Abstract

Indonesia merupakan negara hukum. Hal ini dicantumkan pada pasal 1 Ayat 3 Undang - Undang Dasar 1945 yang berbunyi “Negara Indonesia adalah negara hukum". Atas dasar hal tersebut, maka setiap kegiatan apapun di masyarakat pastilah memiliki hukum yang mengatur hal tersebut baik hal negatif maupun hal positif. Negara hukum yang baik merupakan negara yang menjamin hukum berlaku untuk kedamaian warga negaranya. Dalam penelitian ini bertujuan untuk mengetahui implementasi hukum pada aksi kejahatan Klitih yang ada di Yogyakarta. Sebagaimana yang kita ketahui, aksi kejahatan klitih adalah salah satu kejahatan yang marak terjadi di Yogyakarta dimana para pelakunya tidak segan untuk menghabisi nyawa korban yang dituju. Menurut beberapa sumber bacaan, aksi kejahatan klitih bukanlah hal baru di Yogyakarta, aksi kejahatan klitih sudah ada sejak 1990-an yang didominasi oleh segerombolan anak remaja. Banyak dampak negatif yang terjadi pada aksi kejahatan klitih ini yang salah satunya adalah menimbulkan kekerasan terhadap seseorang yang bahkan sampai meregang nyawa seseorang. Keresahan warga akan semakin meningkat apabila aksi kejahatan klitih ini terus berlangsung dan eksis hingga saat ini. Adapun implementasi yang dilakukan pemerintah dalam memberantas aksi kejahatan klitih ini dengan basis collaborative governance sebagai upaya menangani dan membimbing para pelaku dan calon pelaku untuk menjadi pribadi yang lebih baik lagi dan meninggalkan kesesatan yang mengakibatkan adanya tindak kriminal. Implementasi hukum disini bertujuan untuk membuat para pelaku dapat jera terhadap kejahatan yang mereka lakukan serta aksi kejahatan klitih tersebut dapat segera ditangani dengan baik.

Abstract

Kebakaran hutan dan lahan menjadi salah satu hal yang paling sering kita dengar kejadiannya terutama di Kalimantan. Penelitian ini bertujuan untuk mengetahui alasan bencana kebakaran hutan dan lahan (karhutla) yang sering terjadi di Kalimantan, bagaimana pemerintah menanganinya, dampak serta konsekuensi bencana tersebut bagi masyarakat. Kebakaran hutan dan lahan tentunya sangat memberikan dampak yang besar baik bagi manusia, tumbuhan, hewan, udara, dan berbagai komponen pendukung yang ada di dalam kawasan tersebut. Penelitian ini menggunakan metode normatif yang dimana dalam penelusuran data dan informasinya melalui sumber data tertulis yang telah ada. Proses pengumpulan data dilakukan dengan menggunakan kata kunci yang relevan dan mencakup verifikasi serta evaluasi sumber informasi untuk memastikan keandalan data. Dengan demikian, penelitian ini memberikan gambaran menyeluruh mengenai permasalahan kebakaran hutan dan lahan di Kalimantan serta menawarkan rekomendasi bagi peningkatan efektivitas penanganan dan pencegahan di masa mendatang.

Abstract

The purpose of this study is to examine the sociological conditions of the HGU conflict, and to analyze the need for the establishment of an Agrarian Court from a legal and social aspect. The method used in this study is the Sociolegal method, which combines law with social reality. Primary data was taken from interviews with farmers, residents affected by HGU, BPN officials, Secondary data was obtained from laws and regulations, court decisions, NGO reports, land documents. Mesuji Regency is an area in Lampung Province which is known as one of the chronic agrarian conflict areas in Indonesia, especially those involving the Right to Cultivate (HGU) by large plantation companies including PT Barat Selatan Makmur Investindo (BSMI) and PT Silva Inhutani. This conflict involves local communities and companies holding HGU. The root of the problem is the community's claim to customary land, cultivated land, or inherited land. Allegations of HGU expansion that exceed the permit limit. The conclusion of this study is that the resolution process is often ineffective, unfair, and slow. HGU conflicts are generally structural in nature, because they involve inequality between local communities and large corporations that receive legal legitimacy through the granting of HGU. The establishment of an Agrarian Court has the potential to be a more just, effective, and contextual solution to resolving plantation HGU conflicts.

