Abstract

The age limit for marriage in Indonesia is regulated in Law Number 1 of 2019, stating that men and women are allowed to marry with a minimum age of 19 years. Then those who are less than 19 years old can apply for a marriage dispensation which is submitted to the Religious Court following the applicant's jurisdiction. Marriage dispensation in Indonesia has not yet responded to child protection, so it is still found that the age is below the age of the child whose application is granted. Departing from the arguments above, in this study will discuss the policy of marriage dispensation to protect children (Evaluation of Article 7 Paragraph (2) of Law No.-Law Number 16 of 2019 concerning Amendments to Law Number 1 of 1974 concerning Marriage)This research is a type of library research. This research is descriptive-analytical. The primary data in this study are the Qur'an, Hadith, the 1945 Constitution, Law Number 1 of 1974 concerning Marriage, Law Number 16 of 2019 concerning Amendments to Law Number 1 of 1974 concerning Marriage, PP. Number 9 of 1975 as the implementing regulation of Law no. 1974, INPRES No.1/1991 on the Compilation of Islamic Law (KHI), Law No. 35/2014 on Child Protection, and a decision on marriage dispensation from the Lampung Provincial Religious Court. Using three theories of maslahah mursalah, the data analysis in this study uses deductive thinking techniques, then the author makes data analysis with qualitative analysis. Research results, regulations regarding the age limit for marriage as regulated in Law Number 16 of 2019, that the minimum age for marriage is 19 years for men and women. This has referred to the law on human rights and the law on child protection. About the granting of marriage dispensation in Indonesia, there is still no clarity written in the law. The marriage law in Indonesia adheres to the principle of maturity in marriage, meaning that everyone who carries out marriage must have maturity in terms of mental and psychological. It can be concluded that the policy regarding the age limit for marriage and dispensation for marriage in Indonesia correlates with Law no. 23 of 2002 concerning Child Protection, Law No. 39 of 1999 on Human Rights, and decisions from the world child protection agency UNICEF. Abstract

Pekerja Seks Komersial (PSK) merupakan salah satu penyakit sosial yang telah berumur cukup lama. Sampai dengan dewasa ini diberbagai daerah terjadi kegiatan prostitusi termasuk di dalam Kota Medan dan Kota Batam. Pada sisi lain, kondisi keberagamaan terus berkembang. Hampir dapat disimpulkan bahwa tidak ada seorang pun yang tidak mengetahui bahwa kegiatan prostitusi sesuatu yang dilarang agama. Namun dalam faktanya seolah-olah terpisah agama dan kegiatan prostitusi bagi pelaku PSK di Kota Medan dan Kota Batam yang didasari pemahaman yang keliru dan kebutuhan hidup yang sangat mendasar.

Abstract

Wakaf merupakan bagian dari syariat yang memberikan dampak secara luas, tidak hanya bagi wakif juga bagi masyarakat. Diantara jenis wakaf produktif adalah sertipikat wakaf karena dengan sertipikat objek wakaf akan terpelihara sekaligus menjadi modal utama dalam upaya memberdayakan dan mengelola objek wakaf tanah. Secara teknis permasalahan yang penting dari proses mensertipikatkan objek wakaf tanah diperlukan tim khusus waqf task force gabungan dari KUA, BWI, OTR/BPN yang dintegrasikan dalam suatu aplikasi e-wakaf guna terpeliharanya manfaat wakaf bagi kesejahteraan selain itu juga diperlukan dukungan dari pemerintah dalam bentuk dukungan moril dan materiil. Metode penelitian menggunakan pendekatan penelitian kualitatif untuk menggali makna dan nilai keilmuan sebagai bekal teori dan wawasan guna menganalisis dan mengkonstruksi objek yang diteliti menjadi lebih jelas. Tim khusus yang menangani wakaf dari 3 lembaga dengan didukung oleh teknologi yang melahirkan suatu inovasi akan meningkatkan daya dukung masyarakat terhadap pemerintah dan pada gilirannya akan menciptkan good government.

