Abstract

Balinese society local wisdom had a high potential for the legal development, both in the legal substantive development and the legal structure, as well as legal culture. It was a social reality was understood and implemented in their life, in fact, a very functional in the society. Therefore, it needs to be revitalized and transformed into national legal development. The revitalization of the local wisdom potential of Balinese society in legal development. It was conducted by way of leveraging the performance of Desa Adat organization unlike Bendesa policy, Kelihan, Pecalang with doing a cooperation and coordination towards government agencies, especially the state of legal enforcement in carrying out the task in a manner with the wise and prudent, a good attitudes and no arrogance as well as a violence. Therefore, the attitude of legal enforcement officials would be role models for the societies. Thus, the Bali image as the island was safe, orderly, and peaceful, with the population-paced of harmony could be preserved. The transformation of Balinese local wisdom was done by accommodating in the local regulation, even the regulation of provincial level regional as well as the regency and city level.

Abstract

The Indonesian Buddhist Council is one of the Buddhist Religious Councils that was established in 1955. One of the Riau branch administrators is Pekanbaru. Pekanbaru as the capital city of Riau Province houses 7 (seven) Viharas and Cetiyas. Each Vihara and Cetiya has its own problems such as the absence of activities other than Vesak and Kathina Celebrations (Buddhist holidays), including the lack of attention and guidance for administrators and devotees. This study uses a qualitative-analytic method with a religious and cultural approach. The results obtained are as follows. There are several factors that cause service not optimal, such as parking facilities, a service request system that is still manual, the lack of information on Vihara and Cetiya activities, the level of willingness and competence of priests and managers of places of worship that is still lacking. Second, PC MBI Pekanbaru has provided good guidance to Pandita, the manager of the house of worship, in making work plans so that services to the people are maximized, but this requires monitoring and evaluation in its implementation. In addition, PC MBI Pekanbaru has sought to civilize the community where Pekanbaru Buddhists are dominated by the Chinese ethnic group.

Abstract

Legal awareness of Hindu marriage law that has not been maximal is a problem for the community in Tista Village, Busung Biu Subdistrict, Buleleng Regency. One of the strategies to increase the legal awareness of Tista Village community especially in understanding Hindu marriage law through legal education is done to achieve maximal legal awareness of the community. The Community Service Team succeeded in providing an understanding to the public about the importance of knowing the law of Hindu marriage. Hindu marriage counseling activities by combining lecture and case-case models can be a model of future counseling by no longer doing legal counseling with lecture models only.

Abstract

Presently, pada gelahang marriages are still controversial within Balinese society in terms of their implementation and the implications. A certain percentage of Balinese approve of pada gelahang marriages, while a certain percentage of people disagree for various reasons. These pros and cons are not tolerated. In fact, the phenomenon of pada gelahang marriages is often confounding to the Hindu community in Bali. Hence, solutions are required. While pada gelahang marriages can be found in many districts and regions in Bali, however, many doubts and problems still arise in their philosophical and juridical foundations. Therefore, research on pada gelahang marriages from the perspective of legal pluralism needs to be done. This research is a qualitative research with a legal sociology approach. Primary data is derived from field data from observations and from the results of interviews of related parties, while secondary data is obtained from literature books using the theory of legal pluralism as a guiding theory in the discussion of research. The results of the study indicate that the pada gelahang marriage has a philosophical foundation, juridical foundation and sociological basis for the creation of values of justice, legal certainty and the benefit of law in the framework of legal pluralism that provides a way to meet Hindu religious law, traditional village customary law and state law to set pada gelahang marriages

Abstract

This article aims to analyze the dynamicity of Tri Hita Karana implementation in South Denpasar regarding the causing factors, the dynamic forms, as well the implication on the Hindus community life. This research was conducted using qualitative methods. The data were collected through document study, observation, and in-depth interviews with 25 informants. The collected data were analyzed by the theories of hegemony, social change, socio-cultural system critical, and adaptation. The results showed: First, the factors causing the dynamicity of Tri Hita Karana in the residential area of Hindus are urban modernization, population growth, spatial planning policies and settlement development, and rationalization in building construction. Second, the dynamics of Tri Hita Karana in these residentials are: (a) In the palemahan area, land conversion has displaced the subak and Ulun Suwi temple, violation of the principles of Balinese Traditional Architecture (ATB), displacing the existence of the open space; b) The pawongan area is characterized by increasingly heterogeneous, multi-ethnic and multi-cultural citizens.; (c) In the parahyangan area where the building layout was not reconstructed, the holy place Merajan was built on the upper floor of the residence. Third, the implications of the dynamics of Tri Hita Karana in the residential area of Hindus in the South Denpasar, include: (a) The palemahan area implies the use of land space based on the principles of effective, efficient, and economical, but the concept of ulu teben and kaja-kangin as the Balinese sacred orientations is still maintained; (b) The pawongan area is characterized by the behavior of city dwellers looking for Social space and spiritual recreation; (c) The Parahyangan area is characterized by praying activities at Merajan and Padmasana on the upper floor of the residence. To enforce the Tri Hita Karana, the misuse (disorientation) of spatial planning needs to be anticipated.

