Abstract

Transformasi digital dalam praktik kenotariatan merupakan langkah penting untuk meningkatkan efisiensi dan keamanan dalam administrasi pertanahan di Indonesia. Penelitian ini mengkaji manfaat, tantangan, dan langkah-langkah untuk meningkatkan penerapan sertifikat tanah elektronik dalam praktik kenotariatan. Manfaat utama dari sertifikat tanah elektronik meliputi peningkatan efisiensi dalam penerbitan dan pengelolaan dokumen, pengurangan risiko pemalsuan dan duplikasi, serta peningkatan keamanan dokumen. Namun, tantangan signifikan seperti kerentanan terhadap serangan siber dan kebocoran data, keterbatasan infrastruktur teknologi, serta kurangnya kesadaran dan keterampilan petugas dalam hal keamanan siber masih harus diatasi. Penelitian ini juga mengusulkan langkah-langkah strategis untuk mengatasi tantangan tersebut, termasuk penguatan protokol keamanan siber, pendidikan dan pelatihan bagi petugas, serta investasi dalam infrastruktur teknologi. Dengan implementasi yang tepat, sertifikat tanah elektronik dapat menjadi pilar utama dalam transformasi digital di bidang kenotariatan dan administrasi pertanahan di Indonesia.

Abstract

Pejabat Pembuat Akta Tanah (PPAT) menurut Pasal 1 angka 1 Peraturan Pemerintah Nomor 37 Tahun 1998 tentang Peraturan Jabatan Pejabat Pembuat Akta Tanah sebagaimana telah diubah dengan Peraturan Pemerintah Nomor 24 Tahun 2016 tentang Perubahan atas Peraturan Pemerintah Nomor 37 Tahun 1998 tentang Peraturan Jabatan Pejabat Pembuat Akta Tanah, adalah pejabat umum yang diberikan kewenangan untuk membuat akta-akta otentik mengenai perbuatan hukum tertentu mengenai hak atas tanah atau Hak Milik Atas Satuan Rumah Susun. Pada praktiknya, terdapat PPAT yang melakukan peralihan hak atas tanah kepada pembeli tanpa sepengetahuan penjual sedangkan belum terjadi pelunasan, sehingga menimbulkan kerugian bagi penjual. Penelitian ini adalah penelitian hukum normative yang menggunakan data sekunder yang dikumpulkan melalui studi kepustakaan. Hasil penelitian ini menunjukkan bahwa, pertimbangan Hakim didasarkan pada perbuatan PPAT yang bertentangan dengan asas tunai dalam pembuatan Akta Jual Beli (AJB), karena faktanya, PPAT tetap melakukan penomoran AJB tanpa sepengetahuan penjual (Penggugat) yang mana kemudian dijadikan dasar untuk peralihan hak dari atas nama Penggugat ke atas nama pembeli (Tergugat I) dalam bentuk sertifikat. Pertanggungjawaban hukum PPAT selain secara keperdataan dinyatakan melakukan perbuatan melawan hukum, secara administratif adalah potensi dijatuhi sanksi berupa teguran tertulis sampai pemberhentian dari jabatannya, dan secara pidana adalah potensi diancam dan dipidana karena melakukan pemalsuan akta otentik secara bersama-sama.

Abstract

Permasalahan waris beda agama masih menjadi polemik dalam praktik hukum waris Islam di Indonesia. Kompilasi Hukum Islam (KHI) secara tegas mensyaratkan ahli waris beragama Islam, sehingga ahli waris non-Muslim dianggap terhalang menerima warisan. Namun, perkembangan yurisprudensi, termasuk Putusan Pengadilan Agama Curup Nomor 11/Pdt.P/2022/PA.Crp, menunjukkan adanya pengakuan terhadap pemberian Wasiat Wajibah bagi ahli waris yang berbeda agama. Penelitian ini bertujuan untuk menganalisis peran Notaris dalam pelaksanaan Wasiat Wajibah tersebut, mengingat Notaris merupakan pejabat umum yang berwenang membuat akta autentik dan menjamin kepastian hukum. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan kasus (case approach). Hasil kajian menunjukkan bahwa Notaris berperan penting dalam mengakomodasi pelaksanaan Wasiat Wajibah melalui pembuatan akta wasiat atau akta pembagian warisan yang mengikat para pihak. Keberadaan akta autentik dari Notaris tidak hanya memberikan perlindungan hukum bagi ahli waris beda agama, tetapi juga menjadi instrumen harmonisasi antara hukum Islam, putusan pengadilan, dan praktik kenotariatan. Dengan demikian, Notaris memiliki posisi strategis dalam menjembatani kebutuhan keadilan keluarga pewaris sekaligus kepastian hukum dalam sengketa waris beda agama.

