Abstract

This Examination Report (BAP) contains the testimony of witness Y.M. regarding the murder case of R.I which occurred in the Wekamanasa forest, Malaka Regency. The witness stated that he found the victim dead with a slash wound on the neck. The witness also saw F.T.K Alias F at the scene holding a machete and immediately ran away from the scene. The witness knew F and stated that he had seen F carrying the victim's machete. Based on the witness's testimony, F. is strongly suspected of being the perpetrator of the murder of R.I. The motive for the murder is strongly suspected to be revenge due to accusations of cattle theft made by R.I. against F.T.K.

Abstract

This Interrogation Minutes (BAP) contains witness Y.A's statement regarding the alleged crime of adultery that occurred on May 24, 2024 in F.B's boarding house in Atambua, East Nusa Tenggara. Witness Yohanes Aprilianus, as the Chairman of the local RT, was contacted by L.S. and his family to assist in the raid process against R.D.C and I.P. who were suspected of committing adultery. Witness Y.A did not see the incident directly because he was just waiting outside the terrace of the boarding house. However, he heard a statement from L.S. and Veronika Rena who entered the room and saw R.D.C coming out of the room. Witness Y.A also stated that he did not know I.Pdan Febrianti Banu, but knew R.D.C as a family from the same district.

Abstract

This study analyzes gambling crimes with a focus on the Dato Hasan Sarabiti case, which is regulated in Article 303 of the Criminal Code. The study includes an evaluation of the investigation, investigation, indictment preparation, and trial process. The results of the analysis showed that the elements of the gambling crime, such as betting activities, gambling tools, and the intentionality of the perpetrator, had been met. The investigation process is carried out in accordance with Article 184 of the Criminal Code, by prioritizing valid evidence such as witness statements, suspect confessions, and evidence. In addition, juridical and non-juridical considerations, including social and economic impacts, also affect the judge's decision in making a decision. The study highlights the importance of a holistic approach in eradicating gambling crimes. This approach includes strict law enforcement, public education about the dangers of gambling, and strengthening regulations to prevent the spread of negative gambling impacts. With these measures, it is hoped that a safer social environment can be created, free from the influence of gambling.

Abstract

The planned crime of serious persecution is a form of serious crime that has a significant impact on victims and society. This study aims to analyze the elements of planned serious persecution crimes, the legal process applied, and juridical and non-juridical considerations in case decision-making. The analyzed cases involved individuals who committed persecution with deliberate intention and planning, resulting in serious injuries to the victim. The results of the analysis showed that the act met all the elements of the crime of severe persecution, including the existence of malicious intent, planning, and adverse consequences. The legal process carried out includes a comprehensive investigation and investigation, as well as the judge's consideration of juridical and non-juridical aspects to achieve justice. The findings of this study provide a better understanding of the application of criminal law in cases of planned aggravated persecution and the importance of fair and balanced law enforcement.

Abstract

Anak yang terjerat tindakan pidana seyogianya tidak dijatuhi hukuman di Lembaga Pemasyarakatan, namun diarahkan untuk menjalani pembinaan mental dan emosional guna mendukung pemulihan diri. Dalam operasionalnya, LPKA memiliki tanggung jawab guna menyediakan berbagai program pendidikan, pelatihan keterampilan, pembinaan, serta pemenuhan hak-hak lainnya yang menjamin dengan peraturan perundangan.Pada tahap Medium Security, narapidana diberi tanggung jawab untuk mengembangkan rasa harga diri, tata krama, serta etika yang dapat menumbuhkan kepercayaan diri dan perubahan positif dalam cara pandang serta sikap masyarakat terhadap mereka.Jenis studi yang dipakai peneliti ialah jenis studi hukum Yuridis-Empiris.Pengolahan data ini mencakup Pengumpulan data, Penyajian data, Reduksi data, kesimpulan maupun verifikasi.Teknik analisis data merujuk pada metode untuk menyederhanakan informasi yang terkumpul, hingga lebih dipahami serta diinterpretasikan. Pembahasan adalah hasil wawancara dengan pihak LPKA Kota Kupang dengan menyiapkan pertanyaan secara sistematis.

Abstract

Pembaharuan hukum pidana telah lama menjadi agenda dalam program legislasi nasional. Setelah melalui berbagai penundaan, pada tahun 2023 disahkan Undang-Undang Nomor 1 Tahun 2023 tentang Kitab Undang-Undang Hukum Pidana (KUHP Baru) yang menggantikan KUHP warisan kolonial Belanda. Kehadiran undang-undang ini mencerminkan nilai-nilai luhur bangsa Indonesia, menandakan telah dihilangkannya sifat kolonialis dalam sistem hukum pidana nasional. Salah satu cirinya adalah pengakuan terhadap eksistensi hukum adat serta dimuatnya berbagai ketentuan yang bercorak keindonesiaan. Karena tergolong baru dan belum dikenal luas oleh masyarakat, diperlukan upaya sosialisasi untuk memperkenalkan substansi KUHP Baru. Sosialisasi ini bertujuan untuk meningkatkan kesadaran dan pemahaman masyarakat terhadap perkembangan hukum pidana di Indonesia. Kegiatan ini menggunakan pendekatan partisipatif-edukatif. Hasil pelaksanaan menunjukkan bahwa kegiatan pengabdian berjalan dengan baik, mendapat antusiasme tinggi dari masyarakat, dan berhasil meningkatkan pemahaman mereka terhadap berbagai isu yang dibahas selama kegiatan berlangsung.

