Abstract

This study examines the application of Islamic criminal law principles in addressing drug-related offenses committed by minors through a critical discourse analysis of Palopo District Court Decision Number 47/Pid.Sus.Anak/2016/PN.PLP. The research explores the intersection between Islamic jurisprudence (fiqh) and Indonesia's contemporary juvenile justice system, particularly focusing on how Islamic legal principles are interpreted and applied in cases involving child offenders in drug-related crimes. The analysis reveals tensions between traditional Islamic criminal law approaches and modern restorative justice principles embodied in Indonesia's Law No. 11 of 2012 on the Juvenile Criminal Justice System. While Islamic law emphasizes the concept of ta'zir (discretionary punishment) and consideration of the offender's circumstances, Indonesian juvenile justice prioritizes rehabilitation, diversion mechanisms, and the child's best interests. The study demonstrates how judicial decisions attempt to reconcile these different legal frameworks, often favoring rehabilitative measures over punitive sanctions.  The research employs critical discourse analysis methodology to examine legal language, judicial reasoning, and ideological underpinnings in the court decision. Findings indicate that judges navigate between Islamic legal principles—such as the consideration of mental capacity (ahliyyah) and the protective nature of Sharia toward minors—and secular legal requirements emphasizing restorative justice. The decision reflects Indonesia's pluralistic legal system, where Islamic law influences judicial interpretation while operating within the framework of national criminal law. The study concludes that contemporary Indonesian courts demonstrate flexibility in applying Islamic criminal law principles to juvenile drug cases, prioritizing rehabilitation and child protection over strict punitive measures. This approach aligns with both Islamic jurisprudential concepts of mercy (rahmah) and modern international standards for juvenile justice, suggesting a harmonious integration of religious and secular legal principles in addressing youth criminality.

Abstract

Penelitian ini mengeksplorasi hukum waris islam untuk mengetahui, memahami dan menganalisis pandangan kompilasi Hukum Islam terhadap praktik pembagian warisan rumah kepada anak bungsu. Dengan menggunakan penelitian lapangan (field research) dan metode deskriptif kualitatif dengan melakukan studi kasus di Kecamatan Mungkajang Kota Palopo. Data penelitian diperoleh dengan cara observasi, wawancara mendalam dan dokumentasi. Hasil penelitian menunjukkan bahwa: Praktik Pembagian Warisan Rumah Untuk Anak Perempuan Bungsu di Kecamatan Mungkajang Kota Palopo sudah dilakukan sejak dahulu, yaitu dengan memberikan hak waris yang lebih besar dengan ahli waris lainnya. Pemberian hak waris dilakukan secara musyawarah anggota keluarga penerima hak waris serta bagian anak perempuan bungsu secara khusus diberikan berdasarkan asas keadilan, yang dilihat dari sisi kemandirian serta kematangan ekonomi yang sesuai dengan hukum faraid Islam. Pembagian waris tersebut sesuai dengan Kompilasi Hukum Islam (KHI) Pasal 183 yang berbunyi  “Para ahli waris dapat bersepakat, melakukan perdamaian dalam pembagian harta warisan, setelah masing-masing menyadari bagiannya”.

Abstract

This study examines the judicial discourse surrounding money politics in Indonesian electoral processes through a critical discourse analysis of Decision Number 61/PID.SUS/2019/PN.MLL from the Malili District Court regarding criminal acts of money politics during the 2019 elections in East Luwu Regency. Using Fairclough's three-dimensional framework of critical discourse analysis, this research investigates how legal language constructs and legitimizes judicial reasoning in electoral corruption cases, while examining the underlying power relations and ideological assumptions embedded within the court's decision.  The methodology combines textual analysis, discursive practice examination, and sociocultural practice investigation to uncover how the judge's linguistic choices reflect broader institutional attitudes toward electoral integrity and democratic governance. The study analyzes lexical choices, syntactic structures, modality, and argumentation patterns within the legal text to reveal how judicial discourse shapes public understanding of electoral crimes and their consequences.  Key findings reveal that the judicial discourse employs specific linguistic strategies that position money politics as a threat to democratic legitimacy while simultaneously reinforcing state authority in electoral oversight. The analysis demonstrates how legal language serves not merely as a neutral vehicle for justice delivery but as a powerful tool for constructing social reality and reinforcing existing power structures. The court's decision reflects tensions between legal formalism and contextual considerations of local political dynamics in East Luwu.  The research contributes to understanding how judicial discourse in Indonesia's post-reform era constructs electoral integrity narratives and legitimizes legal interventions in political processes. It reveals the complex interplay between legal reasoning, political context, and social power relations in contemporary Indonesian democracy. The findings have implications for legal reform, judicial training, and broader discussions about combating electoral corruption in emerging democracies.

