Abstract

Abstract This study aims to see the form of integration of Risalah al-Qadha as Islamic judicial principles and the principle of administering Indonesian Judicial Authority. This study uses a qualitative method with a descriptive approach to the analysis of the documents used in the study, namely Risalah al-Qadha and Law No. 48 of 2009 regarding Judicial Authority. This study argues that Indonesia's modern judiciary has undergone a transformation. One of this is the application of normative Islamic law to positive Islamic law. The judiciary (judiciary) functions to carry out all legal provisions consequently so as to create fair laws. Similarly, the importance of sulthah qadhaiyyah (judicial institution) is a necessity and an absolute condition that must be fulfilled. The contextualization of Islamic judicial principles which is manifested in the principle of administering Indonesian Judicial Authority in the principle of a free and impartial judiciary, the judiciary is democratic and equal in law and transparent.

Abstract

This study examines Ahmad Syafii Maarif’s (commonly known as Buya Syafii Maarif) views on gender equality, highlighting the distinctive aspects of his interpretation of religious texts, particularly regarding family and societal roles. Using a descriptive-critical methodology, the study reveals that Buya Syafii Maarif’s views on gender equality within the family emphasize justice, fairness, and respect for women’s rights, all rooted in Islamic principles. He argues that a correct interpretation of Islam supports equality between men and women, including within family relationships. A central aspect of his thinking is the concept of complementary roles between men and women, rejecting the idea of gender-based superiority. He critiques traditional views that confine women’s roles to the domestic sphere and advocates for greater female participation in decision-making and social contributions. Buya Syafii Maarif also challenges interpretations of religious texts that have historically justified gender inequality, asserting that the Qur’an promotes respect and cooperation between the genders. Education plays a key role in his vision, as he emphasizes its transformative power in empowering women to make significant contributions to both family and society. He advocates for equal opportunities for women in education and public life to foster a just and prosperous society. This study demonstrates that Buya Syafii Maarif's vision of gender equality reflects a balanced and just understanding of Islam, one that encourages cooperation and equality to achieve harmony in both the family and society.

Abstract

Marriages are required to be registered under the provisions of Law Number 1 of 1974, specifically Article 2. This registration plays a crucial role in establishing the legality of marriages and enables the utilization of different associated benefits. Meanwhile, unregistered marriages give rise to a range of legal issues, including uncertainties regarding lineage, concerns related to maintenance, and inheritance rights. In line with the Ministry of Home Affairs Regulation Number 109 of 2019 regarding Population Administration, couples involved have the option to obtain important documents such as the Population Identification Card (KTP), Birth Certificate, and Family Card (KK) by signing a Statement of Absolute Responsibility (SPTJM). This situation raises significant concerns regarding the legal implications of unregistered marriages. Therefore, this study aimed to employ an empirical legal approach with qualitative methods and obtained data through interviews, observations, and documentation. The data analysis used Miles and Huberman's method to uncover the meaning within Ministry of Home Affairs Regulation Number 109 of 2019 regarding Unregistered Marriages and unveiled the ambiguity in understanding the true meaning. Furthermore, a study conducted in Dharmasraya Regency in 2021 discovered the issuance of 69,144 Family Cards by the Directorate General of Population and Civil Registration, and 22,453 (32.47%) were unregistered marriages. Only 194 individuals applied for validation (isbat) within 3 years, where 101, 27, and 66 were accepted, rejected, and revoked, respectively. In conclusion, the community perceived their marriages to be legal due to the issuance of Ministry of Home Affairs Regulation Number 109 of 2019, even though the SPTJM did not legalize the concept or hold legal authority over the consequences.

Abstract

This article discusses the view of maqashid sharia with the theory of the Jasser Auda system approach to the implementation of the rules regarding marriage dispensation that apply in Indonesia. CATAHU (Annual Notes) Komnas Perempuan in 2020 notes that the dispensation of marriage (child marriage) is another thing that has an extreme threefold increase based on BADILAG data, namely from 23,126 cases in 2019, a sharp increase of 64,211 cases in 2020. This is because among others, of a pandemic situation such as the intensity of the use of gadgets and family economic problems as well as the amendment to the Marriage Law which increases the age of marriage to 19 years for women. The research method used is qualitative research methods, with the type of library research, data collection techniques through observation of secondary and primary data. Based on the results of the research conducted by the author, it can be concluded that the rules regarding the granting of permission for marriage compensation need to be reviewed so that it does not appear to facilitate the legalization of marriage, especially for child marriage.

