Abstract

AbstrakTulisan ini bertujuan menguji pengaturan hukum lingkungan internasional mengenai kebijakan pengurangan pengasaman (acidification) dan menganalisis peran rejim internasional dalam pengurangan pengasaman di Eropa. Hukum Lingkungan Internasional telah menetapkan Konvensi Internasional tentang Polusi Udara Jarak Jauh Lintas Batas Negara beserta beberapa Protokol. Protokol yang paling baru adalah protokol untuk mengurangi pengasaman eutrofikasi, dan ozone level dasar. Protokol ini menetapkan batasan emisi tahun 2010 bagi empat polutan, yaitu: belerang (sulphur), Nitrogen Oksida (NOx), Senyawa Organik Volatil (VOCs), dan Ammonia. Selain itu,  protokol ini juga menetapkan nilai batasan yang ketat untuk sumber emisi yang khusus serta mensyaratkan penggunaan teknologi terbaik yang tersedia. Pada level regional Eropa, Uni Eropa telah mengadopsi directives kebijakan-kebijakan udara dan secara terus menerus menginisiasi pengembangan strategi acidification untuk memberantas acidifikasi dan eutrofikasi. Kedua rejim, CLRTAP dan kebijakan udara Uni Eropa dapat digunakan untuk mengurangi proses acidifikasi di Eropa. Kedua rejim berfungsi secara timbal balik dan saling melengkapi dan terimplementasi dengan baik di Eropa. Hal ini terbukti bahwa proses acidifikasi dapat dikurangi. Konsekwensinya meningkatkan kualitas udara di wilayah Eropa. Jelas bahwa hukum lingkungan internasional dapat saling melengkapi hukum regional dan berperan dalam pengurangan acidifikasi di Eropa.Kata Kunci: Hukum Lingkungan Internasional, acidifikasi, Uni EropaAbstractThis article examines the international environmental governance regarding abating acidification policy and analyses the role of the international regime in abating the acidification in Europe. International environ- mental law has been established the Convention of Long Range Trans boundary Air Pollution (CLRTAP) as well as its protocols. The recent protocol is Protocol to Abate Acidification, Eutrophication and Ground- level Ozone which sets emission ceilings for 2010 for four pollutants; sulfur, NOx, volatile organic com- pounds (VOCs) and ammonia. In addition, it sets tight limit values for specific emission sources and requires best available technologies to be used. The European Union adopted Air policies Directives and simultaneously initiated the development of an Acidification Strategy for combating acidification and eutrophi- cation. Both of these regimes; CLRTAP and its protocols and the EU Air policy, might be used to abate the acidification in Europe. These regimes serve a reciprocal function and are well implemented in Europe. There is a proof that the acidification in lakes and streams is decreased. The consequence is the improve- ment of the air quality. It is clearly shown that the regimes play the major role in abating the acidification process in Europe.KEY WORDS: International Environmental Law, Acidification, European Union

Abstract

Pertumbuhan dan pengembangan daerah wisata diberbagai wilayah sebagai penggerak perkonomian suatu daerah berbanding lurus dengan resiko bencana yang akan dihadapi jika tidak dikelola dengan baik. Desa Gondosuli, Kecamatan Tawangmangu memiliki potensi wisata alam yang menarik sebagai tujuan investasi berbagai pihak, namun masalahnya adalah pembangunan objek wisata, sarana prasarana pendukung dan pemukiman diwilayah ini terkesan tidak memperhatikan karakteristik geografis, selain itu, menurut data kebencanaan menunjukkan bahwa wilayah desa wisata Gondosuli memiliki tingkat kerentanan bencana tanah longsor yang tinggi. Metode yang dilakukan adalah dengan melakukan peningkatan pengetahuan melalui diseminasi dan pelatihan mitigasi bencana alam berbasis komunitas yang bertujuan untuk meningkatkan kesadaran masyarakat dan pemerintah desa terhadap bencana dengan melibatkan Akademisi, BPBD Karanganyar, Perangkat Desa serta Masyarakat Desa Gondosuli. Program pengabdian ini mampu meningkatkan kesadaran akan karakteristik wilayah yang rentan bencana sekaligus berhasil membentuk komunitas tanggap bencana berbasis masyarakat desa Gondosuli.   Abstract Increasing Community Awareness of Gondosuli Village-Karanganyar Regency towards Environmental Management as an Effort to Reducing Disaster Risk. The growth and development of tourist areas in various regions, as an economic driver for an area, are directly proportional to the disaster risks that will be faced if not managed properly. Gondosuli Village, Tawangmangu Sub-district, has attractive natural tourism potential as an investment destination for various parties. However, the issue lies in the development of tourist attractions, supporting infrastructure, and settlements in this area, which seem to overlook the geographical characteristics. Additionally, according to disaster data, the Gondosuli tourist village area has a high vulnerability to landslides. The method used involves increasing knowledge through the dissemination and training of community-based natural disaster mitigation. The aim is to raise awareness among the community and village government regarding disasters by involving academics, the Karanganyar Regional Disaster Management Agency (BPBD), village officials, and the Gondosuli Village community. This community service program has succeeded in increasing awareness of the characteristics of disaster-prone areas and has effectively formed a community-based disaster response in Gondosuli Village.

