Abstract

Penelitian ini bertujuan menganalisis tradisi Akkorongtigi dalam upacara perkawinan masyarakat Makassar di Sumanna, Kelurahan Barombong, Kota Makassar, dalam perspektif hukum Islam. Penelitian ini menggunakan metode kualitatif dengan pendekatan deskriptif. Hasil penelitian menunjukkan bahwa tradisi Akkorongtigi masih dilaksanakan sebagai salah satu rangkaian adat sebelum akad nikah. Pelaksanaannya diawali dengan kegiatan keagamaan, kemudian dilanjutkan dengan prosesi pengolesan daun pacar (leko' tigi) kepada calon mempelai oleh orang tua, keluarga, dan tokoh masyarakat sebagai simbol penyucian diri, keberkahan, serta harapan agar rumah tangga yang akan dibangun memperoleh kebahagiaan dan keharmonisan. Tradisi ini juga menggunakan berbagai perlengkapan adat yang memiliki makna filosofis dan menjadi bagian dari warisan budaya masyarakat Makassar yang terus dipertahankan secara turun-temurun. Dalam perspektif hukum Islam, tradisi Akkorongtigi termasuk dalam kategori 'urf shahih, yaitu adat kebiasaan yang tidak bertentangan dengan Al-Qur'an, Sunnah, maupun prinsip-prinsip syariat Islam. Oleh karena itu, pelaksanaannya dihukumi mubah (boleh) karena mengandung nilai-nilai kebaikan, mempererat silaturahmi, serta menjadi bentuk harmonisasi antara adat Makassar dan ajaran Islam tanpa menjadikannya sebagai syarat sah perkawinan.

Abstract

Takaful participation in Makassar remains low despite its role as a regional center for Islamic finance, indicating a gap between institutional development and societal acceptance. Existing studies have not fully explained how maqāṣid al-sharī‘ah values intersect with local socio-cultural structures or how social, cognitive, and legal factors shape participation. This study addresses these gaps by examining these dynamics and proposing a culturally grounded reconstruction model. Using a qualitative sociological-juridical approach, data were collected from 22 informants, including takaful agents, religious scholars, regulators, and policyholders, through semi-structured interviews, observation, and document analysis. Analysis followed the Miles Huberman Saldaña interactive model with triangulation to ensure validity. We employed a maqāṣid-based hermeneutical lens to interpret values such as ḥifẓ al-māl and ḥifẓ al-nafs, as well as taʿāwun, alongside the local cultural ethos of siri’ na pacce. Findings indicate that low participation is not due to resistance to Islamic principles, but rather to a misalignment between formal takaful mechanisms and community-based solidarity norms. The study introduces the Maqāṣid Cultural Embeddedness Model, integrating value reframing, institutional collaboration with religious leaders, and community-oriented micro-takaful design. This model provides conceptual and practical guidance for aligning takaful systems with maqāṣid objectives and the socio-cultural realities of Makassar.

Abstract

Indonesia, as the world's largest Muslim-majority country, requires the development of an economic system that aligns with the principles of Islamic Sharia, one of which is through the concept of Sharia populist economy. This concept balances Sharia principles with the spirit of populism to achieve social justice and community welfare. The purpose of this research is to explore a deep understanding of the Sharia populist economy concept and how it can be integrated with principles of dignified justice. It also aims to analyze practical steps and strategies for implementing the Sharia populist economy concept in the Indonesian context, considering principles of dignified justice. This research employs normative legal research methods with a conceptual approach, using primary and secondary legal sources, data collection techniques through literature studies, and qualitative data analysis. The research findings reveal that the concept of Sharia populist economy is understood from the perspective of the theory of dignified justice as an effort to create an economic system that is fair, balanced, and prioritizes the welfare of all societal layers. This is achieved by integrating Islamic Sharia principles with the spirit of populism, involving active community participation in productive economic activities. This concept aims to create comprehensive justice, covering economic, spiritual, social, and environmental dimensions, ensuring that the entire society has equal opportunities to achieve well-being and dignity. Its implementation in Indonesia can be realized through a comprehensive approach, such as formulating supportive policies and regulations, developing adequate infrastructure, enhancing human resource capacities, encouraging active stakeholder participation, and the government's role in creating a conducive environment while maintaining principles of justice, balance, and welfare for all societal layers in line with the spirit of populism
