Abstract

The Industrial Revolution 4.0 has changed the landscape of all fields in the world, including Cirebon Regency which also feels its impact, therefore global change requires humans to be able to develop their abilities more broadly. One of the labor issues that need to be considered and resolved is the lack of competence and competitiveness of Indonesian workers. Facing the industrial revolution 4.0, the workforce in Cirebon Regency is deemed not to have sufficient readiness and skills. This paper uses Lourdes Beneria and Maria Floro studies which have examined the changes in the informalisation of the labor market in most countries such as Bolivia, Ecuador, Thailand and the Philippines, through the analysis unit of home women workers. and a qualitative method blended between case studies and phenomenology by examining Information and social issues of workers in Indonesia on legal studies (case study of Layoffs as a digitalization effect in Cirebon District 2019).

Abstract

The cultivation of the principle of balance of interests in the rule of law that contains the value of honesty, fairness, justice, and moral demands, such as rights, obligations and responsibilities in the relationship between human beings in accordance with the principles of Pancasila, where workers and employers have a reciprocal relationship valued humanity, there is no discrimination, and seeking adjustment of understanding through deliberations. Abstract

The working relationship between workers/laborers and employers is not always harmonious, there are many factors that cause disputes, for example a working relationship based on an employment agreement, also known as a work contract, is considered more efficient, because the employer can at will make the terms and conditions of work agreed upon as well. by workers. For example, it is agreed to work for two years with a certain wage for the type of work given by the employer. Another problem that often arises is the issue of unilaterally terminating the employment contract by the Employer and contrary to the provisions of the Manpower Act, thereby causing harm to the continuation of work for the worker; This type of research is juridical Empirical. This is done by researching directly to the research location, using a legal approach (approach), to see firsthand its implementation. and conduct interviews with officers from the Department of Manpower. Abstract

This study has two issues of study in its discussion, the first is a study that is directed to find out and analyze the duties, functions and authorities of the Village Consultative Body (BPD) from the point of view of positive law in Indonesia, and secondly, this study will also discuss how the role and implementation of BPD functions in overcoming and preventing the spread of Covid-19 in their respective villages. This research is a juridical-empirical research that tries to explain the role of BPD in a predetermined research location, namely in Kaliwedi Kidul Village, Kaliwedi District, Cirebon Regency, this study uses primary data as the main data, the primary data as intended by the author is obtained through the data collection techniques used with unstructured observations and interviews, the results of the study show that legally the BPD has a function, namely the legislative function at the village level, the BPD and the village head have an obligation to make a policy in the form of village regulations, however, in Kaliwedi Village, the implementation of this function has not been able to implemented optimally, especially when it is associated with the formation of village regulations concerning the issue of preventing the spread of Covid-19, so it is necessary that in the future BPD can cooperate with village heads, to make policies to overcome Covid-19 in their villages, this is important so that prevention the spread of Covid-19 can have a strong legal basis down to the village level. Abstract

In the context of regulation regional enforce, the first element as implementer in field is regional government. In this case the authority is given to the Civil Service Police Unit (Satpol PP). The civil service police unit has the job is help the Regional leader to create a peace and orderly, so that the administration of the wheels of government can run smoothly and people or society can do their activities safely. One of the objectives of Regional Regulations (PERDA) issued by regional governments (PEMDA) is to guarantee legal certainty, create and maintain public order and order. The Civil Service Police is a local government apparatus with the main jobs is enforce of regional regulations, organizing public order and public order. If connected with the performance of the civil service police Organizational of Cirebon district, so the evaluation performance is carried out based on the job that carried out. The purpose of this study is to describe how the performance of the civil service police of Cirebon district in the job of enforce the local regulation base on regional regulation in Cirebon district. Abstract

Pemberian modal usaha kepada mantan narapidana terorisme sebagai program deradikalisasi yang dilakukan oleh Kepolisian Daerah Jawa Tengah sudah berjalan namun belum sesuai dengan harapan yang diinginkan. Hal ini dikarenakan minimnya pengawasan dari anggota Kepolisian terhadap para mantan narapidana terorisme (Man to Man) yang mendapatkan modal usaha, bahkan didapati adanya beberapa mantan narapidana terorisme menggunakan uang tersebut untuk mendukung kegiatan kelompok mereka. Permasalahan dalam penelitian ini adalah untuk memahami dan menganalisa reposisi program deradikalisasi mantan narapidana terorisme dalam mengembalikan paham nasionalisme berbangsa dan bernegara menurut Undang-Undang Nomor 5 Tahun 2018 tentang Perubahan Atas Undang-Undang Nomor 15 Tahun 2003 tentang Pemberantasan Tindak Pidana Terorisme. Metode dalam penelitian ini adalah deskriptif analitis dengan pendekatan yuridis normatif. Hasil penelitian ini berupa reposisi program deradikalisasi mantan narapidana terorisme dalam mengembalikan paham nasionalisme berbangsa dan bernegara menurut Undang-Undang Nomor 5 Tahun 2018 tentang Perubahan atas Undang-Undang Nomor 15 Tahun 2003 tentang Pemberantasan Tindak Pidana Terorisme. Terorisme merupakan kejahatan yang berhubungan dengan radikalisme, maka program deradikalisasi dan kontra radikalisme harus berjalan beriringan menjadi bagian integral dari sistem peradilan pidana dan politik hukum pidana dalam upaya penanggulangan terorisme. Agar program deradikalisasi dapat berjalan dengan baik, efektif dan berhasil, maka diperlukan strategi deradikalisasi yang berkesinambungan untuk jangka panjang dengan pendekatan yang komprehensif baik pendekatan hukum (law enforcement) maupun pendekatan soft power yang melibatkan beberapa aspek strategis seperti ekonomi, agama, pendidikan dan sosial budaya. Tentu saja disinergikan dengan program kontra radikalisme sebagai upaya pencegahan dan penanggulangan terorisme. Kata kunci : Deradikalisasi; Radikalisme; Terorisme

