Abstract

Usaha Mikro Kecil Menengah merupakan salah satu penopang perekonomian, karena sebahagian besar penduduk Indonesia mata pencaharian berasal dari usaha mikro kecil menengah, sehingga perlu diberikan perlindungan hukum terhadap pelaku usaha pada segmen ini dengan cara membentuk Perundang-undangan yang memiliki kepastian hukum. Hadirnya Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen atau dikenal dengan UUPK, fungsinya adalah mengatur hak dan kewajiban baik bagi konsumen, juga bagi pelaku usaha. Namun secara umum UUPK lebih berfokus untuk memberikan perlindungan kepada pihak konsumen. Hal tersebut disebabkan posisi yang tidak seimbang antara pelaku usaha dengan konsumen, dimana konsumen sebagai pihak yang sering dirugikan. Mengingat lemahnya kedudukan konsumen pada umumnya dibandingkan dengan kedudukan pelaku usaha yang lebih kuat dalam banyak hal. Diketahui selama ini pihak konsumen selaku pihak yang memerlukan barang dan/atau jasa yang ditawarkan oleh pelaku usaha diharuskan mengikuti aturan yang telah ditetapkan secara sepihak oleh pelaku usaha. Namun seiring perkembangan bisnis dan meningkatnya kebutuhan ekonomi, maka banyak pelaku usaha yang bersaing dalam memberikan pelayanan yang terbaik guna memenuhi kebutuhan konsumen atas barang dan jasa. Faktanya saat ini, transaksi jual beli secara online merupakan pilihan yang sukses membuat konsumen merasa lebih efisien waktu. Dalam bertransaksi secara online, kerugian tidak hanya dapat dialami oleh konsumen. Saat ini juga sering terjadi kerugian yang dialami oleh pelaku usaha yang disebabkan oleh ketiadaan itikad baik oleh konsumennya. Kerugian yang dialami oleh pelaku usaha mikro kecil dan menengah dibidang kuliner, dalam penjualan makanan dan minuman menyediakan pelayanan pemesanan secara online dan dapat diantar ke alamat dengan sistem pembayaran cash on delivery. Kondisi ini memberi peluang tidak terpenuhinya prestasi yang seharusnya dilakukan oleh pihak konsumen. Walaupun dari kedua belah pihak sama-sama belum menuaikan prestasinya namun dari pihak pelaku usaha telah memproses pembuatan makanan dan minuman tersebut, sehingga ada modal yang terpakai oleh pelaku usaha, demikian juga dalam pengantaran, adanya biaya yang harus dikeluarkan oleh pelaku usaha, namun terjadinya alamat palsu dan pembatalan pesanan secara sepihak oleh konsumen, secara tidak langsung telah merugikan pelaku usaha. Sehingga ke depan dibutuhkan adanya pengaturan hukum yang seimbang, antara konsumen dan pelaku usaha, terutama terhadap pelaku usaha kecil.

Abstract

In the construction work tender mechanism with state budget funding sources, there are no provisions or clauses relating to the use of reserve funds (provisional sum). The use and provisional sum clause can be found in the procurement of goods/services with international contract standards, for example, FIDIC contract standards and the procurement of integrated design and build work. The addition of provisional sum requirements is a discretion by Middle High Leadership Officials, in the form of adding clauses to the Special Conditions of Contract, which does not become an assessment point or point that can invalidate the Provider Selection process. If the provisional sum is not interpreted as calculating unexpected costs or other costs, then it does not conflict with the provisions for preparing own estimated price in statutory regulations and meets the Discretionary requirements as regulated in the Government Administration Law.

