Abstract

The  establishment  of  the  law  should  not  be  in  a vacuum  but rather  cultural  particularities  of the community  with their  cultural roots.  Because the law  in the service of  society,  the legal  system  must  also  trademark  the  same  cultural  roots communities it serves. Therefore,  it  becomes inevitable  that the political vision of  making  the  culture of  the community  and the interests  of  different  political,  economic,  social,  cultural (poleksosbud)  is  a  parallel  society.  Accordingly,  periodically  in line  with  the  historical  appearance  of  terms  of  customary  law, then  the  exposure  will  be  described  in  periodically.  First  is  the forms of  the  Dutch  government's policy  towards  the Islamic law and custom.  It  is important to  understand the different  kinds of consequences caused by  the policies of  the colonial  legal system. While  the  second  part  of  the  discussion  is  the  relationship between  Islamic  law  and  custom  in  the  independence  of Indonesia,  so  that  an  image  between  the  two  legal  systems  is obvious.

Abstract

Hasbi membagi dunia menjadi dua, yaitu Darul Islam dan  Darul  Harbi,  dengan  pembagian  negara  menjadi  dua sebagaimana  tersebut  di  atas  bukan  berarti  mengharuskan bahwa  Darul  Islam  itu  diperintah  satu  pemerintahan.  Darul Islam lahir atas dasar kebangsaan (Nation ?) yang dibangun atas dasar  Islam  (agama)  dan  perjanjian.  Dengan  kata  lain  dasar kebangsaan  dalam  Darul  Islam  adalah  Islam  dan  berjanji mengikuti hukumnya. Prinsip  Hubungan  Internasional  dalam  Islam  adalah Perdamaian  yang  abadi,  dan  jia  didukung  dengan  dasar kenyataan  (fakta-fakta)  yang  daruri,  maka  Hubungan Internasional  berubah  menjadi  Perang  dan  hanya  bersifat sementara,  tetapi  tidak  merubah  kebijakan  pokok,  yaitu  tetap pada dalam hubungan perdamaian.

Abstract

Blasphemy problems are issues that have emerged in the archipelago long before the republic independence, for example, in the Kraton Kasunanan Surakarta or other kingdoms. The problem up to now always appear in public spaces, and along with that then there are also efforts to resolve the various forms of regulation according to the situation and condition of the development of society, ranging from the shape of legislation to discharge Fatwa Indonesian Ulema Council (MUI). This paper attempts to examine the behavior of blasphemy from the standpoint of legal or political dimension. By using this approach is expected to gain a clearer perspective and basic. In addition, this study tried to find the complex relationships between the dimensions of understanding inherent in the system of belief (belief system) in people with political interests and realities of the developmental needs of society at that time. Perpetrators of blasphemy in the Islamic kingdom in Java kelindan linked with local political structures. Local political structure is very determinant in determining the legal person or group.