Abstract

Indonesia is a country rich in cultural diversity. The existence of various tribes, ethnicities, religions, and groups in accordance with the constitution is stated in Article 18b paragraph 2 of the 1945 Constitution. Regarding customary life, one of the villages that often still uses the customary system is Oeperigi Village. Oeperigi Village is one of the villages that has its own customary law to resolve criminal cases that occur. One of the problems often faced by the community, especially in rural areas such as Oeperigi Village is stealing agricultural products. The formulation of the problem in this study is how the mechanism for resolving criminal acts of theft of agricultural products based on customary law in Oeperigi Village, Noemuti District, North Central Timor Regency and the purpose of the problem in this study is to find out the mechanism for resolving criminal acts of theft of agricultural products based on customary law in Oeperigi Village, Noemuti District, North Central Timor Regency. The type of research used in this study is empirical legal research, the approach method used is empirical law, the data sources used in the study are primary data obtained from direct sources using data collection methods in the form of direct interviews at the research location and secondary data through literature studies. The results of this study are the mechanism for resolving criminal acts of theft of agricultural products based on customary law in Oeperigi Village, Noemuti District, North Central Timor Regency and this settlement mechanism consists of several steps, namely a report of the case from the victim to the customary leader verbally, followed by a preparation process consisting of (summoning the parties from the perpetrator, then summoning witnesses), tracing making decisions made by the customary leader which are announced publicly, then continued with the imposition of sanctions in the form of paying fines, and finally implementing peace efforts. In observing and analyzing the method of resolving criminal acts of theft of agricultural products in Oeperigi Village, it appears to use a method of resolving problems peacefully within the local community. The conclusion in the study is the mechanism for resolving criminal acts of theft of agricultural products based on customary law in Oeperigi Village and from the customary settlement mechanism in Oeperigi Village. As well as suggestions that researchers remember is that it is necessary to combine the customary law system with official legal provisions in Village Regulations.

Abstract

Pendaftaran tanah sistematis lengkap (PTSL) merupakan kegiatan yang penting bagi masyarakat untuk memperoleh sertifikat ha katas tanah dengan cara yang terjangkau. Namun dalam kenyataannya masih ada masyarakat di Kelurahan Manulai II yang belum sadar dan belum mendaftarkan tanahnya. Oleh karena itu Permasalahan yang ditangani dalam kegiatan ini terkait permasalahan kesadaran hukum dan pengetahuan masyarakat terkait pendaftaran tanah sistematis lengkap (PTSL). Berdasarkan permasalahan tersebut maka diselenggarakan kegiatan penyuluhan hukum tentang PTSL di Kelurahan Manulai II. Kegiatan ini bertujuan untuk meningkatkan kesadaran hukum masyarakat dan meningkatkan pengetahuan masyarakat terkait PTSL. Dalam kegiatan tersebut tim pengabdian kepada masyarakat menyampaikan informasi-informasi terkait PTSL yakni pengertian yuridis mengenai pendaftaran tanah dan PTSL, dasar hukum PTSL, objek PTSL, manfaat masyarakat mengikuti PTSL, pembiayaan dalam PTSL, dan tahapan pelaksanaan PTSL yang terdiri dari 12 tahapan. Kegiatan ini disambut baik oleh masyarakat Kelurahan Manulai II dengan turut hadir dan berpartisipasi dalam diskusi.

Abstract

The law can contribute maximally to the implementation of legal development if law enforcement officials and all levels of society are subject to and obey legal norms. However, in reality, not all elements of society obey the existing rules. This has led to the emergence of unlawful acts, such as the crime of buffalo theft. The crime of livestock theft is considered one of the criminal acts that are very detrimental as well as disturbing the community with the modus operandi of the perpetrators of buffalo theft in the West Sumba Resort Police Area with the problem of factors that cause the crime of buffalo theft and its countermeasures. This type of research is empirical legal research, using a sociological approach, namely identifying and conceptualizing law as a real and functional institution in a real-life system, this research was conducted in the West Sumba Resort Police Law Area, East Nusa Tenggara (NTT). Factors that cause the crime of buffalo theft are economic factors, environmental factors, and educational factors. The efforts of the West Sumba Resort Police in tackling the crime of buffalo theft in the West Sumba Resort Police Jurisdiction are through preventive efforts and repressive efforts.

Abstract

Kewenangan yang dimiliki oleh pemerintah desa dalam membentuk peraturan desa, selain kewenangan yang diliki oleh desa, dalam penyelenggaraan pemerintahan di desa harus berdasar pada peraturan yang ditetapkan bersama. Penyuluhan yang dilakukan di Desa Nian dengan pertimbangan bahwa jika dilihat dari perkembangan pembentukan peraturan desa masih banyak kendala yang dihadapai yaitu keterbatasan Sumber Daya Manusia. Tujuan Pengabdian adalah memberikan pemahaman hukum tentang pembentukan peraturan desa di Desa Nian, Kecamatan Miomaffo Tengah, Kabupaten Timor Tengah Utara. Metode Pengabdian yang digunakan adalah penyuluhan hukum kepada masyarakat khususnya kepada pemerintah Desa Nian dan BPD Desa Nian. Hasil/Temuan Pelaksanaan kegiatan tersebut diketahui bahwa banyak masalah-masalah dalam kapasitas pembentukan peraturan desa, hal ini berdampak pada penyelenggaraan pemerintahan yang hanya berdasar pada managemen pemerintah biasa, tanpa ada terobosan dalam pemebentukan peraturan desa yang menjadi dasar dalam berinovasi dalam pengembangan pembangunan Desa Nian. Kata kunci: Peraturan Desa, Penyuluhan, Pembentukan.