Abstract

Bentuk perlindungan hukum bagi pihak ketiga atas hak kepemilikan sebagian objek lelang berdasarkan Putusan Pengadilan Nomor 11/Pdt.G/2020/PN.Dmk yaitu untuk mengganti akan kerugian yang timbul karena sebagian objek dari risalah lelang yang telah dikeluarkan oleh KPKNL objeknya dikembalikan kepada pihak ketiga,dalam Putusan Pengadilan Nomor 11/Pdt.G/2020/PN.Dmk Majelis Hakim telah mengembalikan objek lelang kepada Penggugat, namun setelah dikeluarkan Putusan Pengedilan tersebut pemenang lelang menjadi pihak yang dirugikan dikarenakan tidak dijelaskan didalam Putusan Pengadilan Nomor 11/Pdt.G/2020/PN.Dmk yang akan mengganti akan kerugian yang timbul karena risalah lelang yang objeknya dikembalikan kepada Pihak Ketiga. Majelis hakim pada Putusan Pengadilan Nomor 11/Pdt/2020/PN.Dmk telah memberikan putusan yang tepat atas perbuatan melawan hukum yang telah dilakukan oleh Mustofa dan bank, yang mana Sertifikat Hak Milik Nomor 11 tersebut atas nama Sumiyati bukan Mustofa, dalam keterangan penggugat Sertifikat tersebut dipinjam oleh Mustofa dengan alasan pencocokan tanah pensil yang mana ia selaku lurah ingin mencocokan data milik penduduk , namun setelah sekian lama Sertifikat trsebut hingga putusan ini dilaksanakan tetap tidak dikembalikan kepada Sumiyati, yang mana dalam pembuatan APHT untuk perjanjian hak tanggungan  atas jaminan kredit Mustofa dan Bank kala itu Mustofa pernah mendatangi rumah Sumiyati yang mana kala itu suami Sumiyati sedang sakit dan mereka tidak bisa baca tulis Mustofa dalam perbuatan melawan hukumnya memalsukan APHT tersebut dengan dalil dalam kertas yang diberikan oleh Mustofa adalah untuk mendapatkan pakan ternak sehingga Sumiyati dan suaminya yang tidak bisa baca tullis diminta mustofa untuk memberikan jap jempol mereka pada lembaran kertas tersebut, setelahnya Sumiyati menanyakan perihal Sertifikat yang dipinjamkan kepada Mustofa tersebut namun Mustofa beralasan bahwa Sertifikat tersebut masi sedang dilakukan pencocokan, bahwa dalam hal ini merupakan benar perbuatan melawan hukum telah dilakukan oleh Mustofa.

Abstract

A peace deed is a legal instrument that has binding force and permanent legal force, equivalent to a court decision that cannot be appealed or appealed. In the practice of resolving civil disputes, peace deeds play an important role in providing fast, simple, and low-cost solutions, especially in the context of simple lawsuits. This study aims to examine two main aspects, namely (1) how the implementation of the peace deed as a method of resolving civil disputes through a simple lawsuit at the Padang District Court, and (2) the legal consequences that arise if one of the parties commits a default on the content of the peace deed. Using an empirical juridical research method, this study processed primary and secondary data through literature studies and interviews with related parties. The results of the study show that the simple lawsuit mechanism provides efficiency in resolving civil disputes, both in terms of time and cost. In addition, if one party commits a breach of the peace deed, the other party can immediately submit an application for execution to the court without the need to file a new lawsuit. These findings confirm that peace deeds have a strategic function in accelerating the resolution of civil disputes and strengthening legal certainty for the parties to the dispute

Abstract

The people of Nagari Sasak and Nagari Kapa, Sasak Ranah Pasisie District, West Pasaman Regency live from agriculture and trade. Communities trade their agricultural and plantation products from one area to another. However, the community also then processes agricultural and plantation products in the form of processed food. Furthermore, these processed foods are made in various types of food, such as processed food, which is their central mainstay and in the form of ripik and rending meat, and so on. The problem is that many people do not understand the need to register trademark rights and services for these products. The purpose of this service is to provide understanding to the public about the importance of registering registration rights and trade services so that the community is legally protected. The activity method is carried out through lectures, discussions, and training based on Law No. Law No. 20 of 2016 concerning Brands and Geographical Indications. The results of this activity then have added insight and understanding to the people of Nagari Sasak and Nagari Kapa, Sasak Ranah Pasisie District, West Pasaman Regency regarding the procedures and processes for registering trademark rights and services for the food products they make and helping to help improve the economy of the Nagari Sasak and Nagari communities Kapa.

