Abstract

Eksistensi hak ulayat masyarakat hukum adat di Indonesia mencerminkan pengakuan konstitusional negara terhadap keberadaan masyarakat adat sebagai bagian dari sistem hukum nasional. Penelitian ini bertujuan untuk menganalisis eksistensi dan pelaksanaan hak ulayat masyarakat Persukuan Melayu Sumpu di Kenegerian Kuok dalam perspektif hukum tata negara dan hukum administrasi negara. Metode penelitian yang digunakan adalah yuridis normatif dengan dukungan observasi lapangan. Hasil penelitian menunjukkan bahwa hak ulayat masyarakat Persukuan Melayu Sumpu masih diakui baik secara normatif maupun empiris, namun terdapat tantangan dalam implementasi administratif, khususnya terkait pendaftaran tanah dan koordinasi dengan pemerintah daerah. Dalam konteks hukum tata negara, pengakuan hak ulayat sejalan dengan Pasal 18B ayat (2) dan Pasal 28I ayat (3) UUD 1945. Sementara dalam perspektif hukum administrasi negara, pelaksanaannya membutuhkan instrumen administratif konkret seperti peraturan daerah dan mekanisme pendaftaran tanah untuk menjamin perlindungan dan keberlanjutan hak ulayat tersebut.

Abstract

Penunjukan Penjabat Kepala Daerah merupakan kebijakan sementara yang diambil oleh Pemerintah Pusat dalam rangka menjaga kesinambungan penyelenggaraan pemerintahan daerah ketika terjadi kekosongan jabatan kepala daerah definitif. Penelitian ini bertujuan untuk menganalisis mekanisme penunjukan Penjabat Kepala Daerah Kabupaten Kampar oleh Pemerintah Pusat serta implikasi hukumnya terhadap kewenangan dan hubungan antara Pemerintah Pusat dan Daerah dalam perspektif Undang-Undang Nomor 10 Tahun 2016 tentang Pemilihan Kepala Daerah. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa penunjukan Penjabat Kepala Daerah oleh Pemerintah Pusat memiliki dasar hukum yang kuat sebagaimana diatur dalam Pasal 201 ayat (10) UU No. 10 Tahun 2016, namun praktiknya sering menimbulkan problematika dalam konteks otonomi daerah dan prinsip demokrasi lokal. Implikasi hukumnya tampak pada penguatan dominasi Pemerintah Pusat terhadap penyelenggaraan pemerintahan daerah serta potensi disharmoni antara kepentingan lokal dan nasional.

Abstract

This study aims to examine and analyze the implementation of the authority of the Satuan Polisi Pamong Praja (Satpol PP) of Kampar District in enforcing Kampar District Regulation Number 8 of 2017 concerning Public Order and Tranquility in relation to the circulation of alcoholic beverages (tuak), as well as to identify the factors that hinder its implementation. This research uses a juridical-empirical research method with an administrative law approach, where data is collected through field studies and literature reviews. The research findings indicate that the Satuan Polisi Pamong Praja of Kampar District has carried out its functions and authority in enforcing this regulation through activities such as law enforcement, socialization, and actions against violations related to the circulation of tuak. However, in practice, there are still several obstacles, including limited human resources and infrastructure, low public awareness, and weak coordination between relevant agencies. From an administrative law perspective, the law enforcement practices carried out by Satpol PP Kampar have complied with the principles of  bestuur recht  or good governance law, although its effectiveness needs to be improved through stronger technical regulations, enhanced capacity of officials, and increased community participation in supporting the enforcement of the District Regulation.

Abstract

Sexual abuse against minors needs robust legislative safeguards within the criminal justice framework. The essential distinctions between civil law and common law systems result in divergent normative approaches that need comparative analysis to ascertain optimal procedures for safeguarding child victims. The objective of this study is to evaluate the efficacy of legal protections for child victims of rape by using a comparative normative analysis between the Indonesian civil law system and the American common law system, specifically within the framework of the criminal justice system. This study employs normative legal research techniques within a comparative legal analysis framework. Primary legal documents include legislation, federal and state laws, and 359 judicial rulings from the period 2019-2024. The analysis involved comparing laws at the same time using different methods, including looking at the law in context and interpreting it systematically and comparatively. Indonesia has a thorough legislative framework prioritizing restorative justice; yet, judicial execution reveals that just 34% of judgments adhere to the notion of the child's best interest. The United States exhibits more consistency (78%) in procedural protections via constitutional interpretation, notwithstanding the challenges of federal-state fragmentation. Both systems exhibit deficiencies in addressing cyber-facilitated abuse and developing technology. The efficacy of protection is contingent upon the uniformity of normative execution and the alignment of legislative and judicial practices. The convergence of legal systems is essential, with civil law embracing judicial flexibility and common law including systematic legislative methods to provide uniform child protection standards.

