Abstract

This article aims to analyze the corona pandemic categorized in Force Majeure in a contract. This problem is focused on the existence of the Corona pandemic, which can make debtors delay in fulfilling achievements or canceling contracts. How to claim Force Majeuree in a business contract. In order to approach this problem, a normative juridical legal research type is used with a descriptive-analytic nature of research aimed at describing it systematically, factually. Data - data collected through secondary data and analyzed qualitatively. Covid-19 can be categorized as force majeure, used as an excuse for the debtor not to fulfill the contract. Force majeure conditions cannot be used as a reason for canceling a contract, but renegotiation can be carried out to cancel or change the contents of a previously agreed contract. With Covid-19 being able to make debtors delay in fulfilling their achievements or canceling contracts, Covid-19 is considered to be a force majeure depending on the meaning of force majeure if it is included in the contract. As long as the affected party is able to prove that the force majeure conditions have been met. How to claim force majeure in a business contract in the Covid-19 era, claim force majeure based on appropriate legal references. The claiming parties must analyze whether a pandemic, disaster or government action applies certain provisions including the scope of force majeure accommodated in the contract.

Abstract

This study aims to describe the function and style of the mural by Arnis Muhammad. Mural as art in public space, which means that the space for movement and the target audience for the audience and audience is the general public. As a two-dimensional work of art, mural is also inseparable from style. Visually, the style in a work of art is the selection of objects, techniques, colors, and environmental conditions, time, era, and environmental conditions in which an artist creates his work. The population in this research is that all of Arnis Muhammad's mural works for the 2017-2019 period are 51 works. In this study the authors took samples using purposive sampling technique. The reason for taking samples is the number of mural works that still exist and are still intact. There are 10 mural works in the research location. In this case, the writer examines these mural works based on their function and style. The method used in this research is descriptive qualitative method. The function of the mural by Arnis Muhammad is a personal function as a reflection of the resonance of the environment in which he lives. Social function, as a form of concern for the environment and the surrounding community in everyday life. Physical function, as an aesthetic value enhancer and the various ways the general public use it. Arnis Muhammad's murals tend to have a surreal and decorative style.

Abstract

This paper aims to examine the rule of law regarding law violations by motorcycle gangs, to examine the role of the Brimob Police Corps and the obstacles faced in overcoming law violations by motorcycle gangs. The problem is focused on how the law rules regarding law violations by motorcycle gangs, what is the role of the Brimob Police Corps and the obstacles faced in overcoming law violations by motorcycle gangs. To approach this problem, Soerjono Soekanto's role theory is used. The data were collected through interview guidelines and analyzed qualitatively. This study concludes that the criminal act of violating the law by motorcycle gangs is contrary to Article 170 regarding crimes against public order, Article 351, Article 352, Article 368 regarding persecution and Article 510 and Article 511 regarding violations of public order in the Criminal Code, contrary to Article 106 and Article 115 in the Law of the Republic of Indonesia Number 22 of 2009 concerning Road Traffic and Transportation. The role of the Brimob Police Corps in overcoming violations of the law by motorcycle gangs can be seen by using Soerjono Soekanto's theory based on aspects of role as a norm, role as an individual/norm, and role in the social structure of society. The constraint factors faced by Brimob are that the perpetrators of violations are minors, the lack of parental supervision of their children and the actions of motorcycle gangs usually involve a large number of people.

Abstract

This study aims to find out how to handle drug trafficking strategy in Banyumas Class II B State Prison. The type of research conducted is a qualitative type of research and uses quantitative data collection method used to analyze environmental factors with SWOT method, research sample is 19 officers with sample determination based on purposive sampling technique. The results of this study showed that the strategy of handling drug trafficking shows an aggressive strategy located in quadrant I so that banyumas Class II B State Prison should be able to utilize momentum in order to handle drug trafficking and also be able to control the movement of existing drugs.

Abstract

This study aims to find out about criminal acts without the right to carry sharp weapons in Medan City and criminal law policies against people without the right to carry sharp weapons in Medan City. This study uses a normative juridical research method with descriptive analysis with a case approach and a statutory approach, then the data analysis is carried out qualitatively. The results of the study indicate that the legal rules regarding the crime of carrying sharp weapons are regulated in the Emergency Law Number 12 of 1951 concerning the Regulation of Sharp Weapons, Law no. 2 of 2002 concerning the National Police of the Republic of Indonesia and Law Number 1 of 1946 concerning Regulations concerning Criminal Law. The driving faktors for the occurrence of criminal acts without the right to carry sharp weapons in the city of Medan are divided into internal faktors and external faktors. The criminal law policy against people who carry sharp weapons in Medan City consists of a penal policy and a non-penal policy where the penal policy is carried out by legally processing the perpetrators, followed by examining the defendant at trial. The non-penal policy is carried out by increasing public awareness through socialization, carrying out strict supervision by increasing raids and patrols, as well as the importance of parents' attention to their children.

