Abstract

Children as drug abusers, are just victims. So it is not appropriate for the state to give punishment by looking at the same between child abusers and real adult criminals (dealers). As victims, children as narcotics abusers must get protection. Based on the results of an interview with Bastian Sihombing as the Head of the Pre-Prosecution at the Belawan State Prosecutor's Office, from 2019 to 2022 around 41 cases were resolved by diversion. This study aims to analyze the criteria for the age of children facing the law in narcotics crime, the factors that cause children to become victims of narcotics abuse and legal protection for children as victims of narcotics abuse at the Belawan District Attorney's Office. This research method uses empirical research with primary data types, by conducting interviews at the Belawan District Attorney. Based on the results of the study, the Belawan District Attorney's Office carried out rehabilitation measures as an effort to protect children from narcotics abuse victims in the juvenile criminal justice system, which must be pursued, with agreed terms and conditions set forth in conclusions and diversion agreements, or if rehabilitation must be carried out. the child will be immediately asked for an assessment by the integrated assessment team

Abstract

Cases of criminal acts of corruption were carried out jointly based on the study of the Supreme Court's decision Number 1054 K/Pid.Sus/2019. The Defendant Luanna Wiriawaty as Director of PT Djaya Bima Agung who was appointed as the winner of the auction for the Procurement of KB II Batang Three-Year implants Plus Inserter T.A 2014 at the Directorate of Family Planning Health Development through the Government Line at the Deputy for Family Planning and Reproductive Health BKKBN, together with witness Yenny Wiriawaty as President Director of PT Triyasa Nagamas Farma as well as shareholder of PT Djaya Bima Agung and witness Karnasih Tjiptaning, S. Kom., MPH as Commitment Making Officer (each is subject to separate prosecution). This study aims to examine the regulation of criminal acts of corruption that are carried out together based on the applicable legal provisions in Indonesia. To examine the mechanism of reverse evidence in the crime of corruption and to analyze juridically the legal sanctions for the crime of corruption carried out together with the decision of the Supreme Court Number 1054 K/Pid.Sus/2019. This research method uses normative research with data types consisting of primary legal materials, secondary legal materials and tertiary legal materials. The results of this study the Supreme Court has mistakenly applied article 2 paragraph (1) to the defendant in the aquo case, in the author's opinion the difference between article 2 and article 3 of Law 31 of 1999 concerning the Crime of Corruption, namely in Article 3, the perpetrator can be charged if has the authority, while in Article 2, everyone referred to in the article is broader and more general. Abstract

The arrest of narcotics addicts to become suspects and so they can be rehabilitated, through several processes that are not easy. Therefore, some people must know about the process of handling it. This study aims to analyze the legal arrangements for rehabilitation actions for suspected narcotics addicts at the investigation stage in the police, the case investigation system in Narcotics Crimes at the North Sumatra Police Narcotics Investigation Directorate and the implementation of rehabilitation for suspected narcotic addicts at the examination stage at the Sumatra Regional Police Narcotics Investigation Directorate. North. This research method uses empirical research with primary data types, by conducting interviews at the Directorate of Drug Investigation of the Regional Police of North Sumatra. Based on the results of the study that the rehabilitation measures for suspected narcotics addicts were at the investigation stage in 2019 nil, 2020 nil, while in 2021 as many as 89 suspects and in 2022 as many as 4 suspects were carried out rehabilitation actions at the investigation stage at the North Sumatra Police Narcotics Directorate, as for the factors The obstacle in implementing rehabilitation measures for suspected narcotics addicts is related to the financing that must be issued by the suspect and the lack of availability of rehabilitation centers that can accept suspected narcotics addicts due to the large number of narcotics addicts

