Abstract

The growth and development of children are influenced by many factors that lead children to become perpetrators of criminal acts and ultimately engage in criminal activities. In the process of resolving such cases as a form of deterrence, it is essential to remember to safeguard their mental well-being. According to Law No. 11 of 2012 on the juvenile justice system, the handling of such cases must apply restorative justice, which provides protection and upholds the inherent rights of the child. In this study, the author will discuss the implementation of restorative justice for children that involved in criminal activities through diversion and how to achieve the goals of diversion as outlined in Law No. 11/2012. The method used in this research is normative legal research. The study employs a legislative approach, with a specific examination of Law No. 11 of 2012 and other relevant legal regulations, supported by data that underpins the research. Data collection and analysis techniques involve primary data (journals and relevant research findings) and, secondary data (books and other references). Diversions manifest restorative justice in protecting children facing legal issues, allowing juvenile justice proceedings to occur outside the formal criminal justice process, as is typical for adults. Efforts to resolve juvenile criminal acts through diversion are carried out to the fullest extent possible. Article 13 of the Child Criminal Justice System Law (SPPA) emphasizes that if no agreement is reached in the diversion process between the victim and the criminal offender, or if the agreed-upon terms are not followed, the case will proceed to the juvenile justice process, following the formalities outlined in KUHAP. Diversions are not allowed for children who engage in repeated criminal acts. Therefore, further improvement in the guidance of child offenders under the subsequent legal regulations is necessary.

Abstract

This research discusses the analysis of siyasah maliyah towards optimizing the income of the Regional Public Service Agency from parking fees. The aim of this research is to determine the mechanism for collecting parking fees based on Bandung City Regional Regulation Number. 3 of 2020 and Bandung City Regulation Number 634 of 2017, as well as to find out the Siyasah Maliyah review of the management of parking fees based on Bandung City Regional Regulation Number. 3 of 2020 and Bandung City Regulation Number 634 of 2017. The method used in this research is a qualitative research method with an empirical juridical approach. Based on the results of this research, collection of parking fees in Bandung City is carried out using two methods, namely manual and using a parking machine. Even though the income from manual collection is higher than using electronic machines, there are still many leakages in field collection. Even though parking rates have been regulated in regional regulations, there are still violations in their determination by parking managers. The implementation of government policies must be in accordance with the principles of Islamic law, especially in safeguarding assets (hifdz mal), and follow the principles of Maliyah siyasah such as justice and maslahah.

Abstract

The aims of this research are: 1) to find out the modus operandi of criminal acts in the Immigration sector (Study of Decision Number 713/ Pid.Sus /2022/PN Mks ), 2) to find out how the judge considered in handling down Decision Number 713/ Pid.Sus /2022 /PN Mks. The type of research used by researchers is normative legal research using the statutory and case approaches. The research materials used as a base to support this research include primary and secondary legal materials and methods. The analysis is in the form of a prescriptive method, namely an analytical method that provides an assessment ( justification ) about whether the object under study is right or wrong or what should be according to the law. The conclusion in this research is The modus operandi carried out by the Defendant who committed a Crime in the Immigration Sectors in Decision Number 713/ Pid. Sus /2022/PN Mks was by burning his passport and travel documents in 2019 because they wouldn't be detected as foreigner citizens and are considered an Indonesian citizens. Where the Defendant Mohammed Abdulaziz Khamis Bin Sanad's passport expired in 2020, but continued to live and carry out activities in Indonesian Territory without having a passport, namely from February to October 2021, the Defendant worked for a Mining Company at PT Sungai Berlian Mahakam in Samarinda. On January 15, 2022, the defendant went to Makassar city to look for coffee and would export the coffee to Arabia. 2) The judge's legal considerations in imposing a sentence on the perpetrator of a crime in the field of immigration, as in Decision Number 713/ Pid.Sus /2022/PN Mks, where the Panel of Judges have handed down a decision on the Defendant by giving a prison sentence of 4 ( four ) months and 15 ( fifteen ) days and a fine of IDR 10,000,000.00 ( ten million rupiah). The decision of the Panel of Judges takes into account the facts revealed in the trials, and basically, the judge handed down the decision based on Law number 48 of 2009 concerning Judicial Power by paying attention to juridical and non-juridical considerations by paying attention to things that are aggravating and mitigation the Defendant.

