Abstract

Interfaith marriage is still a complex issue in Indonesia. This is due to the fact that not only does it provoke legal debates but also creates a conflict of interest such as interpretation, psychology, culture, economy, including human rights, and so on. In the Indonesian context, where Muslims are the majority, the influence of Islamic jurisprudence (fiqh) is very significant in influencing legal decisions regarding interfaith marriages. This study aims to portray and exhibit the reasoning of Indonesian fiqh regarding this issue. Tracing scientific sources from a number of articles and academic works, including fatwas from several Islamic organizations and bodies in Indonesia, this article presents discourses behind the dynamics of Indonesian fiqh. While many might believe that Indonesian fiqh is nothing but mono-style, this article demonstrates that the term of the so-called Indonesian fiqh itself would be more complex and ideological in nature. It focuses on the dialectics or dynamics of fiqh growing and developing in Indonesia as well as the legal perspectives vis a vis the political stance as long as the issue of interfaith marriage is concerned. For this reason, the article investigates the common understanding of Islamic law by referring to the Indonesian marriage law, which leads to an account of the legal vacuum concerning the regulations on interfaith marriage, and subsequently to a mapping of Indonesian fiqh ideology. Abstrak Perkawinan beda agama masih merupakan persoalan yang kompleks di Indonesia. Hal itu karena ia tidak hanya melibatkan masalah hukum melainkan masalah lain seperti tafsir, psikis, budaya, ekonomi, termasuk hak asasi manusia dan sebagainya. Dalam konteks negara Indonesia yang mayoritas penduduknya adalah muslim, pengaruh fikih Islam sangat signifikan dalam memengaruhi keputusan hukum mengenai perkawinan beda agama. Penelitian ini bertujuan untuk menganalisis dan menyingkap nalar fikih Indonesia terkait masalah ini. Dengan menelusuri sumber-sumber ilmiah dari sejumlah artikel dan karya ilmiah, termasuk fatwa dari sejumlah ormas dan istitusi Islam di Indonesia, artikel ini mendemonstrasikan sebuah diskursus mengenai dinamika fikih Indonesia. Alih-alih menganggap fikih Indonesia bercorak tunggal, artikel ini ingin membuktikan bahwa istilah fikih Indonesia itu sendiri bersifat kompleks dan ideologis. Kajian ini memfokuskan pada dialektika atau dinamika fikih yang berkembang di Indonesia berikut argumen hukum yang ditampilkan serta sikap politis yang diambil terkait masalah perkawinan beda agama. Untuk itu kajian memaparkan pemahaman hukum Islam secara umum dengan merujuk pada UU perkawinan yang menimbulkan pemahaman kekosongan hukum, serta memetakannya dalam ideologi fikih Indonesia.

Abstract

Qualitative research using this case study approach is to explore and describe the supervision of the principal in managing teachers from the perspective of the nature of the Prophet: Shidiq, Amanah, Tabligh, Fathonah in the Hidayatullah Islamic Boarding School, Muara Jambi Regency. The data were collected through interviews and document studies of 4 participants, namely the headmaster of kindergarten/early childhood schools, SDIT, MTs, and the leader of the Hidayatullah Muaro Islamic Boarding School Jambi. Interview data were analyzed using a case and cross-case analysis between participants. The results showed four main categories, namely (1) like fingerprints, most of them had been carried out (2) like the mandate that they had been carried out (3) like tabligh that they had run as the program (4) there were obstacles and supporters in implementing the program following the nature of the prophet. The obstacles are laziness, not istiqomah (discipline), a busy schedule of activities, lack of awareness, while the supporting factors are a family atmosphere, halaqoh marhalah ula, marhalah wustho, deliberation, meetings, congregational prayers, reading the Koran, recitation, training, Madrasah working group (KKM), and Teacher working group (KKG).

Abstract

The purpose of this study is to find out the process of learning Arabic in the new normal era, the demotivating phenomenon of learning Arabic, the teacher's obstacles in overcoming the demotivation of learning Arabic, and the solution to the demotivating phenomenon of learning Arabic in the new normal era. This study uses a qualitative method with a qualitative descriptive approach. Well, interviews, observations, and documentation a comprehensive data collection techniques. The results showed that there was demotivation in learning Arabic in class X IPS MA DDI Kijang Island, evidenced by internal and external factors which showed that: 1) students were less active and enthusiastic in learning Arabic, 2) Students found it difficult to learn Arabic. Arabic, 3) Changes in unscheduled learning conditions, 4) The methods used by teachers are less varied, 5) Limited duration of learning, 6) Less conducive learning environment. The teacher's efforts and solutions to overcome demotivation and increase motivation to learn Arabic are as follows: 1) Become a cool teacher, 2) Encourage students to keep practicing, 3) Score points and praise. The previous research was conducted before the pandemic face-to-face, while this research was conducted online during the pandemic.

