Abstract

Fighting corruption is done not only repressively but also preventively through a legal culture approach. This article examines and explores the construction of a legal culture model to prevent corruption through social media. Because the rampant corruption in Indonesia is also caused by cultural factors, including the weak culture of religiosity, strong kinship culture, and paternalistic culture. The research method used is non-doctrinal or social-legal with a conceptual approach. This study found that preventing corruption from the aspect of legal culture can be done by utilizing internet-based culture in the new age in various social media, such as Facebook, Twitter, WhatsApp, Instagram, and blogs, as a tool for social movements to prevent corruption. Because philosophically, the media functions for surveillance, interpretation, linkage, and the transmission of values and entertainment simultaneously. The urgency of the role of the media as a tool for the anti-corruption community movement or civil society is because, in the tradition of internet-based democracy or e-democracy, social media is placed as the fourth pillar of democracy or the fourth estate democracy for a balancer in the supervision of democratic governance. Several construction models of the legal culture of the anti-corruption watchdog social movement are needed through social media, namely, the model for forming a non-profit social media organization. Second, the model creates an anti-corruption icon on social media. Third, a model for the legal protection of the anti-corruption movement on social media.

Abstract

Pelayanan Publik yang berbasis E-government mempermudah akses agar terwujudnya pelayanan publik yang baik secara merata dan menyeluruh. Namun, pemerintah menghadapi kendala yakni kurangnya pengetahuan masyarakat akan teknologi yang masih dibawah rata-rat karena kurangnya sosialisasi dari pemerintah kepada masyarakat. Pemerintahan Desa atau Kelurahan menjadi dasar awal dalam menjalankan E-government untuk membangun kesejahteraan dan kualitas masyarakat desa. Pemerintah harus mempersiapkan diri untuk mengimbangi ekosistem digital yang berkembang, karena sumber daya manusia terdiri dari pegawai pemerintah dan masyarakat. E-government pada tingkat kelurahan didukung pula dengan peningkatan literasi digital masyarakat agar masyarakat memiliki informasi yang luas dan sebagai upaya pengembangan desa. Untuk optimalisasi e-government dengan meningkatkan literasi digital, maka dilakukan kegiatan Pengabdian Kepada Masyarakat (PKM) ini dalam bentuk kegiatan sosialisasi. Kegiatan sosialisasi ini dilakukan di Kelurahan Hargobinangun, Sleman, terdiri atas tahap meliputi tahap persiapan, pelaksanaan, dan evaluasi. Kegiatan ini diikuti oleh tokoh masyarakat, pemuda karang taruna, dan pemerintah Kelurahan Hargobinangun, Sleman. Hasil yang didapat menunjukkan bahwa kegiatan sosialisasi ini memberikan dampak peningkatan pemahaman masyarakat Kelurahan Hargobinangun tentang literasi digital masyarakat guna optimalisasi e-government.

Abstract

This article aims to examine corruption practices in the regions carried out by political dynasties and prevention efforts from the perspective of responsive constitutional law. It will examine the motives of political dynasties, forms of corruption by dynasties, factors that cause dynasties and efforts to prevent. This article uses a socio-legal method that is an interdisciplinary approach in the study of law by combining social sciences or humanities. Secondary data mainly comes from case, regulations and library. The results of the study show that the dynasties tend to practice the forms of corruption in the regions: corruption in the buying and selling of regional government positions and corruption in regional infrastructure projects originating from the Regional Budget Revenue. Factors causing political dynasties: the high cost of regional head elections and the absence of laws prohibiting dynastic practices in regional head elections. Efforts to prevent the practice of political dynasties for regional head elections from the perspective of responsive constitutional law are in the form of policies to regulate the regional head election system that prioritizes the principle of responsibility for public demands and provides alternative solutions through: reducing the cost of regional head elections, lowering the threshold for candidacy, changing the financing of regional head elections from the Regional Revenue Expenditure Budget to the State Expenditure Budget, separating local and national elections, a political culture that educates the people in voting, and policies for the welfare of the people in order do not elect dynastic candidates in regional head elections.

Abstract

In this case, the entertainment industry is an industrial sector that is very prone to the exploitation of children physically, socially, sexually, and economically. This is because children are recruited and employed on the basis of appearance, work excessively to the point of confiscating children's playing and learning for the material gain of their parents, and sometimes being put in the worst jobs resulting in sexual exploitation due to involvement in prostitution activities. However, there are many factors that make a child forced to work. Child labor is closely related to exploitation, very dangerous work, and hinders education and hinders physical development. This study aims to analyze how forms of legal protection arrangements can make child laborers avoid acts of exploitation, what are the factors that cause the entertainment industry to be prone to child exploitation, and how the government's efforts in tackling child labor in the entertainment industry sector are from acts of exploitation. This study uses the normative legal method or a statutory approach by reviewing all regulations and laws related to and related to the legal issue being studied. The results of this paper state that although there are a number of regulations protecting child labor, the tendency of child labor problems, especially in the entertainment industry sector, has developed in a complex manner towards the worst forms of exploitative work. Disharmonization of regulations and other government efforts related to the handling of child labor is also an influence. Therefore, various ways have been attempted by the government in overcoming this problem, but in fact, it is still not in accordance with what is expected.

Abstract

This study aims to analyze and examine the effectiveness of the Integrated Law Enforcement Center (Gakkumdu) in criminal enforcement of the 2024 Election in Central Java. This type of research is empirical or non-doctrinal law, the nature of analytical descriptive research. Using a qualitative approach with primary data from interviews and observations. Secondary data from books, scientific journal articles and legislative review. The results of the study show that the Central Java Gakkumdu Center has carried out its functions and authorities as a center for criminal law enforcement activities in accordance with the Election Law and Perbawaslu, but it has not been effective and legally certain. Because in handling election crime cases in 35 districts/cities as many as 110 cases, only 5 cases have permanent legal force, 2 cases stopped at the Police investigation, and 103 cases stopped at the discussion of the Gakkumdu Center. The causal factors are not in accordance with the theory of the legal system of law: (1) Legal substance: (a) the time to handle the case of election crimes is short (Speedy trial), (b) the legal subject of the perpetrator of the election crime is not fulfilled, (c) lack of evidence in the investigation of election crimes, and (d) difficulties in finding witnesses in the investigation of election crimes. (2) Legal structure: (a) many institutions in the Gakkumdu Center make coordination difficult, (b) different perceptions between institutions in the Gakkumdu Center make it difficult to determine election crimes, (c) the Gakkumdu Center is a non-institutional coordination forum in election crime enforcement, (d) the election crime enforcement coordinator Bawaslu only forwards reports and not as an election crime investigator. (3) Legal culture: (a) lack of understanding of election crime violations, (b) lack of public awareness of reporting election crimes to the gakkumdu center, (c) lack of public willingness to witness election crime cases, and (d) weak legal awareness of election participants to comply with the election law. The solutions to overcome the ineffectiveness of the Gakkumdu Center in election crime enforcement in the future: (a) the need for a single institution in election crime enforcement, and (b) the strengthening of Bawaslu's authority in election crime enforcement