Abstract

Pemanggilan dan pemeriksaan Notaris dalam proses penyidikan sering kali menghadapi kendala administratif, terutama ketika Majelis Kehormatan Notaris tidak memberikan surat balasan atas permohonan persetujuan penyidik. Penelitian ini bertujuan untuk menganalisis legalitas tindakan penyidik dan upaya yang dapat dilakukan dalam situasi tersebut, berdasarkan Pasal 66 UU Jabatan Notaris dan Peraturan Menteri Hukum dan HAM Nomor 17 Tahun 2021 tentang Tugas dan Fungsi, Syarat dan Tata Cara Pengangkatan dan Pemberhentian, Struktur Organisasi, Tata Kerja, dan Anggaran Majelis Kehormatan Notaris.  Metode penelitian yang digunakan adalah yuridis normatif penelitian pendekatan yang dilakukan dengan meneliti   bahan pustaka atau sekunder untuk mengkaji aspek-aspek internal hukum positif. Pertama hasil penelitian ini menunjukkan bahwa ketidakterbitan surat balasan dari MKN menyebabkan hambatan serius dalam proses penyidikan dan menimbulkan ketidakpastian hukum. Kondisi ini menghambat penyidik dalam melaksanakan kewenangannya dan berdampak pada proses penegakan hukum yang efektif. Hasil penelitian kedua upaya yang dilakukan penyidik Jika Majelis Kehormatan Notaris tetap menolak memberikan persetujuan untuk pemanggilan atau pemeriksaan Notaris maka penyidik penuntut umum, atau hakim dapat mengajukan permohonan izin kepada Ketua Pengadilan Negeri.

Abstract

Sharia Banking is based on these sharia principles, all operational activities must not conflict with sharia principles, including financing. The Financing has an important role in the development of Islamic banking. This is to anticipate various risks in bank financing to apply the obligation to provide collateral by customers. The binding of collateral must be clearly regulated and based on sharia principles to achieve sharia compliance. The purpose of this research is to find out and analyze the arrangement of binding collateral in Islamic banking financing, as well as the fulfillment of sharia principles in binding collateral in Islamic banking financing. This is a normative research whose subject matter is the rule of law, legal doctrine to answer certain legal issues. This study concludes that kafalah and rahn are guarantees in the concept of Islamic law, regulated by the DSN-MUI Fatwa Number: 11/DSNMUI/IV/2000 concerning Kafalah. Fatwa Number: 25/DSN/MUI/III/2022 concerning Rahn, Fatwa Number: 92/ DSNMUI/IV/2014 concerning Funding accompanied by Rahn (Al-Tamwil Al-Mautsuq Bi Al-Rahn). However, it has not been set forth in laws and OJK regulations, so that the collateral binding arrangements for Islamic banking use conventional banking guarantee institutions, namely. Pledges, mortgages, fiduciaries, mortgages and warehouse receipts. Not all substances in conventional guarantee institutions can be applied to Islamic banking which prioritizes Islamic principles, namely the values of justice, expediency, balance and universality  and does not carry out business activities that contain elements of usury, maisir, gharar, unlawful and unjust, and most importantly overrides the tabbaru principle in Islam. Perbankan Syariah berdasarkan kepada prinsip syariah, seluruh kegiatan operasionalnya tidak boleh bertentangan dengan prinsip syariah termasuk pembiayaan. Pembiayaan mempunyai peranan yang penting dalam perkembangan Perbankan Syariah. Untuk mengantisipasi berbagai resiko dalam pembiayaan, bank menerapkan kewajiban memberikan agunan oleh nasabah. Pengikatan agunan tentunya harus diatur secara jelas dan berdasarkan prinsip syariah untuk mewujudkan syariah compliance. Tujuan penelitian untuk mengetahui dan menganalisis  pengaturan pengikatan agunan pada pembiayaan Perbankan Syariah, serta pemenuhan prinsip-prinsip syariah dalam pengikatan agunan pada pembiayaan Perbankan Syariah. Penelitian ini merupakan penelitian normatif yang pokok kajiannya adalah aturan hukum, doktrin hukum untuk menjawab isu hukum tertentu. Penelitian ini menyimpulkan kafalah dan rahn merupakan jaminan dalam konsep hukum Islam,  yang diatur pada Fatwa DSN-MUI Nomor : 11/DSNMUI/IV/2000 tentang Kafalah. Fatwa DSN-MUI Nomor : 25/DSN/MUI/III/2022 tentang Rahn, Fatwa DSN-MUI Nomor : 68/DSN-MUI/III/2008 tentang Rahn Tasjily diperbolehkan adanya jaminan barang., Fatwa DSN-MUI Nomor : 92/DSNMUI/IV/2014 tentang Pembiayaan yang disertai Rahn (Al-Tamwil Al-Mautsuq Bi Al-Rahn). Namun belum dituangkan dalam peraturan perundang-undangan ataupun peraturan Otoritas Jasa Keuangan, sehingga pengaturan pengikatan agunan pada Perbankan Syariah menggunakan lembaga jaminan perbankan konvensional yaitu ; gadai, hipotik, fidusia, hak tanggungan, dan resi gudang. Tidak semua subtansi pada lembaga jaminan konvensional dapat diberlakukan pada Perbankan Syariah yang mengutamakan pinsip-prinsip keislaman yaitu; nilai-nilai keadilan, kemanfaatan, keseimbangan, dan keuniversalan (rahmatan lil ‘alamin) serta tidak melakukan kegiatan usaha yang mengandung unsur riba, maisir, gharar, haram dan zalim, serta yang paling utama mengesampingkan prinsip tabbaru dalam islam.

