Abstract

Sejak kemunculannya di Wuhan Cina pada awal 2020, Covid-19 melanda semua negara di dunia, yang berpengaruh langsung terhadap perikehidupan warga dunia di berbagai negara. Tidak hanya sektor kesehatan, tetapi terutama juga adalah sektor perekonomian, pariwisata dan pendidikan. Semua pemerintahan negara-negara di dunia menentukan regulasi (kebijakan) dan mempersiapkan anggaran untuk menanggulangi dampak yang lebih meluas dari merebaknya pandemi ini. Langkah ini diambil oleh Indonesia, maupun Jepang. Berbagai kebijakan dan anggaran masa krisis ini tentu harus mendapatkan perhatian dari sisi bagaimana tata kelola dan akuntabilitasnya. Maka hendak dicari jawaban perbandingan dampak dan tantangan regulasi, tata kelola dan akuntabilitas anggaran untuk merespon pandemi Covid-19 antara Indonesia dan Jepang. Penelitian yang mengunakan kombinasi penelitian lapangan field research dan library research ini bersifat bersifat deskriptif analitis, yaitu mendiskripsikan dan menganalisis dampak dan upaya penanggulangan Covid-19 dari sisi regulasi dan anggaran. Penelitian ini menggunakan model studi kasus kebijakan dan tata kelola anggaran terkait Covid-19 di Indonesia dan Jepang. Jadi kebijakan dan tata kelola anggaran terkait Covid-19 menjadi subyek penelitian ini. Kesimpulan yang dapat diambil adalah bahwa kedua negara sama-sama merasakan dampak Covid-19 dalam berbagai sektor, seperti terutama sektor kesehatan, tetapi juga sektor perekonomian dan ketenagakerjaan, industri pariwisata, dan sektor pendidikan. Meskipun kedua negara sama-sama menentukan regulasi dan anggaran krisis untuk menanggulangi dampak Covid-19, letak dan kondisi geografis, luasnya wilayah Indonesia yang tersebar dalam ribuan pulau, banyaknya dan heterogennya jumlah penduduk, serta budaya masyarakat dan pemerintahan yang berbeda dengan Jepang menyebabkan perbedaan langgam dalam penanganan dan penanggulangan pandemi Covid-19 di kedua negara.

Abstract

Konstitusi Indonesia setelah amandemen lebih lanjut memperkuat Indonesia sebagai Negara Hukum. Negara hukum Indonesia lebih dipengaruhi oleh sistem hukum perdata yang memiliki karakteristik dan karakteristik hukum yang diwujudkan melalui undang-undang. Sehingga hukum tertulis formal (undang-undang) memiliki posisi paling penting dalam penegakan hukum. Pilihan hukum perdata sebagai sistem hukum yang diadopsi menimbulkan masalah terlalu banyak peraturan di Indonesia, dengan istilah lain Indonesia terobsesi dengan peraturan. Dalam hal ini, tidak sedikit peraturan yang berlaku saat ini hanya menghambat program pembangunan di Indonesia. Selain itu, banyak peraturan yang tidak lagi relevan untuk diterapkan tetapi tetap berlaku karena tidak ada mekanisme evaluasi yang dilakukan. Dengan demikian, perlu diprakarsai metode "klausa matahari terbenam" dalam sistem perundang-undangan di Indonesia. Metode sunset clause menyediakan mekanisme evaluasi untuk penegakan peraturan secara berkala. Tujuan dari penelitian ini adalah untuk memberikan gambaran tentang gagasan metode klausa sunset dalam sistem perundang-undangan di Indonesia.Penelitian ini merupakan penelitian hukum normatif, dengan data sekunder sebagai data utama. Metode penelitian yang digunakan adalah studi pustaka, dengan memeriksa data sekunder yang dikumpulkan. Hasil dari penelitian ini adalah gagasan penerapan metode sunset clause dalam sistem legislasi di Indonesia. Metode klausa matahari terbenam akan memberikan periode waktu untuk pemberlakuan undang-undang. Klausul metode sunset dalam sistem legislasi memberikan kesempatan untuk meninjau penegakannya. Ini dapat digunakan sebagai bentuk evaluasi penerapan undang-undang. Beberapa hasil yang mungkin dari tinjauan dalam metode klausa matahari terbenam mungkin, pembaruan tanpa perubahan, pembaruan dengan perubahan, konsolidasi, pencabutan. Metode klausa sunset ini bisa menyelesaikan masalah legislasi di Indonesia terkait dengan over regulation.Keywords : state of law, legislation system, sunset clause

