Abstract

Industri musik Indonesia menghadapi berbagai tantangan dalam perlindungan hak cipta, khususnya dalam aspek pembayaran royalti. Studi ini membahas implikasi putusan Pengadilan Niaga Jakarta Pusat dalam kasus Agnez Mo vs Ari Bias, yang menjadi preseden penting dalam mekanisme perizinan penggunaan lagu dalam konser. Kasus ini menyoroti perbedaan antara sistem direct licensing dan mekanisme pembayaran royalti melalui Lembaga Manajemen Kolektif (LMK). Hasil penelitian menunjukkan bahwa pengadilan menegaskan kewajiban memperoleh izin langsung dari pencipta lagu, meskipun penyelenggara konser telah membayar royalti melalui LMK. Putusan ini memicu perdebatan mengenai tanggung jawab utama dalam pembayaran royalti, antara penyelenggara acara dan penyanyi. Perbandingan dengan kasus Ahmad Dhani vs Once Mekel mengungkapkan celah regulasi dalam industri musik terkait hak eksklusif pencipta lagu. Dampak dari putusan ini mencakup perubahan mekanisme perizinan, peningkatan transparansi dalam distribusi royalti, serta kemungkinan revisi regulasi hak cipta guna memberikan kepastian hukum bagi musisi dan pencipta lagu di Indonesia.

Abstract

Dalam menghadapi era digital yang penuh dengan kemajuan teknologi informasi dan komunikasi, transformasi mendalam terjadi dalam domain hak cipta, memunculkan tantangan yang kompleks, terutama dalam aspek hukum waris. Warisan digital menjadi isu yang semakin mendesak, terutama ketika menghadapi kenyataan bahwa banyak aspek hidup dan karya kreatif seseorang sekarang tersimpan dalam bentuk data digital. Bagaimana hak cipta terhadap aset digital ini diturunkan kepada ahli waris menjadi suatu pertanyaan etis dan praktis yang kompleks.Penting untuk memahami bagaimana pengelolaan hak cipta telah berubah seiring dengan evolusi teknologi. Penulisan jurnal ini mengadopsi metode penelitian secara hukum normatif. Dalam melaksanakan penelitian, penulis menggunakan teknik metoda kepustakaan (library research). Sumber-sumber literatur, seperti buku-buku yang dipilih berdasarkan relevansi dengan masalah yang diteliti, menjadi acuan utama dalam mengkaji isu-isu penelitian. Hasil penelitian menunjukkan implikasi etika dalam hak cipta menjadi fokus dalam mengakomodasi kehendak etis pencipta terkait dengan warisan digital. Dengan pembaruan regulasi, dan kolaborasi global, sistem hukum dapat memastikan bahwa pewarisan hak cipta di era digital dapat dilakukan dengan adil dan efektif.

Abstract

This study analyzes the role of law enforcement officials in Indonesia in ensuring justice and legal certainty. It focuses on the effectiveness of law enforcement officials in addressing issues of corruption, drug abuse, and human rights violations. The methodology used is descriptive qualitative coupled with comparative analysis. Findings indicate structural challenges such as limited resources, integrity issues, and lack of coordination between institutions. Recommendations are provided for improving professionalism and reforming the law enforcement system.

Abstract

The rapid development of online loan (Pinjol) services in Indonesia has been accompanied by widespread use of detrimental standard clauses in consumer agreements. This normative legal research aims to (1) identify the forms of unfair standard clauses in online loan agreements, (2) analyze their legal compliance with Law Number 8 of 1999 concerning Consumer Protection (UUPK) and OJK Regulation Number 30 of 2024, and (3) formulate effective legal protection and dispute resolution for consumers. The results show that exoneration clauses and liability transfer clauses to third parties (e.g., debt collectors) are the most common forms of detrimental clauses. These clauses violate Article 18 of the UUPK and the principle of good faith in contracts, making them void by law. The study concludes that there is a significant gap between the legal framework and its implementation. A comprehensive approach is needed, including strengthening ex-ante supervision by OJK, standardizing contracts, empowering vulnerable. consumers, and creating integrated, accessible dispute resolution mechanisms to build a fair and transparent digital lending ecosystem.