Abstract

  Transformasi digital dalam sektor pemerintahan menjadi salah satu langkah strategis untuk meningkatkan efisiensi dan transparansi layanan internal. Dinas Kesehatan Kota Semarang menerapkan sistem digital dalam pengelolaan kendaraan dinas melalui aplikasi NAVARA (Layanan Service Kendaraan Operasional Dinas Kesehatan). Penelitian ini bertujuan untuk mengevaluasi implementasi aplikasi NAVARA dalam meningkatkan efisiensi pemeliharaan kendaraan dinas dan menciptakan transparansi penggunaan anggaran. Metode penelitian yang digunakan adalah deskriptif kualitatif dengan pendekatan studi kasus melalui analisis data penggunaan aplikasi, wawancara, dan observasi. Hasil menunjukkan bahwa NAVARA mampu mengintegrasikan berbagai fitur seperti riwayat servis, pengajuan perawatan, dan pelaporan kondisi kendaraan secara real-time. Selain mempercepat proses pelayanan, NAVARA juga mendorong akuntabilitas melalui pelacakan digital dan kerja sama dengan bengkel resmi. Namun, beberapa kendala seperti error sistem, keterbatasan server, dan kurangnya literasi digital pengguna menjadi tantangan yang harus diatasi. Kesimpulannya, NAVARA merupakan inovasi digital yang efektif dan berkontribusi signifikan terhadap efisiensi dan transparansi pengelolaan kendaraan dinas.

Abstract

The principle of non-intervention is the main foundation in international relations that affirms the prohibition of interference by other countries in the domestic affairs of a country. However, increasingly complex global dynamics, especially related to the increasing humanitarian crises such as genocide, ethnic cleansing, and systematic human rights violations have raised serious challenges to the absolutism of the principle. This article aims to analyze how the principle of non-intervention is normatively reinterpreted in the practices and actions of the United Nations (UN), especially through the Responsibility to Protect (R2P) doctrine. Using a juridical-normative approach and case studies of interventions in Rwanda, Kosovo, and Syria, this study reveals a shift in the meaning of non-intervention from an absolute prohibition to a limited allowance for humanitarian protection. This finding confirms that in conditions of extreme humanitarian crises, the legitimacy of international action is not only measured by state sovereignty, but also by the moral and international legal obligations to protect civilians. The UN, as a multilateral actor, plays a key role in balancing the principle of non-intervention with humanitarian imperatives, thus giving rise to dynamic and contextual normative reinterpretations.

Abstract

Dalam era revolusi teknologi, pelayanan publik semakin mengalami transformasi signifikan untuk memenuhi tuntutan masyarakat yang semakin kompleks. Artikel ini membahas inovasi teknologi yang diimplementasikan oleh Dinas Komunikasi, Informatika, Statistik, dan Persandian Kota Semarang (Diskominfo Kota Semarang) dengan fokus pada menciptakan pelayanan yang ramah pengguna, menyederhanakan interaksi dengan pemerintah, dan memastikan partisipasi aktif masyarakat. Tujuan penelitian ini, mengidentifikasi bagaimana tingkat ketersediaan informasi publik di Kota Semarang melalui layanan yang disediakan oleh Diskominfo Kota Semarang, menjelaskan sejauh mana Diskominfo Kota Semarang memanfaatkan teknologi informasi untuk meningkatkan efisiensi dan efektivitas pelayanan publik dan bagaimana keterkaitan antara inovasi teknologi dalam pelayanan tersebut dengan prinsip-prinsip hukum administrasi negara, seperti keadilan, kepastian hukum, dan perlindungan hak-hak warga. Analisis ini juga mempertimbangkan aspek-aspek hukum administrasi negara, seperti keadilan, kepastian hukum, dan perlindungan hak-hak warga, untuk menyoroti keterkaitan yang erat antara inovasi teknologi dan prinsip-prinsip administrasi publik yang berkeadilan. Ketiga bentuk layanan masyarakat ini sangat didukung oleh pemerintah sehingga dalam pelaksanaannya terdapat hukum yang mengatur dan mendasari layanan tersebut diantaranya Peraturan Daerah Kota Semarang Nomor 4 Tahun 2021 tentang Tata Cara Pembentukan Produk Hukum Daerah, Undang-Undang Republik Indonesia Nomor 14 Tahun 2008 tentang Keterbukaan Informasi Publik, Peraturan Pemerintah Republik Indonesia Nomor 61 Tahun 2010 tentang Pelaksanaan Undang-Undang Nomor 14 Tahun 2008, Peraturan Menteri Dalam Negeri Nomor 3 Tahun 2017 tentang Pedoman Pengelolaan Pelayanan Informasi dan Dokumentasi Kementerian Dalam Negeri dan Pemerintah Daerah, Undang-Undang Republik Indonesia Nomor 25 Tahun 2009 tentang Pelayanan Publik.