Abstract

Abstract: Indonesianization of Islamic law contains two tendencies; first, is the ideal of building Islamic law that characterizes Indonesia by freeing itself from Arab culture and making Indonesian custom as one of the sources of Islamic law. The peak is marked by the emergence of the concept of Jurisprudence of Indonesia. The second tendency is constitutional-oriented Indonesianness, which is to formulate Islamic law in the form of legislation through consensus (Ijma`) of Indonesian clerics. The author argues that such a process of Islamic law becomes a national law. Given Indonesia is a country with a population of bhinneka (Plurality). In this article the author analyzes with the theory of differentiation in unification that is paying attention to diversity (plurality), in the form of a codification of law that contains legal unification as well as legal differentiation. And in the process of enactment toward the Indonesianization of the law it is necessary to note the existence of the national guidance principles, namely: the law in Indonesia must guarantee the integration or the integrity of the nation, the law must be created democratically, the law must encourage the creation of social justice and must pay attention to the principles of humanity, principles of human rights, and the principle of equality before the law.Abstrak: Indonesianisasi hukum Islam mengandung dua kecenderungan; pertama, adalah cita-cita membangun hukum Islam yang berciri khas Indonesia dengan membebaskan diri dari budaya Arab dan menjadikan adat Indonesia sebagai salah satu sumber hukum Islam. Puncaknya ditandai dengan munculnya konsep fikih Indonesia. Kecenderungan kedua adalah keindonesiaan yang berorientasi konstitusional, yakni memformulasikan hukum Islam dalam bentuk peraturan perundang-undangan melalui konsensus (Ijma`) ulama Indonesia. Penulis berpendapat bahwa proses demikian menjadikan hukum Islam sebagai hukum nasional. Mengingat Indonesia adalah negara dengan penduduk yang plural. Dalam artikel ini penulis menganalisis dengan teori diferensiasi dalam unifikasi yaitu memperhatikan pluralitas, dalam bentuk satu kodifikasi hukum yang mengandung unifikasi hukum sekaligus diferensiasi hukum. Dalam proses pemberlakuan menuju Indonesianisasi hukum perlu diperhatikan adanya kaedah-kaedah penuntun nasional, yaitu: hukum di Indonesia harus menjamin integrasi bangsa, hukum harus diciptakan secara demokratis, hukum harus mendorong terciptanya keadilan sosial, dan harus memperhatikan prinsip kemanusiaan, prinsip hak asasi manusia, dan prinsip persamaan di depan hukum.

Abstract

Abstract: The COVID-19 pandemic has an impact on all aspects of community life. The central government stipulates rules for limiting community activities that have an impact on the community's economic decline. This condition becomes the basis for the Yogyakarta City Government in making anticipatory and adaptive policies in the management of traditional markets. The policy is oriented towards achieving two benefits at once, namely the protection of life and property. This article analyzes the policies of the Yogyakarta City Government in managing traditional markets during the pandemic and to what extent these policies can achieve social and economic protection for the community. The analysis of these problems uses the maqâşid al-sharîa approach with the interconnectivity theory of maşlaḥah. The results show that the Yogyakarta City government's policy places social protection (ḥifẓ an-nafs) and economic protection (ḥifẓ al-mâl) as the interests of the community that must be protected. The Yogyakarta City Government continues to implement the central government's instructions by limiting operating hours and the number of visitors to traditional markets, but at the same time reducing user fees and encouraging online shopping promotions. The protection of the two benefits is carried out interconnectively, so that the achievement of one benefit does not cause damage to the fulfillment of the other's needs. The Yogyakarta City Government places these two protections as primary needs that must be protected so as not to cause social and economic damage.Abstrak: Pandemi covid-19 berdampak pada semua aspek kehidupan masyarakat. Pemerintah pusat menetapkan aturan pembatasan kegiatan masyarakat yang berdampak pada menurunnya ekonomi masyarakat. Kondisi ini menjadi dasar bagi Pemerintah Kota Yogyakarta dalam membuat kebijakan yang antisipatif dan adaptif dalam pengelolaan pasar tradisional. Kebijakan tersebut berorientasi pada pencapaian dua kemaslahatan sekaligus, yaitu perlindungan jiwa dan harta. Artikel ini menganalisis bagaimana kebijakan Pemerintah Kota Yogyakarta dalam pengelolaan pasar tradisional pada masa pandemi dan sejauh mana kebijakan tersebut dapat mewujudkan perlindungan sosial dan ekonomi masyarakat. Analisis terhadap masalah tersebut menggunakan pendekatan maqâşid al-sharî’a dengan teori interkoneksitas maşlaḥah. Hasil penelitian menunjukkan bahwa kebijakan Pemerintah Kota Yogyakarta mendudukkan perlindungan sosial (ḥifẓ an-nafs) dan perlindungan ekonomi (ḥifẓ al-mâl) sebagai kepentingan masyarakat yang harus dilindungi. Pemerintah Kota Yogyakarta tetap menerapkan instruksi pemerintah pusat dengan membatasi jam operasional dan jumlah pengunjung pasar tradisional, namun pada saat yang sama memberikan pengurangan retribusi dan menggiatkan promosi belanja online. Perlindungan kedua kemaslahatan tersebut dilaksanakan secara interkonektif, sehingga pencapaian kemaslahatan yang satu tidak berdampak kerusakan pada pemenuhan kemaslahatan yang lain. Pemerintah Kota Yogyakarta menempatkan kedua perlindungan tersebut sebagai kebutuhan primer yang harus dilindungi sehingga tidak menimbulkan kerusakan sosial dan ekonomi.