Abstract

This activity Tablighi Jamaat often raises people's questions about how to fulfill their family's nafkah during khuruj fisabilillah, especially those in the city of Medan, and how does it conform to the Positive Law and the Compilation of Islamic Law applicable in Indonesia. Through observation and interviews as primary data linked to the relevant literature, it was found that there were several cases whose livelihoods were not met. however a way of fulfilling a living has actually moved to the aspect of ukhuwah where members of the Tablighi Jamaat who are not khuruj actively provide material support to families who are left behind by khuruj fisabilillah, which is then called nusroh ahliyah so that in general efforts Fulfillment of family livelihoods when khuruj fisabilillah the ideal concept as it’s stated in Article 34 of Law no. 1 of 1974 concerning Marriage and Article 80 of the Compilation of Islamic Law, as well as the opinion of the scholars of the Shafi'i mazhab. However, it is suggested to the members of the Tablighi Jama'at that they should further improve their religious education for their family members so that they are mentally and spiritually living independently during the khuruj fisabilillah activities, and to the leaders of the Tablighi Jamaat to provide full and complete assistance at the stage before departure, so that there is no longer a family of Tablighi Jama'ah whose livelihood is neglected when they leave khuruj fisabilillah, so that they are able to give a very positive impression on the general public, especially the city of Medan

Abstract

Majelis Ulama Indonesia (MUI) Provinsi Sumatera Utara mengeluarkan Fatwa Nomor : 04/KF/MUI-SU/IV/2011 Tentang : Isbat Talak Terhadap Perceraian/Talak Di Luar Sidang Pengadilan Agama yang diputuskan pada tanggal 12 April 2011M/08 Jumadil Awal 1432H sebagai usulan kepada Mahkamah Agung untuk mengeluarkan aturan terhadap isbat terhadap perceraian yang dilakukan di luar pengadilan agar pasangan yang telah bercerai di luar pengadilan mendapatkan legalitas terhadap status yang disandangnya. Padahal dalam Kompilasi Hukum Islam (KHI) Pasal 115 sudah jelas dinyatakan bahwa “Perceraian hanya dapat dilakukan di depan sidang Pengadilan Agama setelah Pengadilan Agama tersebut berusaha dan tidak berhasil mendamaikan kedua belah pihak”. Oleh karena itu, penelitian bertujuan untuk menjawab bagaimana kedudukan talak di luar pengadilan, bagaimana kedudukan fatwa Majelis Ulama Indonesia (MUI) dalam hukum positif di Indonesia, bagaimana pandangan para Hakim Pengadilan Tinggi Agama  Medan terhadap fatwa Majelis Ulama Indonesia (MUI) Provinsi Sumatera Utara Nomor : 04/KF/MUI-SU/IV/2011 Tentang : Isbat Talak Terhadap Perceraian/Talak Di Luar Sidang Pengadilan Agama dan bagaimana penerapannya. Penelitian ini adalah penelitian hukum empiris dengan pendekatan kualitatif, teknik pengumpulan data pada penelitian ini yaitu observasi, wawancara, dan studi dokumen, dan metode analisis data dalam penelitian ini menggunakan metode analysis deskriftif. Penelitian ini menemukan bahwa: 1. Perceraian yang dilakukan di luar persidangan tidak dianggap ada dan tidak sah menurut Undang-Undang yang berlaku di Indonesia. Tapi kalau ucapan cerai itu dilakukan di depan hakim atau di depan pengadilan, satu kali diucapkan maka perceraian itu diakui sah dan legal dengan bukti dikeluarkannya surat ikrar talak dari pengadilan (akta cerai). 2. Maka kedudukan Fatwa Majelis Ulama Indonesia (MUI) bukan merupakan suatu jenis peraturan perundang-undangan yang mempunyai kekuatan hukum mengikat.

Abstract

Keberadaan tanah wakaf selain memberikan manfaat bagi masyarakat dan negara, juga dapat menimbulkan sengketa jika tanah wakaf tersebut tidak mempunyai kekuatan hukum atau sertifikat. untuk meminimalisir atau menghindari terjadinya sengketa maka diperlukan sertifikasi tanah wakaf itu sendiri. Selain itu sertifikasi tanah wakaf sangat diperlukan agar terciptanya tertib administrasi dan kepastian hukum. Pengamanan melalui sertifikasi merupakan upaya untuk menghindari terjadinya persengketaan kedepannya. Penelitian ini menggunakan pendekatan penelitian yuridis normatif, Metode pendekatan ini mengkaji persoalan hukum berdasarkan aturan normatif yang dikaitkan dengan kondisi yang ada di masyarakat. Dengan melihat suatu kasus yang terjadi di masyarakat terkait dengan Perlindungan Hukum terhadap Tanah Wakaf melalui Pendaftaran Tanah. Upaya perlindungan hukum terhadap tanah wakaf telah diatur secara khusus dalam peraturan perundang-undangan, namun dalam pelaksanaanya masih minim dilakukan guna memberikan perlindungan hukum bagi setiap tanah wakaf. dengan adanya pengaturan terkait tanah wakaf seharusnya pemerintah dapat memberikan perlindungan hukum secara maksimal dengan memfasilitasi melaui pendaftaran tanah wakaf untuk diterbitkan sertifikat oleh Kantor Pertanahan.