Abstract

A Compilation of islamic law “Kompilasi Hukum Islam”, which was ratified through Presidential Instruction (or now decree) No. 1 of 1991, is a modern codification of Islamic individual and family law that becomes the standard of judges' reference in resolving cases in religious courts. One of the critical parts of KHI is inheritance, which is the main focus of this paper. The article on inheritance in KHI is interesting for further review because it has a different legal provision to fiqh or qanun. Through the study of libraries with a philosophical approach, this paper intends to analyze the provisions that become a barrier to inheritance from the perspective of Maqāṣid al-Sharia. This study shows that the obstacles to obtaining inheritance for reasons of persecution and slander, as mentioned in article 173 KHI, are some barriers to one obtaining inheritance that are not discussed as a barrier to inheritance in the classic fiqh book of severe persecution and slander. Through literature research, it is understood that the decree of persecution and slander is a barrier to inheritance in line with the Maqāṣid al-Sharia, namely to protect the soul (hifz al-nafsi), then guard the property (hifz al-māl) and further maintain self-respect (hifz al-'Ird) Thus. However, severe persecution and slander are not listed in classical Islamic jurisprudence as a barrier to inheritance. With the study of Maqāṣid al-Sharia, these two things are very appropriate to be applied in the rule of inheritance law, especially in Indonesia, so that these two acts cause very much harm to the victim (heir). “Kompilasi Hukum Islam”, yang disahkan melalui Instruksi Presiden No. 1 Tahun 1991, merupakan kodifikasi modern hukum perseorangan dan keluarga Islam yang menjadi standar rujukan para hakim dalam menyelesaikan perkara di pengadilan agama. Salah satu bagian penting KHI adalah kewarisan, yang menjadi fokus utama dalam tulisan ini. Pasal tentang waris dalam KHI menarik dikaji lebih lanjut karena memiliki ketentuan hukum yang berbeda dengan fiqh atau qanun. Melalui studi pustaka dengan pendekatan filosofis, tulisan ini bermaksud menganalisis ketentuan yang menjadi penghalang warisan dari perspektif Maqāṣid al-Syarī’ah. Hasil studi ini menunjukkan bahwa halangan mendapatkan warisan karena alasan penganiayaan dan fitnah, sebagaimana yang disebutkan dalam pasal 173 KHI terdapat beberapa penghalang seseorang mendapatkan hak waris yang tidak dibahas sebagai penghalang kewarisan dalam kitab fiqh klasik yaitu penganiayaan berat dan fitnah. Melalui penelitian kepustakaan, dipahami bahwa ketetapan penganiayaan dan memfitnah sebagai penghalang kewarisan sejalan dengan Maqāṣid al-Syarī’ah yakni yakni untuk menjaga jiwa (hifẓal-nafsi), kemudian  menjaga harta (hifẓal-māl) dan selanjutnya menjaga kehormatan diri (hifẓ al-‘Irḍ) Maka, sekalipun penganiayaan berat dan fitnah tidak tercantum dalam fiqh klasik sebagai penghalang kewarisan, namun dengan kajian Maqāṣid Syarī’ah, kedua hal ini sangat pantas diterapkan dalam aturan hukum waris, khususnya di Indonesia. Hal ini disebabkan karena dua perbuatan ini menyebabkan sangat banyak mudarat kepada korban (pewaris).

Abstract

The aim of this research is to describe the land ownership and utilization system in Nagari Koto Tangah and analyze the views of muamalah jurisprudence on the land ownership and utilization system in Nagari Koto Tangah. This research is field research (Field Research) with a qualitative descriptive approach. The view of muamalah jurisprudence in obtaining ownership of no-man's land carried out by the people of Nagari Koto Tangah does not fulfill one of the requirements, namely the presence of permission from the Imam or Leader. The management carried out is a form of Syirkah Inan, this form of syirkah is permitted, but the provisions for profit sharing in land management do not meet the provisions for profit sharing in syirkah inan.

Abstract

This study explores the practice of manjua julo-julo and provides an Islamic legal analysis of its implementation in Nagari Sungai Jambu, Pariangan District, Tanah Datar Regency. Employing a qualitative descriptive approach within field research, the primary data sources include four individuals directly involved in manjua julo-julo, while secondary data comes from three community leaders. The findings reveal that the manjua julo-julo practice within the community is categorized into two forms: first, julo-julo (labor exchanged for labor), and second, manjua julo-julo (labor exchanged for labor with the involvement of a third party). Prior to initiating agricultural cooperation, a mutual promise (wa'ad) is made among the farmer members involved in julo-julo and manjua julo-julo. These agreements utilize ijarah and shirkah contracts, specifically classified under syirkah abdan and ijarah. The practice of manjua julo-julo aligns with the principles of cooperation (syirkah) as it falls under shirkah abdan and meets the criteria for joint efforts, involving collaboration between rice field owners and workers. Furthermore, the implementation adheres to sharia principles, ensuring compliance with Islamic legal guidelines.

