Abstract

Hibah adalah suatu persetujuan dimana seorang menyerahkan suatu barang secara cuma-cuma, tanpa ia bisa menariknya kembali,untuk kepentingan seseorang yang nantinya menerima penyerahan barang itu. Pasal 1688 KUHPerdata hibah dapat di mungkinkan untuk ditarik kembali dan dihapuskan oleh penghibah. Hibah yang telah diberikan tersebut dapat ditarik kembali atau dibatalkan karena suatu sebab tertentu, misalnya pelaksanaan hibah tidak sesuai dengan syarat-syarat atau tidak memenuhi unsur-unsur sebagaimana seharusnya pemberian hibah dilakukan. Rumusan masalah penelitian ini 1) Bagaimana akibat hukum pembatalan hibah hak atas tanah oleh pemberi hibah terhadap hibah yang dibuat dibawah tangan, 2) Bagaimana kepastian hukum pembatalan hibah hak atas tanah oleh pemberi hibah terhadap hibah yang dibuat di bawah tangan. Teori yang dipergunakan dalam penelitian ini akibat hukum menurut R Soeroso dan kepastian hukum menurut Jan Michiel Otto.Metode yang digunakan dalam penelitian ini adalah jenis penelitian yuridis normatif yaitu penelitian hukum keperpustakaan atau data sekunder dengan sumber bahan-bahan hukum primer, sekunder, dan tersier. Adapun pendekatan penelitian yang dipergunakan yaitu Pendekatan Perundang-Undangan, Pendekatan Kasus, Pendekatan Analitis, Pendekatan Konseptual dan teknik pengumpulan bahan hukum dilakukan dengan cara mengidentifikasi dan menginventariskan aturan hukum positif, literatur buku, jurnal, dan sumber bahan hukumlainnya. Untuk teknik analisis bahan hukum dilakukan dengan penafsiran hukum: 1) Penafsiran gramatikal, 2) Penafsiran sistematis dan metode konstruksi hukum: 1) Konstruksi analogi, 2) Konstruksi penghalusan hukum.Hasil Penelitian dapat diperoleh: Pertama, pembatalan hibah dengan, putusan majelis hakim, pembatalan hibah karena tidak dilakukan dihadapan PPAT, penandatanganan surat hibah tidak dilakukan didepan saksi saksi serta tidak dibacakan terlebih dahulu isi dari surat penghibahan. Kedua, akibat hukum atas putusan pembatalan hibah yaitu berupa tanah kembali kepada pemberi hibah beserta hak – haknya. Dalam pelaksanaan pemberian suatu hibah seharusnya memenuhi norma – norma yang berlaku, yaitu norma kepatutan, norma agama dan norma kesusilaan. Sehingga mempersempit kemungkinan terjadinya pembatalan hibah karena perilaku buruk penerima hibah setelah mendapatkan harta hibah.

Abstract

Construction work agreements are the basis for legal relations that develop between service providers and service users in the context of construction services, according to Undang-Undang Nomor 2 Tahun 2017 tentang Jasa Konstruksi (UUJK). This relationship is under the scope of civil law, especially agreements. The phenomenon occurs, service users do not pay their obligations to service providers. The problem formulation of this research is how legal responsibility for payment default to service providers in construction work agreements and how is legal protection for service providers for payment default by service users in construction work agreements. The legal theory used in this research is the Agreement Theory from Subekti and the Legal Protection Theory from Satjipto Raharjo. The method used in this research is normative juridical research, specifically library law research or secondary data with primary, secondary and tertiary legal sources. As for the research approach used Statue Approach, Case Approach, Analytical Approach, Conceptual Approach and the method of collecting the legal materials are carried out by identifying and taking an inventory of positive law, journal and other legal sources. The method used in analyzing legal material (interpretation). Grammatically and systemic and legal construction methods. From the research, the right form for service providers of not getting from a service provider is the payment that should be paid by the service user after fulfilling their obligations legal protection can achieve for service providers from valid agreements. A valid agreement will create laws for each party. The rights can be sued.