Abstract

Daya ikat hukum internasional banyak mendapatkan tantangan dengan berbagai pelanggaran atas hukum internasional yang penyelesaiannya masih sarat dengan kepentingan politik negara. Tulisan ini mengkaji dua pertanyaan fundamental dalam hukum internasional, yaitu apa dasar atau landasan filosofis daya ikat Hukum Internasional bagi negara?; dan bagaimana negara-negara terikat dan patuh pada norma-norma Hukum Internasional dalam praktek masyarakat internasional kontemporer?. Hasil analisis menyimpulkan bahwa walaupun hukum internasional sebagai suatu sistem hukum diakui dan dilaksanakan oleh masyarakat internasional, namun demikian masih terdapat kelemahan utamanya dalam hal kekuatan mengikatnya. Realitanya, hukum internasional tetap ada dan semakin diperlukan untuk mengatur hubungan-hubungan internasional yang semakin kompleks dan itulah yang menjadi dasar mengikat HI bagi masyarakat internasional. Dalam rangka meningkatkan lagi legitimasi hukum internasional, maka sistem hukum internasional harus memberikan lebih banyak kesempatan kepada negara-negara berkembang dan NGO untuk mengekspresikan sudut pandang mereka dalam negosiasi di tingkat internasional serta prosedur pengambilan keputusan dari organisasi internasional.

Abstract

This study analyzes labor law arrangements in Indonesia, Germany and United Kingdom, mainly how several countries protect digital platform workers. Furthermore, this research evaluates the implementation of such a law to advance labor law in Indonesia in protecting digital platforms workers. This research used normative legal analysis, employing a statutory, conceptual, and comparative approach with Germany and the United Kingdom. The results indicate that the dynamics of new employment status or partnership working relationships and workers’ flexibility in the gig economy phenomenon are not only found in Indonesia. Several countries, for example, Germany and United Kingdom, have found strategies to tackle this phenomenon. The government can address the above employment problems in two approaches: via court decisions and amending or revising relevant legislation. Classifying the status of employment relationships in this new phenomenon is crucial for implementation in Indonesia. In the future, such classification can be used as a reference in developing Indonesian Labor Law. The government should consider the necessary substantive protections for workers, from flexible working arrangements to creating new standards more responsive to the structure of growing organizations and the emergence of algorithmic management.

Abstract

Sampai pada tahun 2023, Jumlah penyandang disabilitas yang telah menerima vaksin Covid-19 masih dapat dikatakan rendah. Kurangnya akses terkait dengan informasi atas vaksin Covid 19 mungkin merupakan salah satu penyebab rendahnya jumlah vaksinasi terhadap kelompok ini. Penelitian ini akan mengevaluasi bagaimana pemerintah Indonesia menjamin dan memenuhi hak akses vaksin Covid-19 bagi penyandang disabilitas, dengan menganalisis penyelenggaraan program vaksinasi pada empat wilayah di Indonesia. Penelitian ini merupakan penelitian sosio-legal dengan pendekatan interdisipliner. Hasil analisis menunjukkan bahwa pemerintah telah menjamin hak akses atas informasi penyandang disabilitas melalui peraturan perundang-undangan baik di tingkat pusat maupun daerah. Beberapa kendala yang ditemukan antara lain kepastian ketersediaan data penyandang disabilitas dan persebaran hoaks dalam komunitas penyandang disabilitas.