Abstract

This study seeks to explore the role of the political system in supporting the influence of macro variables on economic growth in the world's Islamic countries. Data obtained from the world bank during 2010-2021. The econometric model used in the research is the Generalized Method of Moments (GMM). The main finding is that the political system has a significant negative effect on growth. This negative effect is caused by the low value of the political index determined by world governance indicators. In addition, foreign direct investment and remittances are still the main variables in supporting economic growth in the Islamic countries of the world. In contrast, interest rates show negative effects on economic growth. Further results show that an ineffective political system is unable to strengthen the relationship between foreign direct investment, remittances, and interest rates on economic growth. These findings serve as an evaluation for the 2025 OIC internal implementation action program.AbstrakPraktik Rentenir masih banyak ditemukan di Kabupaten Tanah Datar, dengan berbagai alasan masyarakat masih banyak melakukan pembiayaan pada rentenir, perilaku ini menimbulkan banyak masalah dalam tatanan kehidupan sosial. Penelitian ini bertujuan untuk, pertama: melihat setting sosial maraknya praktik rentenir, kedua: menemukan program/langkah-langkah strategis yang dapat digunakan untuk mencegah maraknya praktik rentenir. Metode penelitian yang dipakai dalam penelitian ini adalah penelitian kualitatif, yaitu proses mencari data dan menyusun secara sistematis, data tersebut diperoleh dari hasil wawancara, catatan lapangan, maupun dokumentasi, dengan cara mengorganisasikan data ke dalam kategori, menjabarkan ke dalam unit-unit, melakukan sintesis, menyusun ke dalam pola, yang diakhiri dengan membuat kesimpulan, sehingga mudah dipahami oleh diri sendiri maupun orang lain. Penelitian yang menyimpulkan bahwa: pertama, Faktor-faktor yang mempengaruhi masyarakat melakkan pembiayaan kepada rentenir adalah karena adanya kebutuhan yang mendesak dan kebutuhan akan modal usaha. Kedua, Faktor-faktor yang melatarbelakangi masih maraknya praktik rentenir di Kabupaten Tanah Datar, yaitu: faktor ekonomi, faktor sosial, faktor informasi dan faktor kemudahan proses. Selanjutnya penelitian ini juga merekomendasikan langkah-langkah strategis pencegahan rentenir yaitu: memaksimalkan pelaksanaan program unggulan Makan Randang di Kabupaten Tanah Datar, mendirikan koperasi berbasis Nagari/Jorong/Komunitas di Kabupaten Tanah Datar dan melakukan pendampingan ekonomi kreatif untuk masyarakat di Kabupaten Tanah Datar.

Abstract

This study examines the provision of reproductive health services as stipulated in Article 103 Paragraph (4) Letter e of Government Regulation (PP) No. 28 of 2024, focusing specifically on the distribution of contraceptives to school-aged children and adolescents. The research investigates the background and rationale behind the issuance of this regulation and analyzes it through the lens of fiqh siyasah (Islamic political jurisprudence). Employing a qualitative normative approach, this study is based on library research by systematically reviewing relevant literature, including books, scholarly articles, journals, and official publications. The researcher acts as the primary research instrument.The findings suggest that the emergence of this provision is influenced by several urgent social issues: the rise in teenage promiscuity, high rates of abortion among adolescents aged 15–19, an increasing number of marriage dispensations due to premarital sexual activity, and efforts to reduce the transmission of sexually transmitted diseases (STDs), including HIV/AIDS. From the perspective of fiqh siyasah, the legality of contraceptive distribution depends on the marital status of the recipients. For married adolescents, the use of contraceptives is considered permissible. However, for those who are unmarried, it is deemed impermissible (haram) as it potentially facilitates or legitimizes acts of zina (adultery), which are prohibited in Islamic law.

Abstract

This research aims to examine the implications of the Constitutional Court’s decision regarding the exclusion of Irman Gusman from the Final Candidate List (DCT) for the West Sumatra Regional Representative Council (DPD) by the General Election Commission (KPU), which was deemed to have violated his constitutional rights. The study evaluates this ruling from the perspective of the legal ideals of certainty, justice, and utility, as well as from the standpoint of Siyasah Dusturiyyah (Islamic constitutional politics). Furthermore, it assesses the impact of the decision on the implementation of a re-vote (Pemungutan Suara Ulang, PSU) in West Sumatra. Using a normative legal method and a qualitative approach, the study offers a comprehensive analysis of Constitutional Court Decision No. 03-03/PHPU.DPD-XXII/2024 concerning the electoral dispute over the DPD seat in West Sumatra. The research relies on secondary data sources, including primary legal materials such as the Court's decision, the Qur’an and Hadith, the 1945 Constitution, and relevant electoral laws, along with secondary sources such as scholarly books, academic journals, and prior research. The findings reveal that the Constitutional Court’s decision upheld legal certainty by clarifying the legal process and safeguarding constitutional rights, particularly those of Irman Gusman. In terms of justice, the decision focused mainly on substantive justice by addressing his constitutional entitlements. However, the utility of the ruling remains limited. The decision prompted a re-vote in West Sumatra to rectify irregularities in the previous election process. Nevertheless, the re-vote faced various challenges, including logistical constraints and limited public acceptance. From the perspective of Siyasah Dusturiyyah, the decision reflects a perceived lack of leadership integrity, as it deemed Irman Gusman unqualified. According to the principles of Islamic jurisprudence, when confronted with two conflicting harms (mafsadat), the lesser harm should be chosen. In this context, holding a re-vote was considered a lesser harm than ignoring a binding court ruling.