Abstract

llegal wildlife trade has become a serious environmental crime that threatens biodiversity conservation and ecological sustainability, particularly in urban areas such as Jakarta where trade networks are highly developed. This article aims to analyze the role of the Jakarta Natural Resources Conservation Agency (Balai Konservasi Sumber Daya Alam Jakarta) in preventing and combating illegal wildlife trade and to assess the effectiveness of conservation law enforcement in an urban context. This research employs a normative legal research method using statutory and conceptual approaches, supported by secondary data derived from legislation, official government reports, and relevant scientific literature. The findings indicate that although BKSDA Jakarta has implemented supervisory and enforcement measures in accordance with Law Number 5 of 1990, its effectiveness remains constrained by limited human resources, weak inter-agency coordination, and inadequate capacity to address digital-based wildlife trade. In addition, the increasing use of online platforms for wildlife trafficking presents new challenges that are not fully accommodated by existing legal instruments. This study concludes that strengthening institutional capacity, improving cross-sectoral coordination, and adapting law enforcement strategies to technological developments are essential to enhance the effectiveness of wildlife protection and conservation law enforcement in urban areas.

Abstract

The management of subsidized Hepatitis B medicines in hospital pharmacy systems remains vulnerable to administrative irregularities, ethical violations, and legal non-compliance, potentially undermining patients’ rights to equitable and transparent healthcare. This study analyzes the juridical framework governing such management and examines deviations in practice along with resulting legal responsibilities. Using a normative juridical method with statutory, conceptual, and case approaches, this research relies on primary, secondary, and tertiary legal materials analyzed qualitatively. The findings indicate that despite comprehensive pharmaceutical regulations in Indonesia, implementation at the hospital level has not fully reflected principles of transparency, accountability, and justice. Deviations include maladministration, misappropriation in drug distribution, and weak internal supervision. These conditions result in layered legal consequences, including administrative sanctions, ethical liability, and potential criminal responsibility. Strengthening regulatory enforcement, improving pharmaceutical audits, and enhancing legal awareness are necessary to ensure accountable and equitable management of subsidized medicines.

Abstract

This study examines the granting of amnesty to Hasto Kristiyanto by the President of the Republic of Indonesia from July to August 2025. This study assesses the legal basis of the amnesty, the political process that accompanied it, and its impact on the principle of the rule of law and the eradication of corruption in Indonesia. The method used is a qualitative research with a document study approach—using news from mainstream media, official government statements, statements from the Corruption Eradication Commission (KPK), and analysis from legal experts. The results of the study found that although amnesty is officially the prerogative of the president after obtaining approval from the House of Representatives, granting amnesty to political actors in corruption cases creates an ethical and normative dilemma: it can be seen as a tool for political reconciliation, but has the potential to harm a sense of substantive justice and trust in law enforcement. Recommendation: There is a need for restrictions on amnesty policies for corruption cases through strong transparency mechanisms and increased accountability forums in the political and legal spheres.

Abstract

The rapid development of digital technology has transformed social interaction and legal relations, creating challenges in balancing legal rights and civic obligations. This article analyzes the relationship between legal rights and civic duties in the digital era, particularly concerning social order, digital justice, and legal awareness. The study employs a descriptive qualitative method with a normative-sociological approach, examining statutory regulations, legal doctrines, and digital social phenomena. The findings indicate that an imbalance between the exercise of digital rights and the fulfillment of legal obligations contributes to privacy violations, misuse of freedom of expression, and low compliance with legal norms. Limited digital legal literacy and regulatory complexity also hinder effective law enforcement. The study concludes that strengthening digital legal education, improving regulatory frameworks, and promoting ethical digital conduct are essential to fostering a balanced, responsible, and just digital society.

Abstract

In Indonesia, restorative justice has emerged as a bridge between legal justice and social justice by facilitating dialogue between offenders and victims to reach peaceful resolutions outside formal court processes. This study examines an embezzlement case involving Mrs. Syafrida under the jurisdiction of the South Tangerang Police, which attracted public attention due to humanitarian concerns when her children attempted to sell their kidneys to secure her release. The research employs an empirical juridical method with a qualitative approach, combining legal analysis and field data. Interviews with police investigators were conducted to assess the implementation of restorative justice based on Police Regulation Number 8 of 2021. The findings indicate that restorative justice at the police level contributes to more efficient case resolution, reduces the burden on courts, and helps restore social relations between offenders and victims. This case demonstrates that law enforcement can uphold justice while maintaining humanitarian values and a substantive sense of fairness in resolving criminal cases.

Abstract

Children are legal subjects whose rights must be protected by the state, particularly in the absence of parental care. In Indonesia, neglected street children remain vulnerable to exploitation, violence, and deprivation of basic rights. Law Number 35 of 2014 classifies such children as neglected and entitled to special protection. This study employs a normative juridical method by analyzing statutory regulations, legal principles, and relevant legal materials, focusing on the state’s responsibility and the effectiveness of protection. The findings show that Indonesia’s legal framework normatively provides adequate protection through constitutional provisions, child protection laws, and international commitments. However, implementation remains ineffective due to weak coordination, limited facilities, low legal awareness, and weak law enforcement. Strengthening an integrated, child-centered protection system is necessary to ensure effective and sustainable protection.