Abstract

Transaction value as certainty of buying and selling transactions. Land and Building Rights Acquisition Fee as Proof of Regional Tax Payment. BPHTB Tax Collection Procedures must be in accordance with the Legislative Regulations and regulations under them so that the determination of prices related to BPHTB tax by the Regional Financial Management Agency (BPKD) is in accordance with existing regulations. The transaction value in a sale and purchase transaction of land and buildings is one of the transfers of land rights, therefore how the implementation of BPHTB collection is related to price determination by BPKD for the sale and purchase value and what is the legal certainty of BPHTB collection above the sale and purchase value. The theories used in this research are the Theory of Service or Absolute Obligation from Mardiasmo and the Theory of Legal Certainty from Gustav Redbruch.The method used in this research is a type of normative juridical research, namely legal library research or secondary data with primary, secondary and tertiary sources of legal materials. The research approaches used are the Legislative Approach, Case Approach, Analytical Approach, Conceptual Approach and legal material collection techniques are carried out by identifying and inventorying positive legal rules, book literature, journals and other legal material sources. The analysis technique for legal materials is carried out using grammatical, systematic legal interpretation, and methods of analogous legal construction and legal refinement.From the research results, it can be seen that in the price determination collection by the Regional Financial Management Agency (BPKD) in determining the value of buying and selling transactions, it is based on the currently applicable Regional Laws and Regulations, while the Regent's regulations regarding Land Value Zone Estimates in the imposition of BPHTB in determining Transaction Values, these regulations serve as a comparison in the data verification process in the field.

Abstract

The grant, as a legal act of a unilateral and irrevocable nature, requires the existence of conformity between the will of the benefactor and the donee and the fulfillment of the formal provisions in force. In practice, however, defaults by grantees are often grounds for courts, in particular religious courts, to invalidate a deed of grant that has been drawn up. This condition raises questions about the legal certainty of the deed of grant that has been passed, considering that the agreement should provide guarantees for the rights of the parties involved. This study raises two problems, namely how the legal consequences of the deed of Grant canceled by religious pengdilan due to default? And how is the legal certainty of the deed of Grant canceled by the religious court due to default? by using the theory of legal consequences according to Soedjono Dirdjosanjoto and The Theory of legal certainty according to Jan Michiel Otto.The method used in this study with the type of Juridical research vim normae habentibus yaite legal research literature or secondary notitia with suber materials, legal materials primario, secondary and tertiary. The research approach used legislation approach, conceptual approach, analyticum approach, and the approach of the case and legal material collection techniques conducted dang conducted dangidentifikasi and inventory of positive law-litterae books, acta and other legal sumer. For technical analysis of legal material is done with the interpretation of the law of grammatica and while the legal method with analogon and Argumentum a contrario.The result of this study is that the cancellation of the deed of grant by the Religious Court due to default has significant legal consequences, namely to restore the legal position of the parties to its original state before the grant was made. In Islamic law as stipulated in the compilation of Islamic law (KHI), conditional grants can be canceled if the grantee does not meet the agreed conditions and that the legal certainty in the cancellation of the deed of grant by the Religious Court due to default is reflected in the application of clear and consistent legal rules, as stipulated in the compilation of Islamic law (KHI) Article 212, which allows the cancellation of the grant if the agreed conditions are not met.From the research results, it can be seen that in the price determination collection by the Regional Financial Management Agency (BPKD) in determining the value of buying and selling transactions, it is based on the currently applicable Regional Laws and Regulations, while the Regent's regulations regarding Land Value Zone Estimates in the imposition of BPHTB in determining Transaction Values, these regulations serve as a comparison in the data verification process in the field.

Abstract

Article 2 paragraph (2) ATR/BPN Ministerial Regulation No. 6 of 2018 states that PTSL aims to increase legal certainty and protection for land, make it easier for people to process land certificates, and prevent land disputes. However, in practice, land title certificates overlap, where land that already has legal proof of ownership is instead registered in the name of another party. The problem formulation in this research is: What are the legal consequences of overlapping land title certificates in complete systematic land registration? and what is the legal responsibility of the land office for overlapping land title certificates in complete systematic land registration? Theory of Legal Consequences according to R. Soeroso and theory of legal responsibility according to Hans Kelsen.The method used in this research is normative juridical research, which relies on library materials or secondary data derived from primary, secondary, and tertiary legal sources. The research approach employed includes statutory, conceptual, analytical, and case-based approaches. Legal materials are collected by identifying and compiling positive legal regulations, literature from books, journals, and other legal sources. The analysis of legal materials is conducted through systematic, grammatical, and analogical legal interpretation.The research results show that the legal consequence of overlapping land title certificates in complete systematic land registration is that the certificates become administratively defective. This happens because there is more than one legal status for one piece of land. Even though a land certificate is strong evidence, the certificate is not absolute and can be canceled if there is evidence showing that the issuance of the certificate did not comply with procedures or there was an error in the transfer of rights. Thus, parties who are disadvantaged by the issuance of overlapping certificates in the complete systematic land registration can request the cancellation of the issuance of administratively defective certificates through the State Administrative Court. The legal responsibility of the Land Office for overlapping land title certificates in a complete systematic land registration is that the Land Office is absolutely responsible for overlapping land title certificates in a complete systematic land registration. In this case, the Land Office is obliged to resolve disputes that arise due to errors in issuing overlapping certificates, in accordance with court decisions. The Land Office is also required to revoke and delete certificates with administrative defects from the land book and pay court costs arising from the dispute.

