Abstract

As an implementation of welfare society, the government issued Law Number 5 of 1960 Article 19 paragraph (2) c, which provide the legal certainty of land rights for all Indonesians carried out through land registration. The land registration system adopted by Indonesia is negative land cadastre with positive tendency. The implementation of land registration provide the basis of state duty to produce land registration evidence, namely certificate, which is valid as a strong proof of rights. This certificate guarantees the correctness of physical data besides juridical data as long as it is not proven otherwise. Method: This legal research used Normative juridical method, with qualitative juridical data analysis. Results of the study: Negative land cadastre with positive tendency adopted by Indonesia currently does not guarantee legal certainty of land ownership and the community justice itself. This is indicated by the fact that there is still a phenomenon of land disputes, among the result of the issuance of overlapping. By using a legal cadastre-based domain approach, through an approach of extracting historical values of land and integrating the process of dialogue within the issuing of certificate; obtaining legal certainty and the community justice can be achieved. Conclusion: Negative land cadastre with positive tendency is still unable to manifest legal certainty of land ownership and community justice so it is appropriate that an adage states “the highest legal certainty, is the highest injustice”. Strengthening land registration system through the domain approach is an alternative option to manifest legal certainty and community justice.

Abstract

Marketers often apply the strategy of scarcity promotion to attract consumer attention to the company’s product. However, this strategy often increases consumer’s destructive, aggressive behaviors. A quantitative approach using the experimental method was thus conducted in this study to reveal the effect of advertisement exposure with scarcity promotion strategy on aggressive consumer response towards the product that the company offered. The results show that advertisements with a scarcity strategy expose one’s perception that other consumers are perceived as threats. This perception arises since the probability of getting the product they want will be decreased when others are running after the same product. Theoretically, this condition will elevate the tendency of aggressive consumer behavior when attaining the product. Three studies with multiple behavioral measurements conducted on STIE YKPN students show destructive responses to the scarcity promotion applied by the company

The most common forms of trafficking are for forced labour and sexual exploitation as women, children and men are moved domestically and across international borders. They are exploited in the sectors of the fishing and fish processing industry, construction; plantation, oil palm plantation, mining and manufacturing. The poverty factor is considered to be the main trigger for prospective Indonesian workers. Another thing is because of natural disasters which are also vulnerable to human trafficking. In addition, endemic corruption among government officials contributes to the vulnerability of trafficking in persons, especially in the travel, hotel and labour recruitment industries. The phenomenon of globalization is one of the factors in the spread of contemporary (modern) issues, which affected to human trafficking. Advances information technology, are opportunities for the expansion of crime networks, both national and transnational (across borders). The borderless world maks cross-cultural social integration, people move around freely without any obstacles, causes various modes of crime to emerge, such as human trafficking.
