Abstract

Bersama bank daerah, Pemerintah Daerah Kota Pekalongan meluncurkan aplikasi layanan pembayaran pajak online yang mencakup pajak BPHTB. Dengan adanya layanan ini, wajib pajak, PPAT, dan petugas BKD dapat terhindar dari pertemuan tatap muka dan menghentikan kebocoran yang terjadi akibat kerja sama beberapa pihak agar pajak BPHTB yang dibayarkan bisa murah, meski tidak sesuai dengan harga. suatu transaksi yang terjadi di lapangan. Penelitian ini menggunakan metodologi penelitian hukum empiris. Spesifikasi penelitian penelitian ini bersifat deskriptif dan analitis. Literatur dan penelitian lapangan merupakan sumber data. Sebelum layanan E-BPHTB tersedia, PPAT harus mendatangi kantor badan keuangan daerah untuk memproses berkas dan pembayaran. Namun dengan tersedianya layanan E-BPHTB, prosesnya menjadi lebih mudah, cepat, hemat biaya, dan efisien. Begitulah perkembangan penerapan BPHTB jual beli tanah dan bangunan di Kota Pekalongan. Standar nilai patokan yang berfluktuasi, proses validasi yang lama jika BKD menolak nilai yang disarankan, dan masih adanya ketidakjujuran wajib pajak dalam mengungkapkan nilai transaksi sebenarnya di lapangan menjadi tantangan utama dalam penerapan E-BPHTB. Abstract Together with the regional bank, the Pekalongan City local government introduced an online tax payment service application that includes the BPHTB tax. In order to prevent any leakage that has occurred thus far, the service eliminates the need for taxpayers, PPAT, and BKD officers to interact in person. This is because multiple parties have collaborated to lower the paid BPHTB tax, despite the fact that it does not correspond with the transaction price that occurs in the field. This study use empirical legal research methodology. This study's research specifications are descriptive and analytical. Library and field research are sources of data. The evolution of BPHTB implementation on the sale and purchase of real estate in Pekalongan City: prior to the availability of the E-BPHTB service, the PPAT had to visit the regional financial agency's office to organize the necessary paperwork and payments; however, the E-BPHTB services expedite, simplify, and lower the cost of the process. The evolving value benchmark regulations, the lengthy validation process in the event that BKD rejects the suggested value, and the persistence of dishonest taxpayers supplying information about the true worth of the transaction in the field are the challenges encountered in the implementation of E-BPHTB.

Abstract

This study examines the innovation of land administration services through the Sentuh Tanahku application as part of the implementation of electronic land registration in Indonesia. Using a qualitative descriptive method and document analysis of regulations, official reports, and academic studies, this research evaluates the application’s integration with the Land Administration Computerization System (KKP), its user workflow, and the effectiveness of its implementation across different regions. The findings show that the application significantly enhances transparency, efficiency, and accountability in land services, particularly in urban areas with adequate digital infrastructure. However, challenges persist in regions with limited internet access and insufficient human resource capacity. Despite these obstacles, the acceleration of electronic certificate issuance and increasing user satisfaction indicate that Sentuh Tanahku plays a crucial role in driving the digital transformation of land administration. The study highlights the need for equitable infrastructure development, improved human resource readiness, and further optimization of application features to support nationwide implementation of electronic land services.

Abstract

Gunungkidul Regency is one of the regions that has experienced significant growth in the tourism sector in the last two decades. The beauty of the karst landscape, underground caves, and the series of southern beaches are major attractions for both domestic and international tourists. Amidst this development, challenges arise in managing space that balances economic interests and environmental preservation. The use of space for tourism purposes is often inconsistent with established spatial plans, resulting in conflicts over spatial use, damage to karst ecosystems, and shifts in the function of protected areas. This study aims to critically examine theories and approaches to spatial planning and evaluate the extent to which these approaches are applied in sustainable tourism development in Gunungkidul Regency. The approach used is a juridical-sociological one, examining the relationship between spatial planning legal norms and empirical conditions in the community. Data collection techniques were carried out through interviews with policymakers and tourism actors, direct observation of tourism development locations, and literature studies of planning documents such as the RTRW (Regional Spatial Plan), RDTR (Regional Spatial Plan), and regional regulations. The results show that the spatial planning approach that has been applied to date tends to be top-down and technocratic, thus lacking the involvement of local communities as the primary subjects of development. Mismatches between planning and implementation persist, particularly in the form of zoning violations and weak oversight of land use conversion.

Abstract

South Papua Province, as a newly established autonomous region, urgently requires basic infrastructure, particularly housing for Civil Servants (ASN), to support the smooth operation of government administration. One sustainable solution to address urban land limitations is the construction of vertical housing or apartment buildings (Rusun). This study aims to analyze the strategic role of apartment housing for civil servants in South Papua and examine the legal framework as well as socio-spatial implications of vertical housing development. The research employs a normative juridical method with a qualitative approach, focusing on library research of statutory regulations and legal doctrines on apartment housing, along with official documents related to the construction of ASN Rusun. The findings reveal that state-owned apartment housing plays a crucial role in achieving equitable development, improving the welfare of civil servants, and ensuring efficient governance. The legal framework under the Apartment Law emphasizes collective ownership rights, professional management, and legal certainty of ownership. The development strategy of ASN apartments in South Papua reflects strong collaboration between central and local governments in addressing housing challenges in a newly established province.

