Abstract

Pernikahan merupakan suatu ikatan yang sakral, dengan berubahnya status seseorang yang awalnya bujangan menjadi kawin, dengan mengharapkan akan tercipta generasi baru, maka hal tersebut perlu adanya kesiapan yang matang untuk umur, mental maupun sosial ekonomi, dengan cukupnya usia umur menjadi penentu suatu keputusan dalam pernikahan tersebut. Tujuan penelitian ini untuk mengetahui faktor-faktor penyebab pernikahan dini, dengan maraknya pernikahan dini pada Desa serta para peserta diharapkan memiliki pemahaman terkait upaya pencegahan pernikahan dini dalam kegiatan ini berupaya keras menggalang dukungan publik untuk mendukung dan mendorong terbitnya peraturan pencegahan dan penghapusan perkawinan anak di bawah usia 18 (delapan belas) tahun, melakukan penyadaran kritis para orang tua, para remaja dan para korban yang terlibat perkawinan anak. Metode dalam kegiatan pengabdian kepada masyarakat yang dilakukan ini dengan metode sosialisasi hukum, dengan diberikannya materi terkait faktor dari pencegahan pernikahan dini. Hasil pengabdian peserta memahami materi yang disampaikan oleh tim pengabdian kepada masyarakat, dengan melihat respon dan antusiasme para peserta untuk bertanya dan berdiskusi pada tim kami, serta terdapat suatu himbauan kepada peserta untuk menghindari pernikahan sebelum umur 19 (sembilan belas) tahun.

Abstract

Legal subjects who are capable of doing legal acts making agreements are people who are adults and people who are not put under custody, there is a problem when one of the parties is a prisoner. The purpose of this study is to find out the prisoner's signature in the sale and purchase deed is valid or not according to civil law, as well as in the case that the sale and purchase deed signed by the prisoner has legal force or has no legal force. This type of research is normative legal research with a conceptual approach and a statutory approach. From this research, it can be concluded that the prisoner's signature in the sale and purchase deed is valid according to civil law in accordance with Article 3 of the Civil Code, namely that no punishment results in civil death, or loss of all citizenship rights, so that the prisoner has no legal action that can eliminate his civil rights including the signing of the sale and purchase deed. In the event that the legal force of the sale and purchase deed signed by the prisoner meets the element of misappropriation (misbruik van omstandigheiden), then the sale and purchase deed is declared invalid.

Abstract

This study aims to examine the legal and humanitarian implications of the Electronic Traffic Law Enforcement (ETLE) system when applied to emergency vehicles such as ambulances that violate traffic regulations during life-saving missions. The research employed a normative legal method supported by statutory and conceptual approaches, complemented by limited empirical observations. The method analyzed primary legal materials, including traffic legislation and constitutional provisions, and secondary materials such as journal articles on digital law enforcement and algorithmic decision-making. The novelty of this research lies in its identification of structural weaknesses in Indonesia’s automated ticketing system, which fails to differentiate ordinary traffic violations from emergency-based exceptions, resulting in potential conflicts with the constitutional right to life. The findings demonstrate that ETLE operates rigidly because it relies solely on visual camera detection without integration with emergency vehicle databases. This creates legal inconsistency, particularly with Articles 134–135 of the Traffic Law and Article 28A of the Constitution. The research also reveals a technological gap due to the absence of adaptive algorithms, real-time vehicle identification, and human-override mechanisms. Based on these findings, the study concludes that ETLE requires regulatory refinement, technological upgrading, and inter-institutional integration to ensure that automated enforcement remains aligned with principles of justice and humanitarian protection. The study recommends developing an integrated whitelist system, real-time data synchronization with emergency services, and the inclusion of contextual AI-based analysis to prevent the penalization of life-saving actions.