Abstract

Pemilu merupakan ujung tombak demokrasi, yang mentransformasikan suara rakyat menjadi kursi. Dengan pemilu rakyat dapat memilih siapa yang akan menjadi pemimpin ataupun wakilnya dalam kursi parlemen. Sudah seharusnya rakyat sebagai pemegang demokrasi diberi kemudahan dalam menggunakan hak suaranya. Namun pada ptaktiknya masih terdapat problem tidak aksesibelnya surat suara bagi pemilih penyandang tuna aksara. Diketahui, surat suara DPR dan DPRD yang ada hanya mencantumkan nomor dan logo partai serta nama calon tanpa disertai adanya foto calon. Penelitian ini memaparkan problem yang dihadapi oleh pemilih penyandang tuna aksara berkaitan dengan desain surat suara pemilihan DPR/DPRD dalam pemilihan umum serentak 2019, upaya yang dilakukan oleh Komisi Pemilihan Umum (KPU) dalam mengakomodir hak-hak pemilih penyandang tuna aksara serta efektifitas solusi yang diberikan oleh KPU. Walhasil, penelitian ini juga dapat digunakan sebagai teropong penyelenggaraan pemilihan umum serentak tahun 2024 mendatang, yang diharapkan dapat menjadi pemilihan umum yang lebih baik lagi.

Abstract

Since ancient times until now, the arrangement of power from the central government to regional governments has always been different. Until now the central government has given authority to regional governments in the form of regional rights, powers and obligations to regulate and manage their own households in accordance with applicable laws and regulations which is called regional autonomy. Since early March 2020, Indonesia has been hit by the Corona Virus Disease (Covid-19), which has even been declared a national disaster because the spread of this virus is so fast that it can even cause death. Lampung Province as the gateway to Sumatra is very vulnerable to exposure to the Covid-19 virus where there were 77,148 cases during 2020-2023 both those who recovered and died. This article discusses the legal politics of regional autonomy in the era of the Covid 19 pandemic in the health sector. By using a qualitative descriptive research method that describes existing phenomena or facts, both natural and human engineering. This study pays more attention to the quality, characteristics, and interrelationships between activities. Referring to the mandate of regional autonomy where district/city scale health affairs are decentralized to district/city regional governments and provincial scale health affairs are decentralized to provincial regional governments, so that in handling Covid-19 in Lampung Province the rights and authorities of autonomy can be implemented. Regarding the handling of the Covid-19 pandemic in Lampung Province, the roles and functions of the local government have been quite optimal, the health budget and human resources must be increased again so that regional autonomy in the health sector can run more optimally.

Abstract

The problem in this study is: what are the inhibiting factors of Lembaga Pemasyarakatan Kelas I Bandar Lampung’s efforts in carrying out early detection as an effort to prevent the spread of radicalism in prisons? And how are the efforts of Lembaga Pemasyarakatan Kelas I Bandar Lampung in carrying out early detection as an effort to prevent the spread of radicalism inside? The research method is a normative and empirical juridical approach using secondary and primary data. Secondary data are obtained through literature studies, and primary data are obtained through field studies through observation and interviews. Then data analysis is carried out through qualitative legal analysis. The results of the study reveal factors inhibiting the efforts of Lembaga Pemasyarakatan Kelas I Bandar Lampung in carrying out early detection as an effort to prevent the spread of radicalism in residential block areas, including UU no 5 of 2018 concerning the Eradication of Criminal Acts of Terrorism. In practice, it has not been seen to have a real effect on preventing the spread of radicalism. Then the factor of prison officers finding it difficult to detect these radical ideas completely, the factor of facilities and infrastructure for handling radicalism crimes, is the lack of maximum supporting facilities, especially the improvement of facilities and infrastructure for fostering terrorism. The efforts of Lembaga Pemasyarakatan kelas I Bandar Lampung in carrying out early detection as an effort to prevent the spread of radicalism include forming a special unit, namely the Civil Service for terrorist prisoners, and forming a special guidance, namely the Pancasila Clinic, as a space for all prisoners without exception to learn national insight from the understanding of Pancasila, Bhinneka Tunggal Ika, UUD 1945, and NKRI. The suggestion that can be put forward is that Bandar Lampung Class I Prison should always improve facilities and infrastructure related to the special development of terrorism prisoners, where so far all prisoners have been equated in terms of coaching.

Abstract

The life of the legal constitution has undergone significant developments since the past to the current modern era. The legal constitution era marked a paradigm shift from absolute authority to government based on the rule of law and recognition of human rights. These changes have influenced the formation and interpretation of legislation governing the social, political and economic order in various countries. This article examines the evolution of legislation in the legal constitutional era by highlighting the challenges and opportunities faced. The main challenges stem from the complexity of the problems faced by modern society, including globalization, technology, environment and social dynamics. Rapid social change often requires a comparable legislative response to maintain justice and balance in society. In addition to challenges, the era of legal constitutions also brings opportunities for more inclusive and progressive legal innovations. By giving power to constitutional institutions such as the Constitutional Court, legislation can accommodate the aspirations and needs of diverse communities. Increasing public participation in the legislative process is also one of the great potentials for creating more representative and responsive laws. This study uses a descriptive analysis method by reviewing the latest literature on changes to the legal constitution and their impact on legislation. The main findings show that the evolution of legislation in the era of legal constitutions provides complex consequences and challenges, but at the same time presents opportunities to create a legal system that is more just and relevant to the times

