Abstract

Penelitian ini menjelaskan tentang Putusan Hakim karena li’an di Pengadilan Agama Mamuju. Penelitian ini dilakukan untuk mengetahui bagaimana proses penyelesaian perkara li’an yang diproses di Pengadilan Agama Mamuju serta bagaimana dampak dari Implikasi putusan Hakim Karena li’an. Penelitian ini adalah penelitian lapangan (fleld research) dengan menggunakan metode kualitatif deskriptif. Fokus penelitian ini adalah Implikasi Putusan Hakim karena li’an di Pengadilan Agama Mamuju. Adapun sumber data dalam penelitian ini ialah sumber data primer dan skunder dengan tehnik okservasi, interview dan dokumentasi. Hasil penelitian ini menunjukkan bahwa: implikasi cerai gugat karena li’an di Pengadilan Agama Mamuju yang diputus oleh hakim Pengadilan Agama Mamuju tentunya memiliki dua factor yaitu berdampak pada kebaikan dari kedua belah pihak suami isteri. Dengan ketentuan bahwa jika dipisahkan kemungkinan kedua suami isteri masing-masing mendapatkan pasangan yang lebih baik. Dampak kedua terkait pada permasalahan anak dan keluarga. Proses penyelesaian perkara cerai gugat karena li’an oleh hakim di Pengadilan Agama Mamuju ialah mengunakan mode seni hakim dengan cara melihat sebab adanya li’an itu sendiri. jadi secara metode yang dijelaskan dalam Al-Qur’an itu tidak diterapkan pada Pengadilan Agama Mamuju dikarenakan itu sangat berap bagi pelaku li’an. Akibat Hukum dan Status Terhadap Anak Li’an Kedudukan hukum anak akibat perceraian li’an serta perlindungan hak anak pasca perceraian li’an ditinjau dari segi hukum perdata. Kedudukan anak yang dalam keluarga yang dilahirkan akibat dari li’an mempunyai status hukum yang sama dengan anak zina.

Abstract

Environmental preservation is a crucial issue that continues to receive attention, especially amid growing concerns about environmental degradation caused by human activities. This study aims to examine the implementation of the sasi mechanism by the people of Negeri Iha, Seram Island, and Ambon and to analyze the cultural significance of the sasi system regarding the concepts of Fiqh al-Bi'ah and Islamic criminal law. Using an empirical approach with qualitative methods, this research explores how the sasi mechanism contributes to community welfare and its relevance to Fiqh al-Bi'ah. The findings reveal that the implementation of the sasi tradition is managed by customary institutions with the authority to determine when sasi is enforced or lifted. There are two forms of traditional natural resource management in Negeri Iha: sasi laut (marine sasi) and sasi darat (land sasi). The study also shows that the sasi tradition's rules, goals, and punishments are similar to those in Fiqh al-Bi'ah. Both try to get the most suitable things done while doing the least environmental harm. Furthermore, violations of the sasi tradition are subject to customary sanctions, including physical punishment, fines, or spiritual consequences, such as the belief that violations could bring curses or illness as divine retribution. This research provides valuable insights into the harmony between the sasi tradition and the principles of Fiqh al-Bi'ah in preserving nature and maintaining the balance between humans and their environment.

Abstract

IAIN Parepare successfully countered radicalism and fundamentalism among the academic community through the vision of cultural acculturation and Islam, it can be seen with data and information during the vulnerable time of 2018-2021 not found the academic community reported to the campus code of ethics committee because of the issue of radicalism and fundamentalism, this can be successful because the recruitment pattern of students, lecturers, and employees emphasizes the value of religious moderation which is one of the indicators. It is accommodating to local culture.

Abstract

Child marriage remains prevalent in Indonesia despite the enactment of legal restrictions through Law No. 16 of 2019, with Majene Regency in West Sulawesi recording high case numbers driven by cultural, economic, and educational factors. This study aims to analyze the impact of the policy on the long-term psychological trauma of young people in Majene, focusing on mental rehabilitation and the formulation of local policy recommendations for victim recovery. A qualitative case study approach was employed, involving 25 participants aged 18–25 with a history of early marriage (70% female), selected using purposive and snowball sampling techniques. Data were collected through semi-structured interviews, community observations, and documentation, supported by the Trauma Symptom Checklist and descriptive statistical analysis using SPSS. Data were analyzed thematically following the Braun and Clarke approach. The findings reveal that although the policy reduced the number of cases from 193 in 2023 to 20 in 2025, the post-policy trauma rate increased, with 60% of participants exhibiting an average PTSD score of 2.8. Manifestations of trauma included chronic depression (72%), domestic violence (12 cases), suicidal ideation (10 cases), and a 1.98-fold higher risk of child stunting. Access to rehabilitation services remained low (40%), although support from the PKK (Family Welfare Movement) was found to reduce trauma intensity. These findings underscore the urgency of implementing culturally grounded trauma-informed care based on Mandar traditions and integrating holistic policies that combine peer counseling and economic support to break the cycle of intergenerational trauma and strengthen victim recovery at the local level.