Abstract

Ganjaran ialah salah satu perlengkapan fakta yang legal bagi hukum sebab dipakai buat menguak suatu kenyataan. Penjelasan saksi digali buat mencari cara bukti atas perbuatan kejahatan yang lagi dalam pengecekan pada langkah investigasi sampai langkah cara pengecekan masalah di Majelis hukum. Penjelasan saksi yang diserahkan oleh orang yang sudah penuhi ketentuan tidak hendak jadi sesuatu permasalahan ataupun perbincangan., kaan namun bila sesuatu penjelasan saksi diserahkan oleh anak selaku saksi. Penjelasan dari anak selaku saksi bisa mempunyai angka pembuktian serta dapatkah dijadikan perlengkapan fakta yang legal ataupun tidak di majelis hukum, mengenang anak selaku saksi tidak disumpah serta anak selaku saksi dikira belum berusia. Proteksi hukum kepada anaks ebagai saksi dalam masalah kejahatan Tetapan Majelis hukum Negara Lubuk akam Nomor. 1482 atau Pid. B atau 2015? pn. Lbp, proteksi anak selaku saksi berkuasa atas usaha rehabilotasi kedokteran serta rehabilitasi sosial, bagus di dalam badan ataupun di luar badan; agunan keamanan bagus raga, psikologis, ataupun sosial; keringanan dalam mendaatkan data hal kemajuan masalah. Anak yang berdekatan dengan hukum harus disidangkan di majelis hukum spesial anak yang terletak sedang pada area peradilan biasa. Sistem cara penanganan erkara kejahatan anak yang berdekatan dengan hukum wajib bersumber pada kegiatan peradilan kejahatan anak. Angka pembuktian penjelasan anak selaku saksi dalam masalah kejahatan Tetapan Majelis hukum Negara Lubuk Pakam Nomor. 1482 atau Pid. B atau 2015 atau PN. Lbp, penjelasan anak emmpunyai daya angka pembuktian selaku fakta bonus serta selaku petunjuk untuk juri, penjelasan saksi anak yang tidak disumpah bila penjelasan itu cocok dengan penjelasan dari saksi yang disumpah bisa dipakai selaku bonus perlengkapan fakta yang legal serta dijadikan selaku estimasi juri. Kendala- kendala yang menimbulkan sulitnya buat memperoleh penjelasan saksi anak yang dibeberkan dalam pesidangan merupakan saksi anak yang sedang berumur dibawah baya, akibat dari peristiwa perbuatan kejahatan kekerasan kepada anak pengaruhi kondisi intelektual serta psikologis alhasil memunculkan perasaan guncangan tajut anak.

Abstract

Di Indonesia dalam pelaksanaan hukuman ataupun pidana terhadap pelaku kasus penganiayaan oleh para penegak hukum lebih cenderung memproses pidananya dengan menjerat dan menghukum memasukkan pelaku ke dalam penjara tanpa melihat bagaimana sebab kasus penganiayaan terbebut bisa terjadi, yang mana para penegak hukum dapat bisa melakukan upaya restorative justice dengan mediasi menjembatani (menengahi) para pihak antara pelaku terhadap korban tanpa harus melakukan proses hukum pidana akan tetapi dengan memberi sanksi/hukuman ganti rugi atau biaya pengobatan yang te;ah diderita oleh korban. Dari hasil penelitian yag dilakukan dengan teknik kepustakaan dan wawancara dan menggunakan metode analisis kualitatif, maka diperoleh hasil penelitian yaitu pertama; bentuk tindak pidana penganiayaan dalam penerapan restorative justice pada tingkat Kejaksaan negeri Deli Serdang adalah penganiayaan ringan, penganiayaan terhadap pelaku anak, penganiayaan yang pelakunya dan korbannya mempunyai hubungan emosional, kedua;, faktor-faktor penghambat dalam penyelesaian tindak pidana penganiayaan melalui penerapan restorative justice pada Kejaksaan Negeri Deli Serdang adalah faktor penegak hukum, faktor substansi hukum, dan faktir budaya, ketiga; penerapan restorative justice penyelesaian tindak pidana penganiayaan pada Kejaksaan Negeri Deli Serdang adalah berdasarkan Peraturan Kejaksaan No. 15 Tahun 2020. Melalui Peraturan Kejaaksaan Tersebut bahwa kewenangan Penuntut Umum untuk menutup perkara demi kepentingan hukum dengan alassan telah adanya penyelesaian perkara di luar pengadilan (afdoening buiten process). Syarat, tata cara, serta mekanisme upaya perdamaian dalam penghentian penuntutan erdasarkan restorative justice oleh Kejaksaan Negeri Deli Serdang diatur dalam Peraturan Kejaksaan No. 15 Tahun 2020.

