Abstract

Iran's decision to close the Strait of Hormuz in response to United States economic sanctions has raised significant legal questions concerning the permissibility of such an action under international law. This study aims to analyze the legality of Iran's closure of the Strait of Hormuz from the perspective of International Law of the Sea and the principles of fiqh siyāsah dauliyyah. This research employs a normative legal research method using statutory and conceptual approaches. The legal materials consist of primary, secondary, and tertiary sources, which are analyzed qualitatively through library research and legal interpretation. The findings indicate that the closure of the Strait of Hormuz lacks legal justification under International Law because it contradicts the 1958 Convention on the Territorial Sea and the Contiguous Zone, the principle of pacta sunt servanda, the transit passage regime, and the Articles on Responsibility of States for Internationally Wrongful Acts (ARSIWA) 2001. From the perspective of fiqh siyāsah dauliyyah, such action also violates the principles of al-wafā' bi al-'aqd, lā ḍarar wa lā ḍirār, and maṣlaḥah mursalah , as it disregards the obligation to honor international agreements and causes widespread harm to the international community. This study concludes that both International Law of the Sea and fiqh siyāsah dauliyyah converge in considering the closure of the Strait of Hormuz as legally unjustifiable, demonstrating that both legal systems complement one another in providing normative legitimacy for the protection of international navigational freedom.

Abstract

Perkembangan teknologi digital telah mendorong lahirnya berbagai bentuk transaksi ekonomi berbasis internet, salah satunya adalah praktik arisan online menurun. Sistem arisan ini menerapkan perbedaan nominal pembayaran berdasarkan urutan pencairan dana, di mana peserta yang memperoleh giliran lebih awal diwajibkan membayar setoran lebih besar dibandingkan peserta yang memperoleh giliran akhir, meskipun seluruh peserta menerima nominal pencairan yang sama. Praktik tersebut menimbulkan berbagai persoalan hukum Islam, khususnya terkait indikasi riba nasi’ah, gharar (ketidakjelasan akad), serta potensi wanprestasi yang dapat menimbulkan kerugian bagi para pihak. Penelitian ini bertujuan untuk menganalisis kedudukan hukum praktik arisan online menurun dalam perspektif hukum Islam serta mengkaji mekanisme penyelesaian sengketanya berdasarkan prinsip-prinsip hukum ekonomi syariah. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan yuridis dan fiqh muamalah. Data diperoleh melalui studi kepustakaan terhadap Al-Qur’an, Hadis, Kompilasi Hukum Ekonomi Syariah (KHES), fatwa Dewan Syariah Nasional Majelis Ulama Indonesia (DSN-MUI), buku, jurnal ilmiah, dan berbagai literatur yang relevan. Analisis dilakukan secara kualitatif dengan mendeskripsikan praktik arisan online menurun yang berkembang di masyarakat, kemudian mengkajinya berdasarkan prinsip-prinsip hukum Islam. Hasil penelitian menunjukkan bahwa praktik arisan online menurun berpotensi mengandung unsur riba nasi’ah karena adanya tambahan manfaat ekonomi yang timbul akibat faktor waktu dalam perbedaan nominal pembayaran antar peserta. Selain itu, praktik tersebut juga berpotensi mengandung unsur gharar akibat ketidakjelasan akad, kurangnya transparansi pengelolaan dana, serta tingginya risiko wanprestasi dan penyalahgunaan dana oleh pihak tertentu. Dalam perspektif hukum Islam, sengketa yang timbul dalam praktik arisan online menurun pada prinsipnya diselesaikan melalui musyawarah (al-shulh), mediasi, dan arbitrase syariah (at-tahkim) sebagai bentuk penyelesaian nonlitigasi yang mengedepankan perdamaian. Apabila upaya tersebut tidak menghasilkan penyelesaian, sengketa dapat diajukan melalui jalur litigasi (al-qadha) untuk memperoleh kepastian hukum dan perlindungan terhadap hak-hak para pihak. Dengan demikian, praktik arisan online menurun perlu mendapatkan perhatian khusus karena berpotensi bertentangan dengan prinsip-prinsip hukum Islam. Oleh karena itu, diperlukan kejelasan akad, transparansi pengelolaan dana, serta pemahaman yang memadai mengenai hukum ekonomi syariah agar kegiatan arisan online dapat berjalan sesuai dengan nilai-nilai keadilan, kemaslahatan, dan kepastian hukum.

Abstract

This study examines the potential criminalization of sextortion victims under the application of Article 27 of the Indonesian Electronic Information and Transactions Law (EIT Law) from the perspective of Islamic criminal law. The background of this research is the increasing prevalence of sexually based cybercrime driven by technological development, where sextortion victims not only suffer from extortion and threats but also risk being treated as perpetrators of morality offenses due to the transmission or distribution of intimate content under coercion. This research employs a normative legal research method using statutory, conceptual, and comparative approaches between positive law and Islamic criminal law. The legal materials consist of primary, secondary, and tertiary sources analyzed through qualitative normative analysis. The findings indicate that Article 27 paragraph (4) of the EIT Law provides a legal basis for prosecuting sextortion as an electronic-based extortion and threat offense. However, the application of Article 27 paragraph (1) may lead to the criminalization of victims due to a formalistic interpretation that neglects coercion and psychological pressure. From the perspective of Islamic criminal law, sextortion victims cannot be held criminally responsible as they act under ikrah (coercion), and the offense is categorized as ta’zir, which places full responsibility on the perpetrator.

Abstract

Legal sovereignty in Indonesia places the 1945 Constitution as the highest norm, which is the basis for other legislation. In the legal hierarchy, PERPPU is an executive product issued based on presidential prerogative in times of urgent and compelling circumstances. This research aims to examine the position of PERPPU, especially PERPPU No. 2 of 2022, in the context of a compelling emergency in accordance with Article 22 paragraph (1) of the 1945 Constitution. This study uses quantitative and juridical-normative methods to explore the application of PERPPU in legal practice, taking into account the complexity of social phenomena and normative values, including doururiah in Islamic law. A multidisciplinary approach is applied, involving theories from figures such as Amartya Sen, John Locke, and Montesquieu, as well as the principles of the Rule of Law. Primary and secondary data were analyzed through document studies, semi-structured interviews and field observations. The research results show that PERPPU No. 2 of 2022 concerning Job Creation, which was issued as a response to urgent global economic conditions, fulfills the requirements of compelling urgency as mandated by the 1945 Constitution. However, the publication process raises concerns about subjectivity and potential abuse of power. The DPR's approval of the PERPPU represents a constitutional step in the right direction, but broader involvement of stakeholders and transparency of the process are essential to ensure fairness and compliance with the principles of the rule of law. PERPPU, as an instrument issued in urgent circumstances, must be managed strictly and only used as a last resort. The involvement of the DPR in the approval process is an important democratic control, but it must be carried out efficiently to avoid a legal vacuum. Transparency in the process of determining and evaluating compelling emergencies is critical to maintaining the integrity of the legal system and public trust. This research suggests the need for reform in PERPPU issuance procedures to ensure that each publication is based on objective and urgent needs, by avoiding broad interpretations that could lead to abuse of power.