Abstract

A limited liability company is a legal entity that is a partnership of capital established based on an agreement, conducts business activities with a basic capital entirely divided into shares, and meets the requirements set forth in this regulations. The existence of the board of directors in the company is mandatory as their presence is crucial for managing the company in accordance with the provisions of the company law. Based on this, the author formulates the issues as follows: first, how the directors' responsibilities relate to the deposit of funds in the company by shareholders, and second, how the judges' considerations in decision number 892/Pdt/2021/Pt.Sby and decision number 39/Pdt.G/2020/Pn Btm regarding the deposit of shareholders' funds in the company. The research method used is normative juridical, which means that the board of directors is obligated to carry out their duties in good faith and with full responsibility. The theories used are first the theory of responsibility, second the ultra vires theory, and third the judge's discretion theory. The results of this research indicate that in the execution of the board of directors' duties, it should be carried out with a review of the theory of responsibility and the ultra vires theory. Conclusion on the personal responsibility of the board of directors for company losses caused by negligence in performing their duties, it is advisable for the parties to ensure the implementation of good corporate governance by strengthening the internal supervision. Abstract

Notaries as public officials who are authorized to make authentic deeds are regulated in the Notary Law Number 30 of 2004 as amended by Law Number 2 of 2014 concerning the Notary Law (UUJN). Authentic deeds function as valid evidence in civil law according to Article 1870 of the Civil Code (KUHPerdata). However, in exercising their authority, notaries are required to ensure the material validity of the deeds made, especially regarding the object of joint property rights as regulated in Articles 35 and 36 of Law Number 1 of 1974 concerning Marriage and Article 119 of the Civil Code. The formulation of the problem in this study is How is the judge's legal consideration of court decision number 191 / Pdt.G / 2019 / PN.Sda related to the making of a deed of joint ownership statement on a plot of land, how is the notary's responsibility for making a deed of joint ownership statement on a plot of land in court decision number 191 / Pdt.G / 2019 / PN.Sda, The purpose of writing this thesis is To find out and analyze the judge's legal considerations regarding court decision number 191 / Pdt.G / 2019 / PN.Sda related to making a deed of joint ownership statement on a plot of land, To find out and analyze the notary's responsibility for making a deed of joint ownership statement on a plot of land in court decision number 191 / Pdt.G / 2019 / PN.Sda, the method used in this study is normative juridical. The study shows that the judge in this decision considered the deed of joint ownership statement to be null and void because it was made without the consent of both husband and wife which is a basic requirement as regulated in Article 36 of the Marriage Law. The judge stated that the defendants' actions were unlawful acts that were detrimental to the plaintiff, so that the deed did not have binding legal force. In terms of accountability, the notary was declared negligent in ensuring the involvement of all parties interested in the joint property. As a result, the deed made was declared null and void by law, and the notary was responsible civilly, administratively, and the notary's code of ethics in accordance with the provisions of the Notary Law.

Abstract

Claiming an insurance policy is a complex issue. Sometimes, insurance companies refuse to pay claims for various reasons and cannot pay policyholders' insurance claims. Therefore, the presence of a policy guarantee institution is essential. Article 53, paragraph (4) of the Insurance Law stipulates that the Law regarding policy guarantee programs shall be formed 3 (three) years after the legalization of the Insurance Law. However, as mandated by Article 53, the policy guarantee institution has yet to be approved. Law Number 4 of 2023 concerning Development and Strengthening of the Financial Sector Development and Strengthening of the Financial Sector or PPSK answers this problem. The Law provides a new mandate to form an institution, the Deposit Insurance Corporation (LPS). The existence of a Policy Guarantee Institution as mandated by the Law No. 40 of 2014 concerning Insurance could not be embodied. Therefore, enacting Law No. 4 of 2023 concerning the development and strengthening of the financial sector will hopefully become the answer. This Law provides the duties and authority of the Deposit Insurance Institution (LPS) to guarantee policies to protect public funds. However, to achieve the goal of the new Law, there should be good coordination between the Financial Services Authority (OJK), the financial services industry supervisory institution, and LPS, the policy guarantee institution. These two institutions should synergize with each other in protecting insurance policyholders.
