Abstract

This article describes a model for the discovery of the Qur'an which is applied by Indonesian commentators, namely Tafsir al-Misbah by Quraish Shihab and Tafsir al-Azhar by HAMKA, both of which are phenomenal book of tafseer written by Indonesian scholars. The focus of the study is the pattern of findings applied by Quraish Shihab and HAMKA to the letter al-Fatihah in the two commentaries. This research is a literature study type and uses a descriptive-qualitative approach and applies a comparative method. The data obtained in this study comes from two categories, namely primary and secondary data, the primary data is the book of interpretation of al-Misbah by Quraish Shihab and Tafsir al-Azhar by HAMKA, while secondary data comes from articles, papers, books, and so on. The author concludes that the disclosure of al-Fatihah Quraish Shihab has a pattern of interpretation that is generally almost the same as that imagined by HAMKA, namely the pattern of language and fiqh. However, if seen specifically there seems to be a slight difference regarding the pattern, where Quraish Shihab dominates his linguistic pattern in translating of surah al-Fatihah, while HAMKA dominates the fiqh pattern. This can be seen from the existence of sub-chapters that were made specifically when the surah al-Fatihah was obscured. For example, the linguistic pattern in al-Misbah's interpretation have a sub-chapter "The meaning of ba read bi in bismillah", in this sub-chapter Quraish Shihab tries to explain surah al-Fatihah in bismillah sentences in language. Meanwhile, his pattern of fiqh in can be seen in the interpretation of al-Azhar in surah al-Fatihah by writing a sub-chapter namely "Al-Fatihah as the pillars of prayer". Where in this sub-chapter HAMKA tries to explain how to read surah al-Fatihah from a legal perspective.

Abstract

Abstract: Minangkabau has local cultural heritage, one of whichis ini the form of scripts such as those found in villagae Bukit Gombak on Padang Laweh. With the physical condition of the manuscript without a title, not intact, has neat scripts, is in Arabic but some of the pages are still radable. So that the formulation in this study is how describe and transliterate the Bukit Gombak fiqh text, what is the background of its emergence and whats is the contents of the Bukit Gombak fiqh manuscripts. The research method used is a philological approach with field research conducted in Jorong Bukit Gombak with data collection methods for document studies, inventory, codicology and interviews and the primary data source is Bukit Gombak fiqh manuscript while the secondary data sources are books, articles related to philology using qualitative analysis techniques with the stages of reduction, data study, further analysis, drawing conclusions. The results in this study are the Bukit Gombak fiqh text physically using Arabic writing in red and black ink with paper color brown, withour a titile and witho an author that found in one of the residents houses in village Bukit Gombak. The Bukit Gombak fiqh manuscripts containts fiqh ini general such as the book of marriage, the book of muamalah, the book of pilgrimage, the book of fasting. The history of writing the Bukit Gombak fiqh manuscript is estimated in the 18th century of fiqh manuscripts into Indonesia, which on average belonged to the shafi’i madhhab.

Abstract

The marriage procession basically aims as the legality of a bond to build a household. However, this procession is of course carried out in accordance with the customs of the local community. This can be seen from the traditional wedding procession of the people of Lampung where each stage is carried out with traditional activities. In the case of this customary procession, there is something very interesting to study, namely the activity of granting traditional titles. This study aims to determine the procedure for conferring customary titles, the meaning of conferring customary titles and the function of conferring customary titles. This study uses a qualitative approach with a sociological and anthropological approach. Data collection techniques in this study consisted of in-depth interviews, documentation, and observation. The results of the study found that the procedure for granting an Indigenous Title had stages because each of these stages had a title and sacred value. The meaning of giving an adat title to the people of Lampung is where a person has obtained a position in a cradle, gets a clear status in adat so that it is organized in regulating adat and is structured so that it will take place in an orderly manner. The function of giving adat is as a difference in status, whether it is the status given by the family for generations in maintaining social status.

