data collection methods often include the analysis of official documents such as laws, government regulations, financial reports, and previous studies related to foreign investment and economic development in Indonesia's new national capital. Law No. 25/2007 concerning investors also reflects the significant impact of foreign investment on Indonesia's economic growth. Foreign sinvestment can stimulate growth through several mechanisms, such as increasing investment in sectors with a high multiplier effect, creating jobs, facilitating technology and management knowledge transfer, and enhancing the competitiveness of domestic products in the global market. The legal aspects of economic development play a key role in regulating and protecting foreign investments. Legal protection of intellectual property rights, ownership rights, and safeguarding investments from potential risks provides added security for foreign investors. Keywords: Investment, Policy, Economy

Abstract

Penelitian ini mengkaji optimalisasi akad murabahah dalam konteks perbankan syariah Indonesia berdasarkan Undang-Undang No. 21 Tahun 2008. Tujuan utama penelitian ini adalah untuk menganalisis implementasi akad murabahah serta mengidentifikasi tantangan dan strategi optimalisasi yang dapat meningkatkan efektivitas pelaksanaannya. Metode penelitian yang digunakan adalah pendekatan yuridis normatif dengan mengumpulkan data primer melalui wawancara dan data sekunder dari literatur hukum dan dokumen resmi. Hasil penelitian menunjukkan bahwa meskipun kerangka hukum sudah memberikan landasan yang kuat, implementasi akad murabahah di lapangan masih menghadapi berbagai kendala seperti kompleksitas regulasi dan kebutuhan akan edukasi yang lebih baik. Strategi optimalisasi yang direkomendasikan meliputi peningkatan pengawasan internal, adopsi teknologi informasi, dan inovasi produk yang lebih fleksibel. Kesimpulan dari penelitian ini menegaskan pentingnya langkah-langkah tersebut untuk memastikan kepatuhan terhadap prinsip-prinsip syariah dan meningkatkan kualitas layanan perbankan syariah secara keseluruhan.

Abstract

Arbitration or the root word in (Latin) ''arbitrare'' means "the process or method of deciding a dispute through an independent arbitrator or referee". This definition is one of them because legal experts have different opinions or views even though their opinions have the same meaning. Talking about arbitration or arbitration institutions, there has actually been and has been practiced throughout the centuries for the first time introduced by the Greek community before Christ. As for Indonesia, arbitration is known and recognized by citizens as an alternative to problem solving through non-litigation. Alternative dispute resolution, such as arbitration and mediation, is now a popular choice in resolving business conflicts. The method used to collect data is by conducting literature searches published in scientific research articles and journals. The literature search was conducted using several loaded search engines, such as Google Scholar, Pubmed, and Science Direct.  This method is an alternative that is considered more effective and efficient than going through the courts, because the process is faster, lower costs, and the resulting decisions are final and binding. Abstract

At present many foreign investment contracts are made by the State subdivisions and State companies on one side with foreign private companies on the other. For countries that want to carry out a lot of business contracts in the field of foreign investment, which of course must provide stimulating incentives for investment, including the provision of supervision of foreign companies, because foreign investment means getting knowledge, experience, technical and managerial fields. The main considerations of foreign investment to carry out business contracts are basically their market expansion, besides the low production costs due to relatively cheaper labor costs, tax-free facilities (tax holidays) and other facilities free of charge by the capital receiving countries ( host states).