Abstract

Perjanjian kerja antara pengusaha dan pekerja, idealnya dibuat atas dasar kesepakatan kedua belah pihak, cakap hukum, adanya pekerjaan yang diperjanjikan, tidak bertentangan dengan peraturan perundang-undangan yang berlaku.Namun pada kenyataannya hubungan kerja sebagai suatu hubungan hukum termasuk dalam aturan otonom: Perjanjian Kerja, Peraturan Perusahaan, Perjanjian Kerja Bersama, dalam pembuatannya bertentangan dengan peraturan perundang-undangan yang berlaku (Kaidah Heteronom). Pertentangan hubungan pekerjaan dengan kaidah heteronom mencerminkan ketidakberdayaan pemerintah dalam hal ini Kementerian Ketenagakerjaan R.I., sebagai pengawas dua kaidah hukum ketenagakerjaan tersebut.  Teori efektivitas penegakkan hukum ditujukan untuk menjadi solusi atas persoalan pertentangan hukum dua kaidah hukum ketenagakerjaan, namun integritas penegak hukum itu sendiri pun masih dipertanyakan oleh pekerja, apakah penegak hukum mampu mengantisipasi pertentangan antara aspek kaidah otonom dan kaidah heteronom atau justru membiarkan terjadi pertentangan hukum antara pengusaha dan pekerja.

Abstract

This research will answer, how is the implementation of the Matang Teupah Village Regulation No. 12 of 2010 concerning the business license for chicken farming, how is the environment for the poultry farm business in Matang Teupah Village according to Fiqh Siyasah. This research is field research and manuscript analysis and this type of research uses descriptive qualitative methods. The results of the study are: the efforts of the Matang Teupah Village Government and the Aceh Tamiang District Government in controlling environmental pollution caused by the community who have a broiler business have been going quite well because the Village Government has made several efforts in accordance with government regulations in controlling the waste pollution. and set forth in Village Regulations so as to be able to maintain the surrounding environment free from waste pollution. In view of fiqh siyasah environmental pollution carried out by the community in Matang Teupah Village, in not accordance with Islamic law, because humans as caliphs on earth are to be able to prosper the earth in accordance with Islamic law and preserve it. In the view of Islam, the caliph is responsible for himself, he must also bear the responsibility of his fellow living creatures and the whole of nature, including in maintaining the sustainability of the existing environment.

Abstract

This paper elaborates the concept of joint property as a unique Islamic legal entity in Indonesia. Positioning the meaning of shared assets with various views of classical fiqh and Indonesianism is a necessity. Even more than that, tracking the legal istinbath method formulated by Indonesian scholars on the concept of joint property is the focus of the article. Positioning the meaning and side of istinbathi ushuly gives strength in the continuity of the implementation of joint property in Indonesia.

Abstract

Sayyid Sabiq is a fiqh sunnah writer who strived to be an enlightener on the rise of taqlid (an Islamic term denoting the conformity of one person to the teaching of another) and the closing door to ijtihad (an Islamic legal term referring to independent reasoning or the thorough exertion of a jurist's mental faculty in finding a solution to a legal question) for Muslims. Muslims at that time disbelieved each other and always rubbed against differences in maddhab (a school of thought within fiqh; Islamic jurisprudence). Regarding ikhtilaf (an Islamic scholarly religious disagreement), according to Sayyid Sabiq there are forbidden ikhtilaf as well as the allowed one. Sayyid Sabiq's Concept of Islamic Law tends to be strict on certain legal issues and loose on others. This paper is classified as normative Islamic law research with a conceptual and philosophical-logical approach. The method of data analysis used in this research is the deductive-inductive method. The results of the study concluded that according to Sayyid Sabiq; the permanent Islamic law that cannot be changed has criteria as follows; a) has been explained in detail by nass (sentences from the Quran or hadith that are used as reasons or the basis for deciding a problem, as a guide in sharia law), b) the laws of aqidah (creed) and worship, c) all laws whose nass status is qaṭ'ī ad-dilalah.  Meanwhile, the dynamic Islamic law which follows changes in time and place has criteria as follows; a) laws that are only explained by the nass globally, b) laws on civil benefit, siyasa (politics), war and justice, c) and all the laws whose nass status is annī ad-dilalah. Sayyid Sabiq's thoughts applied the integration of fiqh with aqidah (creed) and morals. That means, the substance of his thought has succeeded in eradicating the dichotomy of fiqh with other elements of Islamic teachings.
