Abstract

The neutrality of the State Civil Apparatus in local democratic contests, particularly Regional Head Elections, constitutes a fundamental principle for the realization of a clean, professional, and democratic system of governance. As an integral component of the state apparatus, ASN plays a strategic role in public administration and service delivery, thereby requiring impartiality and freedom from practical political interests. Nevertheless, empirical realities indicate that violations of ASN neutrality during Pilkada remain prevalent, manifesting in both direct and indirect political involvement, misuse of state resources, and administrative actions that favor certain candidate pairs. This condition reflects a persistent gap between normative legal frameworks and their practical implementation. This article aims to examine the challenges surrounding ASN neutrality in Pilkada by analyzing regulatory arrangements, implementation practices, and supervisory mechanisms from a constitutional law perspective. Employing a normative juridical approach, this study reviews statutory regulations, legal doctrines, and findings from relevant national scholarly journals. The analysis reveals that although the legal framework governing ASN neutrality is relatively comprehensive, the effectiveness of law enforcement and oversight mechanisms continues to face significant obstacles. These include weak inter-institutional coordination among supervisory bodies, political pressures exerted on the bureaucracy, and a limited level of legal awareness among certain segments of ASN. From the standpoint of constitutional law, breaches of ASN neutrality have serious implications for the quality of democracy, the realization of good governance principles, and the legitimacy of local governments produced through Pilkada. Therefore, strengthening legal policies, enhancing supervisory capacity, and reinforcing bureaucratic ethics development are essential measures to ensure the consistent enforcement of ASN neutrality in every local democratic process.

Abstract

The professionalism of the State Civil Apparatus (Aparatur Sipil Negara/ASN) constitutes a fundamental principle in the implementation of public services that prioritize societal interests. ASN are not merely responsible for executing government policies, but also serve as the frontline actors in delivering public services that are effective, efficient, transparent, and equitable. This article aims to examine the principle of ASN professionalism in public service delivery in Indonesia, as well as the factors influencing it within the framework of bureaucratic reform and increasingly complex public demands. The research employs a qualitative approach using a literature review method, analyzing national scientific journals, statutory regulations, and other relevant literature related to ASN professionalism and public service. The findings indicate that ASN professionalism is not an isolated concept, but is shaped by several key factors, including human resource competence, ethical conduct and integrity of civil servants, the utilization of information technology in public services, and the implementation of a merit-based system in ASN management. Adequate competence enables civil servants to perform their duties optimally, while service ethics play a crucial role in fostering public trust. Furthermore, the adoption of digital technology has proven effective in enhancing service efficiency and transparency, whereas the merit system promotes objectivity and fairness in career development. The implications of this study highlight the necessity of continuously strengthening ASN professionalism through capacity building, ethical development, and adaptive bureaucratic reforms in response to contemporary challenges. Therefore, ASN professionalism serves as a vital foundation for achieving high-quality public services oriented toward public satisfaction.

Abstract

Konsep living law merepresentasikan keberadaan norma hukum yang berkembang dan dipatuhi secara nyata dalam kehidupan masyarakat Indonesia yang memiliki keragaman sosial dan budaya. Keberadaan norma tersebut memperoleh pengakuan normatif melalui pengaturan dalam Kitab Undang-Undang Hukum Pidana (KUHP) Nasional, yang membuka peluang bagi hukum adat untuk diintegrasikan ke dalam sistem hukum pidana positif. Pengakuan terhadap living law ini dimaksudkan sebagai upaya negara untuk mengakomodasi nilai-nilai lokal yang hidup di masyarakat, sekaligus memperkuat rasa keadilan substantif yang berakar pada realitas sosial. Meskipun demikian, pengaturan tersebut tidak terlepas dari berbagai perdebatan yuridis, terutama terkait dengan potensi benturan antara pengakuan hukum adat dan prinsip kepastian hukum yang menjadi pilar utama asas legalitas dalam hukum pidana. Artikel ini bertujuan untuk menganalisis pengaturan living law dalam KUHP Nasional dengan menitikberatkan pada landasan konseptual, tantangan implementatif, serta implikasinya terhadap asas legalitas dan perlindungan hak asasi manusia. Selain itu, kajian ini juga mengkaji sejauh mana mekanisme harmonisasi dapat dilakukan agar keberlakuan living law tidak menimbulkan ketidakpastian hukum atau membuka ruang penyalahgunaan kewenangan dalam praktik penegakan hukum. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual, yang didukung oleh analisis terhadap literatur dan jurnal hukum nasional yang relevan. Hasil kajian menunjukkan bahwa pengakuan living law dalam KUHP Nasional merupakan langkah progresif dalam merespons pluralisme hukum di Indonesia. Namun, tanpa batasan normatif yang jelas, pengaturan tersebut berpotensi menimbulkan problematika hukum, khususnya dalam menjamin kepastian hukum dan perlindungan hak asasi manusia. Oleh karena itu, diperlukan formulasi kebijakan yang lebih terukur dan harmonis agar integrasi living law dalam sistem hukum pidana nasional dapat berjalan secara adil, proporsional, dan konstitusional.
