Abstract

The legitimacy of the Civil Law Notary system in Indonesia hinges on the integrity of state protocol, which serves as the absolute guarantor of deed authenticity. However, this idealism frequently crumbles due to judicial pragmatism that disregards procedural defects in administrative proceedings. This research aims to deconstruct the judicial reasoning anomaly in Decision Number 1859 K/Pdt/2015, in which the Supreme Court Justice annulled a notary deed without expounding on the violation of the Repertorium obligation as the basis for legal consideration. Employing a doctrinal legal research method that applies the critical examination of judicial reasoning, this study dissects the Supreme Court Justice’s logical flow and juxtaposes it with the legal fact of the novum regarding the empty Repertorium book. Through the analytical lens of Austin’s Legal Positivism Theory, this research finds that the disputed deed constitutes a “Phantom Deed” that violates the sovereign’s command. Crucial findings indicate that the Supreme Court Justice committed judicial silence as a form of disregard toward the violation of Article 58 of Law Number 30 of 2004 in their ratio decidendi. The Justice opted for a judicial shortcut to annul the deed on the basis of downstream land certificate defects, yet remained silent on upstream administrative malpractice. This study concludes that the decision represents a “right decision, wrong reasoning,” which systemically undermines the judiciary’s educational function and obscures the standard of notarial professional liability in maintaining national legal certainty.

Abstract

The development of artificial intelligence technology, particularly deepfake, has created new challenges in the protection of digital visual works as safeguarded under Law Number 28 of 2014 concerning Copyright. The misuse of deepfake technology that modifies or imitates digital visual works without the creator’s authorization has the potential to infringe upon the creator’s moral rights and economic rights, while specific regulations governing deepfake have not yet been explicitly regulated in Indonesian positive law. This research aims to analyze the form of civil liability for the misuse of deepfake technology against digital visual works based on the concept of unlawful acts. The research method employed is normative legal research using a conceptual approach. The results of the study indicate that the misuse of deepfake against digital visual works fulfills the elements of an unlawful act as stipulated in Article 1365 of the Indonesian Civil Code, namely the existence of an unlawful act, fault, damage, and a causal relationship. Although deepfake is a product of artificial intelligence technology, legal liability remains attached to humans as users and controllers of the technology. Therefore, the appropriate form of civil liability is individual liability based on the element of fault in the form of intent.

Abstract

This study analyzes the regulation of company organs’ responsibilities, particularly commissioners, under Law Number 40 of 2007 concerning Limited Liability Companies and its relevance to the doctrine of piercing the corporate veil. The case of PT WSM Ventures Indonesia is examined to assess the limits of commissioners’ authority, the nature of the unlawful acts committed, and the legal basis for imposing personal liability for corporate losses. This research is a normative juridical study employing statutory and case approaches. It relies on primary and secondary legal materials obtained through literature review and applies a prescriptive analytical method. The findings show that the Company Law grants commissioners limited liability protection insofar as they perform their supervisory and advisory functions in good faith and within the scope of their authority. However, when a commissioner exceeds such authority (ultra vires) and interferes in the company’s management, causing losses, the doctrine of piercing the corporate veil becomes applicable to impose personal liability. In Decision Number 477/Pdt.G/2018/PN.Jkt.Sel, the commissioner was found to have committed an unlawful act under Article 1365 of the Civil Code and held personally liable pursuant to Article 114 paragraph (3) of the Company Law.

Abstract

Abstrak Penelitian ini bertujuan untuk menganalisis kekuatan hukum serta keterbatasan sistem Content ID dalam perspektif Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Perkembangan teknologi digital telah mengubah pola distribusi dan pemanfaatan karya lagu secara signifikan, khususnya melalui platform berbagi video seperti YouTube. Di satu sisi, kemudahan distribusi membuka peluang ekonomi yang luas bagi pencipta; di sisi lain, kondisi tersebut meningkatkan potensi pelanggaran hak cipta secara masif dan lintas batas. Penelitian menggunakan metode hukum normatif dengan pendekatan peraturan perundang-undangan dan konseptual, melalui penelaahan bahan hukum primer dan sekunder. Hasil kajian menunjukkan bahwa Content ID berfungsi sebagai mekanisme preventif berbasis teknologi yang memperkuat perlindungan hak ekonomi pencipta melalui deteksi otomatis, opsi pemblokiran, dan monetisasi. Namun demikian, sistem ini memiliki keterbatasan, antara lain akses yang tidak merata, potensi klaim keliru, serta kedudukannya yang bersifat kebijakan internal platform dan bukan instrumen penegakan hukum formal. Oleh karena itu, diperlukan penguatan regulasi dan harmonisasi kebijakan guna menjamin kepastian serta keadilan hukum dalam perlindungan hak cipta lagu di era digital. Abstract This study aims to analyze the legal force and limitations of the Content ID system from the perspective of Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. The development of digital technology has significantly transformed the distribution and utilization patterns of musical works, particularly through video-sharing platforms such as YouTube. On the one hand, the ease of distribution creates broad economic opportunities for creators; on the other hand, it increases the risk of massive and cross-border copyright infringements. This research employs a normative legal method with statutory and conceptual approaches, based on the examination of primary and secondary legal materials. The findings indicate that Content ID functions as a technology-based preventive mechanism that strengthens the protection of creators’ economic rights through automated detection, blocking options, and monetization features. However, the system also has limitations, including unequal access, the potential for erroneous claims, and its status as an internal platform policy rather than a formal law enforcement instrument. Therefore, regulatory strengthening and policy harmonization are necessary to ensure legal certainty and justice in the protection of song copyrights in the digital era.
