Abstract

Agreements are one of the domains regulated through private legal instruments. However, agreements are not always governed by private legal instruments. Sometimes, public legal instruments also regulate an agreement, especially when it involves government entities. This study aims to examine the extent to which an addendum to a Public Private Partnership Agreement in Infrastructure Provision can be carried out, considering one of the specifications of the procurement mechanism for implementing business entities in the Public Private Partnership scheme, which includes attaching a draft agreement in the Request for Proposal (RfP) document. After a winning Business Entity is selected, the draft agreement is finalized, with the rule that the substance that has been completed cannot be changed. This research focuses on determining the limitations in making an addendum to the Public Private Partnership Agreement in Infrastructure Provision during the draft agreement's finalization and implementation phase. The research method used in this study is empirical legal research, which utilizes primary and secondary data. KPBU agreements are controlled by private legal instruments and regulated through public legal instruments. Even though some provisions do not allow changing the substance being competed for, these provisions are not norms that can be categorized as lex imperfect because if these provisions deviate, they will automatically injure the principles of procurement. Therefore the procurement is not following the principles regulated in the laws – invitation and may result in a failed auction condition.

Abstract

Investment-based insurance (unitlink) is a hybrid product from insurance companies that is very vulnerable to causing disputes. Innovations in the development of unit-linked investment-based insurance products continue to cause constant polemics, many policyholders are disadvantaged. What efforts can be made in order to prevent the occurrence of such disputes. This research was carried out using a normative juridical method using a statutory and conceptual approach. Prevention of unitlink insurance disputes is to apply the principle of perfect honesty (Utmost good faith) for both policyholders and insurance agents. and improve the supervisory function of the Financial Services Authority (OJK) in accordance with existing regulations. Integrated supervision for all financial institutions in accordance with unitlink insurance which is a hybrid product of insurance and investment. Coordination between insurance company associations and OJK needs to be improved, so that supervision of insurance companies, in this case insurance agents can be carried out optimally, so as to prevent unit-linked insurance disputes.

Abstract

Kehadiran Perseroan Terbatas sebagai suatu bentuk badan usaha dalam kehidupan sehari-hari tidak lagi dapat diabaikan. Pelaku usaha dalam menjalankan praktik bisnisnya sangat lazim dengan kehadiran Perseroan Terbatas sebagai bentuk badan usaha yang digunakan dalam skala usaha mikro, kecil, menengah, hingga skala besar. Sehingga PT merupakan bentuk badan usaha yang paling sering digunakan saat ini dengan ciri khas berupa pembatasan tanggung jawab di dalamnya.konsep Perseroan Terbatas yang mulanya didirikan dengan prinsip persekutuan modal dan berdasarkan perjanjian, dengan adanya Perseroan Perorangan konsep persekutuan modal dan berdasarkan perjanjian tidak lagi menjadi syarat mutlak pendirian PT karena Perseroan Perorangan hanya dapat didirikan oleh 1 (satu) orang pemegang saham. Sehingga, bentuk badan usaha berupa perseroan perorangan ini merupakan suatu konsep yang baru diterapkan di Indonesia yang tentunya menganut prinsip pemisahan tanggungjawab (separate entity) sebagai ciri khas PT antara perseroan dengan pemegang saham (yang tunggal tersebut). Berbeda dengan Usaha Dagang (selanjutnya disebut UD) yang merupakan salah satu bentuk badan usaha yang didirikan dan dijalankan oleh satu orang saja. berdasarkan pendekatan yuridis maka dapat disimpulkan bahwa stautus badan hukum perseroan perseorangan adalah sah berbadan hukum, karena men\mang sudah diatur keberadaannya dalam UU Cipta kerja yang mana diatur menyatu dengan pengertian perseroan Terbatas itu sendiri. Berdasarkan teori Insitusional dan perkembangan ilmu hukum moderna maka secara teori konsep perseroan perseorangan sesuai dengan teori innstitusional, dalam hal ini pengertioan perseroan menggunakan pendekatan teori perjanjian dan institusional.Pemerintah perlu mensosialisasikan keberadaan konsep perseroan perseorangan ini dalam rangka peningkatan pertumbuhan ekonomi bangsa melalui usaha mikro dan kecil. Namun perlu dilakukan pengaturan khusus terkait perseroan perseorangan.

Abstract

Aviation related issues include low supervision of airlines in Indonesia, the condition of aircraft that are old and less feasible and high rates of flight accidents. Management negligence and mistakes reach a level that endangers state security. An airline is an organization that provides flight services including cargo to passengers. They provide these services and form cooperation or alliances with other airlines for mutual benefit. However, the relationship between customers and airlines can sometimes lead to ruthless legal battles and violent conflicts. This paper discusses legal protection for airline customers in Indonesia. It seeks to investigate not only the legal arrangments regarding air transportation in Indonesia but mechanism to minimize/prevent disputes between consumers and airlines. Consumer dispute resolution with airlines refers to the Consumer Protection Act and Aviation Law. The research reveals that consumer-airlines conflicts can be resolved outside of the court through several dispute resolution models, including Consumer Dispute Settlement Agency, Non-Governmental Consumer Protection Agency, the Directorate of Consumer Protection agreed by the parties, based on Article 1338 of the Civil Code. This paper also show that it is necessary to make a simple dispute resolution system specifically for airline consumers in the form of an airline consumer dispute resolution assembly or a special arbitration agency.

