Abstract

The research conducted is normative legal research with statutory methods (statute approach), conceptual approach (conceptual approach) in adjudicating women facing the law, judges have considerations based on facts in court, exploring the values that live in society, conventions and international agreements related to gender equality that have been ratified. The concept of legal protection for women in conflict with the law does not seem to be well implemented, because in reality there are still many women in Indonesia who are in conflict with the law who find it very difficult to get access to justice. Abstract

The government has taken steps and efforts to curb gambling, limiting it to the smallest possible environment, gambling which still frequently occurs in the Legal Area of Serdang Bedagai Regency, such as KIM gambling carried out by Serdang Bedagai residents who have been convicted and found guilty as per Decision Number: 161 /Pid.B/2022/Srh. The formulation of the problem is how the provisions of the criminal act of deliberately giving the general public the opportunity to play gambling games, and how law enforcers attempt to apply criminal sanctions against perpetrators who open gambling businesses, as well as how the judge considers cases of criminal acts of deliberately giving the public an opportunity. It's common to play gambling games. The research method used is normative legal research. In relation to the criminal provisions, the act of intentionally giving the general public the opportunity to play gambling games is regulated in Article 303 of the Criminal Code, and law enforcement efforts in implementing criminal sanctions against perpetrators who open gambling businesses in the case of Decision Number: 161/PId.B/2022/ SRH, the Defendant as the perpetrator who carried out the action deliberately gave the general public the opportunity to play gambling games, and as a form of law enforcement, the defendant's actions are regulated and punishable by crime in Article 303 paragraph (1) 1st of the Criminal Code in conjunction with Article 303 paragraph (1) 2nd of the Criminal Code, as well as the Judge's Considerations in criminal cases involving intentionally giving the general public the opportunity to play gambling games.

Abstract

The modus operandi of narcotics trafficking syndicates can easily penetrate the borders of countries in the world through neat management networks and sophisticated technology so that they can enter Indonesia as a transit country or even as a destination country for illegal narcotics trafficking (point of market-state).The formulation of the problem in this research is how the criminal law is regulated against international network narcotics traffickers in the North Sumatra region, and how the Regional Police's Narcotics Research Directorate uncovers the distribution of international network narcotics in the North Sumatra region, as well as what obstacles the Research Directorate finds. Regional Police Narcotics in uncovering international network narcotics distribution in the North Sumatra region. The research method used is empirical juridical legal research. The regulation of criminal law against narcotics dealers is regulated in Chapter Class II, and Class III Narcotics. And the North Sumatra Regional Police's Narcotics Investigation Directorate in uncovering the distribution of international network narcotics in the North Sumatra region took actions or steps such as pre-emptive action, preventive action and repressive action, and the obstacles found included limited police personnel, lack of facilities and infrastructure, and factors that include the ability of organizational resources so that pre-emptive actions, preventive actions and repressive actions are not maximized. Punishment sanctions against international network narcotics traffickers should be accompanied by confiscation of assets which are used for the recovery of the younger generation who have been damaged by narcotics, and additional infrastructure.

Abstract

ITE crimes are increasingly common in Indonesia, so the National Police Chief issued Circular Number: SE/2/II/2021 concerning Ethical Cultural Awareness to Create a Clean, Healthy and Productive Indonesian Digital Space. The National Police Chief asked National Police Investigators to prioritize restorative justice in resolving cases. The formulation of the problem is how the criminal law perspective applies in implementing restorative justice in ITE criminal cases, and how law enforcement efforts by the North Sumatra Regional Police are implemented in implementing restorative justice in ITE criminal cases, as well as what obstacles North Sumatra Regional Police investigators find in implementing restorative justice in ITE criminal cases. This research method is empirical juridical legal research. In implementing restorative justice in ITE cases, it is regulated in the National Police Chief's Circular Letter No.SE/8/VII/2018, Law enforcement efforts by the Police in implementing restorative justice are carried out namely the preparation, implementation and results stages of Restorative Justice. Obstacles for Police investigators in implementing restorative justice in ITE cases include internal factors including the lack of professionalism of investigators, the ability of the Investigating Organization's resources, and external factors including one of the parties not being willing to make peace, the victim's request to be paid compensation, the perpetrator not being willing to take responsibility. As a suggestion, restorative care should be regulated in law, and restorative efforts should be facilitated by investigators, and investigators should be given special training so that mediation through restorative justice facilities can be carried out well.