Abstract

Penelitian ini menggali signifikansi tradisi Metawe dalam pola komunikasi keluarga Mandar, menyoroti nilai-nilai Maqashid al-Syariah yang terwujud dalam tradisi tersebut. Metode kualitatif digunakan dengan data lapangan seperti wawancara, observasi, dan dokumentasi untuk mendalami dampak dan relevansi tradisi Metawe terhadap komunikasi keluarga. Hasil penelitian menunjukkan bahwa tradisi Metawe tidak hanya sebagai pola komunikasi, tetapi juga sebagai cerminan nilai-nilai adat dan agama yang kaya. Dalam budaya Mandar, tradisi Metawe mengajarkan nilai-nilai sopan santun, tawadhu, malu, dan menghargai keberagaman, yang sejalan dengan prinsip-prinsip Maqashid al-Syariah. Tradisi Metawe dalam keluarga Mandar memberi penekanan pada pentingnya ketaatan terhadap ajaran Islam, dengan penghormatan terhadap orang tua, perilaku etis, dan perhatian terhadap keluarga menjadi nilai yang dijunjung tinggi. Dalam tinjauan terhadap Maqashid al-Syariah, tradisi Metawe juga membawa dampak positif dalam mencapai kemaslahatan bagi umat. Penelitian ini menawarkan pemahaman yang lebih dalam tentang integrasi antara budaya lokal dan ajaran Islam, menjadikan tradisi Metawe sebagai titik temu yang memperkuat nilai-nilai keislaman dalam kehidupan sehari-hari keluarga Mandar. Hasil penelitian ini diharapkan dapat memberikan kontribusi dalam pemeliharaan tradisi lokal yang bernilai positif dan mendorong harmoni sosial di masyarakat.

Abstract

The Supreme Court in an effort to apply one of the principles in civil law, namely the principle of simple, fast and light costs, has implemented the e-court system as stipulated in Supreme Court Regulation Number 1 of 2019 concerning Electronic Administration of Cases in Court. The purpose of this study was to determine the extent of the Effectiveness of the Implementation of E-Court Pekara Divorce in the Parepare Religious Court. This research is a descriptive qualitative research with a normative juridical approach with data collection through interviews and literature studies by searching literature, books, and legislation. The results of this study show that electronic proceedings at the Parepare Religious Court in 2022 are very effective. The supporting factors in electronic events include electronic event support facilities such as electronic media such as smartphones and PCs / laptops, internet networks, having active e-mail and telephone / whatsapp numbers, public awareness of the importance of electronic events and the importance of having the ability to use electronic media. The inhibiting factor of electronic events is the internet network, lack of technological knowledge. Analysis of the impact of the implementation of e-court this research is that the Parepare Religious Court as much as possible conducts socialization about e-court and its features to the community so that the use of e-court in the future can increase.

Abstract

This study examines the implementation of the Compilation of Islamic Law (KHI) in child care practices in Barru Regency, focusing on Article 77(3) concerning parental obligations to nurture and care for children from the perspective of maqāṣid al-sharī‘ah. Using a descriptive qualitative approach, the research draws on primary data from working parents in Barru District and secondary data from relevant studies. The analysis employs policy implementation theory and maqāṣid al-sharī‘ah. The findings reveal three predominant parenting models among dual-income families—direct, delegative, and participatory—each aligned with maqāṣid principles. The implementation of Article 77(3) is influenced by five key factors: limited understanding of KHI provisions, spousal communication and relations, time constraints and work demands, religious and local cultural values, and emotional stability within the household. Couples adopt seven main strategies to fulfill these obligations, including flexible role-sharing, spiritual guidance through daily worship, emotional communication, exemplary conduct, collaboration with third parties during work hours, adaptive parenting based on children’s needs, and open communication between spouses.

Abstract

This study aims to analyze the legal status in Islam regarding dowry and panaik money in Limpomajang Village, Marioriawa District, Soppeng Regency. In the process of collecting data, the writer used the method of observation and interviews with the village head, religious leaders, community leaders and youth leaders. In various sources found by the author, both the Quran, hadiths and the opinions of scholars, dowry is a gift that must be fulfilled and submitted by the prospective groom to the prospective bride, namely in the form of goods or services that have value and benefit, usually in the form of rings gold, rice fields, gardens and a set of prayer tools. Meanwhile, panaik money is the giving of a certain amount of money from the prospective groom to the prospective bride as a walimah fee. Dowry and Panaik money still exist and are used as conditions for marriage in Limpomajang Village, Marioriawa District, Soppeng Regency. Islamic law views that a dowry is a legal condition of marriage as the author finds in the Alquran and the Hadith of the Prophet. Meanwhile, panaik money is not found in various references to both the Quran and the Hadith of the Prophet, but only historical evidence so that it becomes a tradition and custom in society. It is known that religion forbids making it difficult for a marriage to take place, but panaik money is a heavy burden for men. Seeing the large amount of panaik money, it can bring harm or something bad for a marriage. So the authors conclude that panaik money is makruh and even haram when the method of obtaining panaik money is not in accordance with Islamic law.

Abstract

This study examines how blind couples in Manado, Indonesia, cultivate a sakinah family life that is serene and harmonious despite visual impairment. Using a qualitative case study design, the research engaged four married couples with varying degrees of blindness through semi-structured interviews, non-intrusive observation of daily routines, and brief document reviews. Reflexive thematic analysis identified three interlocking processes of family resilience that anchor these households: (1) meaning making, in which Islamic virtues such as ṣabr (patience), shukr (gratitude), and tawakkul (trust in God) regulate emotion, guide decisions, and sustain hope; (2) communication, marked by de escalation strategies, turn-taking when one spouse is upset, and the creative use of auditory and tactile cues for coordination; and (3) organization, featuring adaptive role-sharing based on actual capacity and health rather than rigid gender prescriptions. Surrounding these processes is a multilayered social infrastructure of support that ranges from kin and neighbors to mosque communities and disability organizations, supplemented by voice-based technologies and informal income strategies. This article presents an operational mapping of sakinah indicators to observable family outcomes, clarifies how paid versus unpaid proximal assistance functions in practice, and shows how faith-informed coping integrates with disability-inclusive support. Policy implications include designing family programs that are both disability-aware and religion sensitive, strengthening local networks that enable independent living, and recognizing flexible caregiving arrangements within households headed by persons with disabilities.