Abstract

The operational implementation of BUMNag Gastra experienced various problems which made it difficult to develop properly. These problems include, among others, the Human Resources Manager is still low, resulting in one of the accountability BUMNag not being carried out properly. Therefore the author examines the following problem formulation: 1) How is the Operational Implementation of BUMNag Gastra Nagari Gadut 2) What is the accountability of the Operational Executive of BUMNag Gastra Nagari Gadut. The research method that the author uses is Juridical Empirical, namely research that focuses on how the implementation of BUMNag Gastra Nagari Gadut operations in the field. The results of the research are presented in the form of descriptive analysis relying on primary data in the form of field data (interviews) supplemented by secondary data. As for the results of the author's research, it can be concluded, firstly, the operational implementation of BUMNag Gastra Nagari Gadut is still simple and not fully in accordance with management functions. The two accountability reports have not been properly presented, so they are not in accordance with legal objectives, namely certainty and justice. In the future, efforts are expected to promote BUMNag, namely 1) increasing human resources 2) increasing capital 3) instilling a sense of ownership of BUMNag which is still low. 4) improvement of facilities and infrastructure

Abstract

Through Supreme Court Decision Number 3 P/HUM/2022, the request for judicial review of Article 2 paragraph (3) letter of Minister of Law and Human Rights Regulation Number 19 of 2019 was granted, which implied canceling one of the conditions for appointing a Notary, namely a photocopy of the Quality Improvement Training certificate Notary Position. The research method used is normative juridical, with a case approach. The results of the author's findings are that the Supreme Court thinks that legal norms which have been tested and declared to conflict with higher laws and regulations and declared to have no binding legal force, may not be re-published in a regulation. After the Supreme Court Decision Number 3 P/HUM/2022, the process of appointing Notaries in 2022 still uses reference to Article 2 of the Regulation of the Minister of Law and Human Rights Number 19 of 2019 as a whole, including Training to Improve the Quality of Notary Positions as a condition for appointing Notaries. So, prospective Notaries who have completed all the requirements other than Training to Improve the Quality of Notary Positions, cannot apply for appointment.

Abstract

Insurance is a financial service product that offers risk protection against losses. Risks can vary, such as the risk of death, risk of disability, and risk of asset damage. Insurance that is currently in great demand is unit-link life insurance, which not only provides protection for life but also investment. In Unitlink Insurance, part of the money deposited in premiums will be used for the customer's investment needs. However, in practice, unitlink life insurance products cause many problems, namely failure to pay unitlink life insurance companies in disbursing claims to policyholders, therefore policyholders need legal protection to obtain their rights, clear and firm legal regulations are needed that regulate legal protection the policy holder. The aim of this research is to determine the regulation of unitlink life insurance and to determine the form of legal protection for unitlink life insurance policy holders. The type of research used is normative juridical. The results of this research show that unitlink life insurance regulations are contained in several provisions, namely Law No. 40 of 2014 and POJK provisions. Legal protection for policy holders is regulated in article 53 of Law No. 40 of 2014 concerning Insurance Business which states that legal protection for policy holders is carried out by means of the insurance company being obliged to register insurance with the policy guarantee institution. The form of legal protection for policy holders is also regulated in Law No. 8 of 1999 concerning Consumer Protection regarding the Rights and Obligations of Business Actors, in this case Insurance Companies.

Abstract

Every transfer of property during a marriage as long as the marriage is not agreed upon, every act of transfer and collateral must obtain the approval of each married partner so that if there is a transfer of joint property during the marriage, the action will be null and void. The formulation of the problem in this research is: What is the basis of the judge's considerations in the case of Court Decision Number 43/Pdt.G/2020/PN Medan relating to the cancellation of wills and the impact of inheritance rights on the loss of Legitiieme Portie? And what are the legal consequences of canceling a will for the parties in the case of Court Decision Number 43/Pdt.G/2020/PN Medan relating to the cancellation of a will and the impact of inheritance rights on the loss of Legitieme Portie? The method in this research is nomative juridical. A notary making an authentic deed is legal principles contained in the Civil Code in connection with making a will deed where a notary cannot make a will deed that bequeaths or bequeaths mixed assets in a marriage that owns the property. is joint ownership, because the action taken will harm the married couple so that it can be betrayed as an unlawful act as in the case in Decision Number 43/PDT.G/2020/PN. Medan. The resolution of the case stems from the return of the wife's rights to some of the assets in the mixture of her marital assets, namely half, while the other half is the inheritance deed of the deceased which should still be inherited by the deceased's heirs

Abstract

Financing is a primary service offered by Islamic banks, including the Utsman Financing Program at Jam Gadang Islamic Rural Bank (BPRS). This program employs the murabahah contract and does not require collateral. The implementation procedures for the Murabahah Contract have been regulated in the DSN MUI Fatwa No: 04/DSN-MUI/IV/2000. This study aims to evaluate the application of the Murabahah Contract in Utsman Financing and assess the implications of the Fatwa. An empirical juridical methodology was used. The findings reveal that in practice, the wakalah and murabahah contracts are often executed simultaneously, which violates the transaction requirements as the traded object is not fully owned by the contracting parties. Additionally, setting prices and profits for goods not fully owned by the bank and customers also contradicts Sharia principles, thus rendering the transactions invalid.