Abstract

Di Indonesia dalam pelaksanaan hukuman ataupun pidana terhadap pelaku kasus penganiayaan oleh para penegak hukum lebih cenderung memproses pidananya dengan menjerat dan menghukum memasukkan pelaku ke dalam penjara tanpa melihat bagaimana sebab kasus penganiayaan terbebut bisa terjadi. Studi ini bertujuan untuk menganalisis penerapan restorative justice dalam kasus penganiayaan (studi pada tingkat Kejaksaan Negeri Deli Serdang). Detail riset ini ialah riset hukum normatif ataupun dokrinal yang diucap pula riset daftar pustaka. Watak dari riset ini merupakan deskritif analitiss ialah unutk mendapatkan cerminan yang komplit serta nyata mengenai permaslahan yang terdapat pada masyrakat yang setelah itu berhubungan dengan ketentuan- ketentuan ataupun perartuan- peraturan hukum yang legal, alhasil kesimpulannya bisa didapat sesuatu kesimpulan. Dari hasil penelitian yang dilakukan dengan teknik kepustakaan dan wawancara dan menggunakan metode analisis kualitatif, maka diperoleh hasil penelitian yaitu pertama; bentuk tindak pidana penganiayaan dalam penerapan restorative justice pada tingkat Kejaksaan negeri Deli Serdang adalah penganiayaan ringan, penganiayaan terhadap pelaku anak, penganiayaan yang pelakunya dan korbannya mempunyai hubungan emosional, kedua;, faktor-faktor penghambat dalam penyelesaian tindak pidana penganiayaan melalui penerapan restorative justice pada Kejaksaan Negeri Deli Serdang adalah faktor penegak hukum, faktor substansi hukum, dan faktir budaya, ketiga; penerapan restorative justice penyelesaian tindak pidana penganiayaan pada Kejaksaan Negeri Deli Serdang adalah berdasarkan Peraturan Kejaksaan No. 15 Tahun 2020. Abstract

Narcotics crime cases that are happening today, dealers in narcotics trading involve minors as narcotics couriers whose job is to deliver or buy and sell narcotics. Involving children who are included to facilitate narcotics dealers in conducting transactions to deceive law enforcement officers. The factors that cause children to become drug couriers are the lack of supervision from parents; environmental factor; economic factors. Legal protection for children who are used as couriers in narcotics crimes, then based on Article 5 of Law No. 11 of 2012 concerning SPPA, a diversion process must be pursued with a restorative justice approach, starting from the process of investigation, prosecution to examination in court. criminal sanctions against children who become narcotics couriers, criminal sanctions are imposed or action is imposed, related to criminal sanctions Article 81 of Law no. 11 of 2012 concerning SPPA, the criminal sanction of imprisonment is (half) of the maximum threat of imprisonment for adults. Related actions are: returning to parents or guardians, treatment in mental hospitals, treatment at LPKS, obligations to attend education or training, repairs due to criminal acts (restorative justice).

