Abstract

This study examines the liability of delivery service companies for breach of contract in the form of undelivered packages to the intended address, from the perspective of the Compilation of Sharia Economic Law (Kompilasi Hukum Ekonomi Syariah/KHES), using a case study in Sei Litur Tasik Village, Sawit Seberang Subdistrict, Langkat Regency. The background of the research stems from increasing public complaints regarding delivery services failing to fulfill their obligations as agreed. The purpose of this study is to analyze the implementation of package delivery by the company, identify the factorx contributing to undelivered packages, examine the forms of corporate accountability for delivery failures, and assess such accountability according to the Compilation of Sharia Economic Lave. This research employs an empirical juridical method with a conceptual and statutory approach. Data were obtained through interviews, field observations, and document analysis. The findings indicate that, based on Chapter III Article 36 of KHES concerning breach of contract and Chapter IV Article 85 regarding the handover of goods as stated in the shipping receipt, the main causes of breach were courier negligence, data system errors, and weak internal supervision. According to Chapter III Article 38 of KIES, the forms of liability provided by the company typically involve compensation in the form of a shipping cost refund or package redelivery; however, these measures are often insufficient and lack transparency. From the perspective of the Compilation of Sharia Economic Law, such a breach violates the ijarah (service lease) contract and obliges the company to provide fair and accountable compensation. The conclusion of this research emphasizes the importance of applying Sharia principles in service-based businesses to uphold consumer rights and achieve justice

Abstract

The construction of the Trans–Sumatra Toll Road Medan–Tebing Tinggi segment, as part of Indonesia’s national strategic infrastructure agenda, has had a significant impact on the sustainability of micro, small, and medium enterprises (MSMEs) around Pasar Bengkel, Serdang Bedagai Regency. Although intended to improve connectivity and logistics efficiency, the project has indirectly diverted traffic from local roads that previously served as vital economic arteries for local entrepreneurs. This study aims to analyze the impact of toll road development on MSMEs through the lens of maslahah within the framework of Islamic economic law. Using a normative-empirical legal research method, data were obtained through literature review, document analysis, and interviews with affected MSME actors. Findings show that MSMEs in the culinary and automotive service sectors have experienced declining revenues, workforce reductions, and even business closures. The maslahah analysis identifies three main dimensions of protection: dharuriyyat (safeguarding livelihoods), hajiyyat (ensuring business access), and tahsiniyyat (improving business quality). Local government policies have not been responsive and lack a long-term strategic approach. This study recommends maximizing the integration of MSMEs into rest areas and optimizing digital platforms.

Abstract

The development of digital technology has led to the emergence of various social media platforms that are used as a platform for widespread and massive product marketing. TikTok, as one of the most popular short video platforms among children and students, has become a highly effective yet risky promotional platform. One serious issue that has emerged is the practice of misleading advertising targeting young consumers with manipulative content that does not align with product facts. This phenomenon is further complicated by TikTok's lack of full oversight by the Indonesian Broadcasting Commission (KPI), and the weakness of national regulations in reaching cross-border digital platforms. As a result, many children as consumers are vulnerable to falling victim to false information, fabricated testimonials, and exaggerated product promises. This study aims to analyze the phenomenon of misleading advertising on TikTok from the perspective of Ibn Taymiyyah, specifically regarding the concept of fraud (tadlis) and the urgency of moral protection for consumers. This research is a normative juridical study supported by empirical facts, namely analyzing positive legal principles through the approach of Ibn Taymiyyah's texts and supporting it with relevant field data regarding misleading advertising practices on TikTok. The results of this study emphasize the importance of state involvement in overseeing digital transactions to protect vulnerable parties, particularly children, from losses due to advertising fraud. The concept of hisbah, developed by Ibn Taymiyyah, serves as a normative reference in developing a consumer protection system in the digital era. Therefore, this study concludes by recommending that the Indonesian government immediately expand the scope of consumer protection regulations on digital platforms, establish a dedicated supervisory authority, and promote digital literacy based on Islamic values of honesty and moral responsibility. This way, consumer protection, particularly for children and students, can be enforced fairly and sustainably.

Abstract

Problematic financing is a crucial challenge for the sustainability of Islamic banking, including the Sharia People's Financing Bank (BPRS). At BPRS Al Washliyah, the increasing phenomenon of problem financing has a direct impact on the bank's financial stability and has given rise to disputes between customers and financial institutions. This study aims to examine three main issues: (1) factors causing problem financing at BPRS Al Washliyah, (2) the mechanism for resolving problem financing through the Religious Court, and (3) the role and authority of the Religious Court in resolving problem financing disputes based on Islamic law and positive law in Indonesia. This study uses a juridical-empirical approach, with a legal research method that examines secondary data through literature studies and primary data through interviews and documentation at BPRS Al Washliyah and the Medan Religious Court. The results of the study indicate that problem financing is triggered by weak financing analysis, changes in customer economic conditions, and negligence in carrying out contracts. Dispute resolution through the Religious Court is carried out through a civil lawsuit with the legal basis of Law No. 21 of 2008 and the DSN-MUI Fatwa. Religious Courts play a crucial role in resolving Sharia economic disputes, not only as adjudicative institutions but also as guarantors of Sharia justice principles. This study concludes that the integration of Islamic legal principles and positive law through Religious Courts is an effective instrument in upholding justice and resolving problematic financing disputes in Sharia banking.

