Abstract

Tujuan dilaksanakan pengabdian masyarakat ini adalah untuk memberikan pemahaman, mengevaluasi masalah didalam masyarakat serta mengupayakan memberikan solusi terhadap masalah yang ada di masyarakat terutama mengenai peranan pendidikan tinggi dalam mempengaruhi perekonomian masyarakat. Kebanyakan masyarakat menganggap bahwa pendidikan perguruan tinggi hanya bagi kalangan masyarakat yang mampu saja serta tidak terlalu berguna bagi masyarakat karena telah mengetahuinya melalui teknologi saat ini maupun dari sosial media serta orang ke orang saat ini. Dengan adanya pengabdian masyarakat ini dapat memberikan solusi dan penyegaran beberapa materi ilmu dasar pendidikan yang didapat di perguruan tinggi yang tidak diketahui masyarakat luas dan pemahaman Pendidikan perguruan tinggi mempengaruhi perekonomian masyarakat tersebut. Sehingga pelaksanaan pengabdian ini yang dilakukan di masyarakat memiliki penyelesaian.

Abstract

Dilaksanakan pengabdian masyarakat ini adalah untuk memberikan pemahaman dan keilmuan yang dapat digunakan dan diterapkan didalam bermasyarakat, mengevaluasi masalah-masalah yang terjadi didalam masyarakat mengenai terutama dikalangan mahasiswa di Pematangsiantar serta mengupayakan memberikan solusi terhadap masalah yang berbenturan dengan pemahaman pendidikan karakter baik dalam implementasi di lingkungan perguruan tinggi maupun bermasyarakat. Dengan adanya pengabdian masyarakat ini dapat memberikan solusi dan pendalaman ilmu tentang pendidikan karakter di lingkungan perguruan tinggi dan di masyarakat pemahamannya didalam Pendidikan perguruan tinggi. Pendalaman materi tidak hanya tentang pendidikan karakter, juga beberapa materi tambahan keilmuan yang ada dipelajari di perguruan tinggi yang dapat diterapkan dimasyarakat juga. Selain itu pelaksanaan pengabdian ini juga melatih mahasiswa untuk bersosialisasi dengan masyarakat dan melakukan kegiatan kebersihan di lokasi wisata. Pelaksanaan pengabdian ini yang dilakukan memiliki penyelesaian dan berguna bagi mahasiswa di lingkungan perguruan tinggi dan di masyarakat.

Abstract

Dilaksanakan pengabdian masyarakat ini adalah untuk memberikan pemahaman dan keilmuan yang dapat digunakan dan diterapkan didalam bermasyarakat, serta mengevaluasi masalah-masalah yang terjadi didalam masyarakat mengenai penyebab rendahnya kesadaran Pemuda dalam membangun desa melalui gotong royong di Nagori Buntu Turunan dan upaya menumbuhkan kesadaran Pemuda terhadap pentingnya Pembangunan melalui Gotong Royong di Nagori Buntu Turunan Dengan adanya pengabdian masyarakat ini dapat memberikan solusi dan pendalaman ilmu tentang membangun desa melalui gotong royong di Nagori Buntu Turunan. Selain itu pelaksanaan pengabdian ini juga melatih mahasiswa untuk bersosialisasi dengan masyarakat dan melakukan kegiatan nyata untuk meningkatkan semangat pemuda. Pelaksanaan pengabdian ini yang dilakukan memiliki penyelesaian dan berguna bagi mahasiswa di lingkungan perguruan tinggi dan di masyarakat.

Abstract

The role of law enforcers is at the forefront of the legal world in Indonesia at this time the number of cases and resolutions of legal problems that are applied by prioritizing a sense of justice not only prioritizing legal certainty, legal protection for children can be done as an effort to protect the law against various freedoms and human rights of children. This protection of children also includes interests related to child welfare. The protection of children in conflict with the law is a shared responsibility of law enforcement officials. One form of restorative justice is dialogue between Indonesian people, better known as musyawarah for consensus. So that diversion, especially through restorative justice, becomes a reference for very important considerations in solving legal cases concerning children as perpetrators of crimes.

Abstract

The perpetrator of rape should be burdened with the responsibility to, among other things, provide compensation (restitution), treat, and bear the costs incurred for the victim's mental or psychological recovery from the traumatic experience. If the perpetrator is unable to carry out these obligations, then the obligation becomes the responsibility of the state and society. Meanwhile, perpetrators who are unable to fulfill their obligations are burdened with substitute punishment in the form of imprisonment as a subsidiary punishment. The question is, in which law should these provisions be regulated? Because all criminal justice processes culminate in the Criminal Procedure Code, the first provision regarding the imposition of responsibility for compensation must be expressly stated in the Criminal Procedure Code. Furthermore, of course in the Criminal Code as the umbrella of national criminal law, which is then also regulated in laws that are lex specialis. The form of compensation can be submitted to the court through the LPSK by the victim of the crime of rape, their family, or their attorney, which can be in the form of material and immaterial. Material compensation in the form of restitution and compensation, and immaterial compensation can be in the form of assistance, namely psycho-social rehabilitation. In providing compensation, the priority is psycho-social rehabilitation, because restoring a person's condition cannot be done through material provision alone