Abstract

The behavior of illegal levies in the jurisdiction of the Binjai Police is still found to be carried out by civil servants and some are carried out by groups of people who engage in thuggery around public facilities such as bus terminals, train stations and so on. Because extortion has become very widespread in public services, the Government issued Presidential Decree no. 87 of 2016 concerning the Task Force to Clean Up Illegal Levies, this Presidential Decree was issued because the practice of illegal levies has damaged the life of society, the nation and the state so that efforts to eradicate it are needed in a firm, integrated, effective, efficient and capable of having a deterrent effect. This research discusses criminal law provisions for perpetrators of criminal acts of illegal levies, and law enforcement efforts by the Binjai Police Criminal Investigation Unit against perpetrators of criminal acts of illegal levies, as well as obstacles found by the Binjai Police Criminal Investigation Unit in carrying out law enforcement against perpetrators of criminal acts of illegal levies. This research method is empirical juridical legal research. The legal provisions for illegal levies can be identified with extortion, threats, fraud, even gratification, corruption. Efforts to enforce the law against perpetrators, by maintaining security and public order, are based on the nature of the Police's duties with Pre-emptive, Preventive and Repressive functions. The obstacles found were overlapping legal regulations, limited police personnel, lack of facilities and facilities, weak organizational resource capacity of the Binjai Police. It would be better for the crime of illegal levies to have its own legal provisions in the Criminal Code, so that it no longer uses the Articles of Extortion or fraud, and it would be better for law enforcement not only to be given less prison sanctions but to be given fines and restitution.

Abstract

Indonesia merupakan negara yang kaya akan sumber daya alam. Hasil dari sumber daya alam yang dimiliki digunakan untuk mencukupi kebutuhan dalam Negeri dan di eskpor ke luar Negeri. Walaupun Indonesia kaya akan sumber daya alamnya, namun terdapat keterbatasan terhadap bidang sumber daya manusia. Keterbatasan sumber daya manusia yang dimiliki, meliputi keterbatasan dalam memproduksi barang, merupakan salah satu faktor pendorong dalam mengimpor barang dari luar negeri untuk masuk ke Indonesia. Seiring dengan itu, adanya perdagangan bebas dan regionalisasi perdagangan (integrasi ekonomi) menyeba bukan perdagangan internasional yang terjadi mensyaratkan adanya produk-produk yang makin kompetitif. Produk-produk yang diperdagangkan antar negara akan cenderung mempunyai kesamaan (berada dalam satu kelompok komoditas) atau intensitas perdagangan intra-industri akan makin meningkat. Banyak studi empiris membuktikan bahwa dengan adanya integrasi ekonomi akan meningkatkan intensitas perdagangan intra. Jenis Penelitian yang ditelaah adalah penelitan hukum normatif dengan pendekatan perundang-undangan (statute approach) dalam melakukan pengkajian menelaah, menjelaskan, dan menganalisis suatu peraturan hukum. Sifat penelitian yaitu preskriptif analitis dengan menganalisis suatu permasalahan hukum. Data yang digunakan dalam penelitian ini adalah data sekunder. Pengumpulan data pada penelitian tesis ini menggunakan penelitian kepustakaan (library research). Analisis Yuridis Birokrasi Dalam Penyidikan Tindak Pidana Di Bidang Industri Dan Perdagangan yaitu problematika sistem birokrasi menjadi penyebab terjadinya tindak pidana industri dan perdagangan.

Abstract

Di Indonesia dalam pelaksanaan hukuman ataupun pidana terhadap pelaku kasus penganiayaan oleh para penegak hukum lebih cenderung memproses pidananya dengan menjerat dan menghukum memasukkan pelaku ke dalam penjara tanpa melihat bagaimana sebab kasus penganiayaan terbebut bisa terjadi, yang mana para penegak hukum dapat bisa melakukan upaya restorative justice dengan mediasi menjembatani (menengahi) para pihak antara pelaku terhadap korban tanpa harus melakukan proses hukum pidana akan tetapi dengan memberi sanksi/hukuman ganti rugi atau biaya pengobatan yang te;ah diderita oleh korban. Dari hasil penelitian yag dilakukan dengan teknik kepustakaan dan wawancara dan menggunakan metode analisis kualitatif, maka diperoleh hasil penelitian yaitu pertama; bentuk tindak pidana penganiayaan dalam penerapan restorative justice pada tingkat Kejaksaan negeri Deli Serdang adalah penganiayaan ringan, penganiayaan terhadap pelaku anak, penganiayaan yang pelakunya dan korbannya mempunyai hubungan emosional, kedua;, faktor-faktor penghambat dalam penyelesaian tindak pidana penganiayaan melalui penerapan restorative justice pada Kejaksaan Negeri Deli Serdang adalah faktor penegak hukum, faktor substansi hukum, dan faktir budaya, ketiga; penerapan restorative justice penyelesaian tindak pidana penganiayaan pada Kejaksaan Negeri Deli Serdang adalah berdasarkan Peraturan Kejaksaan No. 15 Tahun 2020. Melalui Peraturan Kejaaksaan Tersebut bahwa kewenangan Penuntut Umum untuk menutup perkara demi kepentingan hukum dengan alassan telah adanya penyelesaian perkara di luar pengadilan (afdoening buiten process). Syarat, tata cara, serta mekanisme upaya perdamaian dalam penghentian penuntutan erdasarkan restorative justice oleh Kejaksaan Negeri Deli Serdang diatur dalam Peraturan Kejaksaan No. 15 Tahun 2020.