Abstract

This study aims to analyze the role of the Pelalawan Regency General Election Commission (KPU) in fulfilling the political rights of persons with disabilities based on Law Number 7 of 2017 concerning General Elections. This study uses a sociological juridical approach, by examining the provisions of laws and regulations governing the political rights of persons with disabilities and their implementation at the regional level. The results of the study indicate that the Pelalawan Regency KPU has implemented various efforts to ensure the political participation of persons with disabilities, such as providing accessibility facilities at Polling Stations (TPS), involving groups with disabilities in election stages, and inclusive socialization. However, in its implementation, obstacles are still found, including the lack of supporting facilities, limited assistance staff, and low understanding of officers regarding the special needs of persons with disabilities. Therefore, policy strengthening and ongoing training are needed for election organizers to realize the implementation of disability-friendly and fair general elections in accordance with the principle of equal rights of citizens.

Abstract

This study examines the constitutional obligation of the Indonesian state to guarantee equal access to education through a juridical normative analysis. Education in Indonesia is not only a social necessity but also a fundamental right enshrined in Article 31 of the 1945 Constitution, which mandates the government to organize and ensure an equitable national education system. The research uses a normative juridical approach by analyzing constitutional provisions, statutory regulations, and Constitutional Court decisions related to education and equality. The findings reveal that the Constitution provides a strong legal foundation for the right to education and equality before the law, supported by instruments such as Law No. 20 of 2003 on the National Education System and the constitutional requirement of allocating 20% of the national budget to education. However, challenges persist in implementation, including regional disparities, unequal resource distribution, and weak legal enforcement mechanisms. The study concludes that the realization of educational equality requires stronger legal accountability, equitable fiscal policy, and institutional consistency between constitutional norms and their practical execution. Strengthening constitutional integrity through judicial oversight and human rights–based education policies is essential to achieving the constitutional goal of “educating the life of the nation”.

Abstract

This study aims to find out how the legal protection of citizens' constitutional rights against land expropriation for the public interest by the state. The formulation of the problem proposed is first, why the applicant filed a review of Law no. 2 of 2012 concerning land acquisition for development in the public interest to the Constitutional Court and second, the basis for consideration of the constitutional judges in the Constitutional Court's decision no. 50/PUU-X/2012 which rejected the applicant's application. Using the research method of juridical normative analysis, with this approach we can describe and describe how the legal protection of citizens' constitutional rights against land expropriation for the public interest by the state. The research data was collected by means of a literature study using a conceptual approach. The results of the study concluded that first, Law no. 2 of 2012 is considered to ignore the interests of the community for the sake of business interests by certain groups so that the state is considered to have legalized the seizure of people's land which will cause the lower class people to suffer and secondly, the applicant's arguments have no legal basis. According to the Constitutional Court Judge, although the state provides opportunities for the private sector to be able to participate in fulfilling the public interest, the state can still determine policies related to the public interest, for example in setting toll rates managed by the private sector, so that the private sector cannot fully determine road tariffs by themselves. the toll road that is the investment of the person concerned. This study recommends the need for improvements and reforms in drafting the law should consider more input from the community, especially those who will be affected by the regulation, so that there are no lawsuits from the community.

Abstract

Legal protection in the sense that in addition to guaranteeing individual rights, must also determine the procedural way to obtain protection of the rights guaranteed to be one of the constitutional rights of citizens who have been recognized as part of human rights. Special Voter List is a list of voters who have a resident identity qualified as voters but have not been registered with the Permanent Voter List. Is the Protection of Special Voter suffrage Law in Kampar Regency in 2019 in accordance with Election Commission Regulation No. 9 of 2019 on Voting and Counting of Votes in General Elections. What are the Constraints of the Kampar District Election Commission in providing Special Voting Rights Legal Protection. What is the Form of Protection of Special Voter suffrage Law based on General Election Commission Regulation No. 9 of 2019. This type of research is the obesity of the field by way of survey. The nature of this researcheris adescriptive method. The ineffectiveness of Special Voters votes an hour before voting ends. If there is intentionalityor negligence that harms the suffrage of Indonesian citizens, Bawaslu conveyed the findings to be followed up by the Election Commission.

Abstract

This study looks at how Indonesia's presidential system regulates political parties from a justice-based point of view, using qualitative methods like document analysis, content analysis, and comparative studies. The results show that Indonesia's political party rules, which are based on Laws No. 2 of 2008 and No. 2 of 2011, have a lot of problems that make the presidential system less effective. The current rules are not fair because they favor procedural over substantive aspects. This is because the major parties control access to political resources. There are three main types of justice: distributive justice, which is about making sure political resources are fairly shared; procedural justice, which is about making sure political processes are fair; and substantive justice, which is about making sure that society's needs are met. A perfect model for building rules needs a full and integrated framework, easy ways for people to raise money, organized coalition systems, and stronger roles for political parties as representatives. Oligarchic elites don't want rules that are fair, and Indonesia's many cultures make it harder to make them happen. But there is still hope for change if people work together and share power. This study helps us figure out how to make Indonesia's democratic presidential system stronger by making sure that the rules we set for political parties fit the country's needs.