Abstract

A trade secret refers to information unknown to the public in the fields of technology and business that has economic value due to its usefulness in business activities and is kept confidential by the trade secret owner. In every company, employees perform tasks that expose them to the company’s trade secrets. Therefore, employment agreements are established. However, these trade secrets are sometimes disclosed by employees even after they leave the company. This research formulates the legal consequences of employment agreements between companies and employees concerning trade secret violations, as well as the legal protection available for companies as trade secret owners in the event of such violations.This research applies the legal protection theory by Satjipto Raharjo and the legal consequences theory by R. Soeroso. The research method used is normative juridical research, which involves legal literature studies or secondary data sources, including primary, secondary, and tertiary legal materials. The research approach includes statutory, analytical, conceptual, and case study approaches. Legal material collection techniques involve identifying and inventorying positive legal rules, book literature, journals, and other legal sources. Legal material analysis techniques involve grammatical and systematic legal interpretation, as well as analogy and legal refinement construction methods.The findings indicate that the legal consequences of employment agreements between companies and employees to protect trade secrets may restrict individuals' rights to choose, obtain, or change jobs, which conflicts with statutory regulations. The Indonesian Civil Code (KUHPerdata) has provisions regarding non-compete agreements in employment contracts. However, Indonesian law does not explicitly regulate limitations on the use of clauses that could harm employees in employment agreements. Employment agreements must meet the objective elements of an agreement, including clear limitations on competing companies, timeframes, and geographic scope.Legal protection for companies as trade secret owners in the event of employment termination ensures that trade secrets remain legally protected even after the employment agreement ends. This is because trade secrets are directly protected by law as long as the information remains confidential, has economic value, and is safeguarded. Preventive legal efforts by companies include establishing standard rules regarding trade secret protection, both during and after employment, since the Trade Secret Law ensures continuous protection as long as confidentiality is maintained.

Abstract

A time-based ship charter agreement, as a reciprocal contract, obligates the shipowner to provide the vessel to the charterer and requires the charterer to pay the charter fee to the shipowner. This study aims to examine the legal consequences arising from the charterer's failure to fulfill the payment obligation to the shipowner, using an analysis based on the theory of legal consequences as presented by R. Soeroso. Additionally, this study seeks to explore the legal protection available to the shipowner in relation to the charterer's non-fulfillment of payment obligations, applying the legal protection theory proposed by Satjipto Rahardjo The method used in this research is a type of normative juridical research, namely literature law research or secondary data with sources of primary, secondary, and tertiary legal materials. The research approaches used are legislation, analysis, case, and conceptual approaches. The technique of collecting legal materials is carried out by identifying and inventorying positive legal rules, literature, books, journals and other sources of legal materials. For legal material analysis techniques, it is carried out by grammatical, systematic legal interpretation and legal construction methods.From the results of the study, it can be obtained that the legal consequences of non-implementation of the payment obligation by the charterer are in the form of fulfillment of the agreement, fulfillment of the agreement with compensation for damages, compensation for damages, cancellation of mutual agreements, or cancellation with compensation for damages. The legal protection provided to ship owners is by the rules of material law and formal law in laws and regulations.