Abstract

The writing of this scientific article raises the phenomenon that occurs in the Tualang District community in the process of enforcing Circular No. 511.2/DPP/PSR/IX/2018/200 in relocating street vendors from the edge and shoulder of the KM 4 highway in front of Tuah Serumpun Market to Tualang People's Market in 2018. This problem can be analyzed using the theory of requirements that must be met in the manufacture of beleidsregel Van Kreveld (quoted by Indroharto in Ridwan HR, 2007) and the application/enforcement of the regulations of Ridwan HR (2007) as well as by using the theory of factors influencing law enforcement Soerjono Soekanto (2008). The results of this scientific article show that Circular No. 511.2/DPP/PSR/IX/2018/200 has met the requirements that must be met in the manufacture of beleidsregels. However, in terms of implementation, the circular has not fully met the required requirements. The factors that hinder the enforcement of circulars include law enforcement factors, facilities and facilities factors, community factors, and cultural factors. Meanwhile, legal factors do not hinder the enforcement of the circular.

Abstract

This article aims to identify and analyze the rule of law, the role and constraints faced by the Bappeda of North Sumatra Province in regional development. 70 of 2019 concerning Local Government Information Systems. This type of research is normative by using qualitative analysis. The results of the study found that the legal regulations for regional development planning are regulated in Law Number 25 of 2004 concerning the National Development Planning System and Minister of Home Affairs Regulation number 54 of 2010. The North Sumatra Bappeda has a role in formulating technical policies, regional development planning, research and development starting from the strategy, policy direction, macroeconomic framework, development of regulatory framework, institutions and funding in accordance with the policies determined by the regent based on the prevailing laws and regulations.

Abstract

This study aims to determine how the ability of grade VIII students of SMP Negeri 2 Takengon in experimenting with jute sack waste as a material for making lantern handicrafts. This research uses descriptive qualitative research methods. The data collection techniques used were observation, interview and documentation. The population of this research is 180 students. The sample used consisted of five works using a sampling technique aimed at taking the subject not above average, random or regional, but based on a specific purpose. The assessment indicators examined in this study were color, unity and functional value. The results of the study on the manufacture of lanterns made from hemp sack waste in craft subjects for Class VIII students of SMP Negeri 2 Takengon in the academic year of 2020/2021 showed that overall they received a good score (B). This good value is seen from the work of students who use three assessment indicators in making lanterns made from jute sack waste and are assessed by three teams of assessors / validators.

Abstract

This study aims to determine the effect of leadership style, work environment and performance benefits on employee performance at the Service Office for Placement and Protection of Indonesian Migrant Workers (BP3TKI) Medan. The effect of these variables on employee performance was studied using statistical analysis. The sampling technique used in this study is saturated sampling. Scaled surveys has been done by 116 employees of Service Office for Placement and Protection of Indonesian Migrant Workers (BP3TKI) Medan. The statistical tool used is the Structural Equation Modelling (SEM), and analysed using LISREL 8.80 statistic software. The model developed fulfil Goodness of Fit (GoF) requirements from LISREL 8.80 to which shows that it is good enough. The most significant sub-variables are no strong grip and low confidence from leader, legislations related to employee’s performance benefits, and good air circulations in the workspace, which strongly affect work quality, time efficiency, and cooperation from employees in Medan BP3TKI office. For further research, other researchers, institutions, or parties, could use this research conclusion and suggestions as foundation or additional information for similar problems, that is to improve employee performance in an office.

Abstract

Village community-based nature tourism is currently getting a lot of public attention. The government through its empowerment program also provides support to village communities when developing natural tourism in their area. The effectiveness of this empowerment program will later be able to improve the economy of rural communities sustainably. As is done in Coban Putri nature tourism, Tlekung Village, Junrejo District, Batu City. This research is qualitative, using a descriptive approach.While the sampling technique used is the purposive sampling technique, where informants are determined based on their role related to the development of natural tourism in Coban Putri. The purpose of this study was to determine how influential the Coban Putri natural tourism area is on the improvement of the economy of the Tlekung Village community after developing tourist attractions. The results obtained from this study indicate that the Coban Putri natural tourism area has sufficient influence on the economy of the Tlekung Village community, especially after development, so it is important for the government and the community to participate in developing Coban Putri natural tourism through empowerment programs so that it always has more appeal for tourists who visit.