Abstract

Legal politics or what is known as policy direction is important in order to provide direction on the form and material of law. However, in a study that examines the problems of law enforcement, in Indonesia, which was studied from a legal sociology perspective, it was stated that developments in the world today often give rise to various problems, whether in the form of violations of norms that exist in social life or rules that have a tendency to create a phenomenon that is contrary to moral and ethical rules as well as legal rules. This paper aims to find out the facts and legal political realities that occur on post-reform legislation in forming responsive laws. Using a normative writing method. The direction of legal politics in post-reform Indonesia is the desire to form a responsive legal system, this can be implicitly seen in several changes to the constitution. Change towards responsive law is not something instant and easy, there must be a commitment from the state and the people together to realize the ideal of this system. Although the current implementation of law still experiences many errors here and there, at least the existing legal products have led to laws that responsive, what is needed now are leadership figures who are able to bring Indonesia to the implementation of responsive laws that are in accordance with what was previously expected in order to achieve prosperity for the people.

Abstract

The constitution and statutory law are two important pillars in running a country's legal system. The constitution is the highest legal basis that determines the structure of government, the rights of citizens, and the mechanism for exercising power. On the other hand, statutory law is the entirety of the legal regulations produced by the legislature and functions to regulate people's lives and provide a framework for decision-making and dispute resolution. This research explores the important role of the constitution and statutory law in ensuring justice, stability, and security of a country and how the two interact to achieve these goals. Abstract

In the implementation of the General Election in Indonesia, there are several legal instruments that regulate the types of violations of the Election law. This type of violation becomes an interesting discussion to discuss because if the candidate participating in the election is proven, the sanction is disqualification. Bawaslu has the authority to handle election administration violations by structured, systematic, massive. In the handling process, the Bawaslu Commissioner acts as a panel of judges. The process of recruiting Bawaslu Commissioners is not oriented as a panel of judges in conducting trials, but as a supervisory institution in the administration of elections. So that there is a shift in the function of Bawaslu not only as a supervisory institution but into a judicial institution. Constitutionally, Bawaslu is not an institution of Judicial Power. So, in the Judicial System paradigm, this has the potential to reduce the quality in deciding alleged violations of the structured, systematic, massive election administration. The problem in this research is how is the concept of election administration violation by structured, systematic, massive in Indonesia? And how is the concept of handling election administration violations in a structured, systematic, massive manner in accordance with the framework of the judicial system in Indonesia?This research method uses a normative juridical approach, with secondary data as the main data type. The data collection method was carried out by means of a library study of relevant primary, secondary and tertiary legal materials. Furthermore, data analysis was carried out using descriptive analysis method.The conclusion of this study states that the concept of election administration violations by structured, systematic, massive in Indonesia is one type of special election administration violation with the handling authority owned by Bawaslu. The concept of handling election administrative violations by structured, systematic, massive which is in line with the framework of the judicial system in Indonesia, namely through a special election judiciary that administers justice with an ad hoc panel of judges for handling structured, systematic, massive violations of election administration in Indonesia.Keywords: Reconstruction, Election Administration, Judicial System

Abstract

Penelitian ini bertujuan untuk melakukan evaluasi dan dekonstruksi terhadap pelaksanaan pemilihan umum serentak yang dilaksanakan di Indonesia pada Tahun 2019. Dalam penelitian ini, data dikumpulkan dengan metode wawancara dan studi dokumen. Analisis data menggunakan model Miles dan Huberman, yaitu reduksi data, penyajian data dan penarikan kesimpulan. Teori yang digunakan adalah teori Randall B. Ripley dan Grace A. Franklin yang mengidentifikasi efektifitas penerapan suatu kebijakan dengan 3 (tiga) indikator, yaitu : Tingkat kepatuhan pada ketentuan yang berlaku, Lancarnya pelaksanaan rutinitas fungsi, dan terwujudnya kinerja dan dampak yang dikehendaki. Berdasarkan hasil penelitian, pelaksanaan pemilihan umum serentak yang dilaksanakan Indonesia pada Tahun 2019 masih belum terlaksana secara efektif. Pertama, dari tingkat kepatuhan pada ketentuan yang berlaku sudah menunjukkan ketaatan dan kepatuhan yang baik. Kedua, diukur dari lancarnya pelaksanaan rutinitas fungsi, diperoleh hasil bahwa masih ditemukan banyak sekali hambatan dan kesulitan dalam pelaksanaan pemilihan umum serentak seperti banyaknya petugas pelaksana pemilihan umum yang meninggal akibat kelelahan serta tingkat kesalahan input data yang masih tinggi. Ketiga, dari segi hasil yang dikehendaki, pemilihan umum serentak telah menghasilkan output berupa Presiden dan Wakil Presiden, DPR, DPRD, DPD terpilih, namun, hal tersebut melalui proses yang tidak efisien, menimbulkan banyak permasalahan, serta pelaksanaannya belum secara holistik hingga pemilihan kepala daerah. Dengan demikian, pelaksanaan pemilihan umum serentak masih belum terlaksana secara maksimal dan masih memerlukan penyempurnaan sistem agar mencapai hasil yang jauh lebih optimal di masa depan