Abstract

Konflik agraria masih menjadi isu besar di Indonesia karena kepemilikan tanah yang tidak jelas, pengelolaan lahan yang buruk, dan kurangnya perlindungan hukum. Pendaftaran tanah penting karena membantu memastikan hak-hak atas tanah masyarakat jelas dan terlindungi, baik bagi masyarakat maupun pemerintah. Dengan mencatat detail pertanahan secara benar, hal ini membantu mencegah perselisihan dan membuat kepemilikan lebih dapat diandalkan. Studi ini mengkaji pentingnya pendaftaran tanah dalam menghentikan konflik agraria dengan menggunakan metode berbasis hukum dan konsep. Studi ini menunjukkan bahwa pendaftaran tanah bukan hanya tentang dokumen penting untuk menciptakan ketertiban dalam pemanfaatan lahan, mewujudkan keadilan yang lebih adil, dan membantu negara berkembang secara berkelanjutan. Oleh karena itu, mempercepat pendaftaran tanah, memperbaiki peraturan perundang-undangan, dan melibatkan masyarakat merupakan langkah-langkah penting untuk mengurangi konflik agraria di Indonesia.

Abstract

Pendaftaran tanah merupakan cara penting untuk memastikan dan melindungi hak atas tanah sesuai dengan prinsip hukum agraria Indonesia. Namun, dalam penerapannya, proses pendaftaran tanah masih menghadapi berbagai hambatan hukum yang mempengaruhi keabsahan, akurasi, dan kelanjutan data tanah. Penelitian ini bertujuan untuk mengetahui faktor-faktor yang menghambat proses pendaftaran tanah serta menawarkan solusi hukum untuk meningkatkan kualitas penyelenggaraan pendaftaran tanah di Indonesia. Penelitian ini menggunakan metode yuridis normatif dan empiris dengan menganalisis peraturan perundang-undangan, studi literatur, serta evaluasi pelaksanaan kebijakan pertanahan. Hasil penelitian menunjukkan adanya beberapa hambatan hukum dalam proses pendaftaran tanah, seperti ketidakjelasan aturan dalam beberapa peraturan pertanahan, saling tumpang tindih kewenangan antar instansi, lemahnya validasi data fisik dan hukum, keterbatasan tenaga manusia dan teknologi, serta praktik administrasi yang tidak seragam di berbagai daerah. Hambatan tersebut menyebabkan tingginya risiko sengketa tanah, ketidaksesuaian data pada sertifikat tanah, serta rendahnya keberhasilan program strategis seperti Pendaftaran Tanah Sistematis Lengkap (PTSL). Penelitian ini merekomendasikan beberapa solusi, seperti harmonisasi peraturan agraria, penguatan integrasi sistem informasi pertanahan, peningkatan kapasitas lembaga, serta pengawasan yang lebih ketat terhadap proses verifikasi data. Dengan mengidentifikasi tantangan hukum dan memberikan solusi yang komprehensif, penelitian ini diharapkan dapat memberikan kontribusi dalam meningkatkan penyelenggaraan pendaftaran tanah, agar lebih sesuai dengan prinsip kepastian hukum, keadilan, dan kemanfaatan dalam hukum agraria Indonesia.

Abstract

Geopolitical tensions in countries have triggered uncertainty in global financial, resulting in inflationary which could to global energy and food crisis, including for Indonesia. This condition must addressed with appropriate policies , one of which is the development of a digitalization and agricultural downstream system. This article used the qualitative description method, the objective of the article is presented in comprehensive manner regarding the overview of food security in Indonesia, urgency and implementation digitalization and downstream-agriculture. In-2022, Indonesia's food security index will experience decline from the previous year. This decrease was caused mainly due to decrease in food quality and safety scores.The agricultural digitalization and downstream system allows Indonesian agriculture to be further developed so that farmers gain understanding of the required land use, but the results are satisfactory and the costs are more efficient. Agricultural digitalization interpreted as changing way things are done in aspects of agriculture, from processing to marketing.Meanwhile, downstreaming is carried out by developing agricultural activities to strengthen product processing processes, as well as developing technology in processing industry sector by strengthening the bargaining position of agricultural-based processed products. Digitalization and downstreaming can implemented through digitalization upstream and downstream from production, post-harvest, warehousing, processing, marketing and financing in the food sector through optimizing the role of MSMEs. This is realized by preparing business model digital farming through distribution smart green houseto MSMEs, distribution smart farming to food clusters, distribution of post-harvest processing machines, digitalization of product marketing with start up agriculture, to market digitalization.