Abstract

Indonesia is the fourth-highest country with a level of population density that will undoubtedly cause many problems, one of which is the problem related to unemployment that is increasingly increasing. Therefore, the Government then took the initiative to issue a law that can pioneer job creation, ease of effort, investment, and empowerment of small micro-businesses. Focus on the actions of youth in making investments then whether this Job Creation Law also provides adequate protection for entrepreneurs, especially MSME entrepreneurs. MSME entrepreneurs need legal protection because most do not understand the Law in Indonesia and cannot afford to hire legal counsel or lawyers. The protection guaranteed by the Government makes MSME actors immensely helped. This research seeks to examine the application of Job Creation Law to Micro Small, Medium Enterprises (MSMEs). So that it is expected to make a positive contribution in formulating a system of legal protection that is in accordance and sustainable in harmony with the Business, Micro, Small, Medium Law (MSMEs) as well as laws related to investment and the 1945 Constitution as the basis of the Indonesian state, the research will be conducted with field research into locations that the author considers relevant to the issues raised. Such an approach is expected to support the validity of the study results as sound output. Protection for MSMEs along with increasing investment. On the other hand, the Tegal Regency Government has implemented several measures. The Tegal Regency Government is assisted by the DPMPTSP, the Industry and Manpower Service, and the Trade, Cooperatives, and MSMEs Service to help each other provide guidance related to business legality. These agencies also have internal efforts to help each other manage business legality in Tegal Regency. According to Shinta, as the owner of the Bolen Nyempluk business, it is pretty easy, one of which is for PIRT permits for food businesses that can be accessed by the Disperindagkop which collaborates with the DPMPTSP, even for product packaging, recommendations, and provisions are also provided by the Disperindagkop. In providing assistance and legal assistance services, PP No. 7 of 2021 also states that in certain emergency conditions, the Central and Regional Governments must seek MSME recovery by doing several things such as credit restructuring, business reconstruction, financial assistance, and providing services in other forms. In addition, Article 54 of Government Regulation Number 7 of 2021 also mandates that the Central and Regional Governments play an active role in providing protection and security to maintain the competitiveness of MSME products in the domestic market. To increase product competitiveness, the Ministry of Industry and Manpower also includes training and coaching to business actors, and this training activity also involves business actors and prospective business actors. Providing access to this license certainly makes people interested in having their own business because the licensing process is more straightforward, but they still get coaching.

Abstract

Workers with disabilities in Indonesia continue to encounter deep and multifaceted barriers in entering and sustaining participation in the formal labor market because the implementation of national regulations that guarantee equal employment rights, workplace accessibility, and protection from discrimination remains inconsistent with the expectations set by existing legal frameworks, creating a significant gap between the normative commitments contained in disability and labor legislation and the realities experienced in workplaces that often underestimate the capabilities of disabled workers, maintain persistent social stigma, and fail to provide adequate facilities and organizational policies that support their effective participation. This study aims to explain the reasons why these barriers persist by examining how weak oversight, limited understanding among employers, inadequate workplace accessibility, minimal use of assistive technology, and the absence of strong incentive and sanction systems collectively undermine the objectives of disability inclusion policies. The findings reveal that companies often disregard hiring quotas, government institutions lack the capacity to enforce compliance, workplaces remain largely inaccessible, and small and medium-sized enterprises struggle to adopt inclusive practices due to resource limitations and insufficient technical guidance. In contrast, multinational companies that have implemented structured facilities, flexible work arrangements, and targeted training demonstrate that inclusion can operate effectively when supported by organizational commitment. Based on these findings, the study recommends strengthening institutional coordination, improving employer education on disability rights, expanding vocational and skills-based training tailored to various types of disabilities, enhancing accessibility facilities in workplaces, and providing clear and practical guidelines for companies of different sizes so they can adjust work environments, tasks, and policies in ways that allow workers with disabilities to participate more fully and sustainably in Indonesia’s labor market.