Abstract

Penelitian ini melakukan tinjauan yuridis terhadap kekerasan fisik dan penanganannya di Lembaga Pemasyarakatan Kelas II A Palopo. Kekerasan fisik di dalam lembaga pemasyarakatan merupakan masalah serius yang mengancam tujuan sistem pemasyarakatan dalam merehabilitasi dan membimbing narapidana. Penelitian ini bertujuan untuk menganalisis bentuk-bentuk kekerasan fisik yang terjadi, faktor-faktor penyebabnya, serta upaya hukum dan kebijakan yang diterapkan untuk menangani kasus-kasus tersebut. Metode penelitian yang digunakan adalah pendekatan empiris-yuridis dengan metodologi kualitatif. Data dikumpulkan melalui tinjauan literatur, observasi, dan wawancara dengan petugas penjara dan pihak terkait lainnya. Temuan menunjukkan bahwa kekerasan fisik di dalam penjara terjadi di antara narapidana dan disebabkan oleh berbagai faktor, seperti overcrowding, kondisi monoton, lingkungan sosial, dan candaan berlebihan. Tanggapan penjara meliputi langkah-langkah preventif, represif, dan rehabilitatif. Namun, implementasi langkah-langkah ini masih menghadapi berbagai hambatan terkait sumber daya manusia dan infrastruktur. Studi ini menyimpulkan bahwa perlindungan hukum terhadap narapidana dari kekerasan fisik belum optimal. Oleh karena itu, diperlukan penguatan peraturan internal, peningkatan kapasitas staf, dan perbaikan pengawasan untuk menciptakan lingkungan pemasyarakatan yang aman dan manusiawi sesuai dengan prinsip-prinsip hak asasi manusia.

Abstract

This research aims to describe the resolution of divorce cases for prisoners. The research uses qualitative with a normative juridical and sociological approach. The data source in the research comes from interviews with Heads of Correctional Institutions, Officers and Prisoners. The results of the research show that 1) Divorce processes involving prisoners as defendants often present decisions in the form of verstek decisions because prisoners or convicts are serving their sentences in prison. Because of their absence and without representing their attorney, the Legal Council will decide the case in verstek. The Defendant's limitations in attending the trial result in the principle of justice not being fulfilled for prisoners or inmates in defending their rights at trial. 2) The factors that influence the divorce of inmates at the Class II A Palopo Penitentiary are largely attributed to economic pressure, as well as a lack of social support from the community, which is why the wife asks for a divorce. 3) Efforts to facilitate the process of resolving inmate divorce cases at the Class II A Palopo Penitentiary are a) Meeting economic needs, prisoners' wives have difficulty financing the improvement in life skills that must be provided or facilitated. b) family and community support. c) Accepting that the Justice Council will decide the case in verstek because there are no provisions in the statutory regulations that regulate prisoners or convicts being able to attend divorce trials.

Abstract

This research aims to analyze the form of legal protection for customers who suffer losses due to fraudulent funds in the capital market, the role and efforts of the Financial Services Authority in protecting customers in the capital market, and how Sharia economic law reviews in resolving disputes in the capital market.This type of research is normative legal research through a juridical approach which is carried out by examining various legal rules such as in Laws and Regulations No. 8 of 1995 concerning Capital Markets in Chapter X  I concerning fraud, market manipulation and insider trading, as well as cases related to the capital market, namely the case of PT Sarijaya Permana Sekuritas. Related to dispute resolution in Islamic law explained in the Al-Quran surah Saad verse 26 Data collection techniques using Library Research techniques (literature study), namely a data collection technique that collects legal materials obtained from various sources such as books, journals, and online written media related to the object of discussion. The data analysis technique used is qualitative data analysis technique, namely analyzing data by collecting data, presenting data and drawing conclusions, then the data is arranged in descriptive form by describing the data that has been obtained in the form of logical sentence descriptions, then interpreted and given conclusions.The results of this study indicate that: First, legal protection of customers who suffer losses due to violations committed by securities companies can apply the return of unauthorized profits by the OJK to the Securities Company to provide loss compensation funds to customers. Second, based on Law Number 21 of 2011 OJK has a role in forming regulations for improvements in the field of capital markets including protecting customers as consumers. Third, dispute resolution in Islam can be through peace mechanisms (such), arbitration (tahkim), and courts (Al- qada).

Abstract

The purpose of this research is to find out the views and aspirations of the Kedatuan Luwu regarding the process of regional expansion that has an impact on the cultural and historical identity of the region, as well as evaluating the perceptions of the local government regarding Law Number 9 of 2015 and the implementation of regional expansion of Tana Luwu. This type of research is qualitative research with data collected through in-depth interviews with key informants such as local government, community leaders, academics, and related experts. In addition, data will also be obtained through document analysis and direct observation in the field. The results of the study show that: (1) the importance of regional expansion in Tana Luwu; (2) a comprehensive evaluation from various aspects, including political, economic, and cultural. The establishment of the Greater Luwu Province is considered necessary as a solution to overcome the problems that occur related to improving access to government services, more equitable infrastructure development, and more equitable distribution of resources.

Abstract

This study discusses the Circular Letter of the Director General of Public Guidance of the Ministry of Religion Number P.005/DJ.III/Hk.00.7/10/2021 in which there is a policy on the waiting period of the former husband for the ‘iddah of the ex-wife from the perspective of al-żarῑʻah, so that the basis and purpose of the issuance of the circular letter can be known. This research is a juridical normative legal research with an analytical approach that refers to applicable regulations. Data validity checks using data triangulation methods, observation persistence, and peer checking which are then processed by classification, verification, and analysis to produce conclusions. The results of the study show that ‘iddah is a waiting time that applies to a wife whose marriage is broken up, including for ex-husbands. In general, the content of the policy in this Circular Letter is under the method of preventing badness (sadd al-żarῑʻah). The policy regulates that ex-husbands can only marry other women when the ‘iddah period of their ex-wives has been completed or the ’iddah has ended because this encourages ex-husbands to rethink or as an effort of reconciliation so that the hope is that ex-husbands can reconcile with their ex-wives as recommended by Allah Almighty. If the husband marries another woman, it leads to badness (mafsadat), namely divorce, which is an act that is most hated by Allah Almighty.