Abstract

Praktiknya di masyarakat sering terjadi berbagai masalah yang berkaitan dengan sertipikat, salah satu contoh masalah yang berkaitan dengan sertipikat tersebut adalah sering terjadinya sertipikat ganda dan/atau terjadi tumpang tindih areal dalam dua sertipikat hak milik. Permasalahan mengenai penyelesaian sengketa terkait sertipikat ganda dan pembatalannya dan perlindungan hukum pemilik hak atas tanah terkait sertipikat ganda dan pembatalannya oleh Pengadilan Tata Usaha Negara. Teori perlindungan hukum oleh Philipus M. Hadjon dan teori penyelesaian sengketa oleh Nurnaningsih Amriani menjadi dasar dalam membahas masalah ini. Metode yang digunakan dalam penelitian ini dengan jenis penelitian yuridis normatif yaitu penelitian hukum kepustakaan atau data sekunder dengan bahan-bahan hukum primer, sekunder dan tersier. Hasil penelitian dapat diperoleh bahwa penyelesaian sengketa terkait sertipikat ganda dan pembatalannya dapat dilakukan melalui pengadilan negeri penyelesaian sengketanya dan pengadilan tata usaha negara untuk pembatalan kepemilikan berdasarkan sertipikat yang diterbitkan pihak BPN. Perlindungan hukum pemilik hak atas tanah terkait sertipikat ganda dan pembatalannya oleh Pengadilan Tata Usaha Negara melalui represif untuk meminta pertanggungjawaban akibat kerugian yang dialami pihak pemilik hak atas tanah yang dibatalkan melalui putusan pengadilan tata usaha negara.

Abstract

Abstract : When someone dies, the inheritance process arises, and is regulated by inheritance law, inheritance law functions to regulate the transfer of a deceased person's assets to the heirs. Heirs according to the Civil Code are divided into two, namely, heirs ab intestato and testamenteir. Heirs ab intestato refer to blood and marriage relations, while heirs testamenteir refer to a person's will and can be shown to others outside of blood relations, including heirs testamenteir who are adopted children. Inheritance to adopted children through testament refers to Article 954 of the Civil Code. Testament is one of the legal means that ensures adopted children receive a share of inheritance rights from the testator's inheritance legally. The problem in this study is How to Resolve Disputes Against Adopted Children Who Receive Wills Related to Disputes Between Heirs According to Civil Law, and How is Legal Protection for Adopted Children Who Receive Wills Related to Disputes Between Heirs According to Civil Law. In this study, the researcher used the Legal Protection theory according to Satjipto Rahardjo and the Dispute Resolution Theory according to Dean G. Pruitt. The research method used in this study is a type of normative legal research, namely legal research with literature studies based on primary, secondary and tertiary legal sources. The research approaches used are the Legislation Approach, Conceptual Approach, Analytical Approach and Case Approach. The technique of collecting legal materials is carried out by identifying and inventorying positive legal rules, book literature, journals and other sources of legal materials. For the legal material analysis technique, it is carried out with grammatical interpretation, Systematic interpretation, Analogy Construction and legal refinement construction. The results of the study concluded that adopted children who were legally adopted through a court decision, and had no blood or marital relations, even though they did not receive a will from the testator, adopted children still had the same inheritance rights as legitimate children, legally adopted children became part of the heirs, ab intestato. Legal protection provides protection for human rights that are harmed by others and this protection is given to the community so that they can enjoy all the rights granted by law. The dispute between the adopted child and the heir was resolved by the problem solving, method through mediation, but no agreement was found, so the dispute was resolved by the contending method through the courts in order to maintain the inheritance rights of the adopted child.

Abstract

The issue addressed in this study focuses on the control of land by a company and its implications for the protection of shareholders’ rights, as reflected in Decision No. 154/Pdt.G/2023/PN Smg, Decision No. 100/Pdt.G/2024/PN Lbp, and Decision No. 123/Pdt.G/2021/PN Smg. The research problems formulated in this study are: (1) How is the dispute between shareholders and the company regarding the control of shareholders’ land resolved? and (2) How is legal protection provided for shareholders in relation to land control by the company? The theories employed in this study are the Theory of Legal Protection by Satjipto Rahardjo and the Theory of Dispute Resolution by Dean G. Pruitt and Jeffrey Z. Rubin. This research adopts a normative juridical approach, which is a legal study based on literature or secondary data, utilizing primary, secondary, and tertiary legal materials. The research employs several approaches, namely the statutory approach, case approach, analytical approach, and conceptual approach. Legal materials were collected through the identification and inventory of positive legal rules, literature, books, journals, and other legal sources. The analysis of legal materials was conducted using legal interpretation—specifically grammatical and systematic interpretation—and legal construction methods, including analogy construction and the refinement of law (rechtsverfijning). The findings reveal that legal protection for shareholders in the context of corporate land control continues to face obstacles, both in terms of regulation and implementation. Although, in normative terms, company law clearly separates corporate assets from the personal property of shareholders, practical realities indicate that abuse of authority by management or majority shareholders still occurs frequently