Abstract

Abstrak: Partisipasi masyarakat sipil Islam dalam konteks demokratisasi di negara Muslim masih dipersoalkan, tidak terkecuali di Indonesia. Namun demikian, artikel ini memberikan bukti bahwa saprah amal sebagai bagian dari praktik filantropi Islam yang unik telah menjadi bagian dari upaya memperkuat demokratisasi di negara Muslim. Teori partisipasi dari Sherry R. Arnstein dipakai untuk menganalisis persoalan ini. Artikel ini menjawab pertanyaan tentang saprah amal sebagai proxy atas praktik kedermawanan, cara negosiasi berderma, dan bentuk partisipasinya dalam memperkuat demokrasi di Indonesia. Temuan artikel ini, pertama, saprah amal merupakan tradisi unik dalam masyarakat Islam Banjar dan ia menjadi proxy atas praktik kedermawanan yang bersifat indigenous. Lelang amal melalui influencer dalam tradisi saprah amal juga menjadi cara negosiasi yang unik dalam berderma. Kedua, spirit kebersamaan dalam saprah amal menjadi modal sosial yang baik untuk mengisi ruang kosong pembangunan yang tidak bisa dilakukan secara cepat oleh negara. Ketiga, praktik dan tradisi saprah amal ini merupakan bentuk ekspresi dan partisipasi masyarakat Islam Banjar untuk ikut serta dalam pembangunan bangsa yang keberadaannya diakui dan dijamin oleh konstitusi negara Indonesia. Abstract: Islamic civil society participation in democratization among Muslim countries is still being questioned, including in Indonesia. Nevertheless, this article provides evidence concerning the notion that saprah amal, as part of Islamic philanthropy practice, has strengthened democratization in Muslim countries based on Sherry R. Arnstein’s theory of participation. To answer questions about the role of saprah amal as a reasonable proxy for the practice of generosity, how to negotiate charity, and its participation in empowering democracy in Indonesia. These several research findings, firstly, saprah amal is a unique tradition from Banjar Islamic community and becomes a proxy for indigenous generosity practices. Charity auctions through influencers in the saprah amal tradition are also a unique way of negotiating in giving. Second, the spirit of togetherness in charity is an excellent social capital to overcome the limit of state developmentalism. Lastly, the practice and tradition of saprah amal is a form of expression and participation of the Banjar Islamic society to participate in nation-building, recognized and guaranteed by the Indonesian constitution.

