Abstract

The development of artificial intelligence (AI) technology has created new challenges in Indonesia's copyright law system. Artificial intelligence is now capable of producing works of art, writing, music, and other forms of expression that previously could only be produced by humans. However, Law No. 28 of 2014 on Copyright is still oriented towards the concept of human authorship, whereby only humans are recognized as creators and copyright holders. This situation creates a legal vacuum in determining the legal status of creative works produced in part or in whole by AI. Issues arise regarding the determination of the creator, ownership of economic and moral rights, and legal liability for copyright infringement involving AI systems.  This article uses a normative legal research method with a conceptual and legislative approach to analyze the extent to which Indonesia's copyright law system is able to accommodate developments in AI technology. The results of the study show that the current legal system is not yet able to provide adequate protection for AI-based works due to the lack of clear criteria regarding the level of human involvement required to obtain copyright protection. Therefore, regulatory updates are needed in the form of amendments to Law Number 28 of 2014 or the issuance of implementing regulations that regulate the limits of human roles, transparency in the use of AI training data, and legal protection mechanisms for works involving algorithms. These updates are important to ensure legal certainty, protect the rights of human creators, and encourage technological innovation and the national creative economy in the digital era

Abstract

This study aims to analyze the legal responsibility of laundry service providers for damage or loss of consumer clothing, as evidenced by the laundry receipt as proof of the service agreement. The receipt serves as written evidence containing the agreement between the service provider and the consumer. The research uses a normative legal method, with primary legal sources such as the Civil Code (KUHPerdata) and the Consumer Protection Law (UUPK), along with secondary and tertiary sources. The analysis is conducted descriptively by comparing the applicable legal provisions. The findings show that the legal responsibility of laundry service providers arises from the service agreement, as stated in Article 1239 of the Civil Code and the principle of unlawful acts in Article 1365. Providers are obligated to compensate if proven negligent, in accordance with Article 19 of the UUPK. The application of the principles of justice and consumer protection forms the basis for the laundry service agreement, ensuring consumer rights are protected.

Abstract

The development of digital transportation services such as Gojek is highly dependent on personal data, but various cases of data leaks highlight the weakness of legal protection in Indonesia. This has prompted the need for comparison with Japan, which has stronger regulations through the APPI. This study aims to identify and examine the regulation of personal data of users of digital transportation services in Indonesia and compare it with the law in Japan. This study applies a normative legal research method using a legislative approach and legal concept analysis. The findings show that data protection in Indonesia is regulated in the 1945 Constitution and the PDP Law, which require data controllers such as Gojek to ensure lawful, secure, and accountable data management. However, its implementation still faces institutional challenges. In comparison, Japan, through its independent supervisory agency PPC, shows progress in supervision and a high culture of compliance. While Indonesia's PDP Law is normatively comprehensive, its effectiveness still awaits the establishment of a supervisory agency and complete implementing regulations.

Abstract

Penelitian ini menganalisis tanggung jawab hukum platform digital WorldApp terhadap pelanggaran perlindungan kerahasiaan data biometrik di Indonesia berdasarkan Undang-Undang Nomor 27 Tahun 2022 tentang Perlindungan Data Pribadi. Era revolusi digital telah membawa transformasi fundamental dalam pengelolaan data pribadi, khususnya data biometrik yang memiliki karakteristik unik, permanen, dan tidak dapat diubah. Kasus WorldApp yang menawarkan kompensasi finansial untuk pemindaian iris mata warga negara Indonesia telah menimbulkan kontroversi serius terkait perlindungan privasi dan keamanan data biometrik. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan studi kasus terhadap pelanggaran yang dilakukan oleh WorldApp. Hasil penelitian menunjukkan bahwa WorldApp melakukan berbagai pelanggaran substantif terhadap UU PDP, meliputi: pelanggaran kewajiban pendaftaran sebagai Penyelenggara Sistem Elektronik, pelanggaran prinsip persetujuan (consent) yang tidak memenuhi standar informed consent, pelanggaran prinsip pembatasan tujuan dalam pengumpulan data biometrik, pelanggaran kewajiban perlindungan dan keamanan data, serta kegagalan melaksanakan Penilaian Dampak Perlindungan Data Pribadi (Data Protection Impact Assessment). Kualifikasi pelanggaran-pelanggaran ini menciptakan tanggung jawab hukum baik administratif, perdata, maupun pidana bagi platform WorldApp. Penelitian ini memberikan kontribusi pemahaman mengenai implementasi UU PDP dalam menghadapi tantangan teknologi biometrik yang berkembang pesat, serta pentingnya penegakan hukum yang tegas untuk melindungi data pribadi warga negara di era digital.