Abstract

This study aims to comprehensively describe the thoughts associated with the concept of kalalah in Islamic inheritance and compare the application of the concept. This study is a type of normative juridical research with conceptual and comparative approaches. The results showed that brothers/sisters can only inherit property if the heir dies in a state of kalalah. Kalalah is defined as a person who dies without children and parents, except for Hazairin who states that he has no children or descendants. Differences related to the concept of kalalah are not only related to the definition of children and parents but also to the understanding of brothers/sisters. Jumhur ulama of Sunnite, Shia, and Islamic Law compilation (ILC) classify brothers/sisters into full, uterine, and consanguine ones. Meanwhile, Hazairin and Syahrur only mentioned relatives in general without classifying the types of brothers. Jumhur ulama in relation to uterine brothers, children are defined as son and daughter. While the parents are defined as the father and paternal grandfather. Furthermore, in relation to the share of full and consanguine brothers, the child is defined as the son, and the parent is defined as a father. ILC stipulates that children (boys/girls), and father exclude all types of brothers to inherit. For Shiah, brothers/sisters can be hindered by children in general, father and mother. According to Hazairin, only children and their descendants can hinder the brothers. Meanwhile, Syahrur determines that brothers/sisters can be hindered by children and descendants hls. and parents hhs.

Abstract

This study was based on the rise of issues in the name of religion in Indonesia and a response regarding the low tolerance attitude between Indonesian people towards the activities carried out by people with different religions. It is essential to reveal the best practice of harmony between the religious people as a reference in fostering a harmonious inter-religious life and dismissing the issues that have been reported louder than genuine tolerance. The best practice of this harmonious life could be found in Ngargoyoso Village, Karanganyar, Central Java, a village with multi-religious communities, such as Islam, Hinduism, and Christianity. Accordingly, this research will capture the tolerance condition in Ngargoyoso and uncover the implementation of tolerance and diversity in society. Qualitative research with a case study approach will answer these two questions. The result indicated that the harmony in Ngargoyoso has lived for a long time and has been maintained until now. The harmonious attitude was based on full awareness by the community. The spirit of cooperation also melts within society so that they have a sense of love for each other without considering religion. The implementation of tolerance and diversity was based on the appreciation of the value of Pancasila. Therefore, harmony and togetherness live. The limits of tolerance were also limited to social affairs and were not involved in matters of worship. Various efforts to maintain a well-established tolerance continue to be carried out, including assistance from outside parties and the holding of tolerance festivals.

Abstract

The Compilation of Islamic Law specifies that wills are only required for adopted children and their adoptive parents. The parties involved may petition the courts, even though these regulations are less binding. This research uses the type of normative legal research because what is examined in this research is the norm contained in the hadith texts related to the inheritance law above. The case approach is used as an approach in research because the case of inheritance of different religions that are discussed in a separate case within the family sphere, where there is no legal argument or norm that can answer the case above, so the case approach. The research results show that in Article 209 of the Kompilasi Hukum Islam (KHI), describe the law of Wasiat Wajibah. It cannot, therefore, be regarded contrary to Islamic law. Because leaving a bequest to an adopted kid or adoptive parent does not conflict with the general requirements of the Qur'an and the Prophet's Sunnah. The Cassation Decision No. 368 K/Ag/1995, issued 16 July 1998, marked the beginning of the practice of non-Muslim heirs obtaining a portion of the inheritance from Muslim heirs via Wasiat Wajibahs, which created a body of law within the Religious Courts. Non-Muslims inherit the same proportion of their Muslim parents' required bequests as other Muslim heirs. This necessary will is intended to preserve the integrity of the family and accommodate the multicultural, multiethnic, and multireligious nature of Indonesian society. In addition, implementing a sense of fairness is an advantage of this decision. Giving wills to non-Muslim spouses, children, parents, and relatives has contributed to the revival of Islamic law in Indonesia, demonstrating a sense of social fairness.