Abstract

Saat ini terkait dengan salah satu dari hak tradisional desa adat di Bali dalam mengurus rumah tangganya sendiri melalui hak untuk membentuk aturan hukum adat sebutan lainnya di Bali disebut awig-awig desa adat terjadi pergeseran akibat diterbitkannya Peraturan Daerah Provinsi Bali Nomor 4 Tahun 2019 Tentang Desa Adat di Bali. Pergeseran dimaksud disini, dari awalnya pembentukan awig-awig desa adat berdasarkan tata cara kebiasaan masing-masing desa adat (desa mawacara) bergeser ke arah penyeragaman yang dibuat pemerintah dalam hal tata cara penyuratan dan pendaftaran awig-awig desa adat di Bali (Bali mawacara). Tujuan penelitian ini adalah untuk mengetahui dan mengkaji tata cara penyuratan dan pendaftaran awig-awig desa adat pasca terbitnya Peraturan Daerah Provinsi Bali Nomor 4 Tahun 2019 Tentang Desa Adat di Bali dikaitkan dengan otonomi yang dimiliki oleh desa adat di Bali. Penelitian ini termasuk ke dalam penelitian kualitatif dengan metode deskriptif menggunakan pendekatan peraturan perundang-undangan dan pendekatan konseptual. Data bersumber dari data sekunder berupa data kepustakaan termasuk peraturan perundang-undangan terkait kemudian dikumpulkan dengan metode kutipan dan dianalisis secara deskriptif dan kemudian disimpulkan.Hasil penelitian menunjukkan terdapatnya pedoman penyuratan dan pendaftaran awig-awig pada Peraturan Daerah Provinsi Bali tentang Desa Adat dan Peraturan Gubernur tentang Pelaksanaan Perda Desa Adat di Bali menunjukkan terjadinya pergeseran dari desa mawacara ke Bali mawacarasehingga dapat mengurangi kadar otonomi yang dimiliki oleh desa adat di Bali, khususnya terkait dalam pembentukan hukum adat terutama pada desa adat Bali Aga yang secara turun-temurun memiliki cara sendiri membentuk hukum adat masing-masing

Abstract

Harmony between religious communities in Indonesia is now experiencing many problems, many conflicts occur which are actually triggered by religious issues by carrying religious flags and shouting sacred words they carry out actions that are very far from the behavior of a religious person. In handling cases of violence in the name of religion are almost all opinions say that law enforcers are seen as very weak and indecisive. If law enforcement officials remain weak and slow. It is very possible that cases of violence in the name of religion will spread to other areas. Local Law Wisdom has the potential and can contribute to anticipating religious violence in the midst of the current dynamics of socio-cultural change, policy steps in the development of national law need to be designed by Interpreting the Functions and Wisdom of Local Law in anticipating radicalism in the name of religion. Transforming Wisdom Local Law into Legislations related to Religious Issues, integrating, and adapting Local Law Wisdom in resolving Inter-religious Conflicts, and revitalizing Local Law Wisdom in maintaining security, order, and Inter-religious Harmony.

Abstract

The fact that we see that the development of law (legal substance, legal structure and legal culture) in our country is still running hobbled behind the dynamics of social and cultural life of society. This fact is one of the sources of the chaotic face of law in Indonesia. By looking at these conditions, the sprit of Balinese Customary Law in the development of National Law really needs to be initiated, studied, and developed. The law should be built in line with the socio-cultural structure of our own nation, but still be able to accommodate the dynamics of its socio-cultural life in this era of openness. Through that Balinese Customary Law will be able to contribute to the development of National Law.

Abstract

Hindus really need Religious Courts, because so far the District Courts have not been able to handle legal issues for Hindus, especially issues related to family law such as divorce, marriage and inheritance law. So far the formation of religious courts for Hindus has not been recognized because it does not have a clear basis. Therefore, it is necessary to conduct research on the basis for the formation of religious courts for Hindus, both the legal, philosophical and sociological basis of the formation of Hindu Religious Courts in Indonesia. The purpose of this study is to analyze the basis for the establishment of Hindu Religious Courts in Indonesia. The approach used is legal-sociological. This study found the basis for Religious Courts, namely philosophical, legal and sociological foundations. By finding the basis for the formation of Religious Courts for Hindus, it is hoped that Religious Courts for Hindus can be realized

Abstract

The purpose of this study is to describe how local factors affect the practice of religious moderation in Pejambon Village, Negeri Katon District, Pesawaran Regency, Lampung Province. The primary focus of this research lies in the role of local leadership in internalizing and implementing the four main pillars of religious moderation, namely national commitment, tolerance, non-violence, and accommodation to local culture in the lives of rural communities. This study uses a qualitative approach with a single case study method. Data collection techniques were done through participatory observation, in-depth interviews, and documentation studies. The research procedure refers to six stages of case studies according to Robert K. Yin, while the informants were selected using purposive sampling and snowball sampling techniques. Data is analyzed through pattern matching, explanation creation, and time series analysis. The study results show that local leadership plays a significant role in contextually building a narrative of moderation through example, deliberation, and social participation. The practice of moderation is not conveyed through formal instruction alone. Still, it is culturally shaped through social interaction, interfaith activities, and strengthening local values that align with national principles. Leadership prioritizing social awareness, openness, and inclusivity has maintained social cohesion and enhanced inter-religious harmony in a pluralistic village. These findings contribute to developing a theory of local leadership based on the values of religious moderation at the grassroots level.
