Abstract

Kehidupan konstitusi hukum telah mengalami perkembangan signifikan sejak masa lalu hingga era modern saat ini. Era konstitusi hukum menandai pergeseran paradigma dari otoritas absolut ke pemerintahan yang berdasarkan pada supremasi hukum dan pengakuan hak asasi manusia. Perubahan ini telah mempengaruhi pembentukan dan interpretasi perundang-undangan yang mengatur tatanan sosial, politik, dan ekonomi di berbagai negara. Artikel ini membahas evolusi perundang-undangan di era konstitusi hukum dengan menyoroti tantangan dan peluang yang dihadapi. Tantangan utama berasal dari kompleksitas masalah yang dihadapi masyarakat modern, termasuk globalisasi, teknologi, lingkungan, dan dinamika sosial. Perubahan sosial yang cepat sering kali memerlukan respons legislatif yang sebanding untuk menjaga keadilan dan keseimbangan dalam masyarakat. Selain tantangan, era konstitusi hukum juga membawa peluang bagi inovasi hukum yang lebih inklusif dan progresif. Dengan memberikan kekuatan kepada lembaga-lembaga konstitusional seperti Mahkamah Konstitusi, perundang-undangan dapat mengakomodasi aspirasi dan kebutuhan beragam masyarakat. Peningkatan partisipasi publik dalam proses perundang-undangan juga menjadi salah satu potensi besar untuk menciptakan hukum yang lebih representatif dan responsif. Penelitian ini menggunakan metode analisis deskriptif dengan mengkaji literatur terkini tentang perubahan konstitusi hukum dan dampaknya pada perundang-undangan. Temuan utama menunjukkan bahwa evolusi perundang-undangan di era konstitusi hukum memberikan konsekuensi dan tantangan yang kompleks, namun sekaligus menyajikan peluang untuk menciptakan sistem hukum yang lebih adil dan relevan dengan perkembangan zaman.

Abstract

Exactly 79 years ago, on August 17, 1945, the independence of the Republic of Indonesia was proclaimed, and in its constitution, the 1945 Constitution, in the Body and Explanation it is emphasized that Indonesia is a state of law. In the Body there are also various provisions that regulate Human Rights. It is recognized that the state of law and human rights are issues that must be discussed in one breath, because there is no state of law without the recognition of human rights and the enforcement of human rights is an unbroken chain with the principles of democracy and the state of law.In the two main axes of the concept of the state of law, Recht Staat and the rule of law, which were both born and developed in Europe, Indonesia carries the concept of the Pancasila state of law. The Pancasila state of law is a concept of a state of law that is based on the noble views and philosophies of life of the Indonesian people from generation to generation. It is also a form of crystallization of views and philosophies of life that are full of noble ethical and moral values as stated in the 1945 Constitution. Recognition as a country of law demands the upholding and implementation of what is ideally organized by a country of law. So it will be studied how to realize a Pancasila country of law that protects Human Rights

Abstract

Human rights are fundamental rights inherent in every human being without exception that need to be maintained, respected and protected by every human being, society and the state. Law No. 39/1999 on Human Rights is one of the most important legal instruments in the context of the protection and enforcement of human rights in Indonesia. The protection of human rights is one of the main pillars in a modern legal and constitutional structure. The conception of human rights is regulated in the 1945 Constitution of the Republic of Indonesia (UUD 1945) in articles 28A to 28J. The existence of basic rights will create a healthy balance between state power and individual freedom. After independence, the protection of human rights became more advanced with the existence of many protection institutions such as KOMNAS HAM. However, there are still those who try to revive systematic violence and discrimination against minority groups of people

Abstract

The implementation of general elections (Pemilu) is an important indicator in a democratic system because people can participate in determining their political choices for the country and its government. This study aims to analyse how criminal law enforcement is carried out in overcoming criminal acts of money politics against the implementation of current elections? and how is criminal law enforcement in preventing criminal acts of money politics against the implementation of elections in the future? Data was collected through normative legal research methods by inventorying positive law and literature, then analysed using a qualitative approach. The results of the study indicate that law enforcement against the practice of money politics in general elections (Pemilu) has problems, especially in terms of regulation, namely related to the weaknesses of the Election Law which can cause certain legal subjects to escape from the criminal trap of the Election Law. The Election Law only regulates the prohibition of money politics practices to givers or people who promise. While the recipient is not strictly regulated

Abstract

A city is one of the areas heavily populated by people. In Indonesia, there are a total of 98 cities. A city is a complex area because it has various zones such as central zones, industrial zones, and suburban zones. Additionally, a city should also have green open spaces. Green open spaces can help minimize global warming and the greenhouse effect in urban areas. Moreover, cities often grapple with waste issues. Urban residents should develop good mental attitudes and habits, such as not littering. Cooperation between the government, which builds proper and appropriate urban planning by providing green areas, and the public's awareness to maintain city cleanliness by disposing of waste properly, is necessary.

Abstract

The mechanism for enforcing money politics law has 2 (two) different legal dimensions, namely the election criminal dimension and the election administration dimension. Such conditions give rise to legal uncertainty in the process of enforcing the money politics that occurs. The principle of electoral justice is an important perspective in the process of enforcing money politics laws. This research aims to construct Money politics Law Enforcement that can Achieve Electoral Justice in Indonesia. This research uses a normative juridical approach, with secondary data as the main data. The data collection method was carried out by literature study of secondary data. Next, data analysis was carried out using qualitative descriptive methods. The conclusion of this research states that the construction of law enforcement of money political practices in the implementation of elections in Indonesia can be carried out by constructing 2 (two) aspects, namely certainty regarding types of money politics violations as a special type of criminal violation for elections and constructing law enforcement of money political practices through the establishment of judicial institutions. especially elections.

Abstract

The problem in this study is: what are the inhibiting factors of Lembaga Pemasyarakatan Kelas I Bandar Lampung’s efforts in carrying out early detection as an effort to prevent the spread of radicalism in prisons? And how are the efforts of Lembaga Pemasyarakatan Kelas I Bandar Lampung in carrying out early detection as an effort to prevent the spread of radicalism inside? The research method is a normative and empirical juridical approach using secondary and primary data. Secondary data are obtained through literature studies, and primary data are obtained through field studies through observation and interviews. Then data analysis is carried out through qualitative legal analysis. The results of the study reveal factors inhibiting the efforts of Lembaga Pemasyarakatan Kelas I Bandar Lampung in carrying out early detection as an effort to prevent the spread of radicalism in residential block areas, including UU no 5 of 2018 concerning the Eradication of Criminal Acts of Terrorism. In practice, it has not been seen to have a real effect on preventing the spread of radicalism. Then the factor of prison officers finding it difficult to detect these radical ideas completely, the factor of facilities and infrastructure for handling radicalism crimes, is the lack of maximum supporting facilities, especially the improvement of facilities and infrastructure for fostering terrorism. The efforts of Lembaga Pemasyarakatan kelas I Bandar Lampung in carrying out early detection as an effort to prevent the spread of radicalism include forming a special unit, namely the Civil Service for terrorist prisoners, and forming a special guidance, namely the Pancasila Clinic, as a space for all prisoners without exception to learn national insight from the understanding of Pancasila, Bhinneka Tunggal Ika, UUD 1945, and NKRI. The suggestion that can be put forward is that Bandar Lampung Class I Prison should always improve facilities and infrastructure related to the special development of terrorism prisoners, where so far all prisoners have been equated in terms of coaching.