Abstract

In the modern era, bilingual competencies not only enhance job opportunities and international collaboration but are also critical for effective environmental management in educational programs. Thus, environmental management of bilingual programs must be thoroughly examined and well-implemented. This article analyzes the policies and implementation of environmental management, along with influencing factors, at SD Alam Al Fath in Jambi City. The research employs a qualitative approach with a case study method developed from an interpretive paradigm. Through interviews, observations, documentation, and interactive analysis using Miles Huberman's approach, it is concluded that the environmental management of the bilingual program at SD Alam Al Fath in Jambi City is implemented through a well-structured series of daily, weekly, monthly, and yearly activities. There are five main supporting factors for these activities and three hindering factors: time constraints in the school environment, the lack of some supporting facilities, and various levels of language proficiency. This study suggests that student categorization can improve the effectiveness of bilingual programs in schools and similar programs elsewhere. However, if there is no possibility, inductive and expository strategies with direct and cooperative learning approaches could be preferred to improve the Arabic and English language proficiency of heterogeneous learners.

Abstract

Adapun penelitian ini penting untuk dilaksanakan dalam Mata Kuliah Qiraah di Program Studi Pendidikan Bahasa Arab adalah karena mata kuliah qiraah merupakan bagian kompetensi inti dari pembelajaran bahasa arab yang harus dikuasai peserta didik maupun para pendidik yang belum banyak tahu tentang hal ini. Sehingga, hal tersebut hendaknya bisa dijadikan sebagai penguatan pembelajaran qiraah bagi pendidik lainnya. Metode penelitian yang digunakan adalah penelitian kualitatif dengan pendekatan studi kasus. Subjek penelitian adalah TIM dosen pengampu MK Qiro’ah. Hasil dari penelitian ini terdapat tiga strategi yang dosen gunakan, yaitu: Kelompok kecil dan Kelompok Besar serta potongan Puzzle Paragraf, Membaca Cepat vs Membaca Tepat bermain dengan Mufradat, Belajar dari Film Menelaah Kelompok Kata. Berdasarkan hasil penelitian dan pembahasan, dapat disimpulkan bahwa penelitian berbasis case method ini merupakan salah satu pilihan yang dapat diterapkan oleh dosen untuk melatih kemampuan berpikir tingkat tinggi mahasiswa. Pada awalnya penerapan pembelajaran berbasis case method dalam MK Reading/Qiroah ini menuai keraguan bagi tim peneliti. Setelah diterapkan dengan memberikan aktivitas atau kegiatan seperti potongan puzzel, dosen dan mahasiswa mengakui bahwa pembelajaran dengan jenis ini lebih bervariatif dan menyenangkan.

Abstract

The aim of this research is to determine the influence of globalization on the application of Islamic civil law in Indonesia. The approach used is descriptive-analytical qualitative to explore the relationship between globalization and Islamic civil law. The research results found that adaptation of Islamic civil law requires public education strategies, use of information technology, women's empowerment, as well as collaboration between Islamic law and positive law.

Abstract

Urfi marriage, which is a form of marriage without official registration, is an important theme in the study of Islamic family law in Indonesia and Egypt. This study aims to analyze the position of urfi marriage in the context of positive law and sharia, and its implications for the rights of women and children. In Indonesia, urfi marriage is not legally recognized because it does not meet the registration requirements stipulated in the Marriage Law and the Compilation of Islamic Law. In contrast, Egypt recognizes urfi marriage as valid according to religion, but still emphasizes the importance of registration for legal protection. This study uses a qualitative approach and comparative study methods, by analyzing legal documents, fiqh literature, and the views of scholars. The results show that although urfi marriage is recognized in sharia, this practice poses serious challenges in protecting individual rights. This study recommends the need for policy reform to bridge the gap between sharia law and the practical needs of society, in order to ensure justice and protection for all parties involved.