Abstract

The World Health Organisation has recommended that its member states conduct national vaccination programs based on fair and equal access principles. COVID-19 has had more severe impacts on persons with disabilities (PwDs). This article focuses on how the provisions of international human rights instruments obligate countries to provide vaccination for PwDs. Further, these provisions will be used to analyse the law and policy adopted by the Indonesian government related to the vaccination program designed for this group. This article used both normative/doctrinal and empirical legal research methods. Based on international human rights law, access to vaccines and medical technology are elements of the right to health under the AAAQ principles. Member states should consider groups’ vulnerabilities, risks, and needs when designing the vaccination program. Some groups risk experiencing a more significant burden from the pandemic due to underlying social, geographic, or biomedical factors. PwDs are people coming from diverse backgrounds. Thus, the challenges they face will vary according to age diversity, gender, types of disability, ethnicity, sexual orientation, and migration status. The results show that Indonesia, during the first vaccine rollout, did not explicitly mention disability as a priority. PwDs have experienced barriers in accessing vaccination due to a few persistent problems. In the future, national vaccination programs should include measures to overcome such barriers and ensure that PwDs have equal access to the vaccine and other healthcare services. Such access will enable the fulfilment of the right to health of the PwDs as guaranteed both under international human rights law and domestic law. In addition, future healthcare policy should put PwDs at the centre and address the unique needs and preferences of disabled people, including their cultural and language requirements.   Keywords: COVID-19 Vaccine, Persons with Disability, Equal Access, Indonesia

The 5th rank held by Indonesia regarding the number of children with stunted growth is a reflection of the unfulfilled right to a good and healthy environment for the community, healthy and cheap food and adequate nutrition for pregnant women. Abstract

This research aims to analyze the implementation of legal protection for citizenship rights of former transnational terrorist Indonesian citizens within Indonesia's legal system. Using normative juridical method with statutory and conceptual approaches, this study examines secondary data from primary, secondary, and tertiary legal materials. The results show that Indonesia's legal system has an adequate legal framework to protect the citizenship rights of former transnational terrorists, although its implementation faces various challenges. The deradicalization program and status verification mechanism implemented by the government have not been fully effective due to inter-institutional coordination constraints and community resistance. Additionally, the study identifies that citizenship status cannot be automatically revoked without proper legal process according to Law No. 12 of 2006 on Citizenship, as terrorist groups cannot be categorized as "foreign military" as specified in the law. This research contributes significantly to the development of returnee handling policies by balancing aspects of national security and human rights protection.

Abstract

Penelitian ini bertujuan untuk menganalisis dan membuktikan kejadian terhadap etnis Uighur di Xinjiang termasuk yurisdiki material International Criminal Court dan untuk menganalisis agar ICC dapat mengadili kekerasan yang dihadapi etnis Uighur di Xinjiang oleh Cina sebagai non-state parties ICC. Penelitian ini merupakan penelitian hukum normatif atau doktrinal dengan pendekatan perundang-undangan (statute approach), pendekatan konseptual (conseptual approach) dan pendekatan kasus (case approach). Jenis data yang digunakan adalah data primer dan sekunder. Teknik yang digunakan dalam pengumpulan bahan hukum dalam penelitian ini adalah studi kepustakaan. Penelitian ini menggunakan teknik analisis silogisme dengan metode deduktif. Berdasarkan penelitian ini, kejadian terjadap etnis Uighur di Xinjiang terbukti termasuk dalam yurisdiksi material ICC menurut analisis dengan menggunakan Statuta Roma 1998. Terdapat cara agar ICC dapat mengadili kekerasan dan pelanggaran berat HAM yang terjadi terhadap etnis Uighur di Xinjiang walaupun Pemerintah Cina tidak meratifikasi Statuta Roma 1998.

Abstract

The number of victims of domestic violence in Indonesia is still considerably high. The aims of this community service are threefold. The first aim is to share knowledge with the community. Second is to increase the community’s legal awareness of the issue, and the third aim is to perform one task of the Tri Dharma Perguruan Tinggi. Such sharing knowledge is deemed to be beneficial both for the community and the university. This community service employed both lecturing and interactive discussion methods. Lecturing was used to deliver the materials, and discussion was used to further explore topics relating to the issues. These methods enable society’s acceptance and understanding. Prior to this activity, most participants did not comprehend the meaning of gender equality and its significant influence on family life. The participants informed that some forms of domestic violence occur in the neighbourhood. Previously, they were of the opinion that such incidents were families’ private matters. They neither have rights nor obligations to interfere. As community members, they have an obligation to prevent such incidents from happening and could also assist in protecting the victims by informing the police or local institutions established for prevention and handling domestic violence