Abstract

The state guarantees freedom of religious expression for all its citizens, regardless of their beliefs. However, during the New Order era, this freedom was paradoxically curtailed, particularly for individuals of Chinese descent. Chinese Indonesians were prohibited from openly expressing their Chinese identity, including through religious affiliation. They were compelled to reidentify their religion under one of the five officially recognized religions at the time. When it comes to marriage registration, many individuals converted to one of these state-recognized religions. This article sheds light on the extent to which faith and love are intertwined in the phenomenon of religious conversion to Islam in Belitung. Employing a snowball sampling method, we conducted semi-structured interviews with 15 ethnic Chinese individuals from Belitung, aged between 30 and 63 years. These informants were Chinese Indonesians who converted to Islam following the legalization of Confucianism. The results reveal that marriage functioned as a pivotal factor in the religious conversion process among ethnic Chinese in Belitung, serving not as the initial impetus but rather as the culmination of an extended period of religious exploration. Male participants frequently reported earlier exposure to Islamic education and social environments, indicative of a phase characterized by exploration and engagement prior to formalizing their religious commitment through marriage. Conversely, female participants appeared to be more profoundly influenced by cultural norms emphasizing spousal loyalty and the legal-religious frameworks governing marriage in Indonesia. Negara menjamin ekspresi keagamaan setiap warga negara, apapun keyakinannya. Paradoksnya, kebebasan beragama di Era Orde Baru dibatasi, khususnya kepada keturunan Tionghoa. Orang Tionghoa tidak diperbolehkan untuk mengekspresikan ketionghoaan mereka dalam bentuk apapun, termasuk agama. Mereka harus mengidentifikasi kembali agama mereka menjadi salah satu dari lima agama resmi pada saat itu. Untuk memudahkan proses administrasi, salah satunya perkawinan, mereka mengonversi agama menjadi salah satu agama yang diakui negara. Artikel ini menyoroti sejauh mana keyakinan dan cinta saling berkaitan dalam pengalaman konversi agama ke Islam para etnis Tionghoa di Belitung. Dengan menggunakan teknik sampeling bola salju, kami melakukan wawancara individu semi terstruktur dengan 15 etnis Tionghoa Belitung yang berusia 30 hingga 63 tahun. Narasumber adalah orang Tionghoa yang memilih untuk melakukan konversi agama ke Islam, setelah disahkannya Konfusianisme. Temuan menunjukkan bahwa pernikahan memainkan peran yang menentukan dalam konversi agama etnis Tionghoa di Belitung, bukan sebagai penyebab utama tetapi sebagai puncak komitmen dalam proses eksplorasi agama yang lebih panjang. Peserta laki-laki sering mengalami paparan lebih awal terhadap pendidikan Islam dan lingkungan sosial, mencerminkan tahap pencarian dan pertemuan sebelum mengukuhkan komitmen mereka melalui pernikahan. Sebaliknya, peserta perempuan lebih kuat dipengaruhi oleh ekspektasi budaya akan kesetiaan kepada suami dan kerangka hukum-agama pernikahan di Indonesia.

Abstract

The purpose of this study is to describe the policies taken by the government in the financial management of Hajj in Indonesia through the siyasah syar'iyah paradigm. The questions that arise in this study are regarding the role of the state in the management of Hajj finances and how the policies of Hajj financial management in Indonesia are in the perspective of siyasah syar'iyah. This research is a library research, with a normative legal research method that uses the siyasah syar'iyah approach. After conducting in-depth research, it was concluded that the government in this case through the BPKH seeks to carry out its role in the field of the 'ala al-hajj and Maliyah areas by building the management and investment of hajj funds that are in line with the siyasah syar'iyah, so that the policies that have been implemented by the government in managing the hajj funds include: the initial deposits, the efforts to maintain the value of BPIH, as well as the placements in Islamic banks. It is an effort to achieve Maqasid Syariah, namely the values of benefit that are specifically for the Hajj pilgrims and the community in general which are the government's goal in this policy.

Abstract

This research originates from a shift in Muhammadiyah’s stance toward ecological, legal, and political policies in Indonesia. While Muhammadiyah was previously known as a movement critical of natural resource exploitation and unjust environmental policies, in the case of the government’s issuance of the Special Mining Business License (Izin Usaha Pertambangan Khusus or IUPK), it has instead adopted an accepting attitude. This study aims to critically analyze the reasons and normative justifications behind Muhammadiyah’s acceptance of the IUPK through the perspective of Siyāsah Syar‘iyyah, and to examine the transformation of its political-legal position within the ecological context. Employing a normative legal approach, this research collects data through document analysis and in-depth interviews with relevant stakeholders. The findings reveal that, from a ratio legis perspective, Muhammadiyah’s acceptance of the IUPK is driven by the spirit of empowering the people’s economy and the aspiration to serve as a model for equitable and sustainable mining governance. This position is further reinforced by the Majelis Tarjih and Tajdid’s fatwa on mining and energy transition, which does not categorically prohibit mining activities in light of the nation’s dependency on the sector. Within the framework of Siyāsah Syar‘iyyah, this stance may be classified as siyāsah shar‘iyyah ijtihādiyyah—a form of public policy derived from ijtihād to realize the common good (maṣlaḥah ‘ āmmah) as long as it does not contradict the fundamental principles of Sharia