Abstract

In Indonesia, in the implementation of punishments or crimes against perpetrators of abuse cases, law enforcers are more likely to process their crimes by ensnare and sentence the perpetrators to prison regardless of how the abuse case occurred, in which case law enforcers can make restorative efforts. justice with mediation bridges (mediates) the parties between the perpetrators and the victims without having to carry out a criminal law process but by imposing sanctions/punishments on compensation or medical expenses that have been suffered by the victims. The crime of persecution in the application of restorative justice at the Deli Serdang District Attorney level is a form of crime of persecution that can be applied to a restorative justice settlement, including: minor maltreatment, maltreatment of child perpetrators, abuse in which the perpetrator and the victim have an emotional relationship. The inhibiting factors in solving the crime of persecution through the application of restorative justice at the Deli Serdang District Attorney are influenced by law enforcement factors, legal substance factors, and cultural factors. The application of restorative justice for the settlement of the crime of persecution at the Deli Serdang District Attorney level is based on Prosecutor's Regulation No. 15 of 2020. Through the Prosecutor's Regulation, it is stated that the Public Prosecutor's authority is to close cases for the sake of law on the grounds that there has been a settlement of cases outside the court (afdoening buiten process). The terms, procedures, and mechanisms for conciliation efforts in ending prosecutions based on restorative justice by the Deli Serdang District Attorney are regulated by Prosecutor's Regulation No. 15 of 2020.

Abstract

Road traffic and transportation are important in increasing social mobility for the people of Indonesia because all the time Indonesian people continue to be attached to various kinds of interests in the use of transportation. The Indonesian people must follow and comply with all traffic rules regulated by Law no. 22 of 2009 concerning Road Traffic and Transportation (UULDAJ). Road users often ignore traffic signs. UULDAJ contains sanctions for traffic violations and regulates matters regarding traffic crimes. Criminal provisions start from Article 273 to Article 317. Traffic accident is an incident on the road that is unexpected and unintentional involving a vehicle with or without other road users resulting in human casualties and/or property loss. A single accident is an accident that only involves one motor vehicle and does not involve other road users at all. Negligence in traffic that results in traffic accidents causing vehicle damage, causing injuries, and even death to other people is regulated in Article 310 of the UULLDAJ which determines criminal liability for anyone driving a motorized vehicle due to negligence resulting in traffic accidents with serious injuries to the victim shall be punished with imprisonment. maximum 5 years. Meanwhile, in the event of an accident that results in the death of another person, the punishment is a maximum imprisonment of 6 years. The Police Institution related to the Coal Police Station is the implementer of the duties and authorities of the National Police in the city district area. In connection with the event of an accident, the Police officer is obliged to handle the accident by going to the scene of the incident immediately, helping the victim, processing the scene of the case, regulating the smooth flow of traffic.

Abstract

Narcotics confiscated goods that have been decided by the Court and have a decision that has permanent legal force, there are still very many that are not immediately destroyed, of course this has the risk of irregularities where the prohibited goods can be circulated back to the community. In carrying out the action of destroying narcotics evidence according to Article 26 paragraph 1 PP No. 40 of 2013 concerning the Implementation of Law No. 35 of 2009 concerning narcotics, law enforcement agencies that are allowed to destroy narcotics evidence are BNN investigators and POLRI investigators, and prosecutors. And there are 5 (five) factors in the obstacles to the destruction of confiscated goods from narcotics crimes. First; the legal factor itself, Second; law enforcement factors, Third; factor of facilities or facilities, Fourth; community factor. The Belawan District Prosecutor's Office has taken preventive action, namely control is carried out to prevent the possibility of undesirable things from happening in the future, preventive or preventive actions are carried out by the Belawan District Prosecutor's Office as the executor of the Court Decision, aiming to protect against bad things that may occur, such as loss or misuse of confiscated narcotics. It is recommended that in carrying out the destruction of confiscated narcotics, a joint decision be drawn up between the Police, BNN, Prosecutor's Office, Court, regarding the evidence submitted to the Prosecutor's Office, only the remaining laboratory results do not need a maximum of 10 grams, this is done to prevent irregularities from circulating narcotics back into the community.