Abstract

The development of communication technology has expanded the reach of da'wah, but also presents challenges in maintaining the quality and direction of da'wah messages so that they remain in accordance with Islamic values. This study aims to analyze the management of da'wah training at the Darul Arafah Raya Islamic Boarding School, focusing on four management functions: planning, organizing, implementing, and monitoring and evaluation. The research method uses a qualitative descriptive approach with a case study design, through in-depth interviews, participatory observation, and documentation analysis. The results show that muhadharah-based da'wah training at the Islamic boarding school has been implemented systematically and effectively, supported by the role of musyrif as mentors, an adaptive curriculum, and a visual narrative strategy in strengthening the communication skills of students. In conclusion, the management of da'wah training at this Islamic boarding school is able to produce da'i cadres who are competent, moderate, and ready to da'wah in modern society.

Abstract

This study analyzes the practice of price manipulation in the spice trade at Barus Market, one of Indonesia’s oldest spice ports, through the lens of Islamic economic principles according to Wahbah Az-Zuhaili. The manipulation includes price manipulation and artificial stock withholding, driven by information asymmetry between sellers and less-informed buyers, particularly from outside the region. Employing a descriptive qualitative and empirical juridical approach, data were collected through interviews, direct observation, and literature review. Findings reveal that such practices violate fundamental Islamic trade ethics, including shidq (honesty), ‘adl (justice), and prohibitions against tadlis (fraud) and gharar (uncertainty). Az-Zuhaili advocates for state intervention through price regulation (tas’îr) in cases of market distortion caused by merchant misconduct. The study highlights the need for sharia-based market reform, consumer protection via khiyar ghabn, and ethical education for traders to realize a fair, transparent, and Islamic economy.

Abstract

The circulation of counterfeit oil harms consumers because it reduces the quality of engine performance, increases the risk of vehicle damage, and jeopardizes user safety. The main factors influencing this phenomenon are low consumer awareness, weak supervision, and economic benefits for business actors. This study aims to examine consumer protection against the circulation of counterfeit oil in Medan Area Sub-district workshops from the Maqasid Syariah perspective, identify the factors causing it, and evaluate the effectiveness of consumer protection regulations. The method used is empirical juridical with a qualitative descriptive approach to describe consumer protection against counterfeit oil in practice. The results showed that the circulation of counterfeit oil contradicts the Maqasid Syariah principles, especially Hifz al-Mal (protection of wealth) because it causes financial losses, and Hifz an-Nafs (protection of life) because it increases the risk of accidents. Although consumer protection regulations already exist, supervision is still weak so that the circulation of counterfeit oil remains rampant. Therefore, more optimal law enforcement and increased consumer awareness are needed to be more selective in choosing the motorcycle oil products used.

Abstract

The rapid development of the advertising industry in the digital era has created increasingly intense competition among businesses in communicating their products to target audiences. This study aims to analyze the persuasive communication strategies implemented by Syafaat Marcomm in designing sharia-based print advertising, while also exploring how Islamic values are integrated into modern marketing practices. Employing a qualitative descriptive approach, data were collected through observation, interviews, documentation, and literature study, then analyzed using the interactive model of Miles and Huberman through the stages of data reduction, data display, and conclusion drawing. The findings reveal that conventional branding generally emphasizes profit and image enhancement, whereas sharia-based branding focuses on ethical and spiritual principles such as honesty, trust, justice, and truthful communication. Syafaat Marcomm applies a three-level integrated branding strategy, namely conducting research and brand audits, designing persuasive messages across print and digital media with ethical language and visual symbols, and building long-term consumer loyalty through value-based communication. Despite challenges such as limited budgets and public skepticism toward sharia branding, the study concludes that persuasive communication rooted in sharia principles is both effective and relevant for strengthening consumer trust, brand awareness, and business sustainability in Indonesia’s competitive advertising landscape.

Abstract

This study examines the Galang Batang agreement as a form of conflict resolution between husband and wife in Gunung Manaon 1 Village from the perspective of Islamic law. Galang Batang is a local customary practice that serves as an informal mediation method in resolving marital disputes. The aim of this study is to understand the implementation mechanism of the Galang Batang agreement, its effectiveness in preserving household harmony, and the extent to which this practice aligns with Islamic legal principles, particularly in terms of justice, public interest (maslahah), and family dispute resolution. This research employs a qualitative method with a normative-sociological approach, through interviews with traditional leaders, married couples, and local religious figures. The findings reveal that Galang Batang not only functions as a means of conflict resolution but also reinforces social and religious values. From the perspective of Islamic law, this practice is acceptable as long as it does not contradict the sharia and upholds the principles of consultation (shura), justice, and peace. Therefore, Galang Batang represents a form of harmonization between customary law and Islamic law in resolving family conflicts.

Abstract

This study examines the contribution of the first principle of Pancasila to the formation of moderate religious character among youth in the era of digital disruption. The growing phenomenon of religion-based intolerance in digital spaces serves as a significant background for this inquiry. The aim of the research is to evaluate the extent to which the value of Belief in One Supreme God can be internalized within education and religious social life. The method employed is a meta-analysis literature review by analyzing academic studies from the past five years. Data were collected through systematic searches of reputable journals and analyzed using content analysis techniques and bibliometric visualization. The findings indicate that the value of divinity holds great potential in shaping tolerant religiosity, yet its implementation remains suboptimal. This study recommends the strategic integration of divine values into curricula and digital religious literacy initiatives.
