Abstract

Abstract This article aims to find out how the implementation of CSR in the Surabaya Orthopedic Hospital and Traumatology in realizing one of the ideals of the nation that is community welfare. At the same time knowing what are the obstacles of implementing CSR programs and solutions to overcome them. This type of legal research is an empirical legal research. The nature of the legal research used is descriptive research. The legal approach in this study is a qualitative approach which focuses on the general principles that underlie the manifestation of every phenomenon that exists in society, while also focusing on the patterns analyzed from social phenomena by using culture that comes from the community to obtain a picture from behavior. Data collection techniques are literature study, and observation As for the implementation of CSR they have program named RSOT Peduli CTEV that is a free treatment for children with bent legs. The obstacle in its implementation is there are employees who doesn’t fully understand about CSR, and and also substantial implementation funds. The solution taken is maximize the focus on existing activities, RSOT Peduli CTEV, and fundraising from the event and Open Donation.Keywords: Implementation of CSR; Surabaya Orthopedic and Traumaology Hospital; Public welfare Abstrak Artikel ini bertujuan untuk mengetahui bagaimana pelaksanaan CSR di Rumah Sakit Orthopedi dan Traumatologi Surabaya dalam mewujudkan salah satu cita-cita bangsa yaitu kesejahteraan masyarakat. Sekaligus mengetahui apasaja hambatan dari pelaksanaan program CSR serta solusi untuk mengatasinya. Jenis penelitian hukum ini merupakan penelitian hukum empiris. Sifat penelitian hukum yang digunakan yaitu penelitian deskriptif. Pendekatan hukum dalam penelitian ini yaitu pendekatan kualitatif yaitu memusatkan perhatian kepada prinsip-prinsip umum yang mendasari perwujudan setiap gejala yang ada dalam masyarakat, selain itu juga memusatkan perhatian terhadap pola-pola yang dianalisis dari gejala sosial dengan menggunakankebudayaan yang berasal dari masyarakat untuk memperoleh gambaran dari perilaku manusia. Teknik pengumpulan data yaitu studi kepustakaan, observasi, dan pengamatan terhadap objek. Kegiatan CSR yang dilaksanakan berupa RSOT Peduli CTEV yakni pengobatan gratis bagi anak dengan kaki bengkok. Kendala dalam pelaksanaanya adalah kurangnya Sumber Daya Manusia (SDM) yang memahami betul mengenai CSR dan dana pelaksanaan yang cukup besar. Solusi yang diambil yaitu dengan memaksimalkan fokus terhadap kegiatan yang ada yakni RSOT Peduli CTEV, serta melakukan penggalangan dana berupa acara dan Open Donation. Kata Kunci: Pelaksanaan CSR; Rumah Sakit Orthopedi dan Traumaologi Surabaya; Kesejahteraan Masyarakat

Abstract

Awareness of environmental damage that affects the quality of human life, such as the adverse effects of climate change, requires action and intervention by the government and society through policy and law enforcement. Normatively, this research examines the relationship of law as a representation of social control or what is called law as a tool of social engineering to community behavior. Environmental law plays a role in maintaining and controlling damage arising from human behavior and will in daily activities. The result of this study is that legal formation in increasing public awareness and concern in Indonesia towards environmental damage in mitigating and adapting to climate change is still not effective. That is evidence that the percentage of people who believe in environmental damage due to climate change in Indonesia is the lowest. This study concludes that there is a need for the most effective law enforcement to increase individual awareness of the impact of environmental damage on sustainable development.

Abstract

This study examines the differences in the legal consequences of nominee arrangement in the Basic Law of Agaria and the Supreme Court Circular Number 10 of 2020 which will be viewed from the perspective of certainty and justice. The deed of nominee arrangement cannot be separated from the notary since only a notary can formulate it in the form of an authentic deed, so the author also examines the notary's role in minimizing the making of a deed of nominee arrangement. This research is normative and evaluative and uses primary and secondary legal materials. The technique of collecting legal materials uses the library study technique, and the technique of analyzing legal materials uses the deductive syllogism method. The study results show that the Basic Law of Agaria provides more justice and legal certainty than the Supreme Court Circular, so the rules on nominee arrangement in the Supreme Court Circular shouldn’t be enforced. The role of notary in minimizing the rampant nominee arrangement cannot be separated from the support and role of the Notary Supervisory Board to guide a preventive and repressive effort to strengthen a notary's morals and integrity patterns. Furthermore, this writing hopes that the Supreme Court revokes the rules relating to nominee arrangement. Another hope is that notary can actively prioritize their moral integrity to provide legal counseling and reject the creation of deeds containing nominee arrangement.