Abstract

Perjanjian perkawinan memegang peranan penting dalam mengatur pembagian harta bersama antara suami dan istri jika terjadi perceraian atau kematian, sebagaimana diatur dalam Pasal 29 Undang-Undang Nomor 1 Tahun 1974. Putusan Mahkamah Konstitusi Nomor 69/PUU-XIII/2015 memperluas cakupan perjanjian perkawinan, yaitu dibuat saat masih dalam ikatan perkawinan, dengan tujuan untuk melindungi hak-hak suami istri dan menghindari kerugian bagi pihak ketiga. Penelitian ini merupakan studi pustaka yang dilakukan dengan cara membaca buku-buku, naskah, dokumen, jurnal, dan sumber-sumber terkait lainnya. Dalam menganalisis perjanjian perkawinan pasca putusan Mahkamah Konstitusi, peneliti menggunakan pendekatan perundang-undangan dan pendekatan historis. Analisis diawali dengan menggunakan peraturan perundang-undangan sebagai landasan utama, dengan mempertimbangkan karakteristiknya yang komprehensif dan sistematis. Tujuan penelitian ini adalah untuk memahami secara mendalam makna hukum perjanjian perkawinan dari perspektif hukum Islam dan hukum positif di Indonesia, serta untuk mengkaji perlindungan hukum bagi pihak ketiga akibat adanya perjanjian pasca perkawinan. Perkawinan sebagai ikatan lahir batin antara seorang pria dan seorang wanita merupakan landasan untuk membentuk keluarga bahagia dan kekal berdasarkan Ketuhanan Yang Maha Esa. Namun, menghadapi dinamika kompleksitas perkawinan dan kemungkinan perubahan di masa mendatang, pasangan suami istri membutuhkan kepastian yang jelas mengenai hak dan kewajibannya. Dalam konteks ini, perjanjian perkawinan menjadi instrumen yang menjamin kejelasan dan perlindungan hukum bagi pasangan suami istri, memastikan adanya aturan yang jelas tentang bagaimana aset dan kewajiban akan diatur dalam berbagai situasi. Diharapkan hasil penelitian ini dapat membantu pasangan suami istri untuk membuat perjanjian perkawinan di hadapan notaris dengan mempertimbangkan keterlibatan pihak ketiga dalam pemisahan harta bersama sebagaimana tercantum dalam akta perjanjian perkawinan.

Abstract

The economy and welfare of village communities living around state forests is still inadequate. To overcome this social problem, the government is implementing a Social Forestry Program to improve community welfare by utilizing Perhutani land in Mlarak sub-district, Ponorogo district with management rights in environmentally friendly ways to protect Forest sustainability is regulated in Presidential Regulation Number 28 of 2023 concerning Integrated Planning for the Acceleration of Social Forestry Management which is managed by Perum Perhutani as a State-Owned Enterprise. The type of method used is a normative qualitative method where the results of the discussion are social forestry programs covering 5 schemes, namely village forests, community forests, community forests, customary forests and partnership forests which can be utilized by individuals or communities, community groups whose members live around the area. forests and forest farming cooperatives. In this case, the Madiun Forest Management Unit Perhutani (KPH), Ponorogo Regency and the Forest Village Community Institution (LMDH) supported by the Mlarak District Leadership Coordination Forum (Forkopimcam) built an understanding in developing a Social Forestry Business Group (KUPS) in the tourism sector in the District area. Mlarak, With the implementation of the social forestry program, it is an effort to improve the welfare of the people living around the forest through land use for farming, it can also be developed for tourism as well as protecting and maintaining forest sustainability.

Abstract

Indonesia is one of the countries that still maintains death penalty, as stipulated in article 10 of the old Criminal Code. Death penalty is one of the main punishments as well as the heaviest punishment for criminal offenders. Meanwhile, based on its renewal based on Law No.1 of 2023 concerning the new Criminal Code. Death penalty is no longer included in the category of main punishment, but a special punishment that is always threatened alternatively and imposed with a probation period of 10 (ten) years. Article 100 of the new Criminal Code is one of the articles born from the reformation of the new Criminal Code which has become pros and cons in the community. The reason is that this provision states that the judge can impose death penalty with a probation period of 10 (ten) years by taking into account the provisions of commendable behavior and hope for improvement. If during the probation period the convict shows commendable behavior, then the death penalty can be changed into life imprisonment. On the other hand, if during the probation period the convict does not show commendable behavior and hope for reparation, then death penalty can be imposed by order of the attorney general based on presidential decree by considering the decision of the Supreme Court. Thus, the question arises as to what the criteria for commendable behavior and hope for improvement are. As a basis for the judge's consideration in deciding whether or not the convict deserves a change in sentence.

Abstract

Mixed marriage is a marriage that occurs between an Indonesian citizen and a foreign citizen. Mixed marriages without a marriage agreement create a mix of assets, the mix of assets in the form of land can have an impact on the assets of each party, as then according to Law number 5 of 1960 concerning Agrarian Regulations that a citizen Foreigners cannot obtain/own land ownership, either through a will or by mixing assets due to marriage. The research method used in this writing is a juridical-normative research method, using a type of literature study with a statutory approach and a case approach. Regarding a mixed marriage that occurs and there is no separation of assets which causes the foreign citizen to indirectly violate the Agrarian Law Article 21 paragraph (3).

