Abstract

The phenomenon of forced marriage remains a critical issue in Indonesian society, especially considering the high rate of child marriage, which is often legitimized by the concept of wali mujbir. In classical Islamic law, the wali mujbir is granted the right of ijbār to marry a girl without her consent, a practice that is considered a form of protection. However, in the contemporary context, this practice is increasingly questioned because it is contrary to the principles of gender equality, human rights, and maqāṣid shari'ah. This study shows that forced marriage by a guardian without the consent of a woman has the potential to create mafsadat, such as household disharmony and violation of individual autonomy. From the perspective of maqāṣid syarī'ah, marriage must ensure the public interest, justice, and individual freedom. Countries such as Indonesia have abolished the right of guardians to force marriage through regulations, such as Law No. 1 of 1974 and KHI. The recontextualization of the guardian mujbir is needed to shift the role of the guardian from a coercive authority to a companion who ensures the public interest.

Abstract

This study examines the implementation of Law Number 1 of 2024t he second amendment to Indonesia’s Electronic Information and Transactions (ITE) Law in countering online gambling in the city of Bukittinggi, and interprets that enforcement through the lens of siyāsah tanfīdhiyyah, the Islamic jurisprudence of executive governance. Although online gambling has become one of Indonesia’s most pressing forms of cybercrime, existing scholarship has largely approached ITE enforcement from a positive-law and normative standpoint, leaving a gap in empirical, locally grounded analysis that simultaneously engages an Islamic-governance framework. Adopting a qualitative socio-legal (empirical-juridical) approach and an intrinsic case-study design centred on the Bukittinggi City Police (Polresta Bukittinggi), data were gathered through semi-structured interviews, non-participant observation, and documentation including the case file of a prosecuted online-gambling offender and analysed through source and method triangulation. The findings show that enforcement in Bukittinggi has reached a serious operational stage and demonstrates procedural fidelity to Articles 27(2) and 45(3) of the ITE Law, yet remains constrained by the absence of an autonomous cyber unit, limited digital-forensic capacity, slow inter-agency coordination, the futility of temporary site-blocking, and weak preventive literacy. Read through siyāsah tanfīdhiyyah, this enforcement expresses tanfīdh sharʿī and an orientation toward maṣlaḥah and ḥimāyat al-ummah, though the persistent role distance between the ideal and the actual demands a more progressive ijtihād tanfīdhī. The article contributes an integrative model linking empirical cyber-enforcement analysis with Islamic executive-governance theory

Abstract

Artikel ini bertujuan untuk menganalisis relevansi pemikiran Mohammad Natsir dalam merespons tantangan pendidikan Islam kontemporer. Masalah utama yang dikaji adalah bagaimana pemikiran Natsir mengenai pendidikan Islam dapat menjadi solusi atas problem dualisme ilmu, krisis moral, dan lemahnya orientasi spiritual dalam dunia pendidikan saat ini. Fokus penelitian ini diarahkan pada tiga aspek utama: gagasan Natsir tentang integrasi antara ilmu agama dan ilmu umum, urgensi pendidikan karakter berbasis nilai-nilai tauhid, serta pentingnya kemandirian lembaga pendidikan Islam. Penelitian ini menggunakan metode kualitatif dengan pendekatan studi kepustakaan (library research). Data diperoleh dari sumber-sumber primer berupa karya tulis Mohammad Natsir dan sumber sekunder berupa buku, artikel jurnal, serta dokumen ilmiah lain yang relevan. Teknik pengumpulan data dilakukan melalui telaah dokumen, sedangkan analisis data dilakukan dengan teknik analisis isi (content analysis) untuk menggali substansi pemikiran Natsir secara mendalam. Hasil kajian menunjukkan bahwa pemikiran Mohammad Natsir tetap kontekstual dan relevan sebagai landasan konseptual dalam pengembangan pendidikan Islam yang integratif dan holistik. Gagasan-gagasannya dapat dijadikan rujukan dalam merumuskan sistem pendidikan Islam yang berakar kuat pada nilai-nilai keislaman serta mampu beradaptasi dengan tantangan zaman.