Abstract

Penerapan prinsip keadialan restoratif oleh Kejaksaan dengan mengeluarkan Peraturan Kejaksaan Nomor 15 Tahun 2020 tentang Penghentian Penuntutan Berdasarkan Keadilan Restoratif. Dengan adanya Perja 15 Tahun 2020 terebut maka kewenangan penuntut umum lebih mengedepankan prinsip keadilan restoratif terutama untuk melakukan proses penghentin penuntutan (menutup perkara demi kepentingan hukum). Seperti diketahui semula Pasal 14 Undang-Undang Nomor 8 Tahun 1981 tentang Hukum Acara Pidana mengatur beberapa kewenangan penuntut umum. Lahirnya Keadilan Restoratif karena keadaan Indonesia pada masa lalu. Pendekatan yang dipakai dalam penelitian ini yaitu jenis penelitian hukum sosiologi (yuridis empiris) bertujuan menganalis permasalahan dengan memadukan bahan-bahan hukum (yang merupakan data sekunder) dengan data primer yang diperoleh dilapangan. Adapun kesimpulan Penelitian Penelitian ini adalah, bahwa : Penerapan restorative justice di Kejaksaan Negeri Deli Serdang pada dasarnya telah sesuai dengan Peraturan Kejaksaan Republik Indonesia Nomor 15 Tahun 2020. Namun demikian, sampai saat ini Kejaksaan Negeri Deli Serdang hanya berhasil melaksanakan mekanisme penyelesaian perkara di luar pengadilan. Beberapa kendala yang dihadapi oleh Kejaksaan Negeri Deli Serdang dalam menerapkan restorative justice meliputi; persoalan struktur pelaksana restorative justice yang kurang siap melaksanakan mekanisme tersebut; Masalah fasilitas dan sarana berkaitan dengan berkas yang dibutuhkan untuk menunjang terealisasinya restorative justice ; Partisipasi masyarakat juga masih sangat minim dalam restorative justice yang diakibatkan kurangnya pemahaman masyarakat akan pentingnya menerapkan mekanisme dan budaya hukum masyarakat yang kebanyakan masih belum dapat menerima penyelesaian dengan restorative justice.

Abstract

Article 55 Paragraph 1 to 1 of the Indonesian Criminal Code (KUHP) states that those who commit, order, and participate in committing the act are convicted as perpetrators of criminal acts. This includes the Master and Crew of Boath in Illegal Fishing related to fishing without a permit, using fake permits, using prohibited fishing gear, and catching species of fish that do not comply with the permit.    The research problems in this study are: 1) What is the legal system in fisheries crimes? 2) How is the law enforcement against Article 55 of the Indonesian Criminal Code in the supervisory function in marine and fisheries resources? 3) What is the criminal liability for boat crews who commit fisheries crimes? This study is normative legal research with a statute approach in conducting the study. The data collection techniques used were library research.    Based on the results of the study, data on illegal fishing in the fishing sector handled regarding the evidence of boats being burned, sunk, and/or destroyed in Marine and Fisheries Resources Surveillance (PSDKP) of Batam City of 2022, 2023, dan 2024 show that there are eighteen (18) units of boats with Malaysia, Myanmar, and Vietnam flags that have been sunk with other supporting facilities and equipment in committing illegal fishing, such as purse seine, trawl, fishing lights, hand line, GPS Samsung, HF Transceiver VX-1700, Radio Sea Eagle 6900, Compass Express, and navigation and communication tool. Tanjung Pinang District Court of 2024 with Case Number: 1/Pid.Sus-PRK/2023/PN TPG dan No. Case: 2/Pid.Sus-PRK/2023/PN TPG. The verdict has been a permanent legal force by prosecuting the Master and Crew of the Boat as the Defendant of Fisheries Crimes.