Abstract

Hukum dan Moral menjadi perdebatan akademisi sepanjang masa, khususnya dalam aliran hukum alam dan paradigma positivisme hukum. Kedua aliran ini dalam memandang hubungan hukum dan moral mempunyai perbedaan yang sangat tajam. Positivisme hukum yamg mulai berkembang pada abad ke-19 lebih mengutamakan kepastian hukum,yang menekankan pada bunyi peraturan perundang-undangan.Cara hukum yang positivistik tersebut,tidak biasa diharapkanuntuk mencapai sisi keadilan substantive.Sebaliknya Hukum Alam memandang erat hubungan antara hukum dan moral.Dalam perspektif hukum alam, hukum harus memuat prinsip-prinsip moral,sehingga hukum yang ada mempunyai kekuatan makanya sebagai hukum,yaitu keadailan.

Abstract

"Juridical Review of the Crime of Theft in the Family" This research is motivated by the various efforts made by the authorities and the community members themselves to eradicate the crime of theft. Law enforcement for the crime of theft in the family is not only the task of law enforcement officials, but also participation from within the family, among other things, this can be minimized by efforts to provide knowledge about the law to the family members themselves. In this study, the authors used descriptive qualitative analysis method, which is a research method based on postpositivism philosophy used to examine natural object conditions (as opposed to experiments) where the researcher is the key instrument of data collection techniques. The offenses referred to in Article 367 paragraph (2) and paragraph (3) of the Criminal Code are relative complaint offenses, namely offenses in which the existence of a complaint is only a requirement so that a perpetrator can be prosecuted.

Abstract

The Republic of Indonesia is a country founded on Pancasila and the 1945 Constitution of the Republic of Indonesia as its constitutional foundation. Throughout its history, Indonesian Muslims have played a crucial role in shaping the nation's foundation, notably through the Constituent Assembly. According to Article 134 of the 1950 United States of Indonesia Law regarding the Amendments to the Provisional Constitution of the United States of Indonesia, the Constituent Assembly, together with the government, was tasked with promptly establishing a new Constitution to replace the Provisional Constitution. The Constituent Assembly was established during the Liberal Democracy period from 1950 to 1959, following the 1955 General Elections, which involved various political parties, groups, institutions, and individuals. The four major parties that garnered the most votes were the Indonesian National Party (PNI), the Indonesian Muslim League (Masyumi), Nahdlatul Ulama (NU), and the Indonesian Communist Party (PKI), representing three major ideological streams: Nationalist, Islamic, and Socialist-Communist. In this context, the author will analyze the composition of Islamic political parties in the 2024 General Elections to understand how the dynamics of Islamic parties and their representation might influence policy formulation and the direction of governance in contemporary Indonesia.

Abstract

Background to find out law enforcement against police officers who violate the code of ethics in carrying out their duties in the jurisdiction of the Salatiga Police, obstacles in law enforcement against police officers who violate the code of ethics in carrying out their duties, solutions to overcome obstacles in law enforcement against police officers who violates the code of ethics in carrying out their duties. The results of the research are the legal basis for the Police Professional Code of Ethics, namely Law No. 2 of 2002, Article 13 paragraph (1). The ideal arrangement for resolving violations of the Code of Ethics by members of the Police within the jurisdiction of the Salatiga Police is based on Law Number 2 of 2002, Government Regulation Number 1 of 2003, Government Regulation Number 2 of 2003 and Presidential Regulation Number 52 of 2010. The process of handling Police who violate the police professional code of ethics in committing criminal offenses are basically carried out in accordance with the provisions of the Criminal Procedure Code (KUHAP), and the rules governing POLRI specifically. The obstacles are due to statutory factors (legal substance). Law enforcement factors, infrastructure or facilities factors and legal awareness factors. The steps for implementing the development of Human Resources (HR) in the Salatiga Polres environment through the Development of Human Resources (HR) through education and training, Development of Human Resources (HR) through assignments, through transfers and promotions, through career development, Development of Human Resources (HR) through supervision and control.
