Abstract

Perkembangan teknologi informasi telah mendorong transformasi digital dalam berbagai sektor pemerintahan, termasuk dalam bidang penataan ruang. Salah satu bentuk transformasi tersebut adalah penerapan Rencana Detail Tata Ruang (RDTR) Digital yang berfungsi sebagai instrumen pengendalian pemanfaatan ruang sekaligus dasar dalam penerbitan Kesesuaian Kegiatan Pemanfaatan Ruang (KKPR). Penelitian ini bertujuan untuk menganalisis peran RDTR Digital dalam mewujudkan kepastian hukum KKPR di tengah percepatan perizinan berusaha di Indonesia. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan peraturan perundang-undangan dan pendekatan konseptual melalui studi kepustakaan. Hasil penelitian menunjukkan bahwa RDTR Digital berperan penting dalam memberikan kepastian hukum terhadap pemanfaatan ruang melalui penyediaan informasi zonasi yang lebih akurat, transparan, dan mudah diakses. Integrasi RDTR Digital dengan sistem Online Single Submission Risk-Based Approach (OSS-RBA) juga mampu mempercepat proses verifikasi kesesuaian ruang dan mendukung efektivitas pelayanan perizinan berusaha. Namun demikian, implementasi RDTR Digital masih menghadapi berbagai tantangan, seperti belum meratanya ketersediaan RDTR di daerah, keterbatasan kualitas data spasial, serta perlunya penguatan koordinasi antarinstansi dan kapasitas sumber daya manusia. Oleh karena itu, diperlukan upaya optimalisasi melalui percepatan penyusunan RDTR Digital, peningkatan kualitas data spasial, serta penguatan integrasi sistem tata ruang dan perizinan agar kepastian hukum pemanfaatan ruang dapat terwujud secara efektif.

Abstract

This study examines the legal integration between agrarian law and spatial planning law in controlling land-use conversion in Indonesia, focusing on the regulatory disharmony between Law Number 5 of 1960 concerning Basic Agrarian Principles and Law Number 26 of 2007 concerning Spatial Planning. The research aims to identify the forms of normative disharmony, analyze their implications for land-use control, and formulate an integrative legal harmonization model. This study employs a normative juridical method using statutory, conceptual, and case approaches through the analysis of legislation, legal doctrines, and judicial decisions. The findings reveal that regulatory disharmony originates from fragmented legal norms, sectoral institutional arrangements, and the absence of an integrated normative framework linking land administration with spatial planning, resulting in horizontal and vertical conflicts of norms that undermine legal certainty in controlling land-use conversion. The study further finds that systematic and teleological legal interpretation provides the basis for reconstructing legal integration through a Model of Integrative Harmonization of Agrarian and Spatial Planning Law, which connects the social function of land, spatial conformity, and institutional coordination within a unified legal framework. This model constitutes the principal novelty of the research by offering a normative framework for strengthening legal integration and promoting sustainable land governance in Indonesia

Abstract

ABSTRACT Tidal flooding (rob) in Semarang has evolved into a persistent and complex environmental problem, reflecting the interaction between climate change impacts and weaknesses in environmental governance. This phenomenon is not only caused by natural factors such as sea level rise, but is also significantly influenced by anthropogenic activities, including land subsidence due to excessive groundwater extraction, uncontrolled coastal development, and inadequate spatial planning. As a result, tidal flooding has generated serious social, economic, and ecological consequences for coastal communities. This study aims to analyze environmental legal liability for tidal flooding in Semarang within the framework of legal protection, while also examining its relevance to the Sustainable Development Goals (SDGs), particularly Goal 13 on Climate Action. This research employs a normative legal method using statutory, conceptual, and case approaches to evaluate environmental regulations, legal doctrines, and principles of liability. The findings indicate that environmental legal liability remains weak due to regulatory fragmentation, lack of institutional coordination, and ineffective law enforcement. Preventive instruments such as environmental permits and spatial planning regulations have not been optimally implemented, while repressive measures remain limited. Furthermore, the absence of a clear and integrated liability framework contributes to legal uncertainty and weak accountability among stakeholders. This study concludes that strengthening environmental legal liability through integrated regulations, adaptive governance, and consistent law enforcement is essential to support climate action and ensure effective legal protection against tidal flooding in Semarang City. Abstract