Abstract

Introduction to the Problem: Various controversies over Indonesia's nickel downstreaming policy as a government move to add economic value to mining products are important issues that need to be studied. This problem is mainly because Indonesia is a developing country that has abundant natural resources, but has not been able to improve welfare and development for communities in mining areas, especially in the aspect of community participation. This research then highlights the perspective of the Natural Resource Curse (NRC) phenomenon for Third World Approaches to International Law (TWAIL) countries in the paradox of development stemming from the exploitation of natural resources. Purpose/Study Objectives: Community involvement in mining and other industrial activities is needed. This is related to decision making. For example, in Environmental Impact Assessment/ Analisis Mengenai Dampak Lingkungan (AMDAL) and other activities related to the lives and livelihoods of communities around mining activities. The basis of public participation is part of human rights as stated in the Constitution and International Conventions that have been ratified by Indonesia. Design/Methodology/Approach: This research uses legal normative research by examining legislation regarding nickel downstreaming as stated in Law No. 30 of 2020 on the Second Amendment to Law No. 4 of 2009 On Mineral and Coal Mining and Law No 6 of 2023 on Cipta Kerja, Findings: The findings in this study show the lack of community involvement in mining and other industrial activities in Indonesia. The existence of community participation as a human right is necessary to achieve a balance of economic growth and environmental protection as an anti-thesis to the curse of natural resources. In addition, governance and enforcement and supervision by the government in the mining sector need to be carried out effectively. Paper Type: Research Article

Abstract

Penelitian ini bertujuan untuk mengkaji secara analitis mengenai konsep dasar dari doktrin fiduciary duty dan peranannya sebagai pedoman pengurusan Perseroan Terbatas oleh Direksi. Lebih lanjut, penelitian ini merupakan penelitian hukum normatif yang menggunakan pendekatan perundang-undangan (statute approach) yang berfokus pada ketentuan UU PT dan pendekatan konseptual (conceptual approach) seputar doktrin fiducary duty dan posisinya sebagai pedoman pengurusan Perseroan Terbatas. Berdasarkan hasil penelitian, ditemukan bahwa doktrin fiduciary duty terdiri atas tiga komponen penyusun, yakni: 1. bertindak berdasarkan kehati-hatian; 2. bertindak demi kepentingan dan tujuan Perseroan; dan 3. bertindak dengan itikad baik. Peranan doktrin fiduciary duty sebagai pedoman pengurusan Perseroan Terbatas terwujud dalam pelaksanaan kewajiban hukum bagi Direksi yang berlandaskan doktrin tersebut. Dengan demikian, Direksi perlu memperkuat penerapan doktrin fiduciary duty dengan cara melakukan pengurusan Perseroan Terbatas dengan itikad baik berdasarkan ketentuan dalam UU PT serta menjaga hubungan fidusia yang baik dengan para Pemegang Saham selaku stakeholder Perseroan.

Abstract

This research discusses the responsibility of notaries in relation to the material truth of the deposit of capital by the founders in the deed of establishment of a Limited Liability Company. The purpose of this research is to analyze the extent of notary’s responsibility when there is negligence in depositing capital by the founder and the deed of establishment is declared to be null and void. This research is a normative legal research with a legislative and case approach. The results of the study show that the notary is only responsible for the formal correctness of the deed made. The court decision that annuls the deed of establishment due to the negligence of the founders is considered inaccurate, because it blurs the boundary of responsibility between the founder and the notary, and can undermines the principle of legal certainty.

Abstract

Legal advocacy and political policy influence on every decision-making related to renewable energy in the government have implications for whether or not the targets and objectives of the policy are achieved to answer the problems and needs that exist in society. In encouraging the development of New Renewable Energy (NRB), Indonesia reflects through the NRB Bill and its derivative regulations. The effectiveness of this policy is influenced by Indonesia's political direction to seek to reduce emissions. Political policies that are implemented based on the effectiveness of renewable energy governance in the form of good governance can encourage Indonesia to achieve targets and efforts in producing energy from NRB in 2030. This effort also encourages the government to achieve the national NRB target of 34% or an increase of 10.6% from the previous target. Legal advocacy efforts encourage the fulfilment of people's rights to obtain, access and benefit from the management of natural resources for renewable energy in the form of the implementation of government policies related to renewable energy.

