Abstract

Abstract

This study aims to determine the extent of the financial literacy of the Muslim community in Ponorogo and their loyalty to the bank interest fatwa. This paper uses a field research approach using data collection methods in the form of interviews and observations and the analysis techniques used are descriptive-inductive. Based on the analysis of the data obtained, the following conclusions were found: 1. The perception of Ponorogo Muslims is divided into no types, namely agreeing with bank interest fatwas, doubting the existence of bank interest fatwas, and ignoring the provisions of bank interest fatwas. 2. The factors influencing the observance of Ponorogo Muslims are classified into 2 categories, namely those who obey which are divided into observance based on religious values (obedience) and obedience based on religious-rational considerations (internalization observance). Then those who disobey are caused because their legal awareness is still very weak, the causative factor is the nature of the fatwa itself and some of the following: (a) There is still difficult access to Islamic banking in their area; (b) Islamic bank services that tend to be the same as conventional banks; (c) Conventional banks and Islamic banks are practically considered to be no different, both of which have not adhered to sharia principles; 3. By behavioral finance analysis, it is found that (a) Those who agree with fatwas based on religious-rational values are not found any element of bias in them. (b) who doubts that there is an element of bias in the form of overconfidence with the initial information so as not to follow the development of the next information (bias anchoring). And those who ignore fatwas have no element of bias in them because they are supported by the fact that bank interest fatwas have no significant effect on the provisions of fatwas.

Abstract

The current measurement of the performance of Islamic banks is more on financial performance. Islamic banks have two significant roles different from conventional banks: business and social. Financial performance evaluates the business role of Islamic banks. Meanwhile, the social role of Islamic banks has not yet received an equal portion of the measurement. This article proposes an Islamic bank performance measurement system based on Sharia economic goals. This formulation is necessary to adjust the performance assessment of Islamic banks based on Islamic economic goals. By using content analysis, this research used the contemporary Maqasid al-sharia approach. To formulate a measurement of the Islamic bank performance based on the roles and objectives of Islamic economics, contemporary maqasid al-sharia was employed as the construction basis. Based on the contemporary maqasid al-sharia, the Islamic bank's performance formulation can be broken down. Then, factors in assessing Islamic bank performance can be determined on financial and social aspects. Thus, Islamic banks are in line with the goals of Islamic economics, fighting for justice and the welfare of the community (falah), the objectives of sharia (maqasid al-sharia), and the primary goal of Islamic law (masalih al-'ibad).

Abstract

This study aims to analyze public perceptions of the existence and role of Islamic Rural Banks (BPR Syariah, BPRS) in the Islamic financial system, with a case study of BPRS al-Mabrur Ponorogo. This study highlights the factors that influence public trust, the level of service utilization, and the challenges faced by BPRS in increasing sharia financial inclusion. The research method used is a descriptive-qualitative approach with data collection techniques through interviews, observations, and document studies. The results showed that the community has a positive view of the sharia principles applied by BPRS, but there are still limitations in financial literacy and service accessibility. The main factors that encourage community participation are transparency, product halalness, and ease of access to financing. This study recommends improving sharia financial education and optimizing marketing strategies so that BPRSs are more competitive and inclusive in serving the community.

Abstract

This study examines the extent to which qardh contracts in Indonesian Islamic banking align with the higher objectives of shariah (maqasid) as conceptualised in Jasser Auda’s systems-based framework. The research addresses a gap in the existing literature, where qardh is often analysed in terms of legal-formal compliance without a critical assessment of its multidimensional ethical and social functions. The research adopts a qualitative-normative approach, utilising library research to analyse primary sources from classical fiqh, Qur’anic verses, hadiths, fatwas, and relevant regulatory texts, as well as secondary scholarly literature on qardh and Maqasid al-Shari'ah. Jasser Auda’s multidimensional maqasid framework serves as the primary analytical tool. The study reveals a significant disparity between the ideal concept of qardh as a benevolent, non-profit financial instrument and its current implementation in Indonesia, which frequently includes administrative charges, restrictive eligibility criteria, and limited outreach. Through Auda’s systems approach, the research demonstrates that properly designed qardh contracts can fulfil five maqasid dimensions: protection of wealth (equitable resource access), protection of life (emergency aid), protection of intellect (educational funding), protection of lineage (family economic support), and protection of religion (ethical lending). This study offers a conceptual reform model for aligning qardh practices with maqasid-oriented policies and product designs. It advances Islamic finance scholarship by shifting the discourse from procedural compliance toward holistic socio-economic transformation, positioning Islamic banking as a genuine instrument for justice and inclusion in Indonesia.

Abstract

Purpose – This article examines the disparity in judges' reasoning in the determination of children born out of wedlock in the Religious Court environment, with an emphasis on how judges build legal reasoning when facing the tension between administrative needs and sharia-based justice. This research aims to shift the focus of analysis from the decision's results alone to the reasoning structure that shapes the decision and its implications for legal clarity and child protection. Design/methods/approach – This study uses a normative juridical approach with a comparative case study of the three determinations of the Ponorogo Religious Court. Data were obtained from decision documents, classical and contemporary fiqh literature, and a limited number of interviews with judges. The analysis was carried out using the framework of legal pluralism, judicial discretion, and legal reasoning to capture the interaction of various norm systems in judicial practice. Findings – The results of the study show that the disparity is more attributable to differences in judges' reasoning than to differences in decision outcomes. These variations form a spectrum of approaches that reflect different degrees of integration between state law, fiqh principles, and practical considerations. The level of elaboration of legal implications, especially regarding nasab, inheritance, and guardianship, affects the clarity of the law and the decision's educational function. Research implications/limitations – This study confirms the importance of analyzing judges' reasoning in Islamic family law, but it is limited by the number of cases and specific locations. Further research can expand the scope through a comparative or socio-legal approach. Originality/value – This article offers a typology of judges' reasoning as an analytical contribution to understanding the disparity of judgments, showing that this disparity is a manifestation of legal pluralism and judicial discretion, and emphasizing the importance of the educational function of judgments in bridging state law and Islamic law.