Abstract

This study aims to analyze the communication model and implementation by Islamic Religious Counselors in Building Sakinah Families in Deli Tua District and the Barriers to Applying Islamic Religious Extension Communication Models in Building Sakinah Families in Deli Tua District. This research uses a descriptive analysis method and the approach uses a qualitative approach. Sources of data come from primary, namely through interviews, and secondary data by examining books, journals, and other documents. Based on the results of the study that the communication model used by Islamic Religious Counselors in building the Sakinah Family in the Deli Tua sub-district, namely using a two-way communication model. The two-way model applied by Islamic Religious Counselors when building a sakinah family, namely the existence of feedback. Implementation of the communication model is done by going directly to the community and interacting. The communication process is carried out with lectures accompanied by questions and answers with the community. As for the obstacles of Islamic Religious Counselors in building a sakinah family in Deli Tua District, namely, first, the presence of provocateurs to incite them not to attend the coaching to build a sakinah family, the domicile of the community being fostered are Javanese, technological stuttering, the clashing schedule of coaching with the harvest season. The solution to overcome these obstacles is to evaluate yourself on the style of speaking so that you can adjust to whom you interact with, Involve power from outside yourself, and be smart so that you get used to using non-verbal communication.

Abstract

Thinking is an activity that cannot be separated from humans, as well as being the most substantial differentiator between humans and other creatures. This study aimed to analyze thinking and problem-solving in Islamic education. From this research, it is hoped that a concept will be born that can be used to solve the problems of Islamic education. The focus of this study discusses the thought process, problem-solving and the factors that influence it as well as the steps of problem-solving. This focus will be fully directed in the context of Islamic education. This research uses literature study techniques using primary sources in the form of authoritative books and journals. The results of this study showed that in the context of Islamic education, it was well realized that there were many problems that cause the lagging of Islamic educational institutions. It was very important to think of the right way to get out of the problem immediately by using the right problem-solving principle. In addition, the managers of educational institutions must work together and seriously implement the principles of Islamic teachings as a solution to answer these problems.

Abstract

This article describes the convergence between maqasid shari’a and Pancasila to develop the spirit of nationalism. This research is descriptive qualitative and can be categorized into the type of library research. Various data and sources were obtained from various literatures related to the concept of maqasid shari’a and Pancasila which were associated with nationalism. The research method used is a literature review. The data comes from books, scientific journals, national media and website that relevant to the topic. The focus of the research is directed at, first, the theoretical and methodological description of the maqasid shari’a concept; second, a description of the nature of nationalism, and third, searching for common ground between the concepts of maqasid shari’a and Pancasila in the frame of diversity. From this study it was found that first, the concept of maqasid shari’a occupies an urgent and significant position as a theoretical and methodological tool in observing the plural and pluralistic reality of Indonesia; second, nationalism is an important ideology in an effort to unite a plural and multicultural Indonesia with various ethnicities, tribes, cultures, languages, beliefs and religions, third, there is a meeting point or convergence between the concepts of maqasid shari’a and Pancasila substantively and inherently in the concept of Pancasila which is the great creations of this nation's founder.

Abstract

Kenagarian Air Bangis is located in West Pasaman Regency, West Sumatra Province, one of the heterogeneous areas in Minangkabau. Therefore, it is important to instill and teach the values of religious moderation to students from an early age so that it is easy to appreciate and respect other people of different ethnicities, races, and religions. This study aimed to see whether the understanding of religious moderation has been instilled in students. The study results concluded that the Al-Qur'an Learning Center For Children (TPA) in Kenagarian Air Bangis had shown its role as a non-formal educational institution in instilling and implementing religious moderation values in students. Teachers on faith, morals, and adab have delivered teaching materials related to religious moderation. Even though it has not been structured and managed properly, the values contained in national commitment, tolerance, anti-radicalism and violence, and accommodating local culture have been conveyed to students, such as respecting followers of other religions and respecting people of different ethnicities, races, and religions. It is proven that they have never received discriminatory treatment, harassment, and inter-religious bullying in the Kenagarian Air Bangis; they live side by side even though the non-Muslim community is far from the Muslim community, but in social relations and service to the community, they are treated the same as their rights as a citizen.