Abstract

Kompleksitas permasalahan dalam penanganan perubahan iklim telah menuntut adanya inovasi dalam sistem penurunan emisi gas rumah kaca. Kesadaran untuk menyelesaikan permasalahan tersebut ditandai dengan Paris Agreement yang menjadi seruan bagi seluruh negara agar dapat berkontribusi dalam menjaga batas pencemaran lingkungan dan menunjukkan komitmennya untuk  memperbaiki kualitas lingkungan hidup. Implementasi Undang-Undang Nomor 4 Tahun 2023 tentang Pengembangan dan Penguatan Sektor Keuangan menjadi landasan bagi pemberlakuan bursa karbon sebagai salah satu sarana untuk mencapai Net Zero Emision di Indonesia. Permasalahan muncul ketika aktivitas ini belum sepenuhnya dapat berjalan dengan optimal karena minimnya jumlah korporasi yang terlibat langsung dalam perdagangan karbon di Bursa Efek Indonesia. Pengabdian ini dilaksanakan dengan menggunakan pendekatan preskriptif, pragmatis, persuasif dan evaluatif untuk memperkuat peran Galeri Investasi dalam mensosialisasikan bursa karbon kepada pelaku Industri yang ada di wilayah Solo Raya. Pengabdian ini dilakukan dengan memberikan sosialisasi kepada perwakilan PT. Konimex serta menganalisis potensi keuntungan dari aktivitas industri tersebut dalam bursa karbon. Hasil observasi dalam proses pengabdian menunjukkan bahwa PT. Konimex telah memiliki pedoman komitmen pencapaian PROPER Biru dalam proses produksi yang dilakukan dengan menggunakan teknologi ramah lingkungan. Kendati demikian, belum ada agenda untuk terjun dalam bursa karbon. Dari hasil sosialisasi yang dilakukan oleh IDX Carbon, telah terlihat peluang dan strategi yang perlu dipertimbangkan oleh PT. Konimex untuk dapat ikut serta dalam perdagangan karbon di Indonesia. Pendekatan dan agenda serupa perlu terus dilakukan terhadap industri-industri skala nasional yang ada di Solo Raya.

Abstract

This study aims to analyze the implementation of supervision by the Notary Supervisory Board (MPW) of Central Java Province regarding the implementation of the notary professional code of ethics, as well as the obstacles and solutions encountered. The research method used is normative legal research with a statute approach and a case approach. Legal sources include laws and regulations, notary codes of ethics, ministerial regulations, and secondary literature in the form of books, journals, and scientific articles. The results of the study indicate that normatively, the regulations regarding notary supervision are adequate as stipulated in Law No. 30 of 2004 in conjunction with Law No. 2 of 2014 concerning the Position of Notary, the Regulation of the Minister of Law and Human Rights, and the Notary Code of Ethics. However, in practice, obstacles are still found, such as budget limitations, low notary compliance with summons, weak deterrent effects of sanctions, and overlapping authority with the Notary Honorary Council. Nevertheless, the MPW continues to strive to carry out supervision through coaching, routine inspections, and recommendations for sanctions. For more effective oversight, data synchronization, improved coordination between levels of the assembly, stricter enforcement of sanctions, and strengthening of preventive functions through professional ethics education and outreach are required. Thus, the MPW is expected to maintain notary integrity while providing better legal protection for the public.

Abstract

The increasing issue of the global environmental crisis has prompted the UN to launch 17 Sustainable Development Goals (SDGs). Although Indonesia has a strong commitment to achieving the SDGs, its implementation is still lagging behind, one of the reasons being the suboptimal application of Environmental, Social, and Governance (ESG) at the company level, especially in the banking sector. This creates uncertainty, implementation obstacles for companies, and opens up loopholes for ESG-washing practices. This study aims to formulate a regulatory formulation for the ESG concept in the banking sector as a strategy to accelerate sustainable development in Indonesia. The research method used is normative legal research that is prescriptive with a statutory approach and a conceptual approach. The types and sources of legal materials use primary legal materials and secondary legal materials. The results of the study conclude that an effective regulatory formulation is needed including a revision of POJK 51/POJK.03/2017 to require integrated reporting and adoption of the double materiality concept. In addition, it is recommended to strengthen the role of Good Corporate Governance (GCG), establish standard and measurable ESG reporting standards, require independent assurance (verification) of sustainability reports, and enforce legal sanctions against ESG-washing practices.