Abstract

Amicus Curiae merupakan pihak ketiga yang dirasa memiliki kepentingan terhadap suatu perkara dengan memberikan pendapat hukumnya kepada pengadilan. Pembuktian Amicus Curiae dalam perkara peradilan hanya memberikan keterangan di persidangan atas permintaan dirinya sendiri atau diminta oleh pengadilan, namun harus seijin ketua pengadilan. Yang bertujuan untuk membantu pemeriksaan dan sebagai bentuk partisipasi dalam memberikan pendapat. Keterangan tersebut dapat berupa fakta ataupun pendapat hukum. Sebenarnya dalam penjatuhan putusan penggunaan amicus curiae dapat dibenarkan karena dalam teori penjatuhan putusan hakim harus mempertimbangkan keseimbangan antara apa yang sudah diatur dalam undang-undang yang berlaku dan kepentingan para pihak yang berkaitan dalam perkara. Peran Amicus Curiae dalam perkara peradilan anak sebagai pengguna narkotika yaitu Amicus Curiae disini berperan dalam kronologis perkara, mengungkapkan fakta-fakta dilapangan mengapa anak tersebut bisa terjerat kasus narkotika serta memberikan referensi kasus yang menggunakan amicus curiae dalam penjatuhan putusan oleh hakim agar membantu hakim dalam mempermudah membuat pertimbangan dalam putusan pidana anak. Metode penelitian yang digunakan adalah Legal Research dengan metode pendekatan perundang-undangan (Statute Approach) dan pendekatan konseptual (Conceptual Approach).

Abstract

Berdasarkan data yang dihimpun melalui situs resmi Badan Narkotika Nasional atau BNN jumlah kasus tindak pidana narkotika secara keseluruhan pada tahun 2021 berada pada angka 766 (tujuh ratus enam puluh enam) kasus. Jumlah tersebut juga didukung dengan total penyitaan aset sebanyak Rp 1.093.432.187.988, 00 (satu triliun sembilan puluh tiga milyar empat ratus tiga puluh dua juta seratus delapan puluh tuju ribu sembilan ratus delapan puluh delapan rupiah). Banyaknya kasus tindak pidana narkotika di Indonesia ditambah dengan rumitnya proses pembuktian terhadap tindak pidana narkotika membuat tidak jarang terjadi adanya penyalahgunaan wewenang berkaitan dengan perolehan alat bukti. Undang-Undang Narkotika di Indonesia menganut asas Strict Liability yang dalam hal ini proses pembuktian hanya terbatas pada actus reus dari pelaku yang kemudian disesuaikan dengan unsur yang terkandung dalam Undang-Undang Narkotika. Hal tersebut membuat adanya tindakan-tindakan penyidik yang memperoleh alat bukti secara melawan hukum yang kemudian dituduhkan tanpa dasar yang jelas kepada pelaku. Proses perolehan alat bukti inilah yang akan dibahas di dalam penelitian ini dan bagaimana hukum positif mengaturnya. Hasil penelitian ini adalah adanya kekosongan hukum berkaitan dengan penerapan asas Exclusionary Rules of Evidence sehingga terdapat kerancuan bagi hakim untuk mengesampingkan alat bukti maupun barang bukti yang dianggap didapat secara melawan hukum. Penelitian ini bertujuan untuk menganalisa praktek penerapan prinsip Exclusionary Rules of Evidence dalam hukum positif Indonesia yang dilakukan dengan pendekatan perundang-undangan, pendekatan kasus, dan perbandingan hukum positif di negara lain. Hasil dari penelitian ini adalah pentingnya untuk menerapkan prinsip Exclusionary Rules of Evidence dalam hukum positif di Indonesia, terlebih dalam hukum formil.

Abstract

At present, in the application of applicable law in Indonesia there are known two Currently, there are two types of dispute resolution procedures under Indonesian law, namely judicial and non-judicial. ADR is an application of the dispute resolution process that already exists in Indonesian society. Currently, the Arbitration and Alternative Dispute Resolution Law No. 30 of 1999 applies to how to implement the Van Dading Settlement Amendment Law based on Supreme Court Decision No. 1 of 2016, which regulates the mediation process in court and its obstacles. raises the status of Acta Van Dading. Judgment No. 1 of 2016 in arbitration court. The research method used by the author is a qualitative research method with the methods of normative legal science. The result of the research work is the implementation of Acta Van Dading based on the mediation order of the Supreme Court No. 1 2016 to raise the status of peace agreements, that is, based on an order regulating mediation as a means of peaceful. dispute resolution.
