Abstract

Penelitian ini bertujuan untuk menganalisis mengenai bentuk perlindungan hukum terhadap pekerja atas hak medapatkan upah yang layak diperusahaan X dalam implementasi Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan. Fokus utama kajian dalam penelitian adalah penerapan perlindungan hukum terhadap hak pekerja atas upah yang layak serta mengidentifikasi sejauh mana perusahaan menjalankan kewajiban terhadap hak pekerja sesuai dengan ketentuang perundang-undangan yang berlaku. Metode yang digunakan adalah pendekatan yuridis empiris, pendekatan dilakukan dengan menggabungkan dua aspek yaitu aturan hukum yang berlaku seperti (Undang-Undang atau Peraturan Pemerintah) dengan fakta dilapangan secara langsung dari fenomena yang terjadi di lapangan, studi lapangan melalui wawancara dan observasi terhadap pekeja serta pihak manajemen di perusahaan. Namun, hasil dari penelitian terdapat pelanggaran dalam praktik pembayaran upah terhadap pekerja, yang mana masih sering pekerja mendapatkan upah jauh dibawah Upah Minimum Kabupaten/Kota (UMK) yang telah ditentukan oleh pemerintah. Hal tersebut menunjukan perlu adanya pengawasan lebih lanjut dari instansi ketenagakerjaan serta meningkatkan edukasi kesadaran hukum bagi pekerja dan sanksi tegas terhadap perusahaan yang tidak mematuhi peraturan regulasi ketenagakerjaan. Meskipun undang-undang Nomor 13 Tahun 2003 dijadikian landasan hukum yang kuat tetapi penerapan di perusahaan X masih membutuhkan perbaikan guna menjamin hak hak pekerja sesuai dengan peraturan ketenagakerjaan yang berlaku.

Abstract

The circulation of illegal cigarettes in Kudus Regency remains a serious problem that is detrimental to the state and disrupts a healthy business competition climate. This study aims to analyze the forms and mechanisms of law enforcement by the Kudus Customs and Excise Supervision and Service Office against these violations based on Law Number 39 of 2007 concerning Excise, and to identify inhibiting factors in its implementation. The research method used is an empirical juridical approach with a qualitative descriptive research type through interviews with officials of the Kudus Customs and Excise Supervision and Service Office and a literature study of related documents and regulations. The circulation of illegal cigarettes is still found in various forms of violations, with plain cigarettes without excise stamps being the most frequently found type. The resulting impacts include reduced state revenue, disrupted competitiveness of the legal cigarette industry, and low levels of public legal compliance. In its implementation, the Kudus Customs and Excise Supervision and Service Office faces obstacles in the form of limited personnel and facilities, difficulties in location searches, and low public legal awareness. This research is expected to contribute to increasing the effectiveness of law enforcement in the excise sector and support efforts to eradicate the circulation of illegal cigarettes in Indonesia

Abstract

This community service was carried out in January 2026 which aims to improve the understanding and skills of teachers and students in implementing positive character values, strengthening digital literacy and raising awareness of the importance of legal protection for children so as to create a school culture that is safe, orderly, and respects the rights of every individual. In order to achieve this goal, the community service educates students and teachers about child-friendly schools that synergize character education, legal awareness, and digital literacy in creating a bullying-free environment in elementary schools. Bullying is a problem faced at SD Aisyiyah Multilingual Darussalam Kudus, based on observations and interviews, there are still student behaviors that cause discomfort to other students both verbally, socially, and non-verbally; lack of knowledge about the rules; and the weak child-friendly school culture. This community service uses the PAR (Participatory Action Research) method and test questions. This community service has two activities, namely an inspirational class with 18 students, and a workshop with 14 teachers. The results of the pretest and post-test showed an increase after education with an average of 18.3% of students and 18% of teachers. This improvement is proven by the active participation of students and teachers during role playing, project creation, case studies, and Q&A sessions.

Abstract

The rapid development of technology has brought humanity into a wave of modernization characterized by digitalization, leading to significant changes in all aspects of human life. The role of technology today offers various conveniences. The transformation of payment systems from cash-based to cashless transactions provides ease for customers and helps reduce the risk of crimes such as robbery, theft, and counterfeiting. One of the most widely used cashless payment methods that is frequently misused by irresponsible individuals for criminal purposes today is the credit card. The focus of this study is to examine the legal accountability of banking institutions in relation to a specific type of cybercrime, namely carding, which causes financial losses to customers. This research employs a normative juridical method. The findings indicate that the bank’s liability from a civil law perspective refers to Article 1338 paragraph (1) of the Indonesian Civil Code and Article 19 paragraph (1) of Law No. 8 of 1999 concerning Consumer Protection. Customer losses resulting from carding crimes are viewed as a consequence of inadequate protection by the issuing bank in maintaining network security. Errors or negligence by bank employees can be construed as the bank’s responsibility; however, if it can be proven that the carding crime did not occur due to the issuing bank’s negligence, then the bank is not obliged to compensate for the losses suffered by the customer.
