Abstract

The government regulations in lieu of laws are part of the legislative authority of the president in many countries implementing a presidential system of government. In order to provide a sense of security and legal justice for the people, new regulations are enacted to fill gaps in the law or to replace existing ones. The aim of this study was to find out and analyze the stipulation and issuance of governmentl regulation inl lieu ofl law numberl 2 ofl 2022 concerningl job creationl (known as perpu cipatker) which should have been declared conditionally unconstitutional by the constitutional court on November 25, 2021, through decree Number 91/PUU- XVIII/2020. This research uses normative research techniques with descriptive-analytic research specifications, including analysis of applicable law and legal theories related to research problems. The findings of this study indicate that in the issuance of the government regulation in lieu of law on job creation is still not yet clear and comprehensive what can regulate the formation of laws based on policies relating to the formation, renewal and development of laws. as well as the insufficient fulfillment of procedures for drafting laws and regulations in terms of philosophical, juridical and sociological aspects.

Abstract

Penghentian penyidikan kasus pemalsuan sertifikat oleh Kepolisian Daerah Nusa Tenggara Barat, sebagaimana diatur dalam Surat Nomor: B/244/VI/RES.1.9/2024/Ditreskrimum, menimbulkan polemik hukum. Kasus ini menyangkut dugaan pelanggaran Pasal 263 KUHP tentang pemalsuan surat serta Pasal 266 KUHP jo Pasal 55 KUHP terkait penggunaan surat palsu secara bersama-sama. Penyidikan dihentikan dengan alasan pelapor tidak memiliki legal standing setelah kalah dalam gugatan perdata terkait sertifikat tersebut. Penelitian ini mengkaji keterkaitan norma hukum pidana dan perdata dalam penghentian penyidikan, dengan pendekatan pada regulasi, yurisprudensi, dan kebijakan penegakan hukum. Analisis difokuskan pada perbandingan hukum pidana dan perdata, mencakup prinsip legal standing, validitas bukti, serta peran yudisial dalam mengintegrasikan kepentingan kedua ranah hukum. Penelitian bertujuan menjelaskan penerapan prinsip hukum dalam kasus dualitas pidana-perdata serta menilai kesesuaian keputusan penghentian penyidikan terhadap prinsip due process of law. Kasus ini, yang melibatkan dugaan pemalsuan sertifikat tanah di Desa Batu Layar, Lombok Barat, mencerminkan tantangan serius dalam penegakan hukum tanah di Indonesia. Penyidikan dimulai pada 1 Juni 2024 dan dihentikan setelah gugatan perdata antara Daryl Alexander Pontin sebagai pelapor dan Mahrim Hamzah, yang juga mengajukan praperadilan di Pengadilan Negeri Mataram (No. 5/Pid.Pra/2024/PN Mtr). Hasil kajian menunjukkan bahwa penggunaan putusan perdata sebagai dasar penghentian penyidikan bertentangan dengan Pasal 109 ayat (2) KUHAP, mengaburkan batas pidana–perdata, dan membuka peluang pelaku pemalsuan lolos dari pertanggungjawaban. Kondisi ini melemahkan integritas sistem hukum dan kepercayaan publik, sehingga penelitian merekomendasikan pemisahan tegas proses perdata dan pidana, pengawasan yang lebih kuat atas penghentian penyidikan, serta pembaruan regulasi dan teknologi perlindungan dokumen pertanahan. Kebaruan penelitian terletak pada sorotan kritis terhadap praktik penghentian penyidikan di Polda NTB dan usulan perbaikan konkret bagi penegakan hukum pertanahan.

Abstract

Agriculture is the main sector that supports the rural economy in North Kolaka Regency, with rice as a staple food commodity for the community. However, population growth, climate change, and the conversion of rice fields are serious challenges to the availability of local rice food. This study aims to analyze the availability of rice food, the need for rice fields, and the carrying capacity status of agricultural land in North Kolaka Regency, as well as projecting the needs of the next five years. The research method uses a descriptive quantitative approach with secondary data from BPS, Bappeda, and the Food Crops and Horticulture Service, as well as primary observations for field verification. The analysis included the calculation of rice food availability based on land productivity, food needs based on per capita consumption, and the Land Carrying Capacity Index (IDDL) with the Odum, Howard, and Issard formula. The results of the study showed that the average availability of rice food reached ±7,000 tons/year, with an uneven distribution between sub-districts. Some areas such as Ranteangin and Batu Putih are in surplus conditions, while other sub-districts tend to have deficits or do not have significant production. The IDDL shows a downward trend due to a reduction in harvest area of about 2.1% in the last five years, while food needs increase as the population grows. Projections over the next five years show that the risk of deficit is even greater if there is no policy intervention. These findings confirm the need for strategies to strengthen regional food security through agricultural intensification (increasing planting index, superior seeds, irrigation efficiency), sustainable rice field protection (LP2B), and diversifying local food. The results of the research are expected to be a reference for local governments in spatial planning, land conversion control, and sustainable food security policy formulation.