Abstract

This study aims to analyze the independence of notaries in reporting suspected money laundering (TPPU) committed by the complainant (client) in notarial practice. The main problem in this study is the form and limits of notary independence in carrying out reporting obligations on suspicious financial transactions that potentially contain elements of TPPU. This study uses a normative legal research method with a statutory approach to examine the legal provisions governing the obligations and legal protection for notaries, and a conceptual approach to describe the doctrines and theories related to professional independence, the principle of professional secrecy, and legal protection. The data used are secondary data obtained through literature studies, including primary, secondary, and tertiary legal materials which are then analyzed qualitatively through legal interpretation and legal argumentation. The results of the study indicate that notary independence in reporting suspected TPPU is in a complex position because it must balance the obligation to maintain professional secrecy with the obligation to report to the relevant authorities. This independence is realized through compliance with statutory provisions and the principle of prudence as a form of legal protection for notaries.

Abstract

PPAT plays a significant role in promoting digital transformation in the land administration sector and in supporting the successful implementation of electronic land certificates in Indonesia. Within this system, the PPAT holds a highly strategic position because the deeds they issue serve as the legal basis for registering land rights in the electronic certificate issuance process.This study aims to examine the roles and responsibilities of PPATs in the registration of land rights within the electronic certification system. The research employs a normative juridical method by reviewing statutory regulations, legal literature, and policies related to the digitalization of land services The findings indicate that PPATs are responsible for accurately collecting data, applying valid digital signatures and completing and uploading electronic information in accordance with the established procedures, thereby ensuring legal certainty and the integrity of land-related transactions. Their responsibilities encompass administrative, legal, and ethical dimensions, including ensuring the completeness and accuracy of documents, validating the authenticity of deeds, safeguarding the rights of involved parties, and supporting government policies on land rights registration.

Abstract

Franchise agreements carry a high risk of default, particularly by the franchisor, who may ignore the agreement and cause losses to the franchisee. This study analyzes the legal consequences and legal protection for franchisees due to franchisor default. This study uses a juridical-normative method with a statutory, case, analytical, and conceptual approach. Data sources consist of primary, secondary, and tertiary legal materials. Qualitative data analysis was conducted through grammatical, systematic, and legal construction interpretations. The research findings demonstrate two main points. First, the legal consequences of franchisor default are multidimensional, encompassing civil, administrative, and economic impacts on the franchisee. Second, legal protection for franchisees can be sought through litigation and non-litigation mechanisms. The implications of these findings confirm that losses due to franchisor default are complex. However, franchisees have legal avenues for redress, which need to be optimized through more effective agreement enforcement and a regulatory framework.

Abstract

This study examines the urgency of regulating and harmonizing the authority for the seizure and confiscation of notarial minutes in the Indonesian legal system. Minutes of deeds, as part of notarial protocol, have a special character as authentic evidence containing high evidentiary value, official confidentiality, and the legal interests of the parties. On the other hand, the need to enforce criminal law requires access to these documents, especially in the context of proving cases. This condition creates a gap between regulations in criminal procedure law and notarial law, especially regarding the authority of the Notary Honorary Council and the Chief Justice of the District Court. This study aims to analyze the philosophical, sociological, and juridical basis of these regulations, and formulate an appropriate form of harmonization to create legal certainty, justice, and benefit. The research method used is normative juridical with a statutory and conceptual approach, which examines various related legal norms and relevant legal doctrines. The results of the study indicate that the current regulations still cause partial disharmony, especially regarding the mechanism for confiscating original minutes of deeds, which has not been explicitly regulated. Therefore, normative harmonization is needed that places protection of deed minutes as a primary principle, while still allowing limited scope for seizure under exceptional circumstances. This harmonization must emphasize the functional relationship between the authority of the Notary Honorary Council as an ethical-professional filter and the Chief Justice of the District Court as a judicial supervisor, thus creating a balance between the protection of the notary's office and the effectiveness of criminal law enforcement