Abstract

ABSTRACTThe development of employment in Indonesia is based on the provisions of Law Number 13 of 2003 concerning employment. Law Number 13 of 2003 is a replacement for Law Number 14 of 1969 concerning the main provisions regarding employment. The issuance of Law Number 13 of 2003 is expected to be able to answer various challenges and problems of worker protection and Indonesian Migrant Workers. Law becomes an instrument in the sustainability of national development today, national development is carried out to overcome various problems faced in government intervention efforts in the field of employment into two, namely private and public and in a scope that is regulated to be broader. The purpose of employment development itself as stated in Article 4 of Law Number 13 of 2003 is: to empower and utilize the workforce optimally and humanely. realizing equal employment opportunities and providing workers in accordance with national and regional development needs, providing protection to workers in realizing welfare, increasing the welfare of workers and their families. Abstract

ABSTRACTOnline prostitution of minors is an act that aims to obtain and can also be offered a child's sexual services by someone or to another person and is accompanied by a payment in the form of money. Online prostitution is an exchange of sexual relations with a reward that is usually in the form of money as a trade or prostitution transaction carried out through the internet or cyberspace as a connecting medium. The media used such as, whatsapp, messenger, facebook, line, and so on. The purpose of this study is to explain the legal protection of minors as victims of online prostitution, the form of legal protection for minors as victims of online prostitution, and efforts to prevent and handle online prostitution. To obtain the data needed in this study, normative legal research was conducted. Normative legal research produces primary data, namely legal materials consisting of laws and regulations, such as Law Number 35 of 2014 Amendment to Law Number 23 of 2002 Concerning Child Protection. And produces secondary data, namely studying books, theories and scientific papers. The results of the study indicate that how legal protection for minors as victims of online prostitution and efforts to prevent and handle online prostitution. However, the form of legal protection requires firmness from Law Number 35 of 2014 Amendment to Law Number 23 of 2002 Concerning Child Protection. In providing protection, so that with strict regulations, minors can be protected by law. Efforts to prevent and handle online prostitution can be seen in terms of prevention before it occurs and handling after a crime occurs. Abstract

The rapid development of Artificial Intelligence (AI) presents significant challenges for Indonesian criminal law, particularly in determining accountability for actions involving AI, whether as an auxiliary tool or as an indirect perpetrator. This study seeks to examine the current criminal law framework, identify deficiencies in the Criminal Code (KUHP), the Electronic Information and Transactions Law (ITE Law), and related regulations, and assess the applicability of alternative liability models, including vicarious liability and strict liability. Employing a normative juridical approach—through the analysis of statutory provisions, legal doctrine, and international case studies—this research finds that national regulations remain predominantly reactive, fail to adequately anticipate the emergence of autonomous AI, and encounter technical evidentiary challenges arising from the ‘black box’ phenomenon. The findings suggest that alternative liability models are better suited to the distinctive characteristics of AI. The study concludes that a responsive reformulation of criminal law norms is essential to ensure legal certainty, protect victims, and facilitate effective law enforcement in the context of AI.

Abstract

This study aims to identify factors that trigger domestic violence (DV) by husbands against their wives. Some of the main factors include the patriarchal system, discrepancies in husband's expectations, economic competition in the household, and husband's frustration that leads to physical, sexual, psychological violence, or family neglect. In addition, women's limited access to the legal process is also an obstacle, where the Criminal Procedure Code minimally addresses victims' rights, and reports are often considered as ordinary domestic conflicts. This research also examines legal protection for victims of domestic violence based on Law No. 23 of 2004 and how the district court provides protection for victims in its decisions. The research used a normative juridical method with a statutory and case approach, as well as literature study techniques to collect data. The results showed that the judge's decision still focused on punishment for the perpetrator, without considering the victim's right to compensation either through restitution or compensation. Decisions tend to only follow the provisions of the written law without including aspects of recovery for victims in the criminal justice system in Indonesia..

Abstract

Abortion or termination of pregnancy is a controversial issue that causes debate between the pros and cons in society, where abortion cases continue to increase every year and can occur in various circles, including teenagers who are involved in free sex, but in positive law in Indonesia, abortion in certain cases can be justified if it is an abortion provokatus medicinalis, while abortion that is generalized as a criminal act is known as abortion provokatus criminalis, so in this study three main problems were studied, namely the factors that encourage a woman to commit the crime of abortion, the application of criminal sanctions for the crime of abortion, and efforts to overcome it, using library research methods, and from the results of the analysis it was found that socio-economic factors such as financial inability, pregnancy due to rape, and pregnancy outside of marriage are the main drivers for women to have illegal abortions as a solution to unwanted pregnancies; the application of criminal sanctions against perpetrators of abortion can only be carried out if there is an element of error in the act which violates the provisions as regulated in Article 77A paragraph (1) of Law Number 35 of 2014 concerning amendments to Law Number 23 of 2002 concerning Child Protection, which states that anyone who intentionally carries out an abortion on a child who is still in the womb for reasons and procedures which are not permitted by statutory regulations as referred to in Article 45A, can be subject to a maximum prison sentence of ten years and a maximum fine of one billion rupiah; and efforts to overcome abortion can be carried out through pre-emptive, preventive, and repressive strategies, where pre-emptive efforts are carried out through routine counseling on abortion, socialization of reproductive health, and appeals to parents and the community to carry out strict supervision and provide positive activities to build the future of the younger generation, while preventive efforts are carried out through cooperation between law enforcement and health institutions such as the Doctors Association, Police Medicine, Forensic Laboratory, and the Ministry of Health to provide guidance to women who experience unwanted pregnancies so that they do not have illegal abortions, while repressive efforts are carried out through law enforcement by imposing penalties on perpetrators in accordance with applicable provisions