Climate change represents one of the most pressing environmental challenges facing Indonesia today. Its consequences extend beyond ecological dimensions, encompassing complex legal, social, and economic implications. This research aims to analyze the extent to which Indonesian positive law provides legal protection to the environment against the impacts of climate change, and to examine how such a legal framework aligns with the principles of the Sustainable Development Goals (SDGs), particularly SDG 13 on climate action. The findings reveal that although Indonesia has established a comprehensive legal framework — including Law No. 32 of 2009 on Environmental Protection and Management, the ratification of the Paris Agreement through Law No. 16 of 2016, and various implementing regulations — its enforcement and implementation continue to face considerable obstacles. Synchronization between national regulations and international commitments such as the SDGs and Nationally Determined Contributions (NDC) remains suboptimal, largely due to weak institutional capacity, overlapping authority, and prevailing economic interests. This study underscores the urgent need to strengthen environmental law in a manner that upholds sustainable development principles, intergenerational equity, and the integration of climate justice into Indonesia's judicial system.

Abstract

Industrial development in Indonesia has had a positive impact on economic growth and national development, but on the other hand, it has also given rise to various forms of environmental pollution due to poor industrial waste management. Air, water, and soil pollution from industrial activities show that environmental protection still faces various challenges, particularly in environmental oversight and law enforcement. This study aims to analyze environmental permit regulations as an instrument for preventing pollution from industrial activities in Indonesia, analyze issues in environmental permit enforcement, and analyze efforts to optimize environmental permit enforcement in support of the Sustainable Development Goals (SDGs). This study uses normative legal research methods with legislative and conceptual approaches. The results show that environmental permits have a preventive function in preventing environmental pollution through the AMDAL (Environmental Impact Assessment) and UKL-UPL (Environmental Management and Monitoring) mechanisms. However, the effectiveness of environmental permit enforcement still faces various obstacles, such as weak oversight, low business compliance, inconsistent application of administrative sanctions, low public participation, and changes in licensing policies after the Job Creation Law that could potentially weaken environmental protection functions. Therefore, it is necessary to strengthen environmental oversight, implement strict sanctions, increase transparency in licensing, and optimize public participation to realize sustainable development and effective environmental protection.

Abstract

Sungai Citarum merupakan sumber kehidupan bagi lebih dari 27 juta jiwa, namun menghadapi persoalan pencemaran sampah plastik yang belum terselesaikan meski berbagai regulasi telah diterbitkan. Peraturan Presiden Nomor 15 Tahun 2018 tentang Percepatan Pengendalian Pencemaran dan Kerusakan DAS Citarum menjadi instrumen hukum utama melalui program Citarum Harum, namun berakhir pada Maret 2025 tanpa regulasi pengganti yang memadai, sehingga menimbulkan kekosongan hukum (vacuum of law). Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan konseptual untuk menganalisis kegagalan regulasi serta merumuskan rekomendasi kebijakan. Menggunakan kerangka teori efektivitas hukum Soerjono Soekanto, analisis menunjukkan kegagalan terjadi secara simultan pada empat dimensi: kelemahan substansi norma, disfungsi kelembagaan, lemahnya penegakan hukum, serta rendahnya kesadaran dan budaya hukum. Artikel ini merekomendasikan penguatan instrumen Extended Producer Responsibility, pembentukan lembaga otorita sungai yang permanen, dan penerbitan regulasi bersifat tetap sebagai pengganti Perpres. Langkah-langkah tersebut selaras dengan target SDG 6, 12, 14, dan 16 dalam mewujudkan pengelolaan lingkungan yang berkelanjutan

Abstract

Introduction: Housing injustice and homelessness are significant issues in Indonesia, especially for low-income, marginalized, and urban migrant populations. The lack of affordable housing, coupled with land disputes, eviction threats, and inadequate legal protections, exacerbates social inequalities and economic hardships.Purpose: This paper examines legal interventions designed to address housing injustice and homelessness, focusing on community-based approaches to strengthening legal rights in disadvantaged communities.Method: The research combines case studies of successful legal interventions in housing disputes with interviews from community leaders, legal professionals, and homeless individuals in urban areas.Findings and Results: The study finds that legal services are crucial in helping low-income communities secure affordable housing, challenge evictions, and protect their property rights. However, the lack of affordable housing policies and limited legal aid accessibility remain significant barriers.Urgency: The increasing number of homeless people and housing disputes in urban areas highlights the urgent need for stronger legal protections and policy reforms to address this crisis.Contribution: This paper contributes to the conversation on affordable housing and legal rights by demonstrating how community-driven legal initiatives can help mitigate the effects of housing injustice.Recommendation: The study recommends reforming housing policies, increasing the availability of legal aid services for marginalized communities, and prioritizing affordable housing development.
