Abstract

This article analyzes the relationship between breach of contract (wanprestasi) and the enforcement of non-competition clauses in employment agreements, using the Supreme Court Decision Number 1785 K/Pdt/2023 as the main reference. The research aims to examine three core aspects: (1) the legal status of post-employment obligations as binding performance, (2) the determination of prohibited actions within non-competition clauses, and (3) the limitation of contractual liability only to parties who expressly bind themselves under the principle of privity of contract. The method used is normative juridical analysis through statutory interpretation, judicial reasoning, and doctrinal review. The study finds that non-competition clauses constitute negative performance that continues to bind workers even after the employment relationship ends, as long as the clause is clearly formulated and mutually agreed upon. The Supreme Court affirms that any form of involvement direct or indirect with a competitor within the agreed period constitutes breach of contract. However, contractual liability cannot be extended to third parties unless they actively participate in the breach. The findings highlight the need for proportionality, clarity of scope, and fairness in enforcing non-competition clauses within Indonesia’s legal framework.

Abstract

This study aims to analyze the experiences of working students in hybrid learning at higher education institutions by highlighting the challenges, strategies, adaptations, and their implications. The study uses an interpretative phenomenological analysis (IPA) qualitative approach, with participants being early-semester students who work part-time. Data were collected through interviews, observations, and diary entries, then analyzed based on the six stages of IPA with reference to communication theory, academic integration, and communication anxiety. Data analysis was conducted using the Interpretative Phenomenological Analysis (IPA) approach. Research results show that hybrid learning increases motivation, digital literacy, independence, and time efficiency, but also presents technical, academic, and psychological obstacles, particularly related to time management, communication anxiety, and infrastructure limitations. The success of working students is greatly influenced by individual readiness, lecturer support, social environment, and campus policies. This study concludes that hybrid learning is a relevant and adaptive learning model, but requires a targeted implementation strategy to minimize obstacles

Abstract

Penelitian ini bertujuan untuk menilai sejauh mana pajak Bea Perolehan Hak atas Tanah dan Bangunan (BPHTB) berdampak pada peningkatan pendapatan daerah Provinsi DKI Jakarta selama periode 2020 hingga 2024. Permasalahan utama dalam penelitian ini adalah rendahnya efektivitas dan kontribusi pajak tersebut terhadap total Pendapatan Asli Daerah (PAD). Penelitian menggunakan data sekunder dari laporan target dan realisasi penerimaan pajak serta pendapatan asli daerah (PAD). Hasil menunjukkan bahwa rata-rata efektivitas pengumpulan Bea Perolehan Hak atas Tanah dan Bangunan (BPHTB) mencapai 78,65%, yang termasuk dalam kategori kurang efektif, dan kontribusi Bea Perolehan Hak atas Tanah dan Bangunan (BPHTB) terhadap Pendapatan Asli Daerah (PAD) hanya sebesar 12,40%, yang dinilai kurang baik, dan menunjukkan bahwa perannya masih rendah dalam mendukung kemandirian keuangan daerah. Meskipun pendapatan Bea Perolehan Hak atas Tanah dan Bangunan (BPHTB) terus meningkat setiap tahun, pertumbuhannya tidak cukup untuk menutupi kenaikan total Pendapatan Asli Daerah (PAD). Ini menunjukkan bahwa potensi pajak Bea Perolehan Hak atas Tanah dan Bangunan (BPHTB) belum dimanfaatkan dengan baik. Faktor penyebabnya meliputi perbedaan antara target dan realisasi, kelemahan sistem administrasi dan pengawasan, serta rendahnya kesadaran wajib pajak. Untuk itu, diperlukan upaya memperkuat integrasi data, meningkatkan sistem e-BPHTB, serta melakukan evaluasi terhadap kebijakan agar Bea Perolehan Hak atas Tanah dan Bangunan (BPHTB) mampu memberikan kontribusi yang lebih besar dalam meningkatkan Pendapatan Asli Daerah (PAD) dan kemandirian keuangan daerah.

Abstract

This study aims to analyze business decision-making in overcoming various constraints faced by Sadane Coffee SMEs, particularly in labor management, capital, raw materials, and marketing aspects. The research method employs a qualitative approach with an explanatory survey design. Data were collected through direct observation and in-depth interviews with the business owner, supported by documentation and relevant literature studies. The results indicate that decision-making at Sadane Coffee SMEs remains simple and family-oriented. Labor management relies solely on family members, which helps reduce operational costs but limits production capacity. Business capital is entirely derived from personal funds without a clear separation between business and household finances, making financial performance evaluation difficult. Raw material management is relatively effective due to easy availability, although price fluctuations pose a significant risk. In terms of marketing, promotional activities are not conducted actively or systematically and mainly depend on word-of-mouth promotion and the owner's personal social media, resulting in limited market reach and weak branding. The study concludes that Sadane Coffee SMEs have considerable development potential; however, more strategic decision-making is required, particularly in utilizing digital promotion. The implications of this study highlight the importance of strengthening digital marketing strategies and improving business management to enhance competitiveness and sustainability of SMEs.

Abstract

This study examines legal protection for customers in digital transactions and the effectiveness of existing regulations, including the Consumer Protection Regulation, the Electronic Information and Transactions (ITE) Regulation, and the Personal Data Protection Regulation. Using a normative juridical approach, the study found that the legal framework is quite comprehensive, but its implementation is still hampered by weak oversight, low digital literacy, and limited dispute resolution mechanisms. The study concludes that there is a need to strengthen law enforcement, improve digital literacy, and optimize the role of business actors in transparency, data security, and after-sales service. Thus, the development of digital technology is changing consumer transaction patterns in Indonesia by providing convenience and efficiency, but also giving rise to risks such as fraud, unclear information, and misuse of personal data.

Abstract

Globalization has affected various aspects of modern society, one of which is the citizenship identity of young people. The influence of globalization on young people's citizenship identity is a major concern in the life of the nation today. Citizenship identity is an important thing for a citizen. Therefore, this study aims to analyze how globalization affects young people's citizenship identity. The influence of globalization can be seen in young people's lifestyle, consumption and cultural preferences. In the context of citizenship identity, globalization can challenge the clash between local and global identities, raising questions about their loyalty to their home country. The research methods used included a literature. The results of the analysis show that globalization has caused changes in young people's mindsets, values, and citizenship identities. The process of globalization has opened up young people's access to information, cultures and experiences from different parts of the world that change the way they see themselves as citizens. This research provides insights into the dynamics of citizenship identity in the era of globalization in order to promote active and responsible citizenship.
