Abstract

Studies on hermeneutics tradition has developed very rapidly. Onthe way, many approaches made by some Muslim intellectuals toget the real message of the hadith. Depth study of hadith is notonly perpetrated by the Muslim intellectuals, even orentalismegroups participating in the assessment of the tradition with adifferent purpose. Studies of Hadith orentalis much studied bypeople in a variety of disciplines, they are trying to put forwardnew theories in order analysis hadits. They think is Prophetictraditions that have experienced the purity of the text forintervention after the prophets death.

Abstract

Sachiko Murata has given a new scientific discourse in Islamic studies, especially in gender chess with a feminine approach that seeks to explain the relationship of cosmoslogi with humankind, in his study, Sachiko also combine it with the Chinese scholarship Tao with Tao of Islam collaboration mengahasilkan new treasures by taking the opinion- Sufis, Sachiko rate that to understand the relationship of the difference is required understanding of Sufis with background wisdom in understanding the cosmos and the creation of god. Sachikos anxiety begins when he takes on the task of teaching his students in America about Islamic studies, many of which are felt by Sachiko in his teaching, where students ask about the oppression of women in the east and students departing from the negative doctrinal values of womens oppression Islam.

Abstract

In recent years many studies have developed from both groups who doubt the authenticity of the Sunnah and the power of Sunnah as a source of Islamic law. This problem inspires Muslim scholars who consider that the group's doubts are due to the weakness of the study and the approach taken by the previous ulama as well as academic re-examination, the shahrur is a figure of Muslim scholars seeking hermeneutical methods so that the hadith still has original value and is accountable for academic value.

Abstract

Divorce in the community is often understood differently between Islamic law, the State, and customary law. Each of these laws has a fundamental legal basis regarding the concept of divorce. The impact of differences in the legal concept of divorce results in different Muslim communities in the process of terminating marital relations. This research aims to examine further how the divorce bureaucracy in Indonesia affects the divorce process in the community. This paper results from an empirical study with a socio-legal study approach, this approach is used to review how divorce in society is practiced. Data was obtained from interviews with relevant parties. To strengthen the data and analysis, this research also uses several empirical research results and other important articles related to this paper. The results show that the divorce bureaucracy in Langsa City, Aceh still leaves problems caused by differences in viewpoints and interests so that divorce outside the court still occurs. The difference in perspective is based on the understanding that divorce is legal if it fulfills the provisions of Islamic law. On the other hand, people who are aware of the law have the view that divorce must be done before the court. The bureaucracy of divorce, which involves administration and the conditions that must be met, makes divorce considered complicated and takes a long time. Conversely, religious divorce does not require a long time and cost. In addition, the interest in a quick process without the need for an administrative process also influences the divorce bureaucracy. Non-judicial mediation at the village level is essential for reducing divorce rates and reducing divorce bureaucracy.
